The Jharkhand Restriction on Construction in Unsafe Areas Act, 2002
This Act empowers the District Magistrate to identify and declare specific areas as "unsafe" due to the risk of land subsidence, often caused by mining activities or other geological factors. Once an area is officially declared unsafe, all new construction or structural changes are prohibited without the District Magistrate's written permission. The law provides for penalties, including fines and imprisonment, for unauthorized construction and grants authorities the power to demolish such structures. It ensures public safety by preventing habitation in high-risk zones, while providing mechanisms for appeals and legal protection for officials acting in good faith. It applies to the entire state of Jharkhand.
