Deletion of reservation of designated land from draft or final Development Plan

Deletion of 32.

1. (1) If the Department is satisfied that the land is not or is no longer required reservation of for the public purposes for which it is designated for reserve of designated allocating in the draft Development plan or the final Development Plan land from draft may request – or final Deve- lopment Plan.
   • (a) The Department to sanction the deletion of such designation or reservation of allocation from the draft Development Plan ; or
2. (2) On receipt of such request [from the local authority]1, the Department or as the case may be, the State Government may make an order sanctioning the deletion of such designation or reservation or allocation from the relevant plans ;
3. (3) Upon an order under sub-section
4. (2) being made the land shall be deemed to be released from such designation, reservation or, as the case may be, allocation and shall become available to the owner for the purpose of development as otherwise permissible in the case of adjacent land under the relevant plan.
