The Bihar Wood-Based Industries (Establishment and Regulation) Act, 2025
1. Short title, extent and commencement
Short title, extent and commencement. –
- (1) This Act may be called The Bihar Wood-Based Industries (Establishment and Regulation) Act, 2025.
- (2) It shall extend to the whole of the State of Bihar.
- (3) It shall come into force with effect from the date of its publication in the Bihar Gazette.
2. Definitions
Definitions. –
- (1) In this Act unless there is anything repugnant to the subject or context-
- (a) "Act" means the Bihar Wood Based Industries (Establishment and Regulation) Act, 2025,
- (b) "Industrial Estate or Industrial Area" means areas notified by the State Government for establishment of Industries including the Wood Based Industries;
- (c) "license" means a license granted under section 10 of this Act;
- (d) "licensee" means any person possessing a license duly granted under
section 10 of this Act;
- (e) "licensing officer" means a licensing officer appointed under Section 5 of this Act;
- (f) "A person", for the purpose of this Act, means any applicant including an individual or Karta of a Hindu Undivided family or a partnership firm under the Indian Partnership Act, 1932 or a Company under the Companies Act, 2013 or a registered Co-operative Society;
- (g) "Principal Chief Conservator of Forests" means a forest officer of the rank of the Principal Chief Conservator of Forests in the State;
- (h) "prescribed authority" means a prescribed authority appointed under
Section 6 of this Act;
- (i) "Round log" means a piece of wood in its natural form, having mid girth of thirty centimetre or more under bark and it includes such round log even after its bark has been removed or its surface has been dressed, manually or by using a band saw or any other machine or equipment, to make its cross section square or near square for the purpose of ease in its transportation and / or storage;
- (j) "saw mill" means a wood based industry for conversion of round logs into sawn timber;
- (k) "Sawn Timber" means beams, scantlings, planks, battens and such other products obtained from sawing of a round log;
- (l) "sawing and/ or Processing" with its grammatical variations and cognate expressions means operations of sawing, cutting, slicing, peeling, converting, fashioning or seasoning of wood and includes preservation and treatment thereof either by mechanical or chemical process with the aid of electrical or mechanical power. It shall include the act of extraction of other residues (Katha or Pulp, resin, rosin, fibre, gum etc.) from wood or any activity in which wood is utilized as a raw material.
- (m) "Selected wood based Industry" means a wood based industry having its seniority position within the compiled seniority list at State level as determined under section 9 of this Act;
- (n) "Non Selected wood based Industry" means a wood based industry having its seniority position beyond the compiled seniority at State Level permissible number of units as determined under section 9 of this Act;
- (o) "State" means the State of Bihar.
- (p) "State Level Committee or SLC" means the Committee constituted by the State Government under section 3 of this Act.
- (q) "Vehicle" means a mechanically propelled vehicle or any vehicle drawn by human beings or by animals and includes truck, tractor, trolly, motor vehicle, boat and carts;
- (r) "Wood" includes trees when they have fallen or have been felled and all wood of any species, except bamboos, whether cut, converted, fashioned, sawn or hollowed out for any purpose or not. "Wood Based Industry" means any industry which processes wood as its raw material (Saw Mills/ Veneer/ Plywood or any other form such as sandal, katha wood etc).
- (t) "Charcoal" means a form of carbon derived from incomplete combustion of wood derived from a tree.
- (u) "Composite unit" means any industry where different kinds of wood based industries are under operation.
- (v) "Year" means a Calendar year which commences on the 1st day of January and ends on the 31st day of December of the year.
- (2) Words and expressions used but not defined in this Act and defined in the
3. Indian Forest Act, 1927 (XVI of 1927), shall have the same meaning respectively assigned to them in that Act.
Constitution of the State Level Committee Constitution of the State Level Committee :-
- (1) The State Government by notification shall constitute a State Level Committee
- (SLC) to perform the functions assigned in or by this Act.
