Rejection Order of Memorandum for Registration of Marriage/Acknowledgement of Registered Marriage [Under Rules 7(1) (g)(i) and 7(1)(h)(i) of The Uniform Civil Code Rules, Uttarakhand, 2025]

This is with reference to the memorandum number for registration of marriage/acknowledgment of registered marriage between Ms.

(Date of Submission of Memorandum). Subsequently a summary inquiry was conducted in accordance with the provisions contained in The Uniform Civil Code, Uttarakhand, 2024 and The Uniform Civil Code Rules, Uttarakhand, 2025. During the summary inquiry it was revealed that the memorandum was not in conformity with the following requirements of The Uniform Civil Code, Uttarakhand, 2024/The Uniform Civil Code Rules, Uttarakhand, 2025 - 1. Ms./Mr. had a spouse living at the time the marriage was solemnized/contracted on (a date after the commencement of The Uniform Civil Code, Uttarakhand, 2024); and/or 2. At the time of the marriage, Ms./Mr. was incapable of giving valid consent in consequence of unsoundness of mind/though capable of giving valid consent, has been suffering from a mental disorder of such a kind or to such an extent so as to be unfit for marriage/has been subject to recurrent attacks of insanity; and/or 3. The woman has not completed the age of eighteen years and/or the man has not completed the age of twenty-one years; and/or 4. Ms. and Mr. are within the degrees of prohibited relationship, and no custom or usage governing the parties to the marriage permits marriage between them, and even if permitted, such a marriage is against public policy and morality; and/or 5. The marriage is prohibited under (Name of Statute); and/or 6. No ceremony for marriage has been performed; and/or 7. Ceremony of marriage was performed but the parties to the marriage have not been living together as spouses ever since; and/or 8. Ms./Mr. is in a live-in relationship and has not terminated the said relationship (Applicable only for registration of marriage solemnized/contracted after the commencement of the Code); and/or

9. A statement has been made in the memorandum which is false and which the parties to the marriage know or have reason(s) to believe to be false, or a forged or fabricated document has been submitted; and/or 10. Additional information/clarification has not been submitted within the time limit of five days/twenty-four hours (in case of Tatkal Sewa); and/or 11. The marriage is not registered under any statute of the Government of Bharat or of any State Government (Applicable only for acknowledgement of registered marriage).

Reasoning for Rejection

In the circumstances mentioned above, the said memorandum for registration of marriage/acknowledgment of registered marriage is, hereby, rejected. In case of Rejection by Sub-Registrar

Within thirty days from the receipt of this rejection order an appeal may be presented to the Registrar concerned on the Web-portal/MobileApp of The Uniform Civil Code, Uttarakhand, 2024. In case of Rejection by Registrar

Within thirty days from the receipt of this rejection order an appeal may be presemted to the Registrar General on the Web-portal/MobileApp of The Uniform Civil Code, Uttarakhand, 2024. In case of Rejection by Registrar General This decision is final and binding.
