1. Short title, extent and commencement
Short title, extent and commencement.
- (1) This Act may be called the Bhagat Phool Singh Mahila Vishwa Vidyalaya Khanpur Kalan Act, 2006.
- (2) It extends to the whole of the State of Haryana.
- (3) It shall come into force on such date as the Government may, by notification in the Official Gazette, appoint.
2. Definitions
Definitions. In this Act, and in all Statutes and Ordinances made hereunder, unless the context otherwise requires,—
- (a) "College" means a college maintained by, or admitted to the privileges of, the University under this Act;
- (b) "Employee" means any person appointed by the University, and includes teachers and other staff of the University;
- (c) "Institution" means an academic institution, not being a college, maintained by, or admitted to the privileges of, the University;
- (d) "Principal" means the head of a College, and includes, where there is no Principal, the person for the time being duly appointed to act as Principal, and in the absence of the Principal, the Vice-Principal, duly appointed as such;
- (e) "University" means the Bhagat Phool Singh Mahila Vishwa Vidyalaya Khanpur Kalan.
3. The University
("The University")
- (1) There shall be established a University by the name of Bhagat Phool Singh Mahila Vishwavidyalaya, Khanpur Kalan, within the State of Haryana.
- (2) The University shall be a body corporate by the name aforesaid, shall have perpetual succession and a common seal, and shall sue and be sued by the said name.
- (3) The University shall be competent to acquire and hold property, both movable and immovable, to lease, sell or otherwise transfer any movable or immovable property which may have become vested in or been acquired by the University, for the purpose of the University and to borrow moneys and to contract and to do all other things necessary for the purposes of this Act.
- (4) The headquarters of the University shall be at Khanpur Kalan.
- (5) The Chancellor, the Vice-Chancellor, the Registrar and the members of the Court, the Executive Council and the Academic Council, and all other persons who may hereafter become such officers or members so long as they continue to hold such office or membership, shall constitute the University.
4. Powers and duties of the University
("Powers and duties of the University")
The University shall have the following powers and duties, namely:—
- (a) to provide for research and instruction in such branches of learning as the University may deem fit to take such steps as it considers necessary for the advancement and dissemination of knowledge;
- (b) to hold examinations and to grant degrees, diplomas and other academic distinctions or titles to persons as may be laid down in the Statutes, Ordinances or Regulations;
- (c) to confer honorary degrees or other distinctions, on approved persons in the manner laid down in the Statutes;
- (d) to institute prizes, medals, research studentships, exhibitions and tournaments;
- (e) to receive endowments, donations, or subsidies from the Government or any other person;
- (f) to institute and to sue;
- (g) to appoint teachers and such other officers as in the opinion of the University may be necessary;
- (h) to control and maintain teaching and to determine the teaching requirements of the University;
- (i) to institute and manage halls, hostels and other places of residence and discipline for the students of the University;
- (j) to manage and control the laboratories, libraries, museums and reading rooms;
- (k) to determine the standards of education and research in the University;
- (l) to maintain a University extension programme;
- (m) to demand and receive such fees and other charges as may be prescribed by the Ordinances;
- (n) to organize and carry on physical education, sports and other extra-curricular activities;
- (o) to establish, maintain or recognize colleges and regional centres;
- (p) to make such arrangements as may be required for the education of women students; and
- (q) to do all such other acts and things, whether incidental to the powers aforesaid or not, as may be necessary or desirable to further the objects of the University.
5. Jurisdiction
Jurisdiction.—
- (1) The jurisdiction of the University shall extend to the whole of the State of Haryana and to such other areas as may be notified by the Government.
- (2) No person shall, by reason of his sex, race, creed, class or caste, be denied the rights and privileges as student of the University.
6. University open to all castes, classes, creeds and social
University open to all castes, classes, creeds and social. — The University shall be open to all persons of either sex and of whatever race, creed, caste or class, and it shall not be lawful for the University to adopt or impose on any person any test whatsoever of religious belief or profession in order to entitle him to be admitted therein in any degree or diploma or in any other academic distinction whatsoever of the University or to hold any office therein or to enjoy or exercise any privileges thereof or to be beneficient of any scholarship or to be awarded any prize or other award of the University : Provided that nothing in this provision shall be deemed to prevent the University from making any special provision for the employment or admission of women, persons with disabilities, or of persons belonging to the weaker sections of the society and, in particular, of the Scheduled Castes and the Scheduled Tribes.