- (2) The State Level Committee shall consist of the following & members:- a) Principal Chief Conservator of Forest
- (HoFF) Chairman b) A representative of the Regional Office of the Ministry of Environment, Forest and Climate Change not below the rank of Conservator of Forests. Member c) A representative of the State Forest Department not below the rank of a Conservator of Forests dealing with preparation of working plans/ working schemes. Member d) Director / Additional Director of Department Industry, Bihar. Member e) Managing Director of the Bihar Forestry Development Corporation Ltd. Member f) An officer not below the rank of Conservator of Forests working in the Forest Head Quarters Member Secretary
- (3) The State Level Committee may co-opt an officer from Territorial wing of the Forest Department not below the rank of Conservator of Forests and officers from Department of Agriculture and Department of Revenue & Land Reforms, Government of Bihar.
- (4) State Level Committee will invite a representative of the wood based industry nominated by anyone Saw-mill association as a special invitee to each and every meeting of the State Level Committee.
- (5) The quorum for the meeting of the State Level Committee shall be at least fifty percent of the permanent members.
- (6) The State Level Committee shall meet at least once in three months.
4. Powers and Functions of the State Level Committee
Powers and Functions of the State Level Committee – The State Level Committee
- (SLC) shall –
- (i) Assess the availability of timber in the State by way of appropriate study on demands and supply, as and when it decides. Devise suitable mechanism for sustainable use of timber in a way that does not affect the forests and the tree cover of the area adversely.
- (ii) Approve the name of Wood Based Industries which may be considered for grant of fresh license or enhancement of the existing licensed capacity, in case the SLC is satisfied that wood is available legally for the said new Wood Based Industries (such as Trees outside forest, Forests etc).
- (iii) Ensure that the amount (realised from Wood Based Industries) lying with the State Forest Department is utilized for the purpose of afforestation / plantation only.
- (iv) Examine any other matter referred by the State Government and send appropriate recommendation to the Ministry of Environment, Forest and Climate Change.
5. Appointment of Licensing Officer
Appointment of Licensing Officer. –
- (1) The State Government may, by notification, appoint an officer, not below the rank of Divisional Forest Officer, to be a Licensing Officer for the purpose of this Act;
- (2) The State Government may define the local limits within which a Licensing Officer shall exercise the powers conferred and perform the duties assigned to him by or under this Act.
6. Appointment of Prescribed Authority
Appointment of Prescribed Authority. –
- (1) The State Government, may by notification, appoint an officer, not below the rank of Conservator of Forests, to be the Prescribed Authority, for the purpose of this Act;
- (2) The State Government may define the local limits within which a Prescribed Authority shall exercise the powers conferred and perform the duties assigned to him by or under this Act.
7. Application for license
Application for license. –
- (1) On or after the date of commencement of this Act, no person shall establish and / or operate any Wood Based Industry, except under the authority and subject to the conditions of a license granted in that behalf under this Act on an application made by such person;
- (2) A license issued under the Bihar Saw Mills (Regulation) Act, 1990 shall be deemed to have been issued under this Act.
8. Declaration of restricted places and prohibited areas for the Wood Based Industries
Declaration of restricted places and prohibited areas for the Wood Based Industries. –
- (1) In respect of distance from the boundary of the nearest notified forests or protected areas, Wood Based Industries shall be allowed to operate in the State at a distance as per State-specific order / approval of the Hon'ble Supreme Court / Hon'ble Patna High Court / Central Empowered Committee or beyond ten kilometres of aerial distance from the boundary of the nearest notified forests or protected areas whichever is less.
- (2) The provision under sub-section
- (1) will not be applicable to roadside / railway side / canal side plantations, which have been declared as Protected Forest.
- (3) A Wood Based Industry can be established in an Industrial Estate /Industrial Area or a Municipal area (Nagar Nigam / Nagar Palika / Nagar Panchayat) irrespective of the aerial distance from the boundary of nearest notified forest or protected area.
- (4) The State Government may, by notification, for reasons mentioned therein, declare any area to be a prohibited area, for the period specified therein.
During the period an area is declared to be a restricted area or a prohibited area under this Act or any other order made there under, the following consequences shall ensue, namely-
- (a) no license shall be granted for establishment of Wood Based Industry in that area;
- (b) no license of Wood Based Industry shall be renewed during that period in that area;
- (c) Wood Based Industry situated in that area shall cease to operate and keep its operation closed.
