Establishment and constitution of the Authority
The Jharkhand Tourism Development and Registration Act, 2015(1) The State Government may, for the purpose of implementing the objectives of this Act, by notification in the Gazette, establish an authority named "Tourism Development Authority" for the specified tourist site as may be notified by the State Government. While notifying such tourist site, its extent and jurisdiction shall also be specifically described so that the jurisdiction of such authority can be clearly delineated. (2) The Authority shall be a body corporate with a perpetual succession and a common seal, having the power to acquire, hold and dispose of property and to enter into contracts and shall be capable of suing and being sued in that name. (3) (i) The Authority shall consist of one Chairperson, one Managing Director, one Executive Director and six other Directors, who shall be nominated by the State Government and who shall hold office on such terms and conditions as prescribed for this purpose during the pleasure of the State Government. (ii) The Directors of the Authority shall include such persons, by notification of the Government, who have made excellent contributions in the field of development and promotion of tourism industry, or have acquired expertise, and who have at least ten years of work experience in the tourism business. (iii) The Principal Secretary/Secretary of the Department of Tourism, Art, Culture, Sports and Youth Affairs, Jharkhand shall be the Chairperson of the Authority. (iv) The State Government may, if it deems expedient, appoint the same person as both Chairperson and Managing Director of the Authority. (4) (i) The Deputy Commissioner of the concerned district or the officer notified by the Government shall be the Managing Director of the Authority. The Managing Director shall also be the Vice-Chairperson of the Authority and shall discharge all works related to it. (ii) The services of the Executive Director of the Authority shall be on deputation/contract basis initially for three years. Such services may, however, be terminated on the ground of unsatisfactory work or resignation by giving 15 days notice to either party. (iii) The Executive Director of the Authority shall, under the general guidance of the Chairperson or Managing Director, perform, among other things, the following duties: (a) He shall receive all funds on behalf of the Authority and give receipt for the same and maintain proper accounts thereof; (b) He shall withdraw money for payment of salaries and allowances from the funds of the Authority and to meet the expenses of the Authority; (c) He shall attest any order of the Authority; (d) He shall also be the Member Secretary of the Authority and shall perform all the related works; (e) He shall perform any other such duties assigned to him by the Authority or the State Government from time-to-time. (5) Non-Government Directors shall be paid such allowances as may be notified by the State Government from time-to-time. (6) Every Director and officer and employee of the Authority shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code. (6) Every Director and every officer and employee of the Authority shall be deemed to be a public servant within the meaning of Section 21 of the Indian Penal Code.