7. Officers of the University
"Officers of the University" — The following shall be the officers of the University, namely:
- (1) The Chancellor;
- (2) The Vice-Chancellor;
- (3) The Registrar;
- (4) The Finance Officer;
- (5) The Controller of Examinations;
- (6) The Librarian; and
- (7) Such other persons in the service of the University as may be declared by the Statutes to be the officers of the University.
8. Chancellor
"Chancellor" —
- (1) The Chancellor of the University shall be the Governor of Haryana.
- (2) The Chancellor shall, by virtue of his office, be the head of the University.
- (3) The Chancellor shall, when present, preside over the convocations of the University held for conferring degrees and meetings of the Court.
- (4) The Chancellor shall have the right—
- (i) to cause an inspection to be made by such person or persons as he may direct, of the University, its buildings, laboratories, libraries, museums, workshops and equipment and of any institutions maintained or administered by the University; and
- (ii) to cause an inquiry to be made in like manner in respect of any matter connected with the administration or finances of the University or institutions.
- (5) The Chancellor shall, in every case, give notice to the University of his intention to cause an inspection or inquiry to be made and on such notice, the University shall appoint a representative who shall be present at such inspection or inquiry.
- (6) The Chancellor may inform the University of the results of such inspection or inquiry and may, after considering the representation, if any, made by the University, advise the Executive Council on the action to be taken in the matter referred to in sub-section (4).
- (7) The University shall report to the Chancellor such action, if any, as it has taken or proposes to take upon the results of such inspection or inquiry.
- (8) The Chancellor may, where the Executive Council does not, within a reasonable time, take action to the satisfaction of the Chancellor, issuing such directions as it may think fit and the Executive Council shall be bound to comply with such directions.
- (9) The Executive Council shall communicate through the Registrar to the Chancellor such action, if any, as it proposes to take or has taken upon the result of such inspection or inquiry.
- (10) Where the Executive Council does not, within a reasonable time, take action to the satisfaction of the Chancellor, the Chancellor, after considering any explanation furnished or representation made by the Council, issue such directions as he may think fit and the Executive Council shall be bound to comply with such directions.
- (11) The Chancellor shall have the power to require the University to act in conformity with the provisions of this Act and the Statutes, Ordinances and Regulations made thereunder.
- (12) The powers exercised by the Chancellor under sub-sections
- (11) and
- (12) shall not be called in question in any civil court.
9. Vice-Chancellor
("Vice-Chancellor")
- (1) The Vice-Chancellor shall be a whole-time salaried officer of the University and shall be appointed by the Chancellor on the recommendations of the Executive Council, from amongst the teachers of the University, who shall not be below the rank of Professor on such terms and conditions as the Vice-Chancellor may recommend to the Executive Council: Provided that the term of office of the Vice-Chancellor shall be for a period of three years, which may be renewed for another one year, if deemed proper, by the Executive Council, on the recommendations of the Vice-Chancellor.
- (2) The Vice-Chancellor shall be the principal academic and executive officer of the University and shall, subject to the provisions of this Act, exercise general supervision and control over the affairs of the University and shall give effect to the decisions of all the authorities of the University.
- (3) The Vice-Chancellor shall preside over meetings of the Court, the Executive Council, the Academic Council and shall be entitled to be present at, and to address, any meeting of any other authority or body of the University but shall not be entitled to vote thereat unless she is a member of such authority or body.
- (4) It shall be the duty of the Vice-Chancellor to see that the provisions of this Act, the Statutes, the Ordinances and the Regulations are duly observed and shall take all necessary steps to ensure such observance.
- (5) The Vice-Chancellor shall have the power to convene or cause to be convened meetings of the Court, the Executive Council, the Academic Council and any other authority or body of the University.