- (d) No claim on account of damages as a result of such cessation of operations or closure shall lie before any authority nor any damages arising out of such cessation/ closure, if any, shall be payable to the licensee. (5)
- (a) The State Government may issue directions for disposal of such wood / wood produce which has been received till the date of declaration of an area as restricted or prohibited under this section.
- (b) The affected wood Based industry will be allowed to operate beyond the restricted area subject to the provisions under sub-section
- (1) of Section 8.
9. Fixation of number of various Wood Based Industrial units in the State and restriction on machinery
Fixation of number of various Wood Based Industrial units in the State and restriction on machinery - The State Government, on the basis of recommendation made by State Level Committee on the assessment of availability of timber/wood vis-a-vis the estimated annual consumption of timber/wood by various Wood Based Industries, shall fix the number of different types of Wood Based Industries for their operation in the State from time to time and fix the number and/or type of machinery units to be used by them.
10. Grant and renewal of license
Grant and renewal of license. –
- (1) License may be granted for new Wood Based Industry in cases where the number of licensed Wood Based Industry is less than the number of permissible units as determined under section 9 of this Act.
- (2) The State Government may issue guidelines for issuance of new licenses.
- (3) An application for license under Section 7 of this Act shall be in such form and shall be accompanied by such fee and security deposit, as may be prescribed by the State Government.
- (4) On receipt of an application, the Licensing Officer may, after making such enquiry as he may deem fit, take steps to grant the license in accordance with rules made under this Act.
- (5) No license to a Wood Based Industry shall be granted or renewed without obtaining prior approval of the State Level Committee. Provided that the State Level Committee may delegate the power of renewal of license of a wood based industry to the Divisional Forest Officer of the concerned Forest Divisions.
- (6) A license granted under this section shall be subject to the provisions of this Act and to such conditions as may be prescribed therein.
- (7) The license shall be issued for a period fixed by the State Government and on its expiry shall be renewed on an application in such form and accompanied with such fees as may be prescribed by the State Government.
- (8) Industry/processing plants, not using round logs of domestic origin or operating without a band saw or re-saw or circular saw of more than thirty centimetre diameter shall not require license in cases where they use:- a. sawn timber, cane, bamboo, reed, plywood, Veneers or imported wood procured from legitimate sources; b. block board, Medium Density Fibre
- (MDF) board or similar wood based products procured from legitimate sources; c. round log / timber from species declared as agro-forestry/ agricultural crops and / or exempted from the purview of felling and transit regime in the State and procured from legitimate sources. Provided that the State Level Committee may allow installation of circular saw of diameter upto 60 (sixty) centimetre in such industries having specialized requirement.
- (9) Industries specified under sub section
- (8) of this section shall be registered with the office of the concerned licensing officer and shall be regulated as per the directions issued by the State Government.
11. Transfer of license
Transfer of license –
- (1) Transfer of license on sale / succession etc. shall be done with the approval of State Level Committee.
- (2) The State Government may issue guidelines for transfer of license under this

Seniority inter-se between the licensed Wood Based Industries Seniority inter-se between the licensed Wood Based Industries–
- (1) The seniority list of licensed Wood Based Industries shall be prepared and published for each category.
- (2) In case of transfer of license under section 11 of this Act, the seniority of such Wood Based Industry shall remain unchanged.
- (3) The State Government shall issue guidelines for preparing the inter-se- seniority list of various Wood Based Industries.
13. Power of entry, inspection, search, seizures etc
Power of entry, inspection, search, seizures etc. –
- (1) For the purpose of ascertaining the location or, examine the functioning of a Wood Based Industry or with a view to ensure compliance of the provisions under this Act and the Rules made thereunder, the Licensing Officer or any other Forest Officer not below the rank of Beat officer (Forester) authorised by the Licensing Officer in this behalf, may-
- (a) enter and inspect a Wood Based Industry;
- (b) order for the production of any document, book, register or records in the possession of any person having the control of or employed in connection with a Wood Based Industry for examining;
- (c) search any person, premises, vehicle, machine, tools and equipments used or intended to be used in contravention of the provisions of this Act and the Rules made thereunder and may stop any vehicle or person for this purpose;
- (d) seize any wood, plants and machinery, tools, vehicle and any other articles suspected to be involved or used or is about to be involved or used in contravening the provisions of this Act or the Rules made thereunder.
