Liability for causing loss, waste or misapplication of money or property of the Authority
The Manipur Town and Country Planning Act, 1975(1) No suit, prosecution or other legal proceeding shall lie against an Authority or its officer or servant or any person acting under its or his direction or any Govt. servant employed for the purposes of this Act for anything which is in good faith done or intended to be done under this Act or rules or bye-laws made thereunder. (2) No suit, prosecution or other proceeding shall lie against the State Government for anything done or purported to be done by it under this Act. (3) No suit or other legal proceeding, not being a criminal proceeding, shall be instituted against an Authority, or any of its officers in respect of any act purporting to be done by such officer in his official capacity, or any person acting under its or his direction, until the expiration of one month next after notice in writing has been properly served on: (a) in the case of a suit against the Authority, the Chairman; (b) in the case of an officer, the officer against whom the suit or proceeding is instituted; and in the case of any person acting under the direction of the Authority or of any of its officers delivered to him at his place of residence or business: stating the cause of action, the name, description and place of residence of the plaintiff and the relief which he claims; and the plaint or the petition shall contain a statement that such notice has been so served. Explanation :- "Officer" in this section includes the Chairman and the Vice-Chairman.