- (6) If the Vice-Chancellor is of the opinion that immediate action is necessary on any matter, she may exercise any power conferred on any authority of the University by or under this Act and shall report to such authority the action taken by her on such matters: Provided that if the authority concerned is of the opinion that such action ought not to have been taken, it may refer the matter to the Chancellor whose decision thereon shall be final: Provided further that any person in the service
10. Registrar
Registrar
- (1) The Registrar shall be a whole-time officer of the University and shall be appointed by the Executive Council on the recommendations of the Selection Committee as may be prescribed by the Statutes.
- (2) The Registrar shall be the ex-officio Secretary to the Executive Council.
- (3) The Registrar shall be the authorized officer to enter into agreements, sign documents and authenticate records on behalf of the University and shall act in such capacity when the university authority or the University has taken a decision in the matter.
- (4) The Registrar shall exercise such other powers and perform such other duties as may be prescribed by Statutes or the Ordinances.
- (5) The Registrar shall be responsible for all such duties as are assigned to her by the Vice-Chancellor.
11. Comptroller of Finance
("Comptroller of Finance") 11.
- (1) The Finance Officer shall be a whole-time salaried officer of the University and shall be appointed by the Executive Council on the recommendations of the Selection Committee on such terms and conditions as may be prescribed by the Statutes.
- (2) The Finance Officer shall be ex-officio Secretary to the Finance Committee, but shall not be deemed to be a member of such Committee.
- (3) When the office of the Finance Officer is vacant or when the Finance Officer is by reason of illness or any other cause is unable to perform the duties of his office, the duties of the officer shall be performed by such person as the Vice-Chancellor may appoint for the purpose.
- (4) The Finance Officer shall—
- (a) exercise general supervision over the funds of the University and shall advise it as regards its financial policy; and
- (b) perform such other functions as may be assigned to him by the Executive Council or as may be prescribed by the Statutes.
- (5) Subject to the control of the Executive Council, the Finance Officer shall—
- (a) hold and manage the property and investments of the University including trust and endowed property;
- (b) ensure that the limits fixed by the Finance Committee for recurring and non-recurring expenditure for a year are not exceeded and that the money is expended or spent for the purposes for which it was granted or allotted;
- (c) be responsible for the preparation of annual accounts and the budget of the University and for their presentation to the Executive Council;
- (d) keep a constant watch on the state of the cash and bank balances and on the state of investments;
- (e) watch the progress of the collection of revenue and advise on the methods of collection to be employed;
- (f) ensure that the registers of buildings, land, furniture and equipment are maintained up-to-date and that the stock checking of equipment and other consumable materials in all offices, special centres, specialized laboratories, colleges and institutions maintained by the University is conducted;
- (g) bring to the notice of the Vice-Chancellor any unauthorized expenditure or other financial irregularity and suggest appropriate action to be taken against persons at fault; and
- (h) call from any office or institution, department, laboratory, library of the University any information or returns that he may consider necessary for the performance of his duties.
- (6) Any receipt given by the Finance Officer or by the person or persons duly authorized in this behalf by the Executive Council for any money payable to the University shall be sufficient discharge for payment of such money.
12. Statutes
("Statutes") 12.
- (1) On the commencement of this Act, the Statutes of the University shall be those as set out in the Schedule: Provided that the Executive Council may, from time to time, make new or additional Statutes or may amend or repeal the Statutes referred to in sub-section (1): Provided further that no Statute shall be made by the Executive Council in respect of any matter which may affect the status, powers and functions of the University, until the Court has been consulted.
- (2) The Executive Council shall not propose the draft of any Statute or of any amendment to a Statute or of repeal of any Statute—
- (a) affecting the status, powers or constitution of any authority of the University until such authority has been given an opportunity of expressing an opinion in writing on the proposal; or
- (b) affecting the discipline of students and standards of instruction, education and examination, until the Academic Council has been consulted.
- (3) Every new Statute or addition to the Statutes or any amendment or repeal of a Statute shall require the assent of the Chancellor who may assent thereto or withhold assent or remit to the Executive Council for re-consideration.
