0. Preamble
ͪवͬध (ͪवधान) ͪवभाग -------- अͬधसूचना 22 ͧसतàबर, 2022 संÉया-एल०जी०-03/2022-31--लेज० झारखंड ͪवधान मंडल ɮवारा यथा पाǐरत और माननीय राÏयपाल ɮवारा Ǒदनांक-19/09/2022 को कौशल ͪवɮया उɮयͧमता, ͫडिजटल एवं िèकल ͪवæवͪवɮयालय अͬधǓनयम, 2022 का Ǔनàनांͩकत अंĒेजी अनुवाद झारखंड राÏयपाल के Ĥाͬधकार से इसके ɮवारा Ĥकाͧशत ͩकया जाता है, िजसे भारत का संͪवधान के अनुÍछेद 348 के खंड (3) के अधीन उÈत अͬधǓनयम का अंĒेजी भाषा मɅ Ĥाͬधकृत पाठ समझा जाएगा । KAUSHAL VIDYA ENTREPRENEURSHIP, DIGITAL AND SKILL UNIVERSITY ACT, 2022 (Jharkhand Act, 10, 2022) An Act to establish and incorporate a first of its kind Skill University in the State of Jharkhand for the development and advancement of vocational and professional education, to create highly skilled and employable youth and entrepreneurs, encourage job creation, self-employment, gig-based-engagement and to promote delivery of high quality skill education, Entrepreneurship, start-up incubation, employability, training, counselling, apprenticeship, on-the-job training, and placements in an integrated manner with industry partnership, to promote inclusive growth by facilitating employability and providing self-employment guidance for the youth to enhance their incomes, to support the economically backward communities in terms of providing skill development, employability, entrepreneurship and self-employment opportunities and to provide a job ready workforce to the industry for reducing unemployment and ultimately propelling the economic growth of the State and for matters connected therewith or incidental thereto. Be it enacted by the Legislature of the State of Jharkhand in the Seventy-third Year of the Republic of India as follows: -
1. Short title, extent and commencement:
1. Short title, extent and commencement: (1) This Act may be called the Kaushal Vidya Entrepreneurship, Digital and Skill University Act, 2022. (2) It extends to the whole of the State of Jharkhand. (3) It shall come into force on the date of its publication in the Official Gazette.

Definitions: In this Act and in all Schedule of Statutes and Regulations made thereunder, unless the context otherwise requires- (a) “Associate college/institution” includes a college or an institution established and maintained by government or semi/quasi-government/SPV agencies of the State other than the Skill University, and admitted to the privileges of the Skill University under this Act; (b) “Authorities” means the authorities of the Skill University as specified by or under this Act; (c) “Centre of excellence” means the state-of the art training or research centre established in collaboration with industry or for the benefit of the industry and society, to provide all types of relevant skills to students, in-service employee, working professionals and to undertake joint projects; (d) “Community college” means an institution providing skill based academic programs including as maybe prescribed by the Regulations; (e) “Contribution”, by whatever name it may be called including fees, means monetary collection made by the Skill University or its colleges, institutions, skill centres or study centres, as the case may be including tuition expenses towards training, learning and Information Technology (IT), living infrastructure, utilities set-up, maintenance and any other incidental expenses from the students/sponsors by whatever name it may be called; (f) “Constituent college/institution” means a college or institution established or maintained by the Skill University; (g) “Digital learning” means end-to-end completely online learning, synchronous or asynchronous, with no requirement of physical laboratory or in-person teaching in a physical location. Further it is the mode of providing flexible learning opportunities by overcoming separation of teacher and learner using internet, e- learning materials and full-fledged programme delivery through the internet using technology assisted mechanism and resources; (h) “Government” or “State Government” means the Government of Jharkhand; (i) “Notification” means a notification published in the Gazette; (j) “Open and distance education” means education imparted by a combination of more than one means of communication, viz. broadcasting, telecasting, Information Communication Technology (ICT), correspondence courses, online, digital, blended modes, contact programmes and any other such methodology. Further it includes providing flexible learning opportunities by overcoming separation of teacher and learner using a variety of media, including print, electronic, online and occasional interactive face-to-face meetings with the learners to deliver teaching-learning experiences, including practical or work experiences; (k) “Regulations” means the Regulations of the Skill University made under this Act; (l) “Schedule” means the Schedule of the Skill University made under this Act; (m) “Section” means a section of this Act; (n) “State” means State of Jharkhand; (o) “Student” means a person enrolled in the Skill University for taking a course of study for a degree, diploma or any other academic distinction offered by the Skill University; (p) “Study centre” means a centre established or maintained by the Skill University for the purpose of advising, counselling or for rendering any other assistance required by the students in the context of open and distance education; (q) “Skill centre or satellite centre or school” means a training centre established by the Skill University to provide vocational and skill training for the benefit of the industry, students and local population; (r) “Skill University” means the Kaushal Vidya Entrepreneurship, Digital and Skill University, Jharkhand; (s) “Teachers” means Practitioners-as-faculty, Professor of practice, Professors, Associate Professors, Assistant Professors and such other persons with appropriate titles as may be appointed for imparting instructions, training or conducting research in the Skill University or in any college or institution; (t) “Vocational education” includes competency-building-modules, vocational courses, credits-based-continuum for continuing education or on-the-go learning that is focused on skill-based employability as compared to once-in-a-lifetime degree-based pedagogy for academic qualifications.
3. Incorporation:
3. Incorporation: (1) There shall be established a Skill University by the name of ‘Kaushal Vidya Entrepreneurship, Digital and Skill University’. (2) The Skill University shall be a body corporate with the name aforesaid having perpetual succession and a common seal with power to acquire, hold and dispose of property and to contract etc., and may by the said name sue or be sued. (3) The Skill University shall comprise of the President, the Vice-Chancellor, the Pro- Chancellor, the Registrar, Chief Finance and Accounts Officer, Dean of Credentials, the Governing Council, the Senate, the Vocational Education Council, the Credentials Council and all other persons who may hereafter become such officers or members so long as they continue to hold such office or membership. (4) The Skill University shall be headquartered at such State-owned campus (or campuses) as specified in Schedule. The Skill University may establish and maintain campuses including polytechnic colleges, Industrial Training Institutes (ITIs), community colleges, skill centres and digital learning study centres at such other places as it may deem fit. (5) The Skill University shall at all times follow all applicable laws, regulations of the land.
4. State Nodal Agency:

