0. Preamble
WHEREAS to establish and incorporate an University at Jamshedpur in East Singhbhum District of the State of Jharkhand to facilitate and promote avenues of higher education and research facilities for the tribal population in India and Jharkhand and to provide for matters connected therewith or incidental thereto. Be it enacted by the Legislature of the State of Jharkhand in the 73rd year of the Republic of India as follows: - Preliminary
1. Short title, extent and commencement:
1. Short title, extent and commencement: (1) This Act may be called the Pandit Raghunath Murmu Tribal University Act, 2022. (2) It shall extend to the whole of the State of Jharkhand. (3) It shall come into force from the date of publication in the official Gazette of the State of Jharkhand.

Definitions: In this Act, and in all Statutes made hereunder, unless the context otherwise requires, (a) “Academic Board” in relation to a Regional Centre; means the academic body charged with the academic matters of such Center, as the case may be, and recognised as such by the University; (b) “Academic Council” means the Academic Council of the University; (c) “Academic staff” means such categories of staff as are designated as academic staff by the University; (d) “Board of Studies” means the Board of Studies of the University; (e) “Bi-monthly Meeting” means one of the meetings of the Executive Council to be held once every two months under sub-section (11) of section 27 and declared by the statutes to be the bi-monthly meeting of the Executive Council; (f) “Campus” means the unit established or constituted for making arrangements for instruction, or research, or both, and includes off-campuses; (g) “Chancellor”, “Vice-Chancellor” and “Pro-Vice Chancellor” mean, respectively, the Chancellor, Vice-Chancellor and Pro-Vice Chancellor of the University; (h) “Dean” means Head of a Faculty of the University; (i) “Department” means a University Department; (j) “Director” means Head of a Regional Centre; (k) “Employee” means any person appointed by the University and includes teachers and other staff of the University; (l) “Executive Council” means the Executive Council of the University; (m) “Faculty” means a Faculty of the University; (n) “Finance Committee” means the Finance Committee of the University; (o) “Hall” means a hostel or unit of residence or of corporate life for the students of the University, or of a Centre, maintained or recognised by the University; (p) “Management Board” in relation to a Regional Centre means the board charged with the management of the affairs of such Center and recognised as such by the University; (q) “Recognised teachers” means such persons as may be recognised by the University for the purpose of imparting instructions in the University or in its regional centers admitted to the privileges of the University; (r) “Regional Centers” means off-campuses constituted by the University and functioning as part of the University, established in the State of Jharkhand, as prescribed in the Statutes; (s) “Regulations”, means the Regulations made by any authority of the University under this Act for the time being in force; (t) “Scheduled Population” means and includes the Scheduled Tribes as well as Scheduled Castes, as defined in the Constitution of India; (u) “Statutes” and “Ordinances” mean, respectively, the Statutes and the Ordinances of the University, for the time being in force; (v) “Teachers of the University” means Professor, Associate Professor, Assistant Professor and such other persons as may be appointed for imparting instructions or conducting research in the University or any Regional Centre maintained by the University and are designated, as teachers by the University; (w) “University” means the Pandit Raghunath Murmu Tribal University as incorporated under this Act; (x) “University Selection Committee” means a committee, which will have the power to make appointments to post within the sanctioned grades and scales of pay and within the sanctioned strength of the staff and other servants of the University, not being teachers and officers of the University.
3. Establishment of University:
3. Establishment of University: (1) There shall be established, in the State of Jharkhand, a University by the name of "Pandit Raghunath Murmu Tribal University”. (2) The headquarter of the University shall be at Jamshedpur in East Singhbhum District of Jharkhand. (3) The University shall have such number of Regional Centres and Campuses in the State of Jharkhand, as the University may deem fit. (4) The first Chancellor and the first Vice-Chancellor, the Executive Council and the Academic Council, and all such persons who may hereafter become such officers or members, so long as they continue to hold such office or membership, are hereby constituted a body corporate by the name of “Pandit Raghunath Murmu Tribal University”. (5) The University shall have perpetual succession and a common seal, and shall sue and be sued by the said name.
4. Objects of University: Objects of the University shall be as under:-

Objects of University: Objects of the University shall be as under:- to provide avenues of higher education and research facilities on Tribal Studies, primarily for the tribal population; to disseminate and advance knowledge by providing instructional and research facilities on Tribal focused Social Sciences, Art, Culture, Languages and Linguistics, Science, Forest based Economic Activities, etc; to collaborate with state, national and international universities or organizations, especially for undertaking cultural studies and research on tribal populations; to formulate tribal centric development models, publish reports and monographs; and to organise conferences; seminars on issues relating to tribes; and to provide inputs to policy matters in different spheres; to take appropriate measures for promoting innovations in teaching learning processes in interdisciplinary studies and research, and to pay special attention to the improvement of the social, educational and economic conditions and welfare of the Scheduled Tribes within the State of Jharkhand and Union of India - for intellectual, academic and cultural development; Initially, the University shall establish the following departments in the faculties based on CBCS (Choice Based Credit System) as may be approved by the UGC/MoE from time to time. Later on, according to the need, the University shall introduce new faculties/courses or may omit the old one. Powers of The University: The University shall have the following powers, namely:- (1) to provide for instruction in such branches of learning as the University may, from time to time, determine and to make provisions for research and for the advancement and dissemination of knowledge; (2) to grant, subject to such conditions as the University may determine, diplomas or certificates to, and confer degrees (Undergraduate and Postgraduate) or other academic distinctions on the basis of examinations, evaluation or any other method of testing on, persons, and to withdraw any such diplomas, certificates, degrees or other academic distinctions for good and sufficient cause; (3) to organize and to undertake extra-mural studies, training and extension services; (4) to confer honorary degrees, diplomas and certificates or other distinctions in the manner prescribed by the Statutes; (5) to provide facilities through the distance education system to such persons as it may determine; (6) to institute Directorships, Professorships, Associate Professorships, Assistant Professorships and other teaching or academic positions, required by the University and to appoint persons to such as Director, Professor, Associate Professor, Assistant Professor and other teaching or academic positions; (7) to appoint persons of specific knowledge of tribal culture, traditional knowledge and research, who can contribute significantly in the development of the University, working in any other University or educational institutions, as teachers of the University for a maximum period of one year at a time, extendable up to three years, on deputation with the approval of executive council; (8) to co-operate or collaborate or associate with any other University or authority or Institution of higher learning in such manner and for such purposes as the University may determine; (9) to establish, with the prior approval of the State Government, such Regional Centres, Campuses, Special Centers, Specialized Laboratories or other units for research and instruction as are, in the opinion of the University, necessary for the furtherance of its objects; (10) to institute and award fellowships, scholarships, studentships, medals and prizes; (11) to establish and maintain Regional Centres, Departments and Halls; (12) to make provision for research and advisory services and for that purpose, to enter into such arrangements with other institutions, industrial or other organizations, as the University may deem necessary; (13) to organize and conduct Refresher Courses, Workshops, Seminars and other programmes for teachers, evaluators and other academic staffs; (14) to make special arrangements in respect of the residence and teaching of women students as the University may deem necessary; (15) to appoint on contract or otherwise Visiting Professors (retired and working both), Emeritus Professors, Consultants who may contribute to the advancement of the objects of the University, with the approval of executive council; (16) to determine standards of admission to the University which may include examination, evaluation or any other method of testing; (17) to demand and receive payment of fees and other charges; (18) to supervise the residences of the students of the University and to make arrangements for promoting their health and general welfare; (19) to lay down conditions of service of all categories of employees, including their code of conduct; (20) to regulate and enforce discipline among the students and the employees and to take such disciplinary measures in this regard as may be deemed by the University to be necessary; (21) to make arrangements for promoting the health and general welfare of the employees; (22) to receive benefactions, donations and gifts and to acquire, hold, manage and dispose of with the previous approval of the State Government, any property, movable or immovable, including trust and endowment properties for the purposes of the University; (23) to make collaboration (funding or without funding) with industries in areas of research, workshop/seminar/conference /training and employment etc.; (24) to borrow, with the prior approval of the State Government, on the security of the property of the University, money for the purposes of the University; (25) to establish such number of Regional Centers in various areas of the State of Jharkhand as are, in the opinion of the University, necessary for the furtherance of its objects; (26) to make special provisions for the promotion of educational, economic interests and welfare of the members belonging to the Scheduled Tribes by providing adequate percentage of seats in the matters of admission, of posts in the matter of employment and other benefits; (27) to do all such other acts and things as may be necessary, incidental or conducive to the attainment of all or any of its objects.

University open to all classes, castes and creed: The University shall be open to all persons, regardless of gender, race, creed, caste or class, and it shall not be lawful for the University to adopt or impose on any person, any test whatsoever of religious belief or profession in order to entitle them to be appointed as a teacher of the University or to hold any other office therein or be admitted as a student in the University or to graduate therefrom or to enjoy or exercise any privilege thereof: Provided that nothing in this section shall be deemed to prevent the University from making special provisions for the employment or admission of women, persons with disabilities or of persons belonging to the weaker sections of the society including economically weaker sections, and, in particular of the Scheduled Castes and the Scheduled Tribes.

