Mode of recovery of sums payable to Board
The Madhya Pradesh Shram Kalyan Nidhi Adhiniyam, 1982(1) Any sum payable to the Board under this Act shall, without prejudice to any other mode of recovery, be recoverable as an arrear of land revenue. (2) The Board may, subject to the provisions of this Act, take such steps as it deems fit for the recovery of any such sum. (1) All orders and decisions of the Board shall be authenticated by the signature of the Chairman or such other member of the Board as may be authorised by the Board in this behalf and all other instruments issued by the Board shall be authenticated by the signature of such officer of the Board as may be authorised in this like manner. (2) Save as otherwise expressly provided in this Adhiniyam, all such orders, decisions and instruments shall be final and binding on the parties thereto. No court shall take cognizance of any offence punishable under this Act except on a complaint by, or with the previous sanction in writing of, the Welfare Commissioner. (1) The State Government may appoint Inspectors to inspect records to ascertain and verify the sums payable into the fund. Inspectors appointed under sub-section (2) of section 40 of the Madhya Pradesh Shops and Establishments Act, 1958 (No. 25 of 1958) shall also be deemed to be Inspectors for purposes of this Act in respect of the establishments to which the Act applies. (2) Any Inspector may— with such assistance, if any, as he thinks fit, enter at any reasonable time any premises for carrying out the purposes of this Act; exercise such other powers as may be prescribed. Every Inspector shall,, for carrying out the purposes of the Act, also have the'powers to require any employer to produce any document for his inspection to supply him a true copy of any such document and to give him a statement in writing.
