Power of State Government to appoint Welfare Commissioner and other staff
The Madhya Pradesh Shram Kalyan Nidhi Adhiniyam, 1982(1) The State Government may appoint a Welfare Commissioner who shall be the Chief Executive Officer of the Board. (2) The Board may, with the prior approval of the State Government, appoint such other staff as may be considered necessary for the purposes of this Act. (3) The salary, allowances and conditions of service of the Welfare Commissioner and other staff shall be such as may be prescribed. (1) With effect from such date as the State Government may by notification appoint, there shall be established a Board for the administration of the Fund which shall be a body corporate by the name of the Madhya Pradesh Shram Kalyan Mandal having perpetual succession and a common seal, with power to acquire, hold and dispose of property, both movable and immovable and shall by the said name sue and be sued. (2) The Board shall consist of such number of representatives of employers, employees (as may be nominated in equal proportion) and such number of independent members and officials of the State Government as may be prescribed. (1) A member may resign his office by giving notice thereof in writing, to the State Government and on such resignation being accepted shall be deemed to have vacated his office from the date of such acceptance by the State Government. (2) A casual vacancy in the office of a member shall be filled up, as soon as conveniently may be, by the State Government, and a member so nominated shall hold office for the unexpired portion of the term of the office of his predecessor. (3) No act or proceedings of the Board shall be questioned on the ground merely of the existence of any vacancy in, or any defects in the constitution of the Board or on the ground that any person had taken part in the proceedings of the Board and had voted in an unauthorised manner. (1) The Chairman, if he is a non-official member he will be entitled to get such allowance and other facilities as may be prescribed time to time by the State Government. (2) the other members of the Board excluding Secretary shall be eligible to an allowance of Rs. 25 for attending each meeting of the Board. (3) The Chairman, and members of the board while travelling on duty shall be entitled to travelling and daily allowances as are admissible to First Grade Officers of State Government.