9. Officers of the University: The following shall be the officers of the University

Officers of the University: The following shall be the officers of the University:- (1) The Chancellor; (2) The Vice-Chancellor; (3) The Pro-Vice Chancellor; (4) The Financial Adviser; (5) The Dean of the Students Welfare; (6) The Proctor; (7) The Director; (8) The Deans of Faculties; (9) The Registrar; (10) The Finance Officer; (11) The Controller of Examinations; (12) The Librarian; and (13) Any such other officers as may be declared by the Statutes to be officers of the University.
10. The Chancellor:
10. The Chancellor: (1) The Governor of Jharkhand shall be the Chancellor and shall, by virtue of his office, be the head of the University and shall act as per the recommendation of the State Government and when present, preside at any convocation of the University. (2) For nominating any person in any Council/ Body/ Authority/ Committee or Board of the University, the mode of consultation by the Chancellor with the State Government shall be as follows: - (a) The State Government shall suggest at least three names for each nomination amongst which the Chancellor shall select one as his nominee in any Council/ Body/ Authority/ Committee or Board of the University, and shall communicate the same to the State Government in return. (b) If the Chancellor disagrees with the names proposed by the State Government, he shall record reasons in writing and revert to the State Government. (c) The State Government shall communicate its views in writing as it considers necessary and in such case, the Chancellor shall finalise his nominee. (d) The selection of Vice-Chancellor, Pro-Vice Chancellor, Financial Adviser and Registrar and nomination of any person in any Council/ Body/ Authority/ Committee or Board of the University, shall be through the panel of a Search Committee constituted by the State Government. The Search Committee through public notification or nomination or a talent search process or a combination thereof, identify a panel of 3 names for selection of the candidate. The members of the Search Committee shall not be connected with the University concerned or its colleges. The following shall be the constitution of the Search Committee:- i. An Additional Chief Secretary rank officer of any department of Government of Jharkhand would be the Chairperson of the Committee. ii. Secretary, Department of Higher & Technical Education, Government of Jharkhand – Member. iii. Vice-Chancellor of any university to be nominated by Governor of Jharkhand– Member. (e) While preparing the panel, the existing norms of UGC shall be followed in addition to the desirable qualifications such as adequate experience in administration, either at the government or at the University level. (f) Notwithstanding anything contained in any Statutes, Ordinances and Regulations of this University, the Chairman of any Body or Council or Authority or Committee of this University shall be decided by the University, only after prior approval from the State Government unless the same has been specifically provided in the Act of the University.
11. The Vice-Chancellor:
11. The Vice-Chancellor: (1) The Vice-Chancellor shall be appointed by the Chancellor as per the recommendation of the State Government maintaining the order of preference of names placed before him or her by the State Government. The procedure mentioned in sub-section (2) of Section 10 of the Act shall be adopted for the appointment of the Vice-Chancellor. (2) No person shall be deemed to be qualified to hold the office of the Vice-Chancellor unless he is a reputed scholar and has immense academic interest. Further, a person of the highest level of competence, integrity, moral and institutional commitment is to be appointed as Vice-Chancellor. The Vice-Chancellor to be appointed should be a distinguished academician, with a minimum of ten years of experience as Professor in a University system or ten years of experience in an equivalent position in a reputed research and/or academic administrative organization. Further, it would be desirable that the person has administrative experience either at the Government or at the University level. (3) To meet out any of the situation of not joining by the person so appointed at the first instance, or in case of post of Vice-Chancellor falling vacant on account of death, resignation or removal of the Vice-Chancellor under the provision of this Act, the Chancellor shall appoint the Vice- Chancellor as per the procedure mentioned in sub-section (1) of this section. (4) (i) The Vice-Chancellor shall be a whole-time officer and shall hold office for a term of three years from the date on which he assumes charge of the office. (ii) Provided that the age for applying to the post of Vice-Chancellor shall not exceed 65 years. Ongoing of the said term, he may be reappointed by the Chancellor as per the recommendation of the State Government as per sub-section (1) and he shall hold office at the pleasure of the State Government for a term not exceeding three years, or up-to- the age of 70 years, whichever is earlier. (5) The Vice-Chancellor shall be the principal executive and academic officer of the University, Chairman of the Executive Council and the Academic Council, and shall be entitled to be present and speak at any meeting of any authority or body of the University and shall, in the absence of the Chancellor, preside at any convocation of the University: Provided that the Vice-Chancellor shall not vote in the first instance, but shall exercise a casting vote in the case of an equality of votes. (6) The Vice-Chancellor may hold any meeting of the Council/ Body/ Authority/ Committee or Board, under the information to the State Government. (7) The Vice-Chancellor shall on the recommendation of University Selection Committee and with the approval of Executive Council and subject to the provisions of this Act, the Statutes and the Ordinance, made thereunder, will have power to make appointment to posts within the sanctioned grades and scales of pay and within the sanctioned strength of the staff and other servants of the University, not being teachers and officers of the University and have control and have full disciplinary powers over such staff and servants. The appointment process for these posts shall be completely transparent. The advertisement for the appointment of these posts shall be advertised in leading newspapers. The current reservation policy of the State Government shall strictly be followed as per roster in the appointment of these posts. All these appointments shall be prominently displayed on the home page of the website of the University. (8) The University Selection Committee shall have the following composition: (a) Vice Chancellor – Chairman (b) Pro-Vice Chancellor – Member (c) Representative (Not below the rank of Joint Secretary) of Department of Higher and Technical Education – Member (d) Representative (Not below the rank of Joint Secretary) of Department of Finance – Member (e) Representative (Not below the rank of Joint Secretary) of Department of Personnel, Administrative Reforms and Rajbahasha– Member (9) Representative of The Vice-Chancellor shall have the right to visit and inspect the departments and buildings, laboratories, workshops and equipments thereof and any other institution associated with the University. (10) Save as otherwise provided in the Ordinance or the Statutes, the Vice-Chancellor on the recommendation of University Selection Committee shall appoint teachers and officers other than the Pro-Vice Chancellor, Financial Adviser and Registrar, with prior approval of the State Government and shall define their duties. (11) If at any time except when the Executive Council or the Academic Council is in session, the Vice- Chancellor is satisfied that an emergency has arisen requiring him to take immediate action involving the exercise of any power vested in the Executive Council or the Academic Council by or under this Act, he shall take such action as he deems fit, and shall report the action taken by him to the State Government which may either confirm the action so taken or disapprove it. (12) (i) Subject to the provisions of this Act, it shall be the duty of the Vice-Chancellor to see whether the proceedings of the University are carried out in accordance with the provisions of this Act, the Statutes, the Ordinances, the Regulations and the Rules or not, and the Vice-Chancellor shall report to the State Government every such proceeding which is not in conformity with such provisions. (ii) Till such time as the orders of the State Government are not received on the report of the Vice-Chancellor that the proceeding of the University is not in accordance with this Act, the Statutes, the Ordinances, the Regulations and the Rules, the Vice-Chancellor shall have the powers to stay the proceeding reported against. (13) The Vice-Chancellor shall be the principal executive and academic officer of the University and shall exercise general supervision and control over the affairs of the University and give effect to the decisions of all the authorities of the University. (14) The Vice-Chancellor shall have the power to take disciplinary action against all employees of the University including officers (other than the Pro-Vice Chancellor, Financial adviser and Registrar) and teachers of the University. (15) The Vice-Chancellor may, if he is of the opinion that immediate action is necessary on any matter, exercise any power conferred on any authority of the University by or under this Act and shall report to such authority at its next meeting the action taken by him on such matter: Provided that if the authority concerned is of the opinion that such action ought not to have been taken, it may refer the matter to the State Government, whose decision thereon shall be final: Provided further that any person in the service of the University who is aggrieved by the action taken by the Vice-Chancellor under this subsection shall have the right to represent against such action to the Executive Council within three months from the date on which decision on such action is communicated to him and thereupon the Executive Council may confirm, modify or reverse the action taken by the Vice-Chancellor. (16) The Vice-Chancellor, if he is of the opinion that any decision of any authority of the University is beyond the powers of the authority conferred by the provisions of this Act, the Statutes or the Ordinances or that any decision taken is not in the interest of the University, may ask the authority concerned to review its decision within sixty days of such decision and if the authority refuses to review the decision either in whole or in part or no decision is taken by it within the said period of sixty days the matter shall be referred to the State Government, whose decision thereon shall be final. (17) The Vice-Chancellor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes or the Ordinances.
12. Mode of communication by the Chancellor and Vice-Chancellor with the State Govern

