Statutory text
  1. (1) Every elected member of a Gram Panchayat, [***] and Zilla Parishad shall before taking his seat make and subscribe before such officer as the Government may specify in this behalf an oath or affirmation in the form set out in the Schedule IV. |
  2. (2) A member who has not complied with the requirements of sub-section (1), shall not vote or take part in the proceedings of any meeting of the Gram Panchayat, [***] and Zilla Parishad nor shall he be included as a member of any committee constituted by the Gram Panchayat,[***] and Zilla Parishad. [Deleted by Act 2 of 2005.5. 13(w.e.f. 5.3.2005) 63. *[(1) A Motion of no confidence may be Motion of no confidence moved by one-third of the total number of directly elected members of a Gram Panchayat or an [***] or Zilla 4 of a Gram Panchayat or an [***] or Zilla Parishad against its Chairperson after giving at least seven days notice in writing to the Member Secretary or any other prescribed authority of Gram Panchayat or [*#%] or Zilla Parishad of his intention to 4 move such a motion.
  3. (2) If the motion is carried by a majority of not less than two-thirds of the total number of _ directly elected members of the Gram Panchayat or [**¥*] CC ———————— or Zilla Parishad the Chairperson shall cease to hold office] 3) Notwithstanding anything contained in this Act, the Chairperson of a Gram Panchayat or an [***] or Zilla Parishad shall not preside ata meeting in which a motion of no-confidence against hirn is under discussion, but he shal] have the right to speak or otherwise take part in the proceedings of such meeting.