State Nodal Agency: (1) Prejha Foundation, a Special Purpose Vehicle of Government of Jharkhand as outlined in Clause 6 of gazette notification No.24, dated 27.07.2016, shall be concomitant state nodal agency, in perpetuity, that shall design, set-up, operate and undertake all other acts necessary for achieving the purpose of the Skill University. Hereinafter referred to as the ‘Nodal Agency’. (2) The Board of Directors of Prejha Foundation shall have complete delegation of powers from the State Government and shall be the final authority for all matters concerning the Skill University and shall have the power to delegate to any other person or authority of the Skill University such power as it may deem necessary. Any amendment to the Schedule, attached to this Act, whether by adding, deleting or in any other manner, can be done by the Department of Higher and Technical Education, Government of Jharkhand, subject to due recommendation based on formal approval from the Board of Directors of the nodal agency. (3) Any amendment, except for amendment to Schedule, to this Act can be done solely by the State legislature subject to due recommendation based on formal approval from the Board of Directors of the nodal agency with consensus or at least three-fourth of the majority of all eligible voting members after such a proposal is received from the Governing Council of the Skill University with at least two-third of all eligible voting members. (4) The Nodal agency shall have trademark and copyright of all digital assets including alumni database, website/online domain branding including logo/title (as stipulated in the section 3(1)) of the Skill University and the intellectual property generated from the date of inception of the Skill University shall vest in the nodal agency, notwithstanding any period of limitation.
5. Pedagogy, Framework and Objectives of Skill University:
5. Pedagogy, Framework and Objectives of Skill University: (1) Pedagogy of Skill University:- The Skill University, focussing on vocational education, shall be different from the academic university, focussing on higher education, in its establishment, functioning and objectives, as illustrated below: (a) Vocational education will be a choice of pursuit for those candidates who are vocationally inclined having a passion for crafts, trades or for entrepreneurship or require employability enablement with minimal opportunity cost of time. (b) Focus on design and delivery of competency-building-modules and vocational courses, etc. for enabling skill-based employability, self-employment and gig- engagement etc. Further culmination of vocational education is in being a maestro of the practical trade as compared to pursuit of academic research and theoretical interests in any discipline of study. (c) Award of credentials through credits-based-continuum including certificates, diplomas, advanced diplomas, etc. would be encouraged for a ‘learner-centric’ education paradigm as compared to traditional once-in-a-lifetime degree-based pedagogy for academic qualifications. Degrees can be offered where required including as culmination of study, experience and practice. (d) Imparting continuing education or on-the-go learning especially for practitioners to enable ‘learn while you earn’ with learning delivered in various modes including blended learning modes ranging from on-campus to off-campus, digital, onsite and on-the-job modes to augment the larger narrative of experiential learning, post-industry-experience-entrepreneurship. (e) The Skill University shall have the flexibility for innovative approaches to be fast-paced, industry-aligned, technology embedded, modular in nature, focussed on domain knowledge and competency that involves multiple stakeholders with Industry expertise, market led pedagogy, demand-synced-courseware, learner- centricity with national, international, industry partnerships forming the fulcrum. (f) Based on demand-assessment and skill-gaps, future projections etc. in different sectors of industry, the Skill University shall transform, revise and bring about necessary changes in its governance, curricular, pedagogy, award of credentials including degrees, recognition of prior learning, etc. to meet the demands of market and industry in order to be relevant. (g) The faculty of Skill University shall generally be competent practitioners with work experience or skilled professionals. (2) The Skill University shall follow a tiered approach to impart efficient vocational education delivery:- (a) Employability focussed courses/modules through credits-based-continuum shall offer skill-based programmes at different levels of certification including in line with International standards or Market requirements or Indian National Skills Qualification Framework or National and State Education Policy. Where an award of a degree is needed, the same would be granted based on applicable norms and standards including as determined by the Governing Council of the Skill University. (b) Continuing education for certificate/diploma holders to graduate to advanced diplomas and award of degree based on ‘Practitioner-on-the-go-education’ paradigm would also be pursued to enable career progression for various skilled professionals. Where an award of a degree is needed, the same would be granted based on applicable norms and standards for continuing on-the-go education including as determined by the Governing Council of the Skill University. (c) Digital learning shall also be offered where the application of such learning is geared towards domains including of digital economy and where employability avenues are typically in virtual domain. (3) The Skill University shall have the following objectives: – (a) to emerge as the foremost institution of quality in skill education recognised by industry, nationally and internationally; (b) to provide career-oriented education and skills to students interested in directly entering the workforce or entrepreneurship or launching a start-up; (c) to provide learning, teaching, entrepreneurial training, capability building and skills development covering a wide spectrum of domains and specializations as may be relevant from time to time in the fields of study or trade or industry etc. in which jobs are available or are likely to be created in future, or a start-up can be launched, including the imparting of skills that enhance employability; (d) to develop qualified youth with skill proficiency and competency at different levels including as per prescribed National or State qualifications of skill education; (e) to promote skill education, innovation, entrepreneurship in an integrated and holistic manner to ensure pathways for career progression and upward mobility; (f) to provide opportunities for flexible learning systems and provide a medium for lifelong and continued learning and skill development to enhance employability; (g) to provide entrepreneurial orientation along with required skill training for self- employment and entrepreneurship development; (h) to provide students an opportunity of life long and continuous training through the courses offered through conventional or blended or distance or open or online education and other education delivery models suitable for different pedagogical approaches and systems by the Skill University; (i) to frame a choice-based credit system for competency-based skill and vocational education; (j) to provide a teaching learning pedagogy focused on hands-on training, professional and skill-based training in line with market and industry needs; (k) to exchange expertise and best practices in support of skill development efforts in collaboration with any other college, institution, university, organization or body etc.; (l) to establish innovative approaches for creation of seamlessness in academic structures, learning time-frames, and working and continuous evaluation processes for nurturing and cultivation of creativity and enabling entrepreneurship; (m) to reach the unreached by using latest Information Communication Technology to deliver education, training and teaching resources to learners; (n) to undertake programmes for the training and development of the human resources such as the teachers of the Skill University and other skill imparting institutions; (o) to start skills development programmes, soft skills, courses in new and emerging areas with innovative approaches; (p) to provide a teaching learning pedagogy which combines multiple forms of education and learning pedagogy and course delivery (blended or distance or open or online or skill or other) and thus provide a ‘Virtual Campus’ where students will come together with experienced faculty and industry members to develop and evolve; (q) to provide consultancy to government and semi-government agencies, public and private industries; (r) to prepare and design courses of study and training modules and conduct skill gap analysis in consultation and in partnership with industry with the objective of determination of the skilled manpower needs or requirements of the market and industry; (s) to create an Industry Academia partnership by inviting industry and institutions for mutual benefits; (t) to ensure that the standard of degree, diploma, certificates and other academic distinctions are fit-for-purpose with respect to the needs of market and industry for employment and entrepreneurship, innovation and launch of start-ups; (u) to disseminate skills knowledge through seminars, conferences, executive education programmes, community development programmes, publications and training programmes; (v) to collaborate with business, industry, and institutions, universities, laboratories or agencies or organizations of repute from within the State or from other States or Union Territories of India or foreign countries, to offer joint programmes or courses or research or for exchange of faculty and students, or for sharing information and best practices, and to give or receive equipment or resources or grants or consultancy for the benefit of students; (w) to provide students with technical, vocational and skill-based education and training by offering Certificate, Diploma, Bachelor’s, Master’s and Doctoral programs in high growth sectors and offer various specializations to prepare the students for gainful employability and vertical mobility; (x) to create entrepreneurs by providing necessary skill and support systems; (y) to pursue action research including through tinkering laboratories for enabling adaptive learning, innovation through hands-on methodology in products, services, platforms, and technologies; and (z) to pursue any other objective as may be necessary to further the objectives of the Skill University.

Territorial exercise of powers: (1) The Skill University shall, in the exercise of its powers under this Act, have territorial jurisdiction over the whole of Jharkhand: (a) Provided that the territorial jurisdiction shall extend to the whole of State of Jharkhand in a non-exclusive manner including in matters pertaining to institutions imparting teaching or academic distinctions with a focus on vocational, skill-based education, entrepreneurship and development. (b) Provided that on matters of imparting digital learning, there shall be no limit to the physical geographic jurisdiction of the Skill University in the exercise of its powers under this Act.
7. Bar on conferring, granting or issuing degrees, diplomas or certificates on behal

Bar on conferring, granting or issuing degrees, diplomas or certificates on behalf of the Skill University by unauthorized institutions: No unaffiliated or unrecognised or unassociated college or institution or University, on behalf of the Skill University, shall confer, grant or issue any degree, diploma or certificate which is identical with or is a colourable imitation of any degree, diploma or certificate conferred, granted or issued by the Skill university.
8. Powers and functions of the Skill University: The Skill University shall exercise

Powers and functions of the Skill University: The Skill University shall exercise the following powers and perform the following functions: - (1) to provide facilities and promote training, study and research in emerging areas of skill, vocational education, entrepreneurship including in new frontiers of digital economy and in various sectors as outlined in national skills qualification framework; (2) to conduct research in labour market requirements in order to understand emerging trends; (3) to undertake collaborative research and advocacy with any organization in India or overseas for promoting innovative models of education, research, training and skill development including employability and entrepreneurship; (4) to establish and recognise as constituent/associate institutions of skill education, in such manner and in accordance with such parameters, standards as may be specified by the Skill University; (5) to make provisions and adopt all measures (including adoption and updating of the curricula) in respect of study, teaching and research, relating to the courses through traditional as well as new innovative modes including digital education mode; (6) to take special measures for spreading educational facilities among the educationally backward strata of the society; (7) to institute choice-based credit system in-line with skill development pedagogy; (8) to provide students the facility of multi-entry-exit with or without trade/competency tests, with or without experience pre-requisites and credit accumulation, banking and transfer at all levels; (9) to institute scheme for multi-entry and multi exit, recognition of prior learning, credit banking and transfer, credit waiver, vertical and lateral mobility and any other such scheme which promotes skill development at large; (10) to develop credit framework including in international standards, accordance with the National Occupational Standards as specified by the National Skill Qualification Framework; (11) to develop curriculum packages of skill at different levels, as may be defined by the Skill university or by international standards or the National Skill Qualification Framework; (12) to define norms and parameters of skill education, teaching and instruction, consistent with the credit framework and curriculum packages to make them employability oriented, as the Skill university may deem fit; (13) to confer certificates, diplomas, advanced diplomas, degrees, bachelor’s, master’s, doctoral and other distinctions; Further to offer these distinctions/ credentials for recognition of prior learning/competency/experience with or without academic pre- qualifications, honorary distinctions as per norms laid down by Credentials Council; (14) to enable the student to seek employment on their own accord after any level of award and join back as and when feasible to upgrade qualifications or skill competencies to move higher in the job profile through the multiple entry and exit; (15) to offer, modify or discontinue programmes or courses in domain areas as per demand in the job market; (16) to decide, in consultation with the industry partner(s), industry associations, Sector Skills Councils, etc, specific job role(s) to be embedded in curriculum; (17) to have MoUs with relevant Industry Partner(s) in order to facilitate on-site skill training of the students; (18) to provide education, training and skill development opportunities to the informal sector and unorganized workforce in order to build productivity; (19) to encourage industrial and industrial associations participation through establishment of innovation labs, in-service training centres, workshops and active participation in all aspects of governance, curricula design, skill training, placements, internships, consultancy, joint projects, etc.; (20) to establish campuses, regional centres, skill centres, community colleges, study centres, information centres, test or examination centres, centres of excellence, etc., at various locations in and outside the State and country to facilitate delivery, student services and dissemination of education, consultancy, information and skill training; (21) to promote a spirit of entrepreneurship in skills amongst youth; (22) to promote career guidance and counselling among the youth; (23) to define norms of examination or any other measure of assessment of knowledge and competency of a student for admission to the Skill University; (24) to hold examinations or other assessments of knowledge or competency, or accredit the examination or other assessment system of institution, as the Skill university may, from time to time determine; (25) to collaborate with industries, companies, national and international partners (as skill knowledge providers) for the purposes of practical training of students in skill and entrepreneurship and to define norms for recognition of competency attained by a student in such practical training in industry or training centre for the purpose of earning credits; (26) to lay down norms for transfer of credits to promote new learning opportunities without compromising on learning outcomes; (27) to appoint persons possessing significant professional experience, knowledge and competency, as adjunct, guest or visiting faculty of the Skill University, on such terms and for such duration, as the Skill University may decide; (28) to lay down parameters for assessment and accreditation of skill educators and training providers in accordance with the norms specified under the National Skill Qualification Framework, or such other norms, as may be determined by the Skill University; (29) to determine, specify, fix, demand and receive contribution including payment of fees and other charges, from students, institution, industry or body corporate for instructions and other services, including training, consultancy and advisory services, provided by the Skill University, as the Skill University may deem fit; (30) to receive gifts, grants, donations or benefactions from the Central Government and the State Government and to receive bequests, donations and transfer of movable or immovable properties from testators, donors or transferors, as the case may be; (31) to establish its own school(s) to provide skill education, for identification and recognition of prior learning of skill; (32) to establish and maintain such infrastructure including campuses and training centres within its territorial jurisdiction; (33) to institute and award fellowship, scholarships, exhibitions, prizes and medals; (34) to collaborate with any other Indian or foreign university or institution in offering joint diploma/degree/exchange programmes for reaching global standards of skill attainment; (35) to mutually transfer credits with the institution of exchange in case of exchange students including of foreign candidates; (36) to promote national and international collaboration with institutions of skill education for the purpose of developing competency, knowledge and ability to global standards; (37) to establish its own production house, incubation centre, retail house or service centre or any other centre which shall provide practical training to enhance skill and entrepreneurial level of youth; (38) to create posts and prescribe the terms and conditions of appointment of competent practitioners with work experience or skilled professionals with or without academic pre-qualifications including that of faculty, Asst/Associate/professors/Professors of practice, Deans, Directors, Principals, teachers, teaching /non-teaching skilled, administrative, ustads, demonstrators, tutors and ministerial staff and such other posts, as required by the Skill University or as maybe prescribed by the Regulations; (39) to establish, maintain and manage, such establishments, initiatives whenever necessary including- (a) Knowledge Resource Centre; (b) Skill University extension boards; (c) Information bureaus; (d) Employability guidance bureaus; (e) Autonomous Evaluation Boards; (40) to take up such measures for welfare, holistic development of students including to promote patriotism, self-discipline, peer respect, sustainable living, spirit of service along with prevention of obstacles to such development such as ragging, harassment, discrimination or exclusion, physical or mental or emotional violence; (41) to invest the funds of the Skill University or money entrusted to the Skill University in only approved financial instruments and in such manner as it may deem fit and from time to time dispose any investment; (42) to delegate all or any of its powers to the Pro-Chancellor of the Skill University or any committee or any sub- committee or to anyone or more members of its body or its officers; (43) to make provisions in relation to residence of the students, to provide for a situation wherein the Skill University would like to open residential facilities; (44) to make such Schedule and Regulations as may, from time to time, be considered necessary for regulating the affairs and management of the Skill University and to alter, modify and rescind them; (45) Subject to the provisions of this Act, to do all such things as may be necessary to achieve the objectives of the Skill University.
9. Constituent/ Associate Skill and vocational education institutions: The Skill Uni