Mode of communication by the Chancellor and Vice-Chancellor with the State Government: (1) Notwithstanding anything contained in the Act or in Statutes, Ordinances, or Regulations made thereunder, in every case, all communications proposed to be made to the Chancellor by the Vice-Chancellor, a copy of same shall be addressed to the Secretary of the Department of Higher and Technical Education, Govt. of Jharkhand. (2) Notwithstanding anything contained in the Act or in Statutes, Ordinances, or Regulations made thereunder, the meeting of the Executive Council/ Body/ Authority/ Board of the University, as the case may be, shall be convened by the Vice-Chancellor with an intimation to the Department of Higher and Technical Education, and Department of Higher and Technical Education shall intimate the same to the Chancellor for the record. (3) Notwithstanding anything contained in the Act or in Statutes, Ordinances, or Regulations made thereunder, all notice regarding convocation shall be brought to the notice of the Department of Higher and Technical Education. (4) Notwithstanding anything contained in the Act or in Statutes, Ordinances, or Regulations made thereunder, all proposals for conferring any Honorary Degree to any person shall be placed before the Department of Higher and Technical Education for concurrence, the Department of Higher and Technical Education shall send the list of awardees to the Chancellor for his confirmation. (5) Every communication proposed to be made by the Chancellor to this University, a copy of same shall be provided to the Department of Higher and Technical Education.
13. Removal of the Vice-Chancellor:
13. Removal of the Vice-Chancellor: (1) If at any time and after such enquiry as may be considered necessary, it appears to the Chancellor that the Vice-Chancellor: - (a) has failed to discharge any duty imposed upon him, by or under this Act, the Statutes or the Ordinance, or (b) has acted in a manner prejudicial to the interests of the University, or (c) has been incapable of managing the affairs of the University, The Chancellor may, notwithstanding the fact that the term of office of the Vice- Chancellor has not expired, require the Vice-Chancellor by an order in writing stating the reasons therefore, to resign his post from the date, as may be specified in the order, but only after the recommendation of the State Government. (2) No order under sub-section (1) shall be passed unless a notice stating the specific grounds on which such action is proposed has been served and a reasonable opportunity to show cause against the proposed order has been given to the Vice-Chancellor. (3) On and from the date specified in sub-section (1), it shall be deemed that the Vice-Chancellor has resigned his post and the office of the Vice-Chancellor shall be deemed to be vacant.
14. Pro-Vice Chancellor:
14. Pro-Vice Chancellor: (1) The Pro-Vice Chancellor shall be appointed by the Chancellor as per the recommendations of the State Government in the same manner as prescribed for the appointment of Vice-Chancellor. The procedure mentioned in sub-section (2) of Section 10 of the Act shall be adopted for the appointment of the Pro-Vice Chancellor. The Pro-Vice Chancellor shall be appointed on such terms and conditions of service, and shall exercise such powers and perform such duties, as may be prescribed by this Act. (2) The Pro-Vice Chancellor shall be a whole time Officer of the University. He shall hold office, on such conditions as may be determined as per sub-section (1), for a period not exceeding three years. Provided that the age for applying to the post of Pro-Vice Chancellor shall not exceed 65 years. Ongoing of the said term, he may be reappointed by the Chancellor as per sub-section (1) and he shall hold office at the pleasure of the State Government for a term not exceeding three years, or up-to-the age of 70 years, whichever is earlier. (3) The Pro-Vice Chancellor shall be responsible for admission, conduct of the examinations and the publication of the result of the examination conducted by the University and shall be responsible for student welfare. Subject to the provisions of this Act, the Pro-Vice Chancellor shall exercise such other powers and perform such other duties as may be prescribed or as may be conferred or imposed on him, from time to time, by the Vice-Chancellor. (4) The Pro-Vice Chancellor can be removed in the same manner as prescribed for the removal of the Vice-Chancellor in Section 13.

Arrangement of work during temporary absence of the Vice-Chancellor: During the temporary absence of the Vice-Chancellor by reason of leave, illness or any other cause, it shall be lawful for the Pro-Vice Chancellor to exercise the powers and perform the duties of the Vice-Chancellor, and the matter shall be immediately reported to the Chancellor by the Registrar and if, in the opinion of the Chancellor, the temporary absence of the Vice-Chancellor is for a long period, the Chancellor may make necessary arrangement as per the recommendation of the State Government.
16. Financial Adviser:
16. Financial Adviser: (1) The Financial Adviser shall be a whole-time officer of the University. He shall be appointed by the Chancellor as per the recommendation of the State Government, either on deputation or by re-employment from amongst the working or retired officers of the Indian Audit and Accounts Service or from any other Accounts Service of Government of India, of the level of Deputy Accountant General or above. The procedure mentioned in sub-section (2) of Section 10 of the Act shall be adopted for the appointment of the Financial Adviser. The Financial Adviser shall be appointed for a term not exceeding five years, or up to the age of 70 years, whichever is earlier. (2) In all proposals having financial implication, the advice of the Financial Adviser shall be mandatory. (3) The Financial Adviser shall be an ex-Officio member of the Finance Committee. (4) The Financial Adviser shall work under the Administrative control of the Vice-Chancellor and the Finance Officer shall work directly under the control of the Financial Adviser. (5) It shall be the responsibility of the Registrar to obtain the advice of the Financial Adviser on all matters having financial implication. Moreover, it shall be the responsibility of the Registrar to mention specifically at the time of placing such a proposal before the Executive Council that the concurrence of the Financial Adviser has been obtained or that he has not concurred with the proposal. (6) If in any financial proposal the Vice-Chancellor or the Executive Council takes a decision contrary to the advice of the Financial Adviser, such a decision shall not be implemented and shall be forwarded by the Vice-Chancellor to the State Government, whose decision in the matter shall be final and binding. (7) Preparation of the University Budget, maintenance of accounts, audit of accounts from time to time, compliance of the audit objections, timely receipt of grants from the State Government in accordance with the approved budget and also of grants from the University Grant Commission, arrangements for keeping the same properly and timely submission of utilization certificates of the University grants in the prescribed manner shall be the responsibility of the Financial Adviser. (8) It shall also be the responsibility of the Financial Adviser to see that all financial matters of the University are submitted in accordance with the Act, the Ordinance, the Statutes, the University Ordinance, Regulations and Rules framed thereunder.
17. The Dean of the Students Welfare:
17. The Dean of the Students Welfare: (1) The Dean of Students Welfare shall be appointed by the Vice-Chancellor for a period of two years from amongst the University Professors or Associate Professors: Provided that if the Vice-Chancellor thinks it necessary for administrative reasons, he may revert the Dean to his original post and appoint another person as Dean for the unexpired period. (2) The duties, powers and functions of the Dean of Students Welfare shall be prescribed by the Statutes. (3) The teacher appointed as Dean of Students Welfare under sub-section (1) shall hold lien on his original post and shall be eligible for all the benefits which would have otherwise accrued to him, in case he would not have been appointed as Dean of Students Welfare.
18. Proctor:
18. Proctor: (1) The Vice-Chancellor shall appoint the Proctor from amongst such teachers of the University as are not below the rank of Associate Professor. (2) His tenure shall be of two years and on the expiry of his tenure, he may again be appointed: Provided that if at any time the Vice-Chancellor thinks it proper on administrative grounds, he may send the Proctor back to his original post and appoint another person as Proctor for the unexpired period of his term. (3) In case of vacancy of the Proctor caused due to resignation or illness or any other reason, his duties shall be discharged by a person appointed for the purpose by the Vice-Chancellor. (4) Duties of the Proctor shall be determined by the Statutes.
19. The Deans of Faculties:
19. The Deans of Faculties: (1) Every Dean of a Faculty shall be appointed by the Vice-Chancellor from amongst the Professors in the Faculty for a period of three years and he shall be eligible for reappointment: Provided that a Dean on attaining the age of 65 years shall cease to hold office as such: Provided further that if at any time there is no Professor in a Faculty, the Vice-Chancellor, or a Dean authorised by the Vice-Chancellor in this behalf, shall exercise the powers of the Dean of a Faculty. (2) When the office of the Dean is vacant or when the Dean is, by reason of illness, absence or any other cause, unable to perform duties of his office, the duties of the office shall be performed by such a person as the Vice-Chancellor may appoint for the purpose. (3) The Dean shall be the Head of the Faculty and shall be responsible for the conduct and maintenance of the standards of teaching and research in the Faculty and shall have such other functions as may be prescribed by the Statutes. (4) The Dean shall have the right to be present and to speak at any meeting of the Committees of the Faculty, as the case may be, but shall not have the right to vote thereat unless he is a member thereof.
20. The Directors of Regional Centre:
20. The Directors of Regional Centre: (1) Every Director of Regional Centre shall be appointed in such manner and shall exercise such powers and perform such duties, as has been prescribed by the Statutes/ordinances. (2) The Director shall be the Academic and Administrative Head of the Regional Centre. (3) The Director of the Regional Centre shall be appointed from amongst the professors of the university on rotation basis, on the recommendation of University selection committee. (4) The services of the Director shall be governed by the Act, Statutes, Ordinances and regulations of the University. (5) The services of the Director may be utilized anywhere as per administrative exigencies of the University. (6) He shall attend the meetings of all the statutory bodies as prescribed by the Statutes. (7) He shall execute the academic calendar of the University in the Regional Centre. (8) The Director shall be entitled to unfurnished residential accommodation for which he should pay prescribed license fee. In case of non-availability of such accommodation, he will be entitled to obtain HRA as per State Government Rules. Mobile phone and free telephone service shall be provided. (9) The Director shall be entitled to such leaves, allowances, provident fund and other financial benefits as prescribed by the University from time to time for its non-vacational staff. He shall be entitled to the facility of staff car between the office and his residence. (10) There shall be a Management Board for the development of Regional Centre which shall be constituted as per the approval of the Executive Council. (11) The Director shall be the chairman of the management board: Provided that the Vice-Chancellor shall preside, if present. (12) The Director shall have the power to recommend disciplinary action/suspension pending inquiry to impose the penalty against the employees of the Regional Centre to the management board of the Regional Centre.
21. The Registrar:
21. The Registrar: (1) The Registrar shall be a whole time officer and shall be appointed in such manner and on such terms and conditions as may be prescribed by this Act and statutes made thereunder. Notwithstanding anything contained in this section, the first Registrar shall be nominated by the Chancellor as per the recommendation of the State Government, as soon as practicable after the commencement of the Act for a maximum period of one year or till regular appointment and on such conditions as the State Government thinks fit. (2) The selection of Registrar shall be carried out as mentioned in sub-section (2) of Section 10 of the Act. (3) The Registrar will be appointed for the period of 5 years or till attaining the age of 62 years, whichever is earlier. (4) Registrar- (a) shall act as Secretary to the Executive Council and the Academic Council; (b) shall manage the property and the investments of the University; (c) shall sign all contracts made on behalf of the University; (d) shall exercise and perform such other powers and duties as may be prescribed by the Statutes, the Ordinances, or the Regulations and the Rules as may from time to time, be framed, conferred and imposed on him by the Executive Council and the Academic Council; (e) shall generally render such assistance to the Vice-Chancellor as may be desired by him in the performance of his duties. (5) Notwithstanding anything contained in this Act or the Statutes, the Chancellor on the recommendation of the State Government appoint an Officer of the Central Government or the State Government or of any autonomous body established by an Ordinance of Parliament or the State Legislature, to be the Registrar as per sub-section (1) and (2).
22. The Finance Officer:
22. The Finance Officer: (1) The Finance Officer shall be a whole time Officer of the University and shall act as Secretary to the Finance Committee, and shall exercise such powers and perform such duties as may be prescribed by the Statutes, or as may from time to time, be conferred or imposed on him by the Executive Council, the Vice-Chancellor, the Pro-Vice Chancellor or the Registrar. (2) The Finance Officer shall be appointed by the Executive Council on the recommendations of a Selection Committee constituted for the purpose. (3) The Finance Officer shall be appointed for a term of five years and shall be eligible for reappointment. (4) The emoluments and other terms and conditions of service of the Finance Officer shall be such as may be prescribed by the Statutes. (5) When the office of the Finance Officer is vacant or when the Finance Officer is by reason of illness, absence or any other cause unable to perform the duties of his office, the duties of the office shall be performed by such person as the Vice-Chancellor may appoint for the purpose. (6) The Finance Officer shall— (a) exercise general supervision over the funds of the University and shall advise it as regards its financial policy; and (b) perform such other financial functions as may be assigned to him by the Executive Council or as may be prescribed by the Statutes, the Ordinances or the Regulations. (7) Subject to the control of the Executive Council, the Finance Officer shall— (a) hold and manage the property and investments of the University including trust and endowed property; (b) ensure that the limits fixed by the Executive Council for recurring and nonrecurring expenditure for a year are not exceeded and that all moneys are expended on the purpose for which they are granted or allotted; (c) be responsible for the preparation of annual accounts and the budget of the University and for their presentation to the Executive Council; (d) keep a constant watch on the state of the cash and balances and on the state of investment; (e) watch the progress of the collection of revenue and advise on the methods of collection employed; (f) ensure that the registers of buildings, land, furniture and equipment are maintained up-to- date and that stock-checking are conducted, of equipment and other consumable materials in all offices, Centers, Specialized Laboratories, Colleges and Centres maintained by the University; (g) bring to the notice of the Vice-Chancellor unauthorised expenditure and other financial irregularities and suggest disciplinary action against persons at fault; and (h) call for from any office, Center, Laboratory, College maintained by the University any information that he may consider necessary on the performance of his duties. (8) Any receipt given by the Finance Officer or the person or person duly authorized in this behalf by the Executive Council for any money payable to the University shall be sufficient to discharge for payment of such money.
23. The Controller of Examinations: The Controller of Examinations shall be a whole t