- (2) The provisions under relevant section of the Bharatiya Nagarik Suraksha Sanhita, 2023 relating to search and seizure shall, so far as may, apply to searches and seizure under this Section.
14. Submission of returns
Submission of returns. - Every licensee shall submit such returns relating to the business of the Wood Based Industry in such forms and to such officers and at such frequency as may be prescribed by the State Government.
15. Records to be maintained by the Wood Based Industries
Records to be maintained by the Wood Based Industries - All Wood Based Industries shall maintain records with supporting documents in the forms as may be prescribed by the State Government and regularly update the same. These records shall be produced during inspection.
16. It shall be presumed, in respect of the stock of wood which is not accounted for satisfactorily, that the same has been obtained unlawfully and such stock shall be liable to confiscation.
Prohibition of electric connection etc., in unlicensed Wood Based Industry Prohibition of electric connection etc., in unlicensed Wood Based Industry. –
- (1) On and from the date of commencement of this Act, notwithstanding anything contained in any enactment relating to electricity for the time being in force, no electric energy shall be consumed and no electric connection shall be installed for the purpose of a Wood Based Industry or continued for that purpose unless such Wood Based Industry is duly licensed and operated in accordance with the provisions in this Act.
- (2) The State Government may make Rules for the purpose of the provisions of this section.
17. Revocation or Suspension of license and Appeal
Revocation or Suspension of license and Appeal –
- (1) If the Licensing Officer is satisfied, either on a reference made in this behalf or otherwise, that-
- (a) the licensee has parted, in whole or in part, with his control over the wood based industry or has acquired such unit without obtaining the approval of the State Level Committee as provided under section 11 of this Act; or
- (b) the licensee has ceased to operate his unit; or
- (c) the licensee has without reasonable cause, failed to comply with any of the conditions of the license or any direction lawfully given by the Licensing Officer or has contravened any of the provisions of this Act or the Rules made thereunder; or
- (d) the licensee has kept in the premises of his Wood Based Industry any wood / plant produce which he is not able to account for satisfactorily and consequently which is liable to be confiscated under Section 18; or
- (e) the licensee is involved in activities prejudicial to the interest of Forest Conservation, then without prejudice to any other penalty to which licensee may be liable under this Act the Licensing Officer may, after giving the licensee an opportunity of showing cause, revoke, or suspend the license and forfeit the sum, if any, or any portion thereof deposited as security for the due compliance of the conditions imposed in the license.
- (2) A copy of every order issued under sub-section
- (1) shall be given to the licensee, the Prescribed Authority and the State Level Committee.
- (3) Any person aggrieved by an order of Licensing Officer under section 10, 11 and 17 of this Act may file an appeal before the Prescribed Authority, within thirty days from the communication of such order.
- (4) The Prescribed Authority may, either suo motu or on an appeal, call for and examine the records of an order passed by the Licensing Officer under section 10, 11 and 17 of this Act and may make such enquiry or cause such enquiry to be made and pass such orders, as he may deem fit, preferably within a period of ninety days.
18. Provided that no order prejudicial to any person shall be passed without giving him an opportunity of being heard.
Confiscation of Wood Based Industry etc. and Appeal Confiscation of Wood Based Industry etc. and Appeal-
- (1) The Licensing Officer may order for confiscation of the stock of wood unlawfully stored in whole or in part together with the plants and machinery, vehicles, implements, equipments or any other articles which have been used in the commission of the offence in cases where:
- (a) a Wood Based Industry is established or operated in an area declared to be restricted or a prohibited area under Section 8; or
- (b) a Wood Based Industry is established and / or operated without a valid license; or
- (c) a Wood Based Industry is operated after suspension or revocation of license; or
- (d) a Wood Based Industry is operated with the aid of electrical energy or electrical installation in contravention of the provision of Section 16; or
- (e) unaccounted wood is found in the premises of the Wood Based Industry.