Constituent/ Associate Skill and vocational education institutions: The Skill University may as and when it may deem fit and proper, establish, recognise, manage State-owned campuses, constituent colleges, associate colleges and schools of specialised learning, polytechnic colleges, Industrial Training Institutes (ITIs), vocational education institutions, centres for skill development, training, extension, research and outreach including continuing education, distance learning and e-learning. In case degrees are to be given, such centres or colleges would be established or associated as per applicable norms and standards including as determined by the Governing Council.
10. Skill university open to all races, classes, castes and creeds and to be inclusiv

Skill university open to all races, classes, castes and creeds and to be inclusive in its pedagogy through courses amenable to the poorer strata of the society in the service of public: (1) The Skill University shall be open to all persons irrespective of gender , race, creed, caste or class and no test or condition shall be imposed as to religion, belief or profession in admitting or appointing members, students, teachers, workers, or in any other connection with the affairs of the Skill University and no benefactions shall be accepted the direct and inevitable effect of which, in the opinion of the authorities of the Skill University, is to impose conditions or obligations on the Skill University which is in derogation of its aforesaid power. (2) The Skill University shall include courses amenable to meritorious but poorer sections of the youth, designed to enable employability or entrepreneurship.
11. Teaching of Skill University: All teaching in the Skill University shall be condu
11. Teaching of Skill University: All teaching in the Skill University shall be conducted by and in the name of the Skill University in accordance with the Schedule and Regulations made in this behalf.
12. The Chancellor:
12. The Chancellor: (1) The Governor of Jharkhand will be the Chancellor of the Skill University. (2) The Chancellor shall, when present, preside over the convocation of the Skill University for conferring certificates, diplomas, degrees and other academic distinctions. (3) The Chancellor shall have the power to call for report of any matter pertaining to the affairs of the Skill University.
13. Officers of Skill University:
13. Officers of Skill University: (1) The following shall be officers of the Skill University, namely: - (a) the President; The President shall be the head of the Skill University, and shall be the Chairperson of the Governing Council. (b) the Vice-Chancellor; The Vice-Chancellor shall have ascendance over the academic affairs, on matters where award of bachelor’s/master’s/doctoral degree is concerned. (c) the Pro-Chancellor; The Pro-Chancellor shall be the principal executive officer of the Skill University. (d) the Registrar; (e) the Chief Finance and Accounts Officer; (f) the Dean of Credentials; and (g) such other persons in the service of the Skill University or regulatorily defined posts, as may be declared to be officers of the Skill University. (2) The Governing Council, through the President, may be deemed as the competent authority to make provisions regarding, subject to section 17, the appointment, powers and functions of the officers of the Skill University, as prescribed by the Schedule.
14. Authorities of the Skill University:

Authorities of the Skill University: (1) The following shall be the authorities of the Skill University, namely: - (a) the Governing Council; The Governing Council shall be the supreme body of the Skill University. (b) the Senate; The Senate shall be the Chief Executive body of the Skill University. (c) the Vocational Education Council; The Vocational Education Council shall be the principal vocational education delivery body of the Skill University. (d) the Credentials Council; (e) such other authority as may be declared by the Schedule to be an authority of the Skill University. (2) Subject to provisions set out in section 17, the constitution, powers and functions of the authorities of the Skill University shall be as prescribed by the Schedule.

Disqualifications: A person shall be disqualified from being a member of any of the authorities or bodies of the Skill University, if he- (a) is of unsound mind and stands so declared by a competent court; or (b) has been convicted of an offence which involves moral turpitude; or (c) engages during the term of his office in private coaching with pecuniary gain; or (d) has acquired such financial or other interest as is likely to affect prejudicially his functions as a member; or (e) has been inflicted with any penalty for indulging in or promoting any unfair practice in the conduct of any examination, in any form, anywhere.
16. Committees: The authorities of the Skill University may constitute such committee

The constitution of, and powers to be exercised and duties to be performed by, such committee, shall be such as may be prescribed by the Schedule or Regulations.
17. Schedule:

Schedule: (1) All changes to the Schedule shall be published in the website or any such other medium as determined by the Governing Council of the Skill University and will be deemed as an official notification. (2) For amendment to Schedule, attached to this Act, can be done by the Department of Higher and Technical Education, Government of Jharkhand, subject to due recommendation based on formal approval from the Board of Directors of the nodal agency. (3) The Governing Council of the Skill University may make or amend Schedule (except for Schedule attached to this Act), after due approval from the Board of Directors of the nodal agency, on the following: (a) Administration and management of the Skill University; and (b) Providing for all matters (except for amendment to Schedule, attached to this Act) which by this Act are to be prescribed by the Schedule.
18. Admissions and student matters:

21. Annual Report: The annual report of the Skill University shall be prepared by the

Annual Report: The annual report of the Skill University shall be prepared by the Senate which shall include among other matters, the steps taken by the Skill University towards the fulfilment of its objectives and shall be approved by the Governing Council and a copy of the same shall be submitted to the Nodal Agency.
22. Funds and Accounts:

Funds and Accounts: (1) The Skill University shall have a General Fund to which shall be credited- (a) contribution to its income from fees, grants, donations and gifts, if any; (b) any contribution or grant made by any corporation or agency owned or controlled by the State or Central Government or any other corporation or multilateral agency or philanthropic organization or any other body or trust; (c) endowments and other receipts; (d) any income received from consultancy and other works undertaken by the Skill University; and (e) any other financial aid or grant or any other sums received by the Skill University. (2) The Skill University may have such other funds as may be prescribed by the Schedule and Regulations. (3) The funds and all monies of the Skill University shall be managed in such a manner, as per the policies of the Skill University duly approved by the Governing Council. (4) The State Government may provide grant-in-aid, grant-in-kind including to facilitate, capital investment in various campuses, operational expenditure to promote skill courses, studies and research.
23. Annual Accounts:

Annual Accounts: (1) The annual accounts including balance sheet of the Skill University shall be prepared under the directions of the Senate and the annual accounts shall be audited at least once in every year by the auditors appointed by the Governing Council of the Skill University for this purpose. (2) A copy of the annual accounts together with the audit report shall be submitted to the Governing Council. (3) A copy of the annual accounts and audit report along with the observations of the Governing Council shall be submitted to the Nodal Agency.
24. Meritocracy as sole basis for appointment and service continuation of all personn

Meritocracy as sole basis for appointment and service continuation of all personnel of Skill University: All personnel appointments, by whatever name and designation they are called, of the Skill University, shall be solely based on merit, with promotions and continuation in service, based on performance or requirement.

Vacancy not to invalidate proceedings: No act done, or proceeding taken, under this Act by any authority or other body of the Skill University shall be invalid merely on the ground of any- (a) vacancy or defect in the constitution of the authority or body; or (b) defect or irregularity in election, nomination or appointment of a person acting as a member thereof; or (c) defect or irregularity in such act or proceeding, not affecting the merits of the case.