The Controller of Examinations: The Controller of Examinations shall be a whole time Officer of the University and shall act as Secretary to the Examination Board and shall exercise such powers and perform such duties as may be prescribed by the Statutes or as may, from time to time, be conferred or imposed on him, by the Vice-Chancellor or the Pro-Vice Chancellor.
24. The Librarian: The Librarian shall be appointed in such manner and on such terms
24. The Librarian: The Librarian shall be appointed in such manner and on such terms and conditions of service, and shall exercise such powers and perform such duties, as may be prescribed by the Statutes.
25. Other officers: The manner of appointment and powers and duties of other officers
25. Other officers: The manner of appointment and powers and duties of other officers of the University shall be prescribed by the Statutes.
26. Authorities of University: The following shall be the authorities of the Universi
26. Authorities of University: The following shall be the authorities of the University:- (1) the Executive Council; (2) the Academic Council; (3) the Board of Studies; (4) the Finance Committee; and (5) such other authorities as may be declared by the Statutes to be the authorities of the University.
27. The Executive Council:
27. The Executive Council: The Executive Council shall be the Chief Executive body of the University and shall consist of the following persons, namely:- Ex-officio Members (1) The Vice-Chancellor (2) The Pro-Vice Chancellor (3) The Director, Higher Education, Jharkhand or his representative (4) Dean, Students’ Welfare, and Proctor (5) Registrar- Member Secretary Other Members (6) Two Vice-Chancellors to be nominated by the State Government for a period of one year in the following order of rotation: - (a) Sido Kanhu Murmu University, Dumka (b) Ranchi University, Ranchi (c) Kolhan University, Chaibasa (d) Binod Bihari Mahto Koylanchal University, Dhanbad (e) Nilamber Pitamber University, Medninagar, Palamu (f) Jharkhand Raksha Shakti University, Ranchi (g) Dr. Shyama Prasad Mukerjii University, Ranchi (h) Vinoba Bhave University, Hazaribagh (i) Jharkhand University of Technology, Ranchi (j) Jamshedpur Women University, Jamshedpur (k) Baba BaidyaNath Dham Sanskrit University, Deoghar (7) Two Heads of University Departments, as may be prescribed by the Statutes, by rotation for a period of one year from the date of nomination. (8) Two from amongst the Professors and Associate Professors of the University, other than Heads of Departments and two such Assistant Professors who have teaching experience of at least ten years shall be nominated by the Chancellor as per the recommendation of the State Government. (9) One educationist reputed for his scholarship and academic work, to be nominated by the Chancellor as per the recommendation of the State Government. (10) Five educationists are to be nominated by the State Government one of whom shall be from Scheduled Tribes/Scheduled Castes/Backward Classes and one from women having academic and social work for the maximum period of three years. (11) In case none of the members from sub-sections (1) to (9) above belongs to Scheduled Caste or Scheduled tribe, the Chancellor on recommendations of the State Government, may nominate a person belonging to Scheduled caste or Scheduled tribe, who is interested in the cause of education, to be member of the Executive Council for a period not exceeding three years, but if during the said period of three years a person belonging to Scheduled Caste or Scheduled Tribe becomes a member under any of the sub-sections (1) to (9) the person nominated under this sub-section shall automatically cease to be a member of the Executive Council with immediate effect: Provided that until appointments are made so as to fill up the seats specified in sub- sections (7) and (8) the Chancellor on recommendation of the State Government, shall nominate the teachers from other Universities in the State, who are not below the rank of Professors, to be the members of the Executive Council against those seats: Provided that the Chancellor shall appoint the members of Executive Council after recommendation and decision of the State Government as per sub-section (2) in Section 10. The Executive Council shall meet once every two months. However, the Vice- Chancellor may, wherever he think fit, convene a special meeting. The Executive Council shall have perpetual succession and any of its acts or proceedings shall not be invalid merely because of any vacancy or vacancies in its memberships.
28. Powers and duties of the Executive Council: The Executive Council-
28. Powers and duties of the Executive Council: The Executive Council- (1) shall hold, control and manage the property and funds (together with endowments, bequests and donations) of the University and other transfers of property made to Regional Centres for their benefit; (2) shall regulate the form, provide for the custody and regulate the use of the common seal of the University; (3) shall, subject to the powers conferred by or under this Act on the Vice-Chancellor and Academic Council, determine and regulate all matters concerning the University in accordance with the Ordinance, the Statutes and the Regulations; (4) shall manage funds placed at the disposal of the University for specific purposes; (5) shall have power to accept transfers on behalf of the University of any movable or immovable property to and for the benefit of the University; (6) shall make the Statutes and the Ordinances, and shall amend or repeal them; (7) shall consider the Regulations, and amend or repeal the same; (8) shall pass resolution after having considered the annual report, the annual account, the budget estimates and audit report on such accounts; (9) shall institute and confer such degrees (undergraduate and postgraduate), titles, diplomas and other academic distinctions as may be prescribed by the Statutes; and (10) shall exercise such other powers and perform such other duties as are conferred or imposed on it by the Ordinance or the Statutes.
29. Terms of office of the Members of the Executive Council: Save as otherwise provid
29. Terms of office of the Members of the Executive Council: Save as otherwise provided under this Act, the terms of office of members, other than ex-officio members of the Executive Council, shall be of three years from the date of their nomination and shall include any further period which may elapse between the expiration of the said three years and the date of the next succeeding nomination not being nomination to fill up any casual vacancy: Provided that a member nominated as a representative of anybody shall be deemed to have vacated office with effect from the date on which he ceases to be a member of the body which nominated him.
30. The Academic Council:
30. The Academic Council: (1) The Academic Council shall consist of:- Ex-officio Members (a) The Vice-Chancellor (b) The Pro-Vice Chancellor (c) The Deans of Faculties (d) The Director, Regional Centre (e) Dean, Students’ Welfare, and Proctor (f) All Heads of Departments (g) The President of the University Students’ Union (h) Registrar- Member Secretary Other Members (i) Not more than two experts from outside the University service, to be co-opted by the Academic Council for specific purposes according to need: Provided that until appointments are made so as to fill up the seats specified in above sub-sections as it is necessary, the Chancellor on recommendation of the State Government shall nominate such number of teachers from other Universities in the State, not below the rank of Professor, to be members of the Academic Council. The Academic Council shall meet once in a month. However, the Vice-Chancellor may, wherever he thinks fit, shall convene a special meeting. (2) The terms of office of members, other than the ex-officio members, shall be for a period of three years with effect from the date of their respective election or nomination and shall include any further period which may elapse between the expiration of the said period of three years and the date of the next succeeding election or nomination, as the case may be, not being an election or nomination to fill up any casual vacancy: Provided that any member elected or nominated shall be deemed to vacate office with effect from the date on which he ceases to be a member of the body which elected or nominated him.
31. Powers and duties of the Academic Council: The Academic Council shall be the chie