- (2) An intimation about initiation of proceedings for confiscation of property shall be sent to the magistrate having jurisdiction to try the offence on account of which seizure has been made.
- (3) No order of confiscation of any property shall be made under sub-section
- (1) unless the person from whom the property is seized, and in the case where the owner of such property is known, such person is given-
- (a) a notice in writing intimating him of the grounds on which the confiscation of such property is proposed;
- (b) an opportunity of making a representation in writing within such reasonable time as may be specified in the notice against the grounds for confiscation; and
- (c) a reasonable opportunity of being heard in the matter.
- (4) Appeal against the order of confiscation- Any person aggrieved by an order of confiscation may, within thirty days of the order, or if the fact of such order has not been communicated to him within thirty days of date of knowledge of such order, prefer an appeal in writing, accompanied by such fee payable, in such form as may be prescribed, along with the certified copy of order of confiscation, before the Prescribed Authority of the area in which the seizure has been made.
- (5) Bar of Jurisdiction of Court etc. in certain circumstances- On receipt of intimation under sub section
- (2) of this section about initiation of proceeding for confiscation of property by the Magistrate having jurisdiction to try the offence on account of which the seizure of property which is subject matter of confiscation, has been made, no court shall have jurisdiction to make orders with regard to possession, delivery disposal or distribution of the property with regard to which proceeding of confiscation has been initiated under this Act.
19. Property to vest in the Government in respect of which confiscation order passed Under section 18(1) or 18(3) or 18(4) has reached its’ finality

- (1) Where an order of confiscation of any property passed under sub-section

- (4) of section 18 has become final in respect of the whole or any portion of such property, such property or the portion thereof, as the case may be, shall vest in the State Government free from all encumbrances.
- (2) An order of confiscation under sub-section
- (1) or sub-section

- (4) of section 18 shall not be deemed to bar on the imposition of any such other penalty to which the person from whom the property is seized is liable under this Act.
20. Penalties
Penalties. -
- (1) operation of any wood based industry without obtaining license under this act shall be a cognizable offence.
- (2) If any person contravenes or attempts to contravene or abets the contravention of any of the provisions of this Act or the Rules made thereunder he/she shall be punishable with imprisonment for three months which may extend to one year, and / or with a fine of Rs 10000/- (Ten thousand) which may extend to Rs 100000/- (One Lakh) or with both.
21. Power to arrest without warrant
Power to arrest without warrant.-
- (1) Any Forest Officer may, without orders from a Magistrate and without a warrant, arrest any person, against whom a reasonable suspicion exists of his being involved in the operation of a wood based industry without obtaining license under this Act.
- (2) Every officer making an arrest under this section shall, without unnecessary delay, release the arrested person on bond, or send the person arrested before the magistrate having jurisdiction in the case, or to the Station House Officer of the nearest police station.
22. Power to release an arrested person on bond
Power to release an arrested person on bond.- Any forest officer of the rank not inferior to that of a Assistant Conservator of Forest, who or whose subordinate, has arrested any person under the provisions of section 21, may release such person on his executing a bond to appear, if and when so required, before the magistrate having jurisdiction in the case, or before Station House Officer of the nearest police station.
23. Offence by Companies
Offence by Companies. –
- (1) Where an offence under this Act has been committed by a Company, every person, who at the time of commissioning of the offence was in charge of, and was responsible to, the company for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly. Provided that nothing contained in this sub-section shall render any such person liable to any punishment provided in this Act if he proves that the offence was committed without his knowledge or that he exercised due diligence to prevent the commission of such offence.
- (2) Notwithstanding anything contained in sub-section
- (1) where an offence under this Act has been committed by a company and it is proved that the offence has been committed with the consent or connivance of, or is attributable to any neglect on the part of, any director, manager, secretary, or other officer of the company, such director, manager, secretary or other officer shall also be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly. Explanation. - For the purpose of this Section-
- (a) "company" means any body corporate, and includes a firm or a Co-operative Society or other association of individuals.