Protection of action taken in good faith: No suit or other legal proceedings shall lie against any officer or personnel of the Skill University for anything which is in good faith done or intended to be done in pursuance of any of the provisions of this Act. SCHEDULE Statutes 1. State Public University: The Skill University shall act in public benefit as the State Public University, actualised through delegation of powers to state nodal agency for complete autonomy and financial independence, in its commitment to service of the public. 2. Incorporation: The Skill University shall be headquartered in Khunti, Jharkhand. 3. Appointment, Powers and Functions of the President: (1) Appointment of the President:- (a) The President shall be appointed by the Nodal Agency for a term of three years on the recommendation of a selection committee. (b) Three months prior to the expiry of the term of office of the President, the Nodal Agency shall constitute a Selection Committee consisting of following members, which shall prepare a panel of at least three names, in alphabetical order, from which the Nodal Agency shall appoint the President: (i) two nominees of the Nodal Agency; and (ii) one nominee of the Governing Council (c) The President of the Skill University shall ideally be a leader in his industry, preferably an alumnus of an institute of eminence or similarly bench-marked institution including with an industry/entrepreneurial background. (d) After the completion of his tenure of three years, he shall be eligible for reappointment by the Nodal Agency, limited to number of terms as decided by the nodal agency. (e) This shall be an honorary position and all the reasonable expenses incurred by the President in connection with the affairs of the Skill University shall be reimbursed and paid out of the General Fund of the Skill University. (f) The first president shall be appointed by the Nodal Agency. (g) On a representation made to it or otherwise and after making such enquiry as may be necessary, if the Nodal Agency is of the opinion that the continuance of the President in office may not be in the interest of the Skill University, the Nodal Agency, by an order in writing stating the reasons therein, may direct the President to relinquish his office from the date specified in the order: Provided that prior to the issuance of any such order, the President shall be given an opportunity of being heard. (h) The President may, by an instrument in writing under his hand and addressed to the Chairperson of the Nodal Agency, resign his office: Provided that the President shall continue in office till the date of acceptance of his resignation by the Nodal Agency. (i) In the event of the abrupt occurrence of vacancy in the office of the President by reason of death, conviction or otherwise, the Vice-Chancellor shall act as President until a regular appointment of President is made in accordance with sub-sections (a) and (b): Provided that the period of such interim arrangement shall not exceed six months. (2) Powers and Functions of the President:- (a) The President shall be the head of the Skill University, and shall be the Chairperson of the Governing Council. (b) The President shall preside over the meetings of the Governing Council and, when the Chancellor is not present, at the convocation of the Skill University for conferring of diplomas, degrees or other academic distinctions: Provided that in the absence of the President, such functions shall be carried out by any other member of the Governing Council nominated by it: Provided that, in case of a tie in regard to any of the decisions taken by the Governing Council, the President shall have a casting vote. (c) In case of any disputes or differences of opinion, the decision of the President shall be final and binding on all concerned. (d) The President shall have the power to call for any information or record from any officer or authority of the University, relating to the affairs of the Skill University. 4. Appointment, Powers and Functions of the Vice-Chancellor: (1) Appointment of the Vice-Chancellor:- (a) The Vice-Chancellor shall be appointed by the President with the approval of Nodal Agency for a term of three years on the recommendation of a selection committee. (b) Three months prior to the expiry of term of the Vice-Chancellor, the Nodal Agency shall constitute a Selection Committee consisting of following members, which shall prepare a panel of at least three names, in alphabetical order, from which the Nodal Agency shall appoint the Vice-Chancellor: (i) one nominee of the Nodal Agency who will also act as the Chairperson of the Committee; (ii) one nominee of the President; and (iii) one nominee of the Governing Council (c) The Vice-Chancellor shall be a person of eminence having rich administrative and academic experience possibly with past/present board membership(s) in industry. Suitable person who has been faculty of Indian Institutes of Technology or similar eminent institutions may be considered. (d) After the completion of his tenure of three years as the Vice-Chancellor, he may be considered to be eligible for reappointment, limited to number of terms as decided by the nodal agency. (e) The first Vice-Chancellor shall be appointed by the Nodal Agency. (f) On a representation made to it or otherwise and after making such enquiry as may be necessary, if the Nodal Agency is of the opinion that the continuance of the Vice-Chancellor in office may not be in the interest of the Skill University, the Nodal Agency, by an order in writing stating the reasons therein, may direct the Vice-Chancellor to relinquish his office from the date specified in the order: Provided that prior to the taking of any action under this sub-section, the Vice-Chancellor shall be given an opportunity of being heard. (g) The Vice-Chancellor may, by an instrument in writing under his hand and addressed to the Chairperson of the Nodal Agency, resign his office: Provided that the Vice-Chancellor shall continue in office till the date of acceptance of his resignation by the Nodal Agency. (h) In the event of the abrupt occurrence of vacancy in the office of the Vice- Chancellor by reason of death, conviction or otherwise, the nodal agency may appoint any other suitable officer of the Skill University to act as Vice- Chancellor until a regular appointment of Vice-Chancellor is made in accordance with sub-sections (a) and (b): Provided that the period of such interim arrangement shall not exceed six months. (2) Powers and Functions of the Vice-Chancellor :- The Vice-Chancellor shall have ascendance over the academic affairs, on matters where award of bachelor’s/master’s/doctoral degree is concerned, of the Skill University- (a) to advise the Governing Council, particularly in respect of the norms and standards of education, teaching and research, and training programmes in the Skill University and ensure compliance of the same; (b) to coordinate with Deans / Heads concerned with the introduction of programmes and courses in academic, training and consultancy domains and for teaching, research and development in the Skill University; (c) to ensure adherence to quality, norms and standards pertaining to the programmes and courses of study offered or to be offered, involving with undergraduate and postgraduate education, by the Skill University; (d) to delegate his powers subject to the approval of the President; (e) to exercise such other powers and perform such duties as may be specified in the Schedule and Regulations of the Skill University. 5. Appointment, Powers and Functions of the Pro-Chancellor: (1) Appointment of the Pro-Chancellor:- (a) The Pro-Chancellor shall be appointed by the President with approval of the Nodal Agency for a term of three years on the recommendation of a selection committee: Provided that the first Pro-Chancellor shall be appointed by the Nodal Agency. (b) Three months prior to the expiry of term of the Pro-Chancellor, the Nodal Agency shall constitute a Selection Committee consisting of following members, which shall prepare a panel of at least three names, in alphabetical order, from which the Nodal Agency shall appoint the Pro-Chancellor: (i) one nominee of the Nodal Agency who will also act as the Chairperson of the Committee; (ii) one nominee of the President; and (iii) one nominee of the Governing Council (c) The eligibility criteria with regard to the educational qualifications (academic/ research/ skill specialization, etc.) and industry experience for selection of the Pro-Chancellor shall be as prescribed by the Schedule and Regulations. (d) After the completion of his tenure of three years as the Pro-Chancellor, he may be considered to be eligible for reappointment, limited to number of terms as decided by the nodal agency. (e) The Pro-Chancellor shall be a whole-time salaried officer of the Skill University or be deputed from the nodal agency. (f) On a representation made to it or otherwise and after making such enquiry as may be necessary, if the Nodal Agency is of the opinion that the continuance of the Pro-Chancellor in office may not be in the interest of the Skill University, the Nodal Agency, by an order in writing stating the reasons therein, may direct the Pro-Chancellor to relinquish his office from the date specified in the order: Provided that prior to the taking of any action under this sub-section, the Pro-Chancellor shall be given an opportunity of being heard. (g) The Pro-Chancellor may, by an instrument in writing under his hand and addressed to the Chairperson of the Nodal Agency, resign his office: Provided that the Pro-Chancellor shall continue in office till the date of acceptance of his resignation by the Nodal Agency. (h) In the event of the abrupt occurrence of vacancy in the office of the Pro- Chancellor by reason of death, conviction or otherwise, the nodal agency may appoint any other suitable officer of the Skill University to act as Pro-Chancellor until a regular appointment of Pro-Chancellor is made in accordance with sub- sections (a) and (b): Provided that the period of such interim arrangement shall not exceed six months. (2) Powers and Functions of the Pro-Chancellor:- (a) The Pro-Chancellor shall be the principal executive officer of the Skill University and shall exercise general superintendence and control over the affairs of the Skill University. (b) On matters regarding the academic affairs of the Skill University, where award of bachelor’s/master’s/doctoral degree is concerned, the Pro-Chancellor shall seek guidance from the Vice-Chancellor. (c) The Pro-Chancellor shall execute the decisions of various authorities of the Skill University and take all action as may be necessary to execute for discharge of the duties and responsibilities that may be assigned to him by the President and the authorities of the Skill University. (d) Where, in the opinion of the Pro-Chancellor it is necessary to take immediate action on any matter for which powers are conferred on any other authority by or under the Act, he may take such action as he deems necessary, and, shall at the earliest opportunity thereafter, report the action taken by him to such officer or authority as would have in the ordinary course dealt with the matter: Provided that if, in the opinion of the concerned officer or authority such action should not have been taken by the Pro-Chancellor, then such case shall be referred to the President, whose decision thereon shall be final: Provided further that where any such action taken by the Pro-Chancellor adversely affects the rights of any personnel of the Skill University, such person shall be entitled to prefer, within three months from the date on which such action is communicated to him, an appeal to the Governing Council, and, the Governing Council may confirm or modify or reverse the action taken by the Pro-Chancellor. (e) Where, in the opinion of the Pro-Chancellor, any decision taken by any authority of the Skill University is not within the powers conferred on such authority by the Act, or is likely to be prejudicial to the interests of the Skill University, he shall forthwith request the concerned authority to revise its decision within fifteen days from the date of its decision, and, in case the authority refuses to revise such decision wholly or partly or fails to take any decision within fifteen days, then such matter shall be referred by the Pro- Chancellor to the President and his decision thereon shall be final. (f) The Pro-Chancellor shall be the Chairperson of the Vocational Education Council and shall have a casting vote in case of a tie in regard to any of the decisions taken by the Vocational Education Council. (g) The Pro-Chancellor shall ensure compliance with the provisions of the Act, Schedule and Regulations of the Skill University. (h) The Pro-Chancellor shall be entitled to be present at, and to address, any meeting of any authority of the Skill University, but shall not be entitled to vote unless he is a member of that particular authority. (i) In all suits and other legal proceedings by or against the Skill University, the pleadings shall be signed and verified by the Pro-Chancellor and all processes in such suits and proceedings shall be issued to, and served on, the Pro-Chancellor. (j) The Pro-Chancellor shall have the power- (i) to advise the Governing Council on matters regarding the planning and development of the Skill University, particularly in respect of the norms and standards of education, teaching and research, and training programmes in the Skill University and