Statutory text
Penalties for breach of bye-laws.—
- (1) In making a bye-law under section 386, the Corporation may provide that a breach or any abatement of a breach of it shall be punishable.
- (a) with fine which may extend to ten thousand rupees and in the case of a continuing breach, with fine which may extend to one thousand rupees for each day during which the breach continues after conviction for the first breach, or
- (b) with fine which may extend to one thousand rupees for every day during which the breach continues after receipt of written notice from the Commissioner to discontinue the breach.
- (1) In making a bye-law under section 386, the Corporation may provide that a breach or any abatement of a breach thereof shall be liable to a penalty—
- (a) which may extend to one lakh rupees and, in the case of a continuing breach, to a penalty which may extend to ten thousand rupees for each day during which the breach continues after the first breach; or
- (b) which may extend to ten thousand rupees for every day during which the breach continues after receipt of written notice from the Commissioner to discontinue the breach.]
- (2) In lieu of or in addition to such fine 51[penalty], the Magistrate may require the offender to remedy the mischief so far as is in his power.