Powers and duties of the Academic Council: The Academic Council shall be the chief academic and planning body of the University and shall- (1) subject to the powers conferred by or under this Act on the Vice-Chancellor and on the Executive Council, determine and regulate all academic and planning matters concerning the University in accordance with this Act and the Statutes; (2) have the powers of superintendence and control over and be responsible for the maintenance of standards of instruction and education, including through correspondence course, online mode and contact programme and the promotion of research work in the University; (3) prepare and finalise plan and programme of development and improvements of the University, its Courses of Regional, examination and evaluation including new methods of teaching and for consultation and exchange of information with similar organisations, other Universities and research institutes; (4) exercise supervision and control over the conduct of teaching in the departments and Regional Centres in such manner as may be prescribed by the Statutes; (5) have powers of general control over the Examination Board, and may review the results of University Examinations; and (6) exercise such other powers and perform such other duties as may be conferred or imposed upon it by the Statutes.
32. The Faculties, Deans of Faculties and Heads of Department:
32. The Faculties, Deans of Faculties and Heads of Department: (1) The University may include the Faculties of Humanities, Social Sciences, Science, Commerce, Education and such other Faculties as may be prescribed by the Statutes: Provided that no Faculty/Post shall be created by the Academic/Executive Council in respect of any branch of learning without prior approval of the State Government: Provided that no Faculty shall be created by the Academic Council in respect of any branch of learning for the instruction of which no provision exists in any department of the University: Provided further that the degrees (undergraduate and postgraduate) to be awarded in the Faculties of Humanities and Social Science shall be in Arts. (2) Each Faculty shall, subject to the control of the Academic Council, have charge of the courses of studies, conduct courses and research work in such subjects as may be assigned to such Faculty by the Regulation. (3) The total number of members of each Faculty shall not exceed such as may, from time to time, be prescribed by the Statutes. (4) Subject to the provisions of sub-section (3) each Faculty shall consist of- (a) such number of teachers as may be assigned to each Faculty by the Academic Council keeping in view the qualifications of such teacher members; (b) such number of members to be co-opted as experts by the Academic Council from amongst persons who are not members of the Academic Council, as may be prescribed by the Statutes: Provided that no person shall be a member of more than two Faculties. i. Each Faculty shall comprise such departments of teaching as may be prescribed by the Statutes. The Heads of Department shall be appointed by the Vice-Chancellor, by rotation, in the manner prescribed by the Statutes, for a period of two years. Each Department shall consist of the following members, namely: — a) Head of Department; b) Teachers of the Department; c) Persons conducting research in the Department; d) Dean of the Faculty; e) Honorary Professors, if any, attached to the Department; and f) Such other persons as may be members of the Department in accordance with the provisions of the Statutes. ii. Subject to the provisions of this Act each Faculty shall have the following powers: - a) to constitute the Boards of courses of Study of the departments allotted to it; and b) to exercise such powers and perform such duties as may be prescribed by the Statutes. (5) (i) The Dean of Faculty shall be appointed by the Vice-Chancellor, by rotation, in the manner prescribed by the Statutes, for a period of two years in the Faculty concerned from amongst the Professors: Provided that where in any faculty there is no teacher having the qualifications of a Professor then a teacher not below the rank of Associate Professor may be appointed as the Dean of Faculty. (ii) The Dean of Faculty shall be responsible to the Vice-Chancellor for the conduct of teaching and research work in that faculty. (6) Where it is proposed to appoint any teacher to be the Head of a department who is not the senior most Professor or Associate Professor of the Department, no such appointment shall be made without the prior approval of the Academic Council.
33. The Departmental Council:
33. The Departmental Council: (1) There shall be a Departmental Council for each University Department which shall consist of the following members: - (a) the Head of the Department (b) all teachers of the department (c) two students - one nominated by the Vice-Chancellor and another by the Head of the Department for each academic year (2) The Departmental Council shall, from time to time, review the activities of the department and suggest ways of its improvement. This council shall meet at least thrice in a year on dates to be appointed by the Head of the Department. In between two meetings, there shall not be an interval of more than three months.
34. The Examination Board:
34. The Examination Board: (1) Subject to the provisions of the Regulations, advice shall be given in respect of conduct of examinations by the Examination Board consisting of the Vice-Chancellor as Chairman and Deans of Faculties as members. (2) The Examination Board shall render advice to the Vice-Chancellor on conduct of examinations and appointments of examiners, setting and moderating question papers, preparation, moderation and publication of examination results, submission of such examination results to the Academic Council, and generally regulating the methods of improvement in the procedure of correct evaluation of achievement of students and the Vice-Chancellor shall be competent to take the final decision: Provided that the Vice-Chancellor shall appoint the question setters and examiners from the panel of names submitted by the Examination Board.
35. Holding of examinations:
35. Holding of examinations: (1) The examination of the University shall be held from such dates as may be prescribed in the Academic calendar approved by the Academic Council for each academic year. (2) Results of examinations shall be published within sixty days of the completion of the concerned examination, which may be extended to a period beyond sixty days for reasons to be recorded in writing.
36. The Planning and Evaluation Committee:
36. The Planning and Evaluation Committee: (1) There shall be a Planning and Evaluation Committee for the purposes of preparing plan programme of development and improvements of the University and in its courses of study, examining and evaluating, from time to time, the progress achieved in such plans and programmes, testing and evolving new methods of teaching (including online mode) and for consultation and exchange of information with similar organisations, other Universities and research institutes for any of these purposes. (2) The Committee shall consist of the following members: (a) The Vice-Chancellor; (b) The Pro-Vice Chancellor; (c) three Deans of Faculties to be appointed in the manner as prescribed by the Statutes; (d) two members of the Executive Council to be nominated by it; (e) two members of the Academic Council to be nominated by it; (f) three heads of Departments to be nominated by the Vice-Chancellor every year, by rotation; and (g) two such members representing academic interests and professions, as may be co-opted by the Committee, either by rotation every year or according to subject or subjects, as may be required. (3) The Registrar shall act as the Secretary to the Committee. (4) The term of office of members, other than ex-officio members, shall be of three year's duration, except where otherwise provided.
37. The Research Council:
37. The Research Council: (1) There shall be a separate Post-Graduate Research Council in each faculty of the University for the registration and proper guidance of research work which shall work under the general control of the Academic Council. (2) The Post-Graduate Research Council shall consist of the following persons: (a) The Vice-Chancellor; (b) The Pro-Vice Chancellor; (c) The Dean of the concerned Faculty; (d) All University Professors and those teachers having at least 8 years' experience as Associate Professor posted in the University Department; and (e) Four teachers imparting Post-Graduate teaching of the concerned Faculty to be nominated by the Vice-Chancellor in each academic year. (3) The Post-Graduate Research Council shall meet at least once every quarter.
38. The Board of Studies, Academic Board and Management Board:
38. The Board of Studies, Academic Board and Management Board: The constitution, powers and functions of the Board of Studies, the Academic Board and the Management Board shall be prescribed by the Statutes: Provided that the Board of Studies, the Academic Board and the Management Board shall have adequate number of members from amongst the Scheduled Tribes.
39. The Finance Committee:
39. The Finance Committee: (1) The Finance Committee shall consist of:- (a) the Vice-Chancellor as Chairman; (b) the Financial Adviser as member; (c) an officer of the State Government not below the rank of a Special Secretary to be nominated by the State Government; (d) the Finance Officer as Member Secretary; and (e) four such other members as are not official members of the Executive Council, to be elected by and from amongst the members of the executive council of the University in the manner prescribed by the Statutes. (2) The term of office of members other than the ex-officio members shall be for a period of three years with effect from the respective dates of their election and shall include any further period which may elapse between the expiration of the said three years and the date of the next succeeding election not being an election to fill up any casual vacancy. (3) The Finance Committee shall- (a) advise the University on any question affecting its finance; (b) prepare the annual estimate of income and expenditure of the University including the estimates of the departments of the University and of the Regional Centres recognised by it; (c) subject to Statutes, have power to scrutinise the estimates of the Regional Centres; (d) subject to Statutes, have power to scrutinise every item of new expenditure not provided for in the Budget estimates of the University; (e) be responsible for the strict observance of the Statutes relating to the maintenance of accounts of income and expenditure of the University; and (f) discharge such other functions of financial nature as may from time to time, be prescribed by the Statutes or entrusted to it by the Executive Council.
40. Disqualification:
40. Disqualification: (1) A Person shall be disqualified for being chosen as, and for being, a member of any of the authorities of the University, (a) if he is of unsound mind; or (b) if he is an undischarged insolvent; or (c) if he has been convicted by a court of law (2) If any question arises as to whether a person is or had been subjected to any of the disqualifications mentioned in sub-section (1), the question shall be referred to the State Government.
41. Other authorities of University:
41. Other authorities of University: The constitution, powers and functions of other authorities, as may be declared by the Statutes to, be the authorities of the University, shall be prescribed by the Statutes: Provided that the other authorities of the University shall have adequate number of members from amongst the Scheduled Tribes.
42. Statutes:
42. Statutes: Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely: - (a) The institution of fellowships, scholarships, exhibitions, medals and prizes; (b) The designations and powers of the officers of the University; (c) The constitution, powers, functions and duties of the authorities of the University; (d) The institution of departments and their maintenance and management; (e) The classification of teachers of the University, the manner of their appointment and their recognition; (f) The constitution of New Pension Scheme and insurance for the benefit of the officers, teachers and other employees of the University; (g) The number, qualification, grade pay, reservation of posts for scheduled castes and scheduled tribes, backward classes, economically backward classes and women and conditions of service of teachers, officers and other employees of the University including the creation of new posts after considering, as the case may be, the recommendations of the Academic Council and the Executive Council in the case of creation of other posts, and the recommendation of the Executive Council in the case of post of officers and employees of the University; (h) The maintenance of accounts of the income and expenditure of the University and the forms and registers in which such accounts shall be kept; (i) The maintenance of a register of teachers; (j) The conferment of honorary degrees (undergraduate and postgraduate), diplomas, certificates and distinctions; and (k) All other matters which are or may be prescribed by the Act or the Statutes. (l) The first Statutes, regulation and ordinances shall be made by the University after enactment of this Act, must be placed before the State Government for approval within three months.