ensure compliance of the same; (ii) to coordinate with Deans / Heads concerned with the introduction of programmes and courses in academic, training and consultancy domains and for teaching, research and development in the Skill University; (iii) to provide pedagogical leadership and motivation for excellence; (iv) to coordinate with Deans / Heads for collaboration with any university, Research Institute, Centre in India and abroad from time to time with prior approval of the Governing Council; (v) to apply for membership of other institutions like Association of Indian Universities, Commonwealth Universities, International Universities, and India International Centre, etc.; (vi) to ensure adherence to quality, norms and standards pertaining to the programmes and courses of study offered or to be offered by the Skill University; (vii) to take necessary steps to obtain accreditation, etc.; (viii) to convene or cause to be convened meetings of any segment or authority of the Skill University except the Governing Council and the Senate; (ix) To make regular appointments with the prior approval of the Senate, as maybe prescribed by the Regulations- a) for all posts of teaching staff; and b) for posts of officers among the administrative staff and technical support staff; (x) to make provision for the offer of scholarships, fellowships, studentships, medals and awards with the prior approval of the Senate; (xi) to appoint course writers, script writers, counsellors, programmers, artists, consultants and such other persons as maybe considered necessary for the efficient functioning of the Skill University; (xii) to fix emoluments and other terms and conditions of service of the teaching staff, administrative staff and technical support staff with the approval of the Senate, as maybe prescribed by the Regulations; (xiii) to make temporary appointments, with the approval of the Senate of such persons as he may consider necessary for the functioning of the Skill University, as maybe prescribed by the Regulations: Provided that, in case of any exigency, the Pro-Chancellor may appoint such staff for a period not exceeding six months, and such appointments shall be reported to the Senate in its next meeting. (xiv) to grant leave to- a) Teaching staff; and b) Officers among the administrative staff and technical support staff, and make necessary arrangements for the discharge of the functions of such personnel during their absence; (xv) to grant leave of absence to any personnel of the Skill University in accordance with the Regulations and if he so desires, delegate such powers to any other officer of the Skill University; (xvi) to make necessary arrangements for the discharge of the functions of an officer whose position falls vacant due to resignation, retirement or any other reason till such time as regular appointment to such position is made; (xvii) to ensure proper maintenance of discipline in the Skill University and to delegate any such power to such officer or officers as he may deem fit; (xviii) to suspend and to initiate disciplinary action against any student or personnel of the Skill University as per the Regulations; (xix) to delegate his powers subject to the approval of the President; (xx) to perform all such acts as may be deemed necessary for furtherance of duties and objectives of the Skill University. 6. Appointment, Powers and Functions of the Registrar: (1) Appointment of the Registrar:- (a) The first Registrar shall be appointed by the Nodal Agency. After completion of the term of the first Registrar, the President shall appoint the next Registrars with the approval of the Nodal Agency on the recommendation of the selection committee constituted for the purpose, as specified by the Governing Council. (b) He shall report to the Pro-Chancellor. (c) He shall be a whole-time salaried officer of the Skill University or be deputed from nodal agency. (d) He shall be appointed for a term of five years and shall be eligible for reappointment, limited to number of terms as decided by the nodal agency. (e) On a representation made to him or otherwise and after making such inquiry as may be necessary, if the Pro-Chancellor is of the opinion that the continuance of the Registrar in office will not in the interests of the Skill University, he may by an order in writing stating the reasons therein, direct the Registrar to relinquish his office from the date specified in the order: Provided that prior to taking any action under this sub-section, the Pro- Chancellor shall ensure that it gets the approval of the Nodal Agency after giving to the Registrar reasonable opportunity of a hearing. (f) The Registrar may, by an instrument in writing under his hand and addressed to the Pro-Chancellor, may resign his office: Provided that the Registrar shall continue in office till the date of acceptance of his resignation by the Nodal Agency. (g) In the event of the abrupt occurrence of vacancy in the office of the Registrar by reason of death, conviction or otherwise, the Pro-Chancellor may appoint any other suitable officer or personnel of the Skill University to act as Registrar until a regular appointment of Registrar is made in accordance with sub-section (a): Provided that the period of such interim arrangement shall not exceed six months. (2) Powers and Functions of the Registrar:- (a) The Registrar shall be the Member-Secretary of the Governing Council, Senate, Vocational Education Council and Credentials Council but he shall not have a right to vote; (b) All contracts shall be signed and all documents and records shall be authenticated by the Registrar on behalf of the Skill University; (c) The Registrar shall exercise and perform the following powers and functions- (i) to function as the custodian of the records, minutes of the meetings of the authorities of the Skill University, the common seal and all properties of the Skill University; (ii) to place before the President, Vice-Chancellor, Pro-Chancellor or any authority of the Skill university, all such information and documents as may be necessary for transaction of their business; (iii) to conduct official correspondence on behalf of the Skill University and be responsible for the proper maintenance of all the records of the Skill University, subject to the provisions of the Act, the Schedule and the Regulations; (iv) to issue notices concerning all meetings of the Governing Council, Senate, Vocational Education Council, and any other committee or body constituted as per instructions of the President or Pro-Chancellor; (v) to represent the Skill University in suits or proceedings by or against the Skill University, sign powers of attorney and plead in such cases or depute his representative for this purpose; (vi) to maintain a register of all students registered in any course or programme offered by the Skill University in the prescribed form; (vii) to maintain a register of all certificates, diplomas, degrees or any academic distinction conferred on any person by the Skill University; (viii) to suspend and to initiate disciplinary control over the personnel, of the Skill University, as per powers delegated by the Pro-Chancellor; (ix) to render to the Pro-Chancellor and the President such assistance as may be desired by them in the performance of their official duties; (x) to appoint persons to the posts below the level of officers among the technical support staff and administrative staff, as maybe prescribed by the Regulations; (xi) to maintain the service records of all the personnel of the Skill University; (xii) to perform such other duties as may be specified by the Governing Council or the Senate or the President or the Vice-Chancellor or the Pro- Chancellor from time to time; (xiii) to exercise such powers and perform such duties as may be specified in the Schedule and Regulations of the Skill University. 7. Appointment, Powers and Functions of the Chief Finance and Accounts Officer: (1) The appointment of the Chief Finance and Accounts Officer shall be made by the President, in such manner as specified by the Governing Council, as maybe prescribed by the Schedule and Regulations. (2) The Chief Finance and Accounts Officer shall exercise such powers and perform such duties as may be specified by the Governing Council. 8. Appointment, Powers and Functions of the Dean of Credentials: (1) The appointment of the Dean of Credentials shall be made by the President, in such manner as specified by the Governing Council, as maybe prescribed by the Schedule and Regulations. (2) The Dean of Credentials shall exercise such powers and perform such duties including with respect to all aspects of credentials such as laying down of the norms and standards, mode of assessments and certifications etc. as may be specified by the Governing Council. 9. Governing Council: (1) Constitution of the Governing Council:- (a) The Governing Council of the Skill University shall consist of the following members as part of its initial constitution, namely:- (i) The President; (ii) The Vice-Chancellor; (iii) The Pro-Chancellor; (iv) Two representatives of the Nodal Agency; (v) One eminent alumni or faculty of an Indian Institute of Technology or similarly benchmarked institution based out of Jharkhand nominated by Nodal Agency; (vi) Two officials from Department of Higher and Technical Education, Government of Jharkhand; (vii) Up to three eminent industrialists to be nominated by the President on the recommendation from industry bodies or sectors of focus; (viii) One senior faculty member from the skill university; and (ix) the Registrar of the Skill University. (b) The President shall be the Chairperson of the Governing Council, and in his absence, a member of the Governing Council nominated by it shall chair its meeting. (c) Save as otherwise provided in this section, the term of nominated members of the Governing Council shall be three years from the date of nomination. (d) An ex officio member shall continue so long as he holds the office by virtue of which he is such member. (e) One-third of the nominated members, except ex officio members, shall retire by rotation each year. In the first two instances, the Governing Council may decide the procedure to identify the members who will retire. (f) A member may be re-nominated for the next succeeding term. (g) A member may resign his office by an instrument in writing under his hand and addressed to the Chairperson, but he shall continue in office until the date of acceptance of his resignation by the Chairperson. (h) A casual vacancy, arising out of the coming to an end of the membership of any member (other than an ex officio member) during the term of office of such member for any reason whatsoever, shall be filled up in the manner provided for the constitution of the Governing Council in sub-section (a): Provided that a person nominated to a casual vacancy shall be a member for the residual term of office of such member resultant to the termination of whose membership the casual vacancy has arisen. (i) The Governing Council shall meet at least two times in a calendar year, as possible. (j) A minimum of four members present shall form a quorum for a meeting of the Governing Council with the President being the Chairman of the meeting: Provided that, in case of leave of absence of the President, the attending members may choose a chairperson for the meeting: Provided further that the members may participate in the meeting person or through teleconferencing or video conferencing or any other form of participation through any other mode of Information and Communication Technologies. (k) The decisions of the Governing Council shall be taken through consensus: Provided that in cases in which decisions of the Governing Council cannot be taken through consensus, the decision shall be taken through a majority vote, including through electronic voting technology, by a quorum of not less than four members of Governing Council participating in the meeting of the Governing Council. (2) Powers and Functions of the Governing Council:- (a) Subject to the provisions of this Act, the Governing Council may be delegated such powers by the Board of Directors of the Nodal Agency as is necessary for the conduct of the affairs and business of the Skill University. (b) All property of the Skill University shall vest in the Governing Council, with prior approval of competent authorities. (c) Subject to the provisions of this Act, the Governing Council shall exercise the following powers and discharge the following functions, namely:- (i) to exercise general superintendence and control over all personnel, authorities, committees and bodies of the Skill University; (ii) to review the decisions by any authority of the Skill University in the cases where the decisions taken by any authority of the Skill University is not in conformity with the power under the provisions of the Act or the Schedule or the Regulations made thereunder; (iii) to approve the budget and annual report of the Skill University; (iv) to lay down the policies to be followed and implemented by the Skill University; (v) to create or abolish posts as may be deemed necessary for the functioning of the Skill University; (vi) to appoint statutory auditors of the Skill University; (vii) to delegate such powers as it may deem fit to the Senate and other authorities or officers of the Skill University; (viii) to take all such actions as may be necessary to achieve the objectives of the Skill University; (ix) to make provision for appointment of practitioners-as-faculty, Professors of