- (4) A new Statute or a Statute amending or repealing an existing Statute shall have no validity unless it has been assented to by the Chancellor.
13. Statutes how made
- (1) The statutes shall be made, amended or repealed by the Court in the manner hereafter provided.
- (2) The Court may of its own motion take up for consideration the draft of any statute: Provided that the Court shall not propose the draft of any statute or of any amendment to a statute affecting the status, powers or constitution of any authority of the University until such authority has been given an opportunity of expressing an opinion upon the proposal.
- (3) The Executive Council may propose to the Court the draft of any statute to be passed by the Court and such draft shall be considered by the Court at its next meeting.
- (4) The Court may approve any such draft as is referred to in sub-section
- (3) and pass the statute or reject it or return it to the Executive Council for reconsideration, either in whole or in part, together with any amendments which the Court may suggest.
- (5) Any member of the Court may propose to the Court the draft of any statute and the Court may either accept or reject the proposal.
14. Ordinances
- (1) The Executive Council may make, amend or repeal ordinances in the manner hereafter provided.
- (2) The ordinances shall be made by the Executive Council: Provided that no ordinance shall be made—
- (a) affecting the admission or enrolment of students or prescribing the examinations to be recognized or the fees to be charged for the courses of study or for examinations by the University; or
- (b) affecting the conditions and mode of appointment or duties of examiners or the conduct or standard of examinations or any course of study; or
- (c) affecting the degrees, diplomas or other academic distinctions to be awarded by the University, unless a draft of such ordinance has been proposed by the Academic Council.
- (3) The Executive Council shall not have power to amend any draft proposed by the Academic Council under sub-section (2), but may reject the proposal or return the draft to the Academic Council for reconsideration, either in whole or in part, together with any amendments which the Executive Council may suggest.
- (4) All ordinances made by the Executive Council shall have effect from such date as it may direct, but every ordinance so made shall be laid before the Court as soon as may be.
15. Ordinances how made
("Ordinances how made")
- (1) The First Ordinances shall be made by the Vice-Chancellor and shall be submitted to the Executive Council for its approval.
- (2) Subject to the provisions of this Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely:—
- (a) the fees to be charged for courses of study in the University and for admission to the examinations, degrees and diplomas of the University;
- (b) the conditions of the award of fellowships, scholarships, studentships, exhibitions, medals and prizes;
- (c) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (d) the conditions of residence of the students of the University;
- (e) the special arrangements, if any, which may be made for the residence, discipline and teaching of women students and prescribing of special courses of studies for them;
- (f) the emoluments and the terms and conditions of service of teachers and other employees of the University;
- (g) the management of the colleges maintained by the University;
- (h) the setting up of the machinery for arbitration or settlement of disputes between students and the University; and
- (i) all other matters which by this Act or the Statutes are to be or may be provided for by the Ordinances.
- (3) The Executive Council either on its own motion or on the recommendation of the Academic Council may, from time to time, make new or additional Ordinances or may amend or repeal the Ordinances referred to in sub-section (1): Provided that the Executive Council shall not make, amend or repeal any Ordinance affecting the status, powers or constitution of any authority of the University until after the Academic Council has been given an opportunity of expressing an opinion in writing on the proposed changes and any opinion so expressed shall be considered by the Executive Council:
16. Provided further that no Ordinance shall be made by the Executive Council in respect of any matter which under this Act has to be regulated by the Statutes.
Regulations ("Regulations")
- (1) The authorities of the University may make Regulations consistent with this Act, the Statutes and the Ordinances—
- (a) laying down the procedure to be observed at their meetings and the number of members required to form a quorum;
- (b) providing for all matters which by this Act, the Statutes or the Ordinances are to be provided for by Regulations; and
- (c) providing for any other matter solely concerning such authorities or committees appointed by them and not provided for by this Act, the Statutes or the Ordinances.
- (2) Every authority of the University shall make Regulations providing
17. Annual Report
Annual Report
- (1) The annual report of the University shall be prepared under the direction of the Executive Council and shall be submitted to the Court on or before such date as may be prescribed by the Statutes and shall be considered by the Court at its annual meeting.