43. No post for appointment shall be created without the prior sanction of the State Government: Notwithstanding anything contained in this Act the University shall not, except with the prior approval of the State Government: - (a) create any teaching or non-teaching post involving financial liability: Provided that University can create any teaching or non-teaching post which runs on self-financing schemes and does not involve financial liability but they shall not claim for confirmation of these posts in future; (b) sanction any special pay or allowance or other remuneration of any kind including ex-gratia payment, pension or any other-benefit having financial implication to any person holding a teaching or non-teaching post; (c) incur expenditure of any kind on development scheme.
44. Statutes, how made:
44. Statutes, how made: (1) The Executive Council may either on its own motion or on submission by the Academic Council make statutes or amend or repeal it: Provided that the Executive Council shall not take up any such statutes as may affect the status, powers and constitution of any authority of the University unless that authority has been allowed an opportunity to furnish written opinions upon the proposed changes and the Executive Council shall have to consider such opinion expressed in writing. (2) If the draft of any statutes or a portion thereof after being presented by the Academic Council before the Executive Council is sent back to the Academic Council for reconsideration and the Academic Council does not agree, after reconsideration to the amendment suggested by the Executive Council then it shall be lawful for the Executive Council to pass the statutes or a portion of the Statutes in such form as it may deem appropriate and the decision of the Executive Council shall, subject to the provisions contained in sub-section (3) and sub-section (4) be final. (3) Where the draft of any statute has been passed by the Executive Council it shall be submitted to the State Government, who may declare that they approve to the statute, with or without amendment, or that they withhold approval therefrom. (4) A statute passed by the Executive Council shall not have validity until it has been approved to by the State Government.
45. Ordinances:
45. Ordinances: (1) The Executive Council may subject to the provisions of this Act and Statutes, make Ordinances to provide for all or any of the following matters, namely: - (a) The admission of students to the University and their enrolment as such (b) The fees to be charged for courses run in the University and for admission to the examinations, degrees (undergraduate and postgraduate), certificates and diplomas of the University (c) The constitution, powers and duties of the Committee of the University (d) All matters which according to the Statutes or the Act are to be or may be provided for by Ordinances (2) An Ordinance made by the Executive Council under sub-section (1) shall be submitted as soon as may be to the State Government, which shall give assent to the Ordinance with or without amendment or it may withhold assent therefrom. (3) An Ordinance shall have no validity until it has been approved by the State Government under sub-section (2).
46. Regulations, how made:
46. Regulations, how made: (1) Subject to the provisions of this Act, the Statutes and the Ordinances, Regulations may be made to provide for all or any of the following matters, namely:- (a) The courses to be laid down for all degrees (undergraduate and postgraduate), certificates and diplomas of the University; (b) The condition under which students shall be admitted to the degree (undergraduate and postgraduate) or diploma or certificate course and to the examinations of the University and shall be eligible for such degrees and diplomas and certificates; (c) The formation of departments in the faculties; (d) The conditions and mode of appointment and duties of paper setters and examiners and the conduct of examinations; and (e) All matters which according to the Ordinances, Statutes or the Act are to be or may be provided for by Regulations. (2) (i) A Regulation made by the Academic Council under sub-section (1) shall be forwarded, as soon as may be to the Executive Council for consideration and approval. Where the Executive Council wishes to make any amendment, it shall obtain the opinion of the Academic Council and shall consider the same. (ii) Such Regulation shall have effect from the date on which it is approved by the State Government, with or without any amendment, or from such other date as the Executive Council may appoint.
47. Rules:
47. Rules: (1) The authorities and the Boards of the University constituted either under this Act or under the Statutes made thereunder may make Rules consistent with the Act, the Statutes, the Ordinances and the Regulations for the following matters, namely: - (a) Laying down the procedure to be observed at their meetings and the number of members required to form a quorum; (b) Laying down the procedure to be observed by committees subordinate to any such authorities and the Boards at their meetings and the number of members required to form a quorum; (c) Providing for all matters which by the Ordinances, the Statutes, the Act or the Regulations are to be prescribed by the Rules; and (d) Providing for all other matters exclusively concerning such authorities, Committees and Boards and not provided for by this Act, the Statutes, the Ordinances or the Regulations. (2) Every authority of the University may make Rules providing for the giving of notice to the members of such authority of the dates of meetings and of the business to be considered at meetings and for the keeping of a record of the proceedings of the meetings.

Approval from the Directorate of Higher Education, Government of Jharkhand shall be necessary in the matters relating to making of certain Statutes, etc: The University shall send drafts of all proposed statutes, ordinances, regulations and rules to the Directorate of Higher Education, Government of Jharkhand for consideration of the State Government and shall comply only after the approval is given by the State Government.
49. The Students’ Union:
49. The Students’ Union: (1) There shall be a Union of Students of the University consisting of all the Students of the University. (2) The organisation and function of the University Students’ Union shall be prescribed by the Statutes.
50. Annual report:
50. Annual report: (1) The annual report on the working of the University shall be prepared under the direction of the Vice-Chancellor and shall include the annual accounts of the University and the steps taken by the University towards the fulfilment of its objects and shall be submitted to the Executive Council on or before such date as may be prescribed by the Statutes and shall be considered by the Executive Council in its annual meeting which may pass resolutions thereon for such action, if any, as may be specified in such resolutions: Provided that no decision shall be taken on the annual accounts nor shall there be anything in the resolution on the annual report which may have the effect of anticipating the report of the auditors on the annual accounts: Provided further that the report of annual accounts together with resolution, if any, of the Executive Council relating thereto shall be placed before the legislature for consideration in its next session. (2) The Executive Council shall submit the annual report, as prepared under sub-section (1), to the State Government along with its comments, if any, which shall, as soon as may be, cause the same to be laid before legislature if needed. Finance, Accounts and the Audit of the University
51. Establishment of the University Funds:
51. Establishment of the University Funds: (1) There shall be a Fund to be called the Pandit Raghunath Murmu Tribal University Fund and this fund shall vest in the University for the purposes of this Act, subject to the provision contained therein, and the following amounts shall be credited thereto, namely:- (a) All sums contributed or granted to the University from the consolidated fund of the State of Jharkhand by the State Government for the purposes of the University and all sums borrowed by the University for the purpose of carrying out the provisions of this Act and the Statutes, Ordinances, Regulations and Rules made thereunder; (b) All money received by and on behalf of the Regional Centres and departments established and maintained by the University including all sums paid to the University under any provision of this Act and the Statutes, the Ordinances, Regulations and Rules made thereunder; (c) All interests and profits arising from endowments made to the University and all contributions, donations and subsidies received from any local authority or private person; (d) All fees payable and levied under this Act and the Statutes, Ordinances and Regulations made thereunder; and (e) All other sums received by the University, not included in sub-sections (a), (b), (c) or (d). (2) The University fund shall be kept in such scheduled bank within the meaning of the Reserve Bank of India Act, 1934 (II of 1934), or invested in such securities authorised by the Indian Trusts Act, 1882 (II of 1882), as may from time to time be approved by the State Government. However, any grant or contribution from the State Government shall be kept in Public Ledger Account only.
52. Contribution by Government to the University:
52. Contribution by Government to the University: (1) The State Government shall contribute annually to the University Fund a recurring grant out of the Consolidated Fund of the State which shall include all expenses of recurring nature. (2) The State Government shall calculate the amount of annual recurring grant in consultation with the Vice-Chancellor and the amount may be revised at the expiry of a period of every five years. (3) The State Government may, from time to time, contribute such additional grants to the University Fund as it may deem fit having regard to the need of expansion and development of the University or Regional centers.
53. Annual estimates of income and expenditure of Regional Centres and University:
53. Annual estimates of income and expenditure of Regional Centres and University: (1) The Director of every Regional Centre, if any, shall, if required to do so, prepare in the prescribed form an estimate of its probable income including income from endowments and bequests, if any, and expenditure for the next financial year and the same shall be considered and sanctioned by the Executive Council either without alteration or with such alterations as it thinks fit. (2) (i) On receipt of the estimate under sub-section (1) it shall forthwith be referred by the Vice-Chancellor to the Finance Committee for scrutiny and report. Thereupon, the Finance Committee shall scrutinize every item of the estimate and in particular the portion of the estimate relating to grants in-aid to the Regional Centres and submit along with a report to the Executive Council as may be prescribed by the Statutes. (ii) The Executive Council shall consider forthwith the estimate and the report of the Finance Committee and return the estimate to the Regional Centres for rectification of defects therein, if any. (3) The Finance Committee shall prepare the annual estimate of income and expenditure of the University for the ensuing financial year and shall on or before such date as may be prescribed forward the same together with a memorandum containing explanatory notes thereon to the Executive Council which may approve the estimates either without alteration or with such alteration as it thinks fit. (4) Every estimate prepared under sub-section (3) shall in accordance with the directions given by the State Government, make provisions for the due fulfilment of all the liabilities of the University including the allotment of grants to the Regional Centres and for the efficient administration of this Act and the Statutes, the Ordinances, the Regulations and the Rules made thereunder. (5) Every estimate under this section shall be prepared in such form and shall contain such details as may be prescribed by the Statutes.
54. The Budget shall be approved by the State Government:
54. The Budget shall be approved by the State Government: (1) Notwithstanding anything contained in this Act or in Statutes, Ordinances or Regulations made thereunder, the University shall send the budget for the ensuing financial year to the State Government at least two months before the end of the current financial year. The University shall show therein the estimates of receipts and disbursements for the ensuing year. The State Government shall return the budget with such modifications, if any, as it may deem fit, and the University shall act in conformity with such modified and approved budget. (2) The University shall send a supplementary budget to the State Government at any time during the current financial year and the State Government shall return the budget to the University with such modifications and approval, as it may deem fit. (3) No expenditure shall be incurred by the University unless such an expenditure has become a part of the budget, as finally approved under sub-sections (1) and (2).
55. Consideration of estimates by the Executive Council: The Executive Council shall
55. Consideration of estimates by the Executive Council: The Executive Council shall consider every estimate laid before it under sub-section (3) of Section 54 and shall sanction the same, either without alteration or with such alterations as it may think fit.
56. Restriction on expenditure not included in the Budget:
56. Restriction on expenditure not included in the Budget: (1) No sum shall be spent by or on behalf of the University unless the expenditure thereof is included in the current budget estimates or can be met, with the previous approval of the State Government by re-appropriation or by drawing upon the closing balance. (2) The closing balance shall not be reduced below such amount as may be prescribed by the Statutes.
57. Objects to which the University Fund may be applied: The University Fund shall be

