Application of Fund
The Madhya Pradesh Shram Kalyan Nidhi Adhiniyam, 1982(1) The Fund shall be utilised to defray the cost of carrying out such measures as may be prescribed for promoting the welfare of employees and their dependants, including the maintenance of welfare centres and libraries, the provision of recreational facilities, and such other purposes as may be specified by the State Government. (2) The Board may also apply the Fund for the purpose of such other activities as may be conducive to the welfare of the employees. Any person who wilfully obstructs an Inspector in the exercise of his powers or duties under this Act or fails to produce for inspection on demand by an Inspector any registers, records or other documents maintained in pursuance of this Act shall, on conviction, be punishable with imprisonment for a term which may extend to three months or with fine which may extend to five hundred rupees or with both. (iii) It shall be the duty of the Welfare Commissioner to ensure that the provisions of this Act and the rules made thereunder are duly carried out and the decisions of the Board under this Act or the rules made thereunder are implemented. He shall therefore have the powers to issue orders not inconsistent with the provisions of this Act and the rules made thereunder, as he deems fit. The State Government may also appoint one or more persons as Additional or Deputy Welfare Commissioner. The Additional or Deputy Welfare Commissioner shall exercise such powers and perform such duties as the Welfare Commissioner may, with the approval of the Board, by order specify. For this purpose the Board shall be competent to fix the area or areas within which the Additional or the Deputy Welfare Commissioners shall exercise the powers and perform the functions so specified. The Secretary of the Board shall be appointed by the State Government. Payment from the Fund shall be made.— (i) where the amount payable is less than Rs. 250 in cash, and (ii) Where the amount payable is more than Rs. 250 by Bank Draft or through Cheques issued by the Welfare Commissioner: Provided that in any particualr case the Board may, for speciel reasons to be recorded, authorise payment in cash in respect of any amount payable by it.