- (2) The Court may pass resolutions thereon and communicate the same to the Executive Council.
- (3) A copy of the annual report along with the observations of the Court, if any, shall be submitted to the Government.
18. Annual Accounts
Annual Accounts
- (1) The annual accounts and the balance sheet of the University shall be prepared under the direction of the Executive Council and shall be submitted to the Government for such examination as the Government may consider necessary.
- (2) The annual accounts and the balance sheet of the University, as so audited, shall be submitted to the Government for its consideration and shall be submitted to the Court along with the observations of the Executive Council.
- (3) The annual accounts and the balance sheet of the University shall be prepared in such manner as may be prescribed by the Statutes.
19. Conditions of service of officers, teachers and other employees
- (1) The University shall institute, for the benefit of its officers, teachers and other employees, such pension, provident fund, insurance and gratuity schemes as it may deem fit.
- (2) Where any provident fund has been so instituted, the provisions of the Provident Funds Act, 1925 (Act 19 of 1925), shall be applicable to it as if it were a Government Provident Fund.
20. Right to appeal and arbitration in disciplinary cases against students or employees
- (1) Every salaried officer and teacher, except the Vice-Chancellor, shall be appointed under a written contract, which shall be lodged with the University and any dispute arising out of the contract between the University and any of the officers or teachers shall, at the request of the officer or teacher concerned, be referred to a Tribunal of arbitration consisting of one member appointed by the Executive Council, one member appointed by the officer or teacher concerned and one nominee of the Chancellor. The decision of the majority of the members of the Tribunal shall be final and no suit shall lie in any civil court in respect
21. Constitution of Validation of proceedings
("Constitution of Validation of proceedings")
- (1) All acts done, or proceedings taken, under this Act by any authority or body or committee of the University shall be invalid on the ground only of—
- (a) any vacancy or defect in the constitution of the authority, or body, or committee; or
- (b) any defect or irregularity in election, nomination or appointment of a person acting as a member thereof; or
- (c) any defect or irregularity in such act or proceeding not affecting the merits of the case.
22. Seniority
("Seniority")
- (1) Whenever in accordance with this Act any person is to hold an office or be a member of any authority of the University by rotation according to seniority, such seniority shall be determined according to the length of continuous service of such person in a particular grade in the University and in accordance with such other principles as the Executive Council may, from time to time, prescribe.
- (2) It shall be the duty of the Registrar to prepare and maintain, in respect of all officers, teachers and other employees of the University, seniority lists for the purpose of this Act and it shall be considered as the final record of the proceedings of the University.
23. Disputes as to constitution of authorities and bodies
("Disputes as to constitution of authorities and bodies") 23. If any question arises whether any person has been duly elected or appointed as, or is entitled to be, a member of any authority or other body of the University, the matter shall be referred to the Chancellor whose decision thereon shall be final.
24. Constitution of committees
("Constitution of committees") 24. Where any authority of the University is given power by this Act or the Statutes to appoint committees, such committees shall, save as otherwise provided, consist of the members of the authority concerned and of such other persons, if any, as the authority in each case may think fit.
25. Filling of casual vacancies
Filling of casual vacancies
- (1) Any casual vacancy among the members (other than ex-officio members) of any authority or other body of the University shall be filled, as soon as may be, by the person or body who appoints, elects or co-opts the member whose place has become vacant and the person so appointed, elected or co-opted to a casual vacancy shall be a member of such authority or body for the residue of the term for which the person whose place she fills would have been a member.
- (2) A casual vacancy shall be filled and consultations made in accordance with the provisions of this Act.
26. Protection of action taken in good faith
Protection of action taken in good faith No suit or other legal proceeding shall lie against any officer or employee of the University for anything which is in good faith done or intended to be done in pursuance of any of the provisions of this Act, the Statutes or Ordinances.