practice, Emeritus Professors, Visiting Professors, Visiting Fellows, Adjunct Professors, etc., as required by the Skill University on the recommendations of the Senate; (x) to administer and manage the Skill University and such centres for research, education and instruction as are necessary for furtherance of the objects of the Skill University; (xi) to regulate the expenditure and to manage the accounts of the Skill University; (xii) to draw and accept, to make and endorse, to discount or negotiate promissory notes, bills of exchange, cheques or other negotiable instruments; (xiii) to execute conveyances, transfers, reconveyances, mortgages, leases, licences and agreements in respect of property, including government securities belonging to the Skill University or to be acquired for the purpose of the Skill University, with prior approval of competent authorities; (xiv) to give up and cease from carrying on any classes or departments of the Skill University; (xv) to enter into any agreement with the central government, state governments, University Grants Commission or other authorities for receiving grants; (xvi) to accept grants of money, securities or property of any kind on such terms as may be deemed expedient; (xvii) to approve the student contribution prepared by Senate, including tuition expenses towards training, learning and Information Technology, living infrastructure, utilities, set-up, maintenance and such other expenses for enabling self-sustainability of the Skill University; (xviii) to exercise all such powers and discharge all such functions of the Skill University as mentioned in the Act. (d) When urgent action by the Governing Council becomes necessary, the Chairperson may permit the business to be transacted by the circulation of papers to the members of the Governing Council. The action proposed to be taken shall not be taken unless agreed to by consensus or by a majority of the voting members of a quorum of not less than four members of the Governing Council. The resolution so circulated and approved shall be as effective and binding as if such resolution has been passed at the meeting of Governing Council. (e) The Governing Council shall exercise such other powers and functions as may be prescribed by the Schedule and the Regulations from time to time. (f) The nodal agency may amend the composition of Governing Council through a formal resolution of the Board of Directors. 10. Senate: (1) The Senate shall consist of the following persons as part of its initial constitution, namely:- (a) The Pro-Chancellor; (b) The Dean of Credentials; (c) The Chief Finance and Accounts Officer; (d) One member of the Governing Council, to be nominated by the Nodal Agency; (e) Two persons from amongst the personnel of the Skill University, to be nominated by the President; and (f) The Registrar of the Skill University (2) The Vice-Chancellor shall be the permanent invitee to the meetings of Senate on matters regarding the academic affairs of the Skill University, where award of bachelor’s/master’s/doctoral degree is concerned. (3) The Pro-Chancellor shall be the Chairperson of the Senate, provided that President may at his discretion, nominate any other member of the Governing Council to be the Chairperson of the Senate. (4) The Senate shall meet once in every three months as possible. (5) A minimum of three members present shall form a quorum of a meeting of the Senate. In case of leave of absence of the Pro-Chancellor, the members present in the meeting may choose a chairperson for the meeting. The members may participate in person or through teleconferencing or video conferencing or any other mode of Information and Communication Technologies: Provided that the decisions of the Senate should be taken through consensus: Provided further that in cases in which decisions of the Senate cannot be taken through consensus, the decision shall be taken through a majority vote, including through electronic voting technology, by a quorum of not less than three members of Senate participating in the meeting of the Senate. (6) The Regulations of the Skill University, concerning all matters which are required to be provided by the Regulations under the provisions of this Act or the Schedule made there under, shall be laid down by Senate and duly approved by the Governing Council. (7) The Governing Council may amend the initial or subsequent composition of Senate through a formal resolution. (8) Subject to the provisions of this Act, the Senate shall exercise all such powers and discharge all such functions of the Skill University as mentioned in the Act, the Schedule or as prescribed by the Regulations from time to time. 11. Vocational Education Council: (1) The Vocational Education Council shall consist of the Pro-Chancellor and such other members as may be specified by the Senate as maybe prescribed by the Schedule and Regulations. (2) The Pro-Chancellor shall be the Chairperson of the Vocational Education Council. (3) Subject to the provisions of this Act, the Schedule and the Regulations made thereunder, the Vocational Education Council shall be the principal vocational education delivery body of the Skill University and shall co-ordinate and exercise general superintendence and control in matters regarding the implementation of the policies relating to vocational education imparted by the Skill University. (4) The quorum for meetings of the Vocational Education Council shall be such as may be specified by the Senate. 12. Credentials Council: (1) The Credentials Council shall consist of the Dean of Credentials and such other members as may be prescribed by the Governing Council, reporting to authority as deemed by the Governing Council. (2) The Dean of Credentials shall be the Chairperson of the Credentials Council. (3) Subject to the provisions of this Act, the Schedule and the Regulations made thereunder, the Credentials Council shall be responsible for laying down of the norms and standards, modes of assessments and certifications, grant of the privileges of recognition and shall co-ordinate with other authorities of the Skill University, other institutes (including training institutes) and universities, research and development organizations, industry, other agencies of the State and Central Governments, Union Territories and other State Governments etc., and exercise general supervision and control over the matters concerning the quality of vocational education offered and imparted, and credentials given, by the Skill University. (4) The quorum for meetings of the Credentials Council shall be such as may be specified by the Governing Council. 13. Updation of Schedule, Regulations, etc. and formal communications: (1) All changes to the Schedule, Regulations, etc. shall be published in the website or any such other medium as determined by the Governing Council of the Skill University and will be deemed as an official notification. SCHEDULE Statutes 1. State Public University: The Skill University shall act in public benefit as the State Public University, actualised through delegation of powers to state nodal agency for complete autonomy and financial independence, in its commitment to service of the public. 2. Incorporation: The Skill University shall be headquartered in Khunti, Jharkhand. 3. Appointment, Powers and Functions of the President: (1) Appointment of the President:- (a) The President shall be appointed by the Nodal Agency for a term of three years on the recommendation of a selection committee. (b) Three months prior to the expiry of the term of office of the President, the Nodal Agency shall constitute a Selection Committee consisting of following members, which shall prepare a panel of at least three names, in alphabetical order, from which the Nodal Agency shall appoint the President: (i) two nominees of the Nodal Agency; and (ii) one nominee of the Governing Council (c) The President of the Skill University shall ideally be a leader in his industry, preferably an alumnus of an institute of eminence or similarly bench-marked institution including with an industry/entrepreneurial background. (d) After the completion of his tenure of three years, he shall be eligible for reappointment by the Nodal Agency, limited to number of terms as decided by the nodal agency. (e) This shall be an honorary position and all the reasonable expenses incurred by the President in connection with the affairs of the Skill University shall be reimbursed and paid out of the General Fund of the Skill University. (f) The first president shall be appointed by the Nodal Agency. (g) On a representation made to it or otherwise and after making such enquiry as may be necessary, if the Nodal Agency is of the opinion that the continuance of the President in office may not be in the interest of the Skill University, the Nodal Agency, by an order in writing stating the reasons therein, may direct the President to relinquish his office from the date specified in the order: Provided that prior to the issuance of any such order, the President shall be given an opportunity of being heard. (h) The President may, by an instrument in writing under his hand and addressed to the Chairperson of the Nodal Agency, resign his office: Provided that the President shall continue in office till the date of acceptance of his resignation by the Nodal Agency. (i) In the event of the abrupt occurrence of vacancy in the office of the President by reason of death, conviction or otherwise, the Vice-Chancellor shall act as President until a regular appointment of President is made in accordance with sub-sections (a) and (b): Provided that the period of such interim arrangement shall not exceed six months. (2) Powers and Functions of the President:- (a) The President shall be the head of the Skill University, and shall be the Chairperson of the Governing Council. (b) The President shall preside over the meetings of the Governing Council and, when the Chancellor is not present, at the convocation of the Skill University for conferring of diplomas, degrees or other academic distinctions: Provided that in the absence of the President, such functions shall be carried out by any other member of the Governing Council nominated by it: Provided that, in case of a tie in regard to any of the decisions taken by the Governing Council, the President shall have a casting vote. (c) In case of any disputes or differences of opinion, the decision of the President shall be final and binding on all concerned. (d) The President shall have the power to call for any information or record from any officer or authority of the University, relating to the affairs of the Skill University. 4. Appointment, Powers and Functions of the Vice-Chancellor: (1) Appointment of the Vice-Chancellor:- (a) The Vice-Chancellor shall be appointed by the President with the approval of Nodal Agency for a term of three years on the recommendation of a selection committee. (b) Three months prior to the expiry of term of the Vice-Chancellor, the Nodal Agency shall constitute a Selection Committee consisting of following members, which shall prepare a panel of at least three names, in alphabetical order, from which the Nodal Agency shall appoint the Vice-Chancellor: (i) one nominee of the Nodal Agency who will also act as the Chairperson of the Committee; (ii) one nominee of the President; and (iii) one nominee of the Governing Council (c) The Vice-Chancellor shall be a person of eminence having rich administrative and academic experience possibly with past/present board membership(s) in industry. Suitable person who has been faculty of Indian Institutes of Technology or similar eminent institutions may be considered. (d) After the completion of his tenure of three years as the Vice-Chancellor, he may be considered to be eligible for reappointment, limited to number of terms as decided by the nodal agency. (e) The first Vice-Chancellor shall be appointed by the Nodal Agency. (f) On a representation made to it or otherwise and after making such enquiry as may be necessary, if the Nodal Agency is of the opinion that the continuance of the Vice-Chancellor in office may not be in the interest of the Skill University, the Nodal Agency, by an order in writing stating the reasons therein, may direct the Vice-Chancellor to relinquish his office from the date specified in the order: Provided that prior to the taking of any action under this sub-section, the Vice-Chancellor shall be given an opportunity of being heard. (g) The Vice-Chancellor may, by an instrument in writing under his hand and addressed to the Chairperson of the Nodal Agency, resign his office: Provided that the Vice-Chancellor shall continue in office till the date of acceptance of his resignation by the Nodal Agency. (h) In the event of the abrupt occurrence of vacancy in the office of the Vice- Chancellor by reason of death, conviction or otherwise, the nodal agency may appoint any other suitable officer of the Skill University to act as Vice- Chancellor until a regular appointment of Vice-Chancellor is made in accordance with sub-sections (a) and (b): Provided that the period of such interim arrangement shall not exceed six months. (2) Powers and Functions of the Vice-Chancellor :- The Vice-Chancellor shall have ascendance over the academic affairs, on matters where award of bachelor’s/master’s/doctoral degree is concerned, of the Skill University- (a) to advise the Governing Council, particularly in respect of the norms and standards of education, teaching and research, and training programmes in the Skill University and ensure compliance of the same; (b) to coordinate with Deans / Heads concerned with the introduction of programmes and courses in academic, training and consultancy domains and for teaching, research and development in the Skill University; (c) to ensure adherence to quality, norms and standards pertaining to the programmes and courses of study offered or to be offered, involving with undergraduate and postgraduate education, by the Skill University; (d) to delegate his powers subject to the approval of the President; (e) to exercise such other powers and perform such duties as may be specified in the Schedule and Regulations of the Skill University. 