Objects to which the University Fund may be applied: The University Fund shall be applicable to the following objects:- (a) to the repayment of debts incurred by the University for the purposes of this Act and the Statutes, the Ordinances, the Regulations and the Rules made thereunder; (b) to the upkeep of departments and Regional Centres established by the University; (c) to the payment of the salaries and advances of officers, teachers and other employees of the University, and of any Provident Fund contributions or pension or gratuity to any such officers, teachers and other employees; (d) to the payment of the travelling and other allowances of the members of the Executive Council, the Academic Council and any other authorities of the University or the members of any Committee or Boards appointed in pursuance of any provisions of this Act and the Statutes, the Regulations and the Rules made thereunder; (e) to the making of grants to the Regional Centres and other institutions if any; (f) to the payment of the cost of audit of the University Fund and of the cost of audit of the accounts of any department or Regional Centres; (g) to the payment of expenses of any suit or proceeding to which the University is a party; (h) to the payment of any expense incurred by the University in carrying out the provisions of this Act and the Statutes, the Ordinances, the Regulations and the Rules made thereunder; and (i) to the payment of any other expense, though not specified in any of the preceding sub-sections, but declared by the Executive Council to be the expense for the purpose of the University.
58. Accounts and audit of the University Fund:
58. Accounts and audit of the University Fund: (1) (i) Financial Adviser of the University shall prepare the Annual Budget according to the direction of the Vice-Chancellor. In the annual budget of the University, there shall be mention of income from all sources and all items of expenditure. (ii) Subject to the provisions of this Act and the Statutes made thereunder, the annual accounts of the University shall be audited by auditors appointed by the Accountant General Jharkhand. (2) A copy of the annual accounts of the University together with the auditor's report thereon shall be submitted by the Executive Council, within six months of the receipt of the report, to the State Government, who shall cause the same to be published in the official Gazette. (3) (i) Within six months of the receipt of the auditor's report under sub-section (2) the Executive Council shall appoint an ad-hoc committee consisting of the Deputy Accountant General/Senior Deputy Accountant General in charge of Local Bodies Audit, and eight such members of the Executive Council as are not members of the Finance Committee. (ii) The said Committee shall be known as the University Audit Committee and shall have power, for the purpose of examining the auditor's report to call for explanations from the controlling and disbursing officers and it may- (a) suggest ways and means to avoid in future any misuse of the University Fund or irregularity in the accounts of the University. (b) suggest the recovery of any sum on account of any payment contrary to law from a University authority, officer or other employees or from any person making or authorising such payment, or the recovery of the amount of any loss or deficiency from the person responsible therefore or any amount which ought to have been but which is not brought into account from the person failing to account for such amount. (4) The auditor's report together with the report of the University Audit Committee thereon shall be submitted to the Executive Council and the State Government for such action as they think fit. (5) It shall be lawful for the State Government either on the suggestions of the University Audit Committee or on its own motion to require any authority, officer or other employee of the University or any other person who is found to have spent or authorised the expenditure of any amount in excess of the amount provided in the budget or in violation of any provisions of this Act, the Statutes, Ordinances, Regulations or Rules or is found to have failed to account for any amount to reimburse the amount in the manner prescribed in the Statutes: Provided that no order for reimbursement shall be made until the authority, officer, other employee or the person concerned has been given a reasonable opportunity of making representation and the same has been considered by the State Government.

Power of the State Government to have accounts of the University audited: The State Government may, if it considers necessary, cause the accounts of the University to be audited as it thinks fit and on receipt of the audit report, it may, after calling for a report from the University on the points raised therein and after considering the same, issue such directions as it thinks fit and thereupon the University shall comply with such directions within the time specified therein. However, the State Government can order any account to be audited by CAG.

60. Returns and Information: The University shall furnish to the State Government such returns or other information with respect to its property or activities as the State Government may, from time to time, require.
61. Inspection of Regional Centres:
61. Inspection of Regional Centres: (1) Regional Centres shall furnish such reports, returns and other information as the Executive Council, after consulting the Academic Council, may require, to enable it to evaluate the efficiency of the Centres. (2) The Executive Council shall cause every such Centre to be inspected from time to time. (3) The Executive Council may call upon any Centre so inspected to take necessary action for the benefit of the Centre. (4) The inspection team will submit inspection report to the Executive Council, who thereupon submit it to the State Government for any action, if required.
62. Appointment to the posts of teachers and officers: In matters pertaining to appoi
62. Appointment to the posts of teachers and officers: In matters pertaining to appointment to the posts of teachers and officers (other than the Vice-Chancellor, Financial Adviser, Pro-Vice Chancellor and the Registrar), the extant UGC regulations shall be applicable ipso facto. In view of the special requirements, if any, related to particular departments of the University, statutes shall be framed for this purpose in accordance with extant UGC regulations. These appointments shall be done on the recommendations of Jharkhand Public Service Commission under the extant UGC regulations.
63. Conditions of Appointment: Subject to the approval of the Executive Council, the

Conditions of Appointment: Subject to the approval of the Executive Council, the matter relating to appointment and disciplinary actions shall be disposed of after obtaining the advice of the University Selection Committee in the manner as may be prescribed by the Statutes framed under this Act.
64. Qualification for enrolment as students of the University:
64. Qualification for enrolment as students of the University: (1) (i) No student shall be enrolled as a student of the University unless he/she has passed the Intermediate Examination or any other equivalent examination held by the University or any other University or-body incorporate by any law for the time being in force and recognised by the University: Provided that students who have passed the Intermediate/ Equivalent Examination or Pre-University Examination shall continue to be enrolled in the manner as prescribed in the Ordinance and Regulations. (ii) The State Government may determine the maximum number of seats for enrolment of students in the Faculties and Departments of the University and the Regional Centres under its jurisdiction and directions issued thereto shall be binding on the University. (iii) The reservation policy of the State Government shall be binding on the University. (iv) The fee structure for the various University courses shall be decided by the Academic Council from time to time under the Statutes/ Ordinances/ Regulations/ Rules made under the Act. (2) Honorary degrees: The Executive Council may, on the recommendation of the Academic Council and by a resolution passed by a majority of not less than two-thirds of the members present and voting, make proposals to the State Government, who shall act as per sub-section (4) of Section 12 of the Act: Provided that in case of emergency, the Executive Council may, on its own motion, make such proposals. (3) Withdrawal of degrees, etc.: The Executive Council may, by a special resolution passed by a majority of not less than two-thirds of the members present and voting, for good and sufficient cause, withdraw any degree (undergraduate or postgraduate) or academic distinction conferred on, or any certificate or diploma granted to, any person by the University (in case of any honorary degree conferred by the University, prior sanction of the State Government shall be required): Provided that no such resolution shall be passed until a notice in writing has been given to that person calling upon them to show cause within such time as may be specified in the notice why such a resolution should not be passed and until their objections, if any, and any evidence they may produce in support of those objections, have been considered by the Executive Council.
65. Maintenance of discipline among students of the University:
65. Maintenance of discipline among students of the University: (1) All powers relating to the maintenance of discipline and disciplinary action in relation to students of the University shall vest in the Vice-Chancellor. (2) The Vice-Chancellor may delegate all or any of his powers referred to in sub-section (1), as he deems proper, to Pro-Vice Chancellor and to such other officers as he may specify in this behalf. (3) Without prejudice to the generality of his powers relating to the maintenance of discipline and taking such action, as may seem to him appropriate for the maintenance of discipline, the Vice- Chancellor may, in exercise of his powers, by order, direct that any student or students be expelled, or rusticated, for a specified period or be not admitted to a course or courses of study in a Department, Regional Centres or a Faculty of the University for a stated period, or be punished with fine for an amount to be specified in the order, or be debarred from taking an examination or examinations conducted by the University or Department or a Faculty for one or more years, or that the results of the student or students concerned in the examination or examinations in which he or they have appeared be cancelled. (4) The Director of Regional centres, Deans of Faculties and Heads of teaching Departments in the University shall have the authority to exercise all such disciplinary powers over the students in their respective Centres, Faculties and teaching Departments in the University, as may be necessary for the proper conduct of such Centres, Faculties and teaching Department. (5) Without prejudice to the powers of the Vice-Chancellor, the Directors and other persons specified in sub-section (4), detailed rules of discipline and proper conduct shall be made by the University. The Director of Regional Centres, Deans of Faculties and Heads of teaching Departments in the University may also make the supplementary rules as they deem necessary to the aforesaid purpose. (6) At the time of admission, every student shall be required to sign a declaration to the effect that he submits himself to the disciplinary jurisdiction of the Vice-Chancellor and other authorities of the University.
66. Procedure of appeal and arbitration in disciplinary cases against students:
66. Procedure of appeal and arbitration in disciplinary cases against students: (1) Any student or candidate for an examination whose name has been removed from the rolls of the University by the orders or resolution of the Vice-Chancellor, Discipline Committee or Examination Committee, as the case may be, and who has been debarred from appearing at the examinations of the University for more than one year, may, within ten days of the date of receipt of such orders or copy of such resolution by him, appeal to the Executive Council and the Executive Council may confirm, modify or reverse the decision of the Vice-Chancellor or the Committee, as the case may be. (2) Any dispute arising out of any disciplinary action taken by the University against a student shall, at the request of such student, be referred to a Tribunal of Arbitration constituted by the State Government.
67. Students’ Council:
67. Students’ Council: (1) There shall be constituted in the University, a Students’ Council for every academic year, consisting of:- (a) the Dean of Students’ Welfare who shall be the Chairman of the Students Council; (b) twenty students to be nominated by the Academic Council on the basis of merit in studies, sports and extra-curricular activities; and (c) such number of elected representatives of students as may be specified by the Academic Council: Provided that any student of the University shall have the right to bring up any matter concerning the University before the Students’ Council if so, permitted by the Chairman, and he shall have the right to participate in the discussions at any meeting when the matter is taken up for consideration. (2) The functions of the Students’ Council shall be to make suggestions to the appropriate authorities of the University in regard to the programmes of studies, students’ welfare and other matters of importance, in regard to the working of the University in general and such suggestions shall be made on the basis of consensus of opinion. (3) The Students’ Council shall meet at least once in an academic year preferably in the beginning of that year.