27. Mode of proof of University record
Mode of proof of University record.—Notwithstanding anything to the contrary contained in the Indian Evidence Act, 1872 (Act 1 of 1872), or in any other law for the time being in force, a copy of any receipt, application, notice, order, proceedings, resolution of any authority or committee of the University, or other documents in possession of the University, or any entry in any register duly maintained by the University, if certified by the Registrar, shall be received as evidence of such receipt, application, notice, order, proceedings, resolution
28. Power to remove difficulties
Power to remove difficulties.—If any difficulty arises with respect to the establishment of the University or in connection with the first meeting of any authority of the University or otherwise in first giving effect to the provisions of this Act, the Government may
29. Effect of this Act on other Acts
Effect of this Act on other Acts.—(1) The Bhagat Phool Singh Mahila Vishwa Vidyalaya Khanpur Kalan Act, 2006, shall be the principal Act for the purpose of the University.
- (2) If any provision of any other law for the time being in force is inconsistent with any of the provisions of this Act, the provisions of this Act shall prevail.
30. Transitional provisions
Transitional provisions.—(1) Any act done or proceeding taken under this Act by any authority or body of the University shall not be invalid on the ground of—
- (a) any vacancy or defect in the constitution of the authority, or body; or
- (b) any defect or irregularity in election, nomination or appointment of a person acting as a member thereof; or
- (c) any defect or irregularity in such act or proceeding, not affecting the merits of the case.
- (2) The Teacher, Student or any other member of the University shall be governed by the ordinances and regulations as specified in this Act, until the new statutes are made.
31. Statutes of the University
Statutes of the University:—
- (1) Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:—
- (a) the constitution, powers and duties of the authorities and other bodies of the University as may be constituted from time to time;
- (b) the election and continuance in office of the members of the said authorities and bodies, the filling of vacancies of members and all other matters relative to those authorities and bodies for which it may be necessary or desirable to provide;
- (c) the appointment, powers and duties of the officers of the University and their emoluments;
- (d) the appointment of teachers of the University, persons employed in the University and their emoulments;
- (e) the remuneration and allowances, including travelling and daily allowances, to be paid to persons employed in the business of the University;
- (f) the degree, diplomas, certificates and other academic distinctions to be awarded by the University;
- (g) the terms and conditions under which the degrees, diplomas, certificates and other academic distinctions may be awarded;
- (h) the establishment, maintenance and abolition of faculties, departments, hostels, colleges and institutions;
- (i) the quorum and procedure to be followed in the transaction of business of the authorities and other bodies of the University;
- (j) the conditions of award of fellowships, scholarships, studentships, medals and prizes;
- (k) the maintenance of records, registers and maps of the University;
- (l) the fees to be charged for courses of study, research, experiment, practical training in the University; and
- (m) all other matters which by this Act are to be or may be provided for by the Statutes.
- (2) The first Statutes of the University shall be those as set out in Schedule.
- (3) The Executive Council may, from time to time, make new or additional Statutes or may amend or repeal the Statutes referred to in sub-section (1): Provided that the Executive Council shall not make, amend or repeal any Statute affecting the status, powers or constitution of any authority of the University until such authority has been given an opportunity of expressing an opinion in writing on the proposed changes, and any opinion so expressed shall be considered by the Executive Council: Provided further that no Statute shall be made by the Executive Council and submitted to the Chancellor for assent that affects the promotion of Bhagat Phool Singh Mahila Vishwa Vidyalaya Khanpur Kalan for which the Act is enacted.
- (4) Every new Statute or addition to the Statutes or any amendment or repeal of a Statute shall require the assent of the Chancellor, who may assent thereto or withhold assent or remit to the Executive Council for re-consideration.
- (5) A new Statute or a Statute amending or repealing an existing Statute shall have no validity unless it has been assented to by the Chancellor.
