Enhanced penalty after previous conviction
The Kerala Agricultural Workers Act 1974If any person who has been convicted of any offence punishable under this Act is again found guilty of an offence involving a contravention of the same provision, he shall be punishable on a subsequent conviction with imprisonment for a term which shall not be less than one month, but which may extend to six months and with fine which shall not be less than five hundred rupees, but which may extend to two thousand rupees: Provided that for the purposes of this section, no cognizance shall be taken of any conviction made more than five years before the commission of the offence which is being punished. On the death of a member before payment has been made.— (i) If a nomination made by the member in accordance with this scheme subsists, the amount standing to his credit in the fund, or part thereof to which nomination relates shall become payable to his nominee or nominees in accordance with such nomination; or (ii) If no nomination subsists or if the nomination relates only to a part of the amount standing to his credit in the Fund, the amount or part thereof to which the nomination does not relate, as the case may be, shall become payable to the legal heirs of the deceased member.