5. Appointment, Powers and Functions of the Pro-Chancellor: (1) Appointment of the Pro-Chancellor:- (a) The Pro-Chancellor shall be appointed by the President with approval of the Nodal Agency for a term of three years on the recommendation of a selection committee: Provided that the first Pro-Chancellor shall be appointed by the Nodal Agency. (b) Three months prior to the expiry of term of the Pro-Chancellor, the Nodal Agency shall constitute a Selection Committee consisting of following members, which shall prepare a panel of at least three names, in alphabetical order, from which the Nodal Agency shall appoint the Pro-Chancellor: (i) one nominee of the Nodal Agency who will also act as the Chairperson of the Committee; (ii) one nominee of the President; and (iii) one nominee of the Governing Council (c) The eligibility criteria with regard to the educational qualifications (academic/ research/ skill specialization, etc.) and industry experience for selection of the Pro-Chancellor shall be as prescribed by the Schedule and Regulations. (d) After the completion of his tenure of three years as the Pro-Chancellor, he may be considered to be eligible for reappointment, limited to number of terms as decided by the nodal agency. (e) The Pro-Chancellor shall be a whole-time salaried officer of the Skill University or be deputed from the nodal agency. (f) On a representation made to it or otherwise and after making such enquiry as may be necessary, if the Nodal Agency is of the opinion that the continuance of the Pro-Chancellor in office may not be in the interest of the Skill University, the Nodal Agency, by an order in writing stating the reasons therein, may direct the Pro-Chancellor to relinquish his office from the date specified in the order: Provided that prior to the taking of any action under this sub-section, the Pro-Chancellor shall be given an opportunity of being heard. (g) The Pro-Chancellor may, by an instrument in writing under his hand and addressed to the Chairperson of the Nodal Agency, resign his office: Provided that the Pro-Chancellor shall continue in office till the date of acceptance of his resignation by the Nodal Agency. (h) In the event of the abrupt occurrence of vacancy in the office of the Pro- Chancellor by reason of death, conviction or otherwise, the nodal agency may appoint any other suitable officer of the Skill University to act as Pro-Chancellor until a regular appointment of Pro-Chancellor is made in accordance with sub- sections (a) and (b): Provided that the period of such interim arrangement shall not exceed six months. (2) Powers and Functions of the Pro-Chancellor:- (a) The Pro-Chancellor shall be the principal executive officer of the Skill University and shall exercise general superintendence and control over the affairs of the Skill University. (b) On matters regarding the academic affairs of the Skill University, where award of bachelor’s/master’s/doctoral degree is concerned, the Pro-Chancellor shall seek guidance from the Vice-Chancellor. (c) The Pro-Chancellor shall execute the decisions of various authorities of the Skill University and take all action as may be necessary to execute for discharge of the duties and responsibilities that may be assigned to him by the President and the authorities of the Skill University. (d) Where, in the opinion of the Pro-Chancellor it is necessary to take immediate action on any matter for which powers are conferred on any other authority by or under the Act, he may take such action as he deems necessary, and, shall at the earliest opportunity thereafter, report the action taken by him to such officer or authority as would have in the ordinary course dealt with the matter: Provided that if, in the opinion of the concerned officer or authority such action should not have been taken by the Pro-Chancellor, then such case shall be referred to the President, whose decision thereon shall be final: Provided further that where any such action taken by the Pro-Chancellor adversely affects the rights of any personnel of the Skill University, such person shall be entitled to prefer, within three months from the date on which such action is communicated to him, an appeal to the Governing Council, and, the Governing Council may confirm or modify or reverse the action taken by the Pro-Chancellor. (e) Where, in the opinion of the Pro-Chancellor, any decision taken by any authority of the Skill University is not within the powers conferred on such authority by the Act, or is likely to be prejudicial to the interests of the Skill University, he shall forthwith request the concerned authority to revise its decision within fifteen days from the date of its decision, and, in case the authority refuses to revise such decision wholly or partly or fails to take any decision within fifteen days, then such matter shall be referred by the Pro- Chancellor to the President and his decision thereon shall be final. (f) The Pro-Chancellor shall be the Chairperson of the Vocational Education Council and shall have a casting vote in case of a tie in regard to any of the decisions taken by the Vocational Education Council. (g) The Pro-Chancellor shall ensure compliance with the provisions of the Act, Schedule and Regulations of the Skill University. (h) The Pro-Chancellor shall be entitled to be present at, and to address, any meeting of any authority of the Skill University, but shall not be entitled to vote unless he is a member of that particular authority. (i) In all suits and other legal proceedings by or against the Skill University, the pleadings shall be signed and verified by the Pro-Chancellor and all processes in such suits and proceedings shall be issued to, and served on, the Pro-Chancellor. (j) The Pro-Chancellor shall have the power- (i) to advise the Governing Council on matters regarding the planning and development of the Skill University, particularly in respect of the norms and standards of education, teaching and research, and training programmes in the Skill University and ensure compliance of the same; (ii) to coordinate with Deans / Heads concerned with the introduction of programmes and courses in academic, training and consultancy domains and for teaching, research and development in the Skill University; (iii) to provide pedagogical leadership and motivation for excellence; (iv) to coordinate with Deans / Heads for collaboration with any university, Research Institute, Centre in India and abroad from time to time with prior approval of the Governing Council; (v) to apply for membership of other institutions like Association of Indian Universities, Commonwealth Universities, International Universities, and India International Centre, etc.; (vi) to ensure adherence to quality, norms and standards pertaining to the programmes and courses of study offered or to be offered by the Skill University; (vii) to take necessary steps to obtain accreditation, etc.; (viii) to convene or cause to be convened meetings of any segment or authority of the Skill University except the Governing Council and the Senate; (ix) To make regular appointments with the prior approval of the Senate, as maybe prescribed by the Regulations- a) for all posts of teaching staff; and b) for posts of officers among the administrative staff and technical support staff; (x) to make provision for the offer of scholarships, fellowships, studentships, medals and awards with the prior approval of the Senate; (xi) to appoint course writers, script writers, counsellors, programmers, artists, consultants and such other persons as maybe considered necessary for the efficient functioning of the Skill University; (xii) to fix emoluments and other terms and conditions of service of the teaching staff, administrative staff and technical support staff with the approval of the Senate, as maybe prescribed by the Regulations; (xiii) to make temporary appointments, with the approval of the Senate of such persons as he may consider necessary for the functioning of the Skill University, as maybe prescribed by the Regulations: Provided that, in case of any exigency, the Pro-Chancellor may appoint such staff for a period not exceeding six months, and such appointments shall be reported to the Senate in its next meeting. (xiv) to grant leave to- a) Teaching staff; and b) Officers among the administrative staff and technical support staff, and make necessary arrangements for the discharge of the functions of such personnel during their absence; (xv) to grant leave of absence to any personnel of the Skill University in accordance with the Regulations and if he so desires, delegate such powers to any other officer of the Skill University; (xvi) to make necessary arrangements for the discharge of the functions of an officer whose position falls vacant due to resignation, retirement or any other reason till such time as regular appointment to such position is made; (xvii) to ensure proper maintenance of discipline in the Skill University and to delegate any such power to such officer or officers as he may deem fit; (xviii) to suspend and to initiate disciplinary action against any student or personnel of the Skill University as per the Regulations; (xix) to delegate his powers subject to the approval of the President; (xx) to perform all such acts as may be deemed necessary for furtherance of duties and objectives of the Skill University. 6. Appointment, Powers and Functions of the Registrar: (1) Appointment of the Registrar:- (a) The first Registrar shall be appointed by the Nodal Agency. After completion of the term of the first Registrar, the President shall appoint the next Registrars with the approval of the Nodal Agency on the recommendation of the selection committee constituted for the purpose, as specified by the Governing Council. (b) He shall report to the Pro-Chancellor. (c) He shall be a whole-time salaried officer of the Skill University or be deputed from nodal agency. (d) He shall be appointed for a term of five years and shall be eligible for reappointment, limited to number of terms as decided by the nodal agency. (e) On a representation made to him or otherwise and after making such inquiry as may be necessary, if the Pro-Chancellor is of the opinion that the continuance of the Registrar in office will not in the interests of the Skill University, he may by an order in writing stating the reasons therein, direct the Registrar to relinquish his office from the date specified in the order: Provided that prior to taking any action under this sub-section, the Pro- Chancellor shall ensure that it gets the approval of the Nodal Agency after giving to the Registrar reasonable opportunity of a hearing. (f) The Registrar may, by an instrument in writing under his hand and addressed to the Pro-Chancellor, may resign his office: Provided that the Registrar shall continue in office till the date of acceptance of his resignation by the Nodal Agency. (g) In the event of the abrupt occurrence of vacancy in the office of the Registrar by reason of death, conviction or otherwise, the Pro-Chancellor may appoint any other suitable officer or personnel of the Skill University to act as Registrar until a regular appointment of Registrar is made in accordance with sub-section (a): Provided that the period of such interim arrangement shall not exceed six months. (2) Powers and Functions of the Registrar:- (a) The Registrar shall be the Member-Secretary of the Governing Council, Senate, Vocational Education Council and Credentials Council but he shall not have a right to vote; (b) All contracts shall be signed and all documents and records shall be authenticated by the Registrar on behalf of the Skill University; (c) The Registrar shall exercise and perform the following powers and functions- (i) to function as the custodian of the records, minutes of the meetings of the authorities of the Skill University, the common seal and all properties of the Skill University; (ii) to place before the President, Vice-Chancellor, Pro-Chancellor or any authority of the Skill university, all such information and documents as may be necessary for transaction of their business; (iii) to conduct official correspondence on behalf of the Skill University and be responsible for the proper maintenance of all the records of the Skill University, subject to the provisions of the Act, the Schedule and the Regulations; (iv) to issue notices concerning all meetings of the Governing Council, Senate, Vocational Education Council, and any other committee or body constituted as per instructions of the President or Pro-Chancellor; (v) to represent the Skill University in suits or proceedings by or against the Skill University, sign powers of attorney and plead in such cases or depute his representative for this purpose; (vi) to maintain a register of all students registered in any course or programme offered by the Skill University in the prescribed form; (vii) to maintain a register of all certificates, diplomas, degrees or any academic distinction conferred on any person by the Skill University; (viii) to suspend and to initiate disciplinary control over the personnel, of the Skill University, as per powers delegated by the Pro-Chancellor; (ix) to render to the Pro-Chancellor and the President such assistance as may be desired by them in the performance of their official duties; (x) to appoint persons to the posts below the level of officers among the technical support staff and administrative staff, as maybe prescribed by the Regulations; (xi) to maintain the service records of all the personnel of the Skill University; (xii) to perform such other duties as may be specified by the Governing Council or the Senate or the President or the Vice-Chancellor or the Pro- Chancellor from time to time; (xiii) to exercise such powers and perform such duties as may be specified in the Schedule and Regulations of the Skill University. 