32. The Court
The Court:—
- (1) The Court shall consist of the following members, namely:—
- (i) The Chancellor;
- (ii) The Vice-Chancellor;
- (iii) The Secretary to Government, Haryana, Finance Department, or in his absence, his nominee not below the rank of Joint Secretary;
- (iv) The Secretary to Government, Haryana, Education Department, or in his absence, his nominee not below the rank of Director, Higher Education;
- (v) The Secretary to Government, Haryana, Health Department, or in his absence, his nominee not below the rank of Director-General/Joint Secretary;
- (vi) The Secretary to Government, Haryana, Technical Education Department, or in his absence, his nominee not below the rank of Director, Technical Education;
- (vii) The Deans of Faculties;
- (viii) The Registrar;
- (ix) The Dean of Students' Welfare, if any;
- (x) The Proctor;
- (xi) The Controller of Examinations, if any;
- (xii) Professors Emeritus appointed by the University;
- (xiii) University Grants Commission Representative (one without having right to vote or election);
- (xiv) Librarian;
- (xv) Finance Officer; Other members—
- (i) One Professor appointed by the University by rotation, on the basis of seniority;
- (ii) One University Reader from each faculty, by rotation, on the basis of seniority;
- (iii) One principal and three teachers to be elected from amongst themselves by the principals and teachers respectively, holding their posts in substantive capacity in the colleges included in each of the constituencies mentioned below:—
- (a) ten teachers of the University by rotation from amongst the teachers, other than professors and readers, on the basis of seniority so that those who have not been members of the Court shall have greater chances for being elected to the Court:
- (b) fifteen representatives from amongst eminent academicians and representatives from industry, commerce, medicine, administration etc. to be nominated by the Chancellor, for a term of two years;
- (c) ten representatives of donors, if any, to be nominated by the Chancellor for a term of two years;
- (d) one student from each faculty who has shown distinguished performance in sports, debates, seminars etc. to be nominated by the Vice-Chancellor for one year.
- (2) The Court shall meet at least twice a year, on a date to be fixed by the Vice-Chancellor.
- (3) A special meeting of the Court may be convened at any time, by the Chancellor, the Vice-Chancellor or on a written request by one-third of its members.
33. Meetings of the Court

- (1) The Court shall meet at least twice a year, on a date to be fixed by the Vice-Chancellor.

34. Executive Council
Executive Council.—
- (1) The Executive Council shall be the principal executive body of the University.
- (2) The constitution of the Executive Council, the term of office of its members and its powers and duties shall be such as may be prescribed by the Statutes.
35. The Academic Council
- (1) The Academic Council shall consist of the following members, namely:—
- (i) The Vice-Chancellor;
- (ii) The Secretary to Government, Haryana, Finance Department, or in his absence, his nominee not below the rank of Joint Secretary;
- (iii) The Secretary to Government, Haryana, Education Department, or in his absence, his nominee not below the rank of Director, Higher Education/Joint Secretary;
- (iv) The Secretary to Government, Haryana, Technical Education Department, or in his absence, his nominee not below the rank of Director, Technical Education/Joint Secretary;
- (v) The Secretary to Government, Haryana, Health Department, or in his absence, his nominee not below the rank of Director-General/Joint Secretary;
- (b) Other members—
- (i) Five Deans of the Faculties one from each of the following categories:—
- (i) Dean, Faculty of Science;
- (ii) Dean, Faculty of Commerce and Management/Social Sciences and Humanities;
- (iii) Dean, Faculty of Arts and Languages and Law, by rotation;
- (iv) Dean, Faculty of Public Studies and Education, by rotation;
- (v) Dean, Faculty of Engineering and Technology, Pharmaceutical Sciences and Medical and Life Sciences, by rotation;
- (b) two principals (other than the Deans of the Faculties) from women colleges, by rotation, on the basis of seniority;
- (c) one teacher (other than a principal) of a college elected by the members of the Court from amongst themselves;
- (d) one teacher of the University/College other than those elected under sub-clause
- (c) above, on the basis of seniority;
- (e) three persons elected by the Court from amongst its own members;
- (f) President, Bhagat Phool Singh Mahila Vishwa Vidyalaya Students' Union and two members to be elected from amongst themselves by the students of the Students' Union of the University/College for the period from the date of election till the 31st May of the academic year: Provided that the members elected under this sub-clause shall not participate in any meeting of the Academic Council when the Academic Council considers the examination of results.
- (2) The Registrar shall be the ex-officio Secretary of the Academic Council.
- (3) Two-thirds of the members shall be a quorum.
- (4) Save as otherwise expressly provided, the members of the Academic Council, other than ex-officio members, shall hold office for a term of two years.