Internal Quality Assessment Cell: The University shall constitute an Internal Quality Assessment Cell (IQAC) for NAAC Accreditation of University, and to achieve quality, access and equity in education of University and Regional Centres as per norms of University Grants Commission (UGC), Rashtriya Uchchatar Shiksha Abhiyan (RUSA) and National Assessment and Accreditation Council (NAAC) as prescribed by the Statutes framed under this Act.

69. Placement Cell: The University shall constitute a placement cell to place the students in employment as prescribed by the Statutes framed under this Act.
70. Appointment of the Commission:
70. Appointment of the Commission: (1) The State Government may at any time, by an order published in the Official Gazette, constitute a Commission. (2) The Commission constituted under sub-section (1) shall inquire into and report on the following:- (a) the working of the University; (b) the financial condition of the University, its Regional Centres and other academic institutions if any; (c) any change to be made in the provisions of this Act, the Statutes, the Ordinances and the Regulations with a view to bringing about improvements; and (d) Such other matters as may be referred to it by the State Government. (3) On receipt of the recommendations under sub-section (2), the State Government may send the same to the appropriate authority of the University for consideration and report thereon, and on receipt of its report, may pass such orders thereon as it may consider fit. It shall cause the said order to be published in the official Gazette. Thereupon the University shall comply with the order within such time as may be specified by the State Government.
71. Filling of vacancies: All vacancies among the members (other than ex-officio memb

Filling of vacancies: All vacancies among the members (other than ex-officio members) of any authority or body of the University by reason of death, resignation or otherwise shall be filled, as soon as conveniently may be by the person or body who appointed, nominated, elected or co-opted the member whose place has become vacant, and the person not appointed, nominated, elected or co- opted shall be a member of such authority or body for the unexpired period of the prescribed term: Provided that pending the filling up of such vacancies by appointment, nomination or election in the manner aforesaid, the vacancies may, if the authority or body of the University so decides, be filled by the co-option of any person qualified to fill such vacancy under the provisions of this Act and any person so co-opted shall hold office as a member of such authority or body until a person is appointed, nominated or elected thereto in accordance with the provisions of this Act.
72. Proceedings of University authorities and bodies not to be invalidated due to vac
72. Proceedings of University authorities and bodies not to be invalidated due to vacancies: No act or proceeding of any authority or other body of the University shall be invalid merely by reason of the existence of a vacancy or vacancies among its members.
73. Conditions of service of officers and teachers of the University:
73. Conditions of service of officers and teachers of the University: (1) Every salaried officer of the University and every teacher employed in a University Department other than officers and teachers who are members of the public services in India and whose services have been lent to the University under clause (a) of sub-section (2), shall be appointed on a written contract which shall be lodged with the Registrar of the University and a copy thereof shall be furnished to the officer or teacher concerned. Every teacher of the University shall in the absence of any agreement to the contrary, be governed by the conditions and restrictions as specified in the Statutes. (2) Any member of the public services in India whom it is proposed to appoint to a post in the University, shall subject to the approval of such appointment by the Government concerned and the terms thereto, have the option- (a) of having his services lent to the University and remaining at any time, liable to recall to the service of the Government at the option of the Government concerned; or (b) of resigning the service of the Government on entering the service of the University: Provided that where the University, after consultation with the Public Service Commission, is satisfied that an officer or teacher, being a servant of the Government whose services have been lent to the University deserves the punishment of dismissal, removal or reduction in rank, the University shall forward to the Government the proceedings instituted against such officer or teacher together with all connected papers including the findings of Public Service Commission, and thereupon the Government shall forthwith cause the said officer or teacher to be reverted to the service of the Government and take such action against him as it thinks fit. (3) The teacher or any officer of the University may take lien in accordance with the Statutes framed thereunder the Act. All their service benefit shall be secured during the period of lien. (4) When there are no statutes/regulations/rules etc. framed on the matter of any service conditions of teachers then those service conditions shall be guided by extant UGC guidelines.
74. Seniority list:
74. Seniority list: (1) Whenever, in accordance with the Statutes, any person is to hold an office or be a member of an authority of the University by rotation according to seniority, such seniority shall be determined according to the length of continuous service of such person in his grade and in accordance with such other principles as the Executive Council may, from time to time, prescribe. (2) It shall be the duty of the Registrar to prepare and maintain in respect of each class of persons to whom the provisions of these Act apply, a complete and up-to-date seniority list in accordance with the provisions of sub-section (1). (3) If two or more persons have equal length of continuous service in a particular grade then their relative seniority shall be decided on the basis of date of birth and if date of birth is also the same then seniority shall be decided on the basis of their academic and research qualification. In case of any confusion or doubt, the Registrar may, on his own motion and shall, at the request of any such person, submit the matter to the Executive Council whose decision thereon shall be final.

Norms / regulations for promotion through Career Advancement of Assistant Professors, Associate Professors and Professors: The promotion through career advancement of Assistant Professors / Associate Professors /Professors in the University shall be governed by the Norms / Regulations prescribed by the University Grants Commission as amended from time to time.

Retirement from Service: (1) Save as otherwise expressly provided in this Act– (a) the date of retirement of teaching employees shall be the date on which they attain the age of 65 years; (b) the date of all other employees not included in (a) above, shall be the date on which they attain the age of 60 years; (c) if an employee of another University of this State, who under the Act of that University, is to retire on attaining the age of 62 years, joins the service of this University, such an employee shall retire on the date on which he attains the age of 62 years: Provided that a teaching or non-teaching employees whose date of retirement falls on the first day of a month will retire from service from the afternoon of the last date of the preceding month and if the date of retirement falls on any other date of the months, he will retire in the afternoon of the last date of that month: Provided further that the University shall not extend the period of service or re- appoint any teaching or non-teaching employee after his completing the age of 65 and 60 years, as the case may be. (2) The University may require any teaching or non-teaching employee, who reckoned from the date of his first appointment has completed the qualifying service of 23 years or a total service of 27 years, to retire from the University service, if it considers that his conduct or efficiency is such as does not justify his continuance in the service. (3) (i) Notwithstanding anything contained in the preceding sub-sections, any teaching or non- teaching employee may, after giving at least three months prior notice in writing, to the concerned appointing authority, retire from such date on which such a teaching or non- teaching employee has completed 32 years of qualifying service or has attained 52 years of age, or from such date thereafter as may be specified in the notice: Provided that no employee of the University under order of suspension shall retire except without specific approval of the Executive Council. (ii) The University may, in the public interest, require any teaching or non-teaching employee, after giving at least three months prior notice in writing or after paying an amount equivalent to pay and allowances of three months in lieu of such notice to retire from such date on which he completes 32 years of qualifying service or attains 52 years of age, or from such date thereafter as may be specified in the notice.

77. Code of Conduct: (1) The Code of conduct of the employees of the University shall be prescribed by Statutes. (2) If an employee of the University joins a post or membership by election or otherwise of another institution on account of which work of the University suffers, such an employee shall be required to obtain prior permission and extraordinary leave for a definite period from the University. (3) No employee of the University shall engage himself in any trade, business, occupation or in any other work than that of his office without the previous permission of the Vice-Chancellor and in the event of his proceeding on leave without pay he shall not be entitled to receive any salary or allowances from the University Fund but in view of the nature of his duty in another institution he may or may not be allowed to earn any increment during the period. Such extraordinary leave shall be prescribed by Statute: Provided that if an employee of the University is elected as a member of Central or State Legislature, he shall be deemed to be on special leave without pay for the entire period of his membership. The service condition of such an employee shall be duly safeguarded so that he may continue to earn increment in pay, promotion, seniority and on completion of the term of membership resume his duties in the University: Provided further that the membership of such an employee of the University body shall be deemed to have expired with effect from the date on which he has become a member of the Central or State Legislature.

(3) Every rule made under this Act shall, as soon as they are made, be laid in the Legislative Assembly while it is in session