7. Appointment, Powers and Functions of the Chief Finance and Accounts Officer: (1) The appointment of the Chief Finance and Accounts Officer shall be made by the President, in such manner as specified by the Governing Council, as maybe prescribed by the Schedule and Regulations. (2) The Chief Finance and Accounts Officer shall exercise such powers and perform such duties as may be specified by the Governing Council. 8. Appointment, Powers and Functions of the Dean of Credentials: (1) The appointment of the Dean of Credentials shall be made by the President, in such manner as specified by the Governing Council, as maybe prescribed by the Schedule and Regulations. (2) The Dean of Credentials shall exercise such powers and perform such duties including with respect to all aspects of credentials such as laying down of the norms and standards, mode of assessments and certifications etc. as may be specified by the Governing Council. 9. Governing Council: (1) Constitution of the Governing Council:- (a) The Governing Council of the Skill University shall consist of the following members as part of its initial constitution, namely:- (i) The President; (ii) The Vice-Chancellor; (iii) The Pro-Chancellor; (iv) Two representatives of the Nodal Agency; (v) One eminent alumni or faculty of an Indian Institute of Technology or similarly benchmarked institution based out of Jharkhand nominated by Nodal Agency; (vi) Two officials from Department of Higher and Technical Education, Government of Jharkhand; (vii) Up to three eminent industrialists to be nominated by the President on the recommendation from industry bodies or sectors of focus; (viii) One senior faculty member from the skill university; and (ix) the Registrar of the Skill University. (b) The President shall be the Chairperson of the Governing Council, and in his absence, a member of the Governing Council nominated by it shall chair its meeting. (c) Save as otherwise provided in this section, the term of nominated members of the Governing Council shall be three years from the date of nomination. (d) An ex officio member shall continue so long as he holds the office by virtue of which he is such member. (e) One-third of the nominated members, except ex officio members, shall retire by rotation each year. In the first two instances, the Governing Council may decide the procedure to identify the members who will retire. (f) A member may be re-nominated for the next succeeding term. (g) A member may resign his office by an instrument in writing under his hand and addressed to the Chairperson, but he shall continue in office until the date of acceptance of his resignation by the Chairperson. (h) A casual vacancy, arising out of the coming to an end of the membership of any member (other than an ex officio member) during the term of office of such member for any reason whatsoever, shall be filled up in the manner provided for the constitution of the Governing Council in sub-section (a): Provided that a person nominated to a casual vacancy shall be a member for the residual term of office of such member resultant to the termination of whose membership the casual vacancy has arisen. (i) The Governing Council shall meet at least two times in a calendar year, as possible. (j) A minimum of four members present shall form a quorum for a meeting of the Governing Council with the President being the Chairman of the meeting: Provided that, in case of leave of absence of the President, the attending members may choose a chairperson for the meeting: Provided further that the members may participate in the meeting person or through teleconferencing or video conferencing or any other form of participation through any other mode of Information and Communication Technologies. (k) The decisions of the Governing Council shall be taken through consensus: Provided that in cases in which decisions of the Governing Council cannot be taken through consensus, the decision shall be taken through a majority vote, including through electronic voting technology, by a quorum of not less than four members of Governing Council participating in the meeting of the Governing Council. (2) Powers and Functions of the Governing Council:- (a) Subject to the provisions of this Act, the Governing Council may be delegated such powers by the Board of Directors of the Nodal Agency as is necessary for the conduct of the affairs and business of the Skill University. (b) All property of the Skill University shall vest in the Governing Council, with prior approval of competent authorities. (c) Subject to the provisions of this Act, the Governing Council shall exercise the following powers and discharge the following functions, namely:- (i) to exercise general superintendence and control over all personnel, authorities, committees and bodies of the Skill University; (ii) to review the decisions by any authority of the Skill University in the cases where the decisions taken by any authority of the Skill University is not in conformity with the power under the provisions of the Act or the Schedule or the Regulations made thereunder; (iii) to approve the budget and annual report of the Skill University; (iv) to lay down the policies to be followed and implemented by the Skill University; (v) to create or abolish posts as may be deemed necessary for the functioning of the Skill University; (vi) to appoint statutory auditors of the Skill University; (vii) to delegate such powers as it may deem fit to the Senate and other authorities or officers of the Skill University; (viii) to take all such actions as may be necessary to achieve the objectives of the Skill University; (ix) to make provision for appointment of practitioners-as-faculty, Professors of practice, Emeritus Professors, Visiting Professors, Visiting Fellows, Adjunct Professors, etc., as required by the Skill University on the recommendations of the Senate; (x) to administer and manage the Skill University and such centres for research, education and instruction as are necessary for furtherance of the objects of the Skill University; (xi) to regulate the expenditure and to manage the accounts of the Skill University; (xii) to draw and accept, to make and endorse, to discount or negotiate promissory notes, bills of exchange, cheques or other negotiable instruments; (xiii) to execute conveyances, transfers, reconveyances, mortgages, leases, licences and agreements in respect of property, including government securities belonging to the Skill University or to be acquired for the purpose of the Skill University, with prior approval of competent authorities; (xiv) to give up and cease from carrying on any classes or departments of the Skill University; (xv) to enter into any agreement with the central government, state governments, University Grants Commission or other authorities for receiving grants; (xvi) to accept grants of money, securities or property of any kind on such terms as may be deemed expedient; (xvii) to approve the student contribution prepared by Senate, including tuition expenses towards training, learning and Information Technology, living infrastructure, utilities, set-up, maintenance and such other expenses for enabling self-sustainability of the Skill University; (xviii) to exercise all such powers and discharge all such functions of the Skill University as mentioned in the Act. (d) When urgent action by the Governing Council becomes necessary, the Chairperson may permit the business to be transacted by the circulation of papers to the members of the Governing Council. The action proposed to be taken shall not be taken unless agreed to by consensus or by a majority of the voting members of a quorum of not less than four members of the Governing Council. The resolution so circulated and approved shall be as effective and binding as if such resolution has been passed at the meeting of Governing Council. (e) The Governing Council shall exercise such other powers and functions as may be prescribed by the Schedule and the Regulations from time to time. (f) The nodal agency may amend the composition of Governing Council through a formal resolution of the Board of Directors. 10. Senate: (1) The Senate shall consist of the following persons as part of its initial constitution, namely:- (a) The Pro-Chancellor; (b) The Dean of Credentials; (c) The Chief Finance and Accounts Officer; (d) One member of the Governing Council, to be nominated by the Nodal Agency; (e) Two persons from amongst the personnel of the Skill University, to be nominated by the President; and (f) The Registrar of the Skill University (2) The Vice-Chancellor shall be the permanent invitee to the meetings of Senate on matters regarding the academic affairs of the Skill University, where award of bachelor’s/master’s/doctoral degree is concerned. (3) The Pro-Chancellor shall be the Chairperson of the Senate, provided that President may at his discretion, nominate any other member of the Governing Council to be the Chairperson of the Senate. (4) The Senate shall meet once in every three months as possible. (5) A minimum of three members present shall form a quorum of a meeting of the Senate. In case of leave of absence of the Pro-Chancellor, the members present in the meeting may choose a chairperson for the meeting. The members may participate in person or through teleconferencing or video conferencing or any other mode of Information and Communication Technologies: Provided that the decisions of the Senate should be taken through consensus: Provided further that in cases in which decisions of the Senate cannot be taken through consensus, the decision shall be taken through a majority vote, including through electronic voting technology, by a quorum of not less than three members of Senate participating in the meeting of the Senate. (6) The Regulations of the Skill University, concerning all matters which are required to be provided by the Regulations under the provisions of this Act or the Schedule made there under, shall be laid down by Senate and duly approved by the Governing Council. (7) The Governing Council may amend the initial or subsequent composition of Senate through a formal resolution. (8) Subject to the provisions of this Act, the Senate shall exercise all such powers and discharge all such functions of the Skill University as mentioned in the Act, the Schedule or as prescribed by the Regulations from time to time. 11. Vocational Education Council: (1) The Vocational Education Council shall consist of the Pro-Chancellor and such other members as may be specified by the Senate as maybe prescribed by the Schedule and Regulations. (2) The Pro-Chancellor shall be the Chairperson of the Vocational Education Council. (3) Subject to the provisions of this Act, the Schedule and the Regulations made thereunder, the Vocational Education Council shall be the principal vocational education delivery body of the Skill University and shall co-ordinate and exercise general superintendence and control in matters regarding the implementation of the policies relating to vocational education imparted by the Skill University. (4) The quorum for meetings of the Vocational Education Council shall be such as may be specified by the Senate. 12. Credentials Council: (1) The Credentials Council shall consist of the Dean of Credentials and such other members as may be prescribed by the Governing Council, reporting to authority as deemed by the Governing Council. (2) The Dean of Credentials shall be the Chairperson of the Credentials Council. (3) Subject to the provisions of this Act, the Schedule and the Regulations made thereunder, the Credentials Council shall be responsible for laying down of the norms and standards, modes of assessments and certifications, grant of the privileges of recognition and shall co-ordinate with other authorities of the Skill University, other institutes (including training institutes) and universities, research and development organizations, industry, other agencies of the State and Central Governments, Union Territories and other State Governments etc., and exercise general supervision and control over the matters concerning the quality of vocational education offered and imparted, and credentials given, by the Skill University. (4) The quorum for meetings of the Credentials Council shall be such as may be specified by the Governing Council. 13. Updation of Schedule, Regulations, etc. and formal communications: (1) All changes to the Schedule, Regulations, etc. shall be published in the website or any such other medium as determined by the Governing Council of the Skill University and will be deemed as an official notification.