- (5) The elected members shall be eligible for re-election in accordance with the rules framed by the Vice-Chancellor.
36. Faculties
- (1) The University shall have the following faculties, namely:—
- (i) Faculty of Science;
- (ii) Faculty of Commerce and Management;
- (iii) Faculty of Social Sciences and Humanities;
- (iv) Faculty of Arts and Languages;
- (v) Faculty of Public Studies and Education;
- (vi) Faculty of Engineering and Technology;
- (vii) Faculty of Pharmaceutical Sciences;
- (viii) Faculty of Medical and Life Sciences; and
- (ix) such other faculties as the Executive Council, on the recommendation of the Academic Council, may prescribe by the Statutes.
- (2) It shall examine and recommend to the Executive Council the teaching and other posts. (3)
- (i) Each faculty shall consist of the following members, namely:—
- (a) Dean;
- (b) Chairman and Readers of the departments comprised in the Faculty;
- (c) two teachers of the subjects concerned admitted to the privileges of the University by the Vice-Chancellor on the basis of seniority; Provided that if the number of colleges having Post-Graduate Department is more than six, then one more teacher of the subject concerned shall be nominated but not more than one such member shall be from the same college:
- (v) six others nominated by the Vice-Chancellor, on the recommendation of the Chairperson of Departments: Provided that the Executive Council at the request of the department may enlarge the number of members of a Board of Post-Graduate Studies under sub-clause
- (ii) above, accordingly. (4)
- (i) The Boards of Studies shall recommend to the Academic Council courses and syllabi and text books for the subjects for all the under-graduate classes and post-graduate studies and Board of Studies shall recommend the list of examiners for post-graduate classes and research degrees.
- (ii) The Boards of Studies shall also make recommendations to the Academic Council, regarding its achievements, teaching, research, standards, publications, scholarships, medals and prizes and the like or any other matter referred to them by the Faculty.
- (iii) Teacher members, other than ex-officio members, shall hold office for a term of two years: Provided that a member once elected/nominated shall not be eligible for re-election/nomination till the expiry of the next term.
- (iv) The quorum for a meeting of the Board of Studies shall be one-third of the total number of members.
37. Board of Post-graduate Studies

Board of Post-graduate Studies
- (1) Each Board of Post-graduate Studies shall consist of the following members, namely:—
- (a) the Dean of the Faculty concerned;
- (b) the Head of the University teaching Department concerned;
- (c) Professors, Readers and Lecturers in the subject concerned, if any, in the University;
- (d) two external experts to be nominated by the Vice-Chancellor after consulting the Department concerned: Provided that if the number of colleges having post-graduate department is more than six, then one more teacher of the subject concerned shall be nominated but no more than one such member shall be from the same college;
- (e) two teachers to be nominated by the Vice-Chancellor, on the recommendation of the concerned Department: Provided that the Executive Council at the request of the Department may increase the number of members of a Board of Post-graduate Studies under sub-clause
- (d) above: Provided further that in case the Department concerned holds only under-graduate classes, the Board shall consist of the following:—
- (i) Dean of the Faculty;
- (ii) Head of the Department concerned;
- (iii) two teachers of the subject concerned from the affiliated colleges to be nominated by the Vice-Chancellor;
- (iv) two external experts to be nominated by the Vice-Chancellor.
- (2) The Board of Post-graduate Studies shall recommend to the Academic Council, the courses and syllabi of studies and text books for the subjects concerned for the post-graduate classes and research courses and the Board shall also make recommendations in respect of the courses for post-graduate classes and research courses if so referred to it by the Faculty.
- (3) Member other than ex-officio members, shall hold office for a term of two years.
- (4) One-third of the members shall form a quorum.
- (5) Any member who is a member of any other authority or body, shall not have the right to vote if he or she is not a member of such board: Provided that in one case, if in one year, one Board of Post-graduate Studies has been involved in publication or research notes, it shall have to be referred to the Executive Council.
- (6) If any question arises whether a person has been duly nominated in terms of this statute, it shall be referred to the Vice-Chancellor, whose decision shall be final.