- (b) "director" in relation to a firm, also includes a partner/partners in the firm.
24. Burden of Proof
Burden of Proof. –
- (1) Where wood, whether sawn or unsawn, and/or wood or plant produce is recovered from a Wood Based Industry for which no valid license exists in accordance with the provisions of this Act or the rules made there under, it shall be presumed that the Wood Based Industry was in operation until the contrary is proved, burden to proof of which shall lie on the accused.
- (2) Where, in any prosecution for an offence against this Act or the rules made there under, it is established that any wood declared unlawful was seized in the premises of a Wood Based Industry of a person, or at any site where sawing / processing was being done, it shall be presumed that such person has contravened the provisions of this Act or the rules, made thereunder until the contrary is proved, the burden of proving the same shall lie on the accused.
25. Cognizance of offence
Cognizance of offence. - No court shall take cognizance of any offence punishable under this Act except on a report in writing of the facts constituting such offence made by the Licensing Officer or any person duly authorised by the State Government or the Licensing Officer in this behalf.
26. Jurisdiction of court
Jurisdiction of court. - No court inferior to that of a Judicial Magistrate of the first class, shall try offence punishable under this Act.
27. Compounding of offence
Compounding of offence. –
- (1) Forest Officer empowered by the State Government in this behalf may:
- (a) accept from any person, whose license is liable to be revoked or suspended under clause
- (c) of sub-section
- (1) of Section 17 or who is reasonably suspected of having committed for the first time an offence relating to non-submission of return under Section 14 or of non-maintenance of account of stock under Section 15 of this Act or processing of wood/ any other form such as sandal, katha wood, charcoal etc, unlawfully obtained which is less than half a cubic meter in volume, a sum prescribed in the rules made under this Act in lieu of such revocation or suspension or by way of compounding for such offence, as the case may be, and may impose as a penalty a sum prescribed in the rules and shall order confiscation of unlawfully obtained wood and or any other form such as sandal, katha wood, charcoal etc. which was seized.
- (b) in case any property has been seized as liable to confiscation under section 18 of this Act, at any time before an order of confiscation is passed by the competent authority under this Act, release the same on payment of the value as prescribed in the rules.
- (2) On the payment of such sum of money, or such value, or both, as the case may be, to the forest officer, the accused person, if in custody, shall be discharged, the property seized shall be released, and no further proceeding shall be taken against such person or in relation to such property.
- (3) The provision of this section shall not apply to the Wood Based Industry operating without a valid license.
28. Licensing Officer or an authorised person to be a public servant
Licensing Officer or an authorised person to be a public servant. - The Licensing Officer and every officer duly authorised to discharge any duties assigned to him or required under this Act shall be deemed to be a public servant within the meaning of relevant provision of the Bharatiya Nyaya sanhita, 2023.
29. Punishment for wrongful seizure
Punishment for wrongful seizure-Any Forest Officer who vexatiously and unnecessarily seizes any property on the pretence of seizing property liable to confiscation under this Act shall be punishable with a fine of Rs 10000/- (Ten Thousand) which may extend to Rs. 100000/- (One Lakh).
30. Protection of action taken in good faith
Protection of action taken in good faith. - No suit, prosecution or other legal proceedings shall lie against the State Government or any officer or person or authority for anything which is done in good faith or intended to be done in pursuance of the provisions of this Act or any Rules or order made thereunder.
31. Rewards
Rewards. - The Court or the Licensing Officer, as the case may be, may by order permit giving of reward in the shape of an amount which is not more than one-fourth of the amount of fine and/or of the value of the property forfeited and/or confiscated to such person or persons whose information has indisputably led to the detection of the contravention of any of the provisions of this Act or the Rules made thereunder.
32. Power to make Rules
Power to make Rules. –
- (1) The State Government may by notification and subject to the condition of prior publication for the comment of stakeholders make Rules to carry out the purpose of this Act.
- (2) In particular, and without prejudice to the generality of the foregoing power, such Rules may provide for all or any of the following matters, namely-
- (a) The Form in which application shall be made under sub-section
- (3) of Section 10 and the fee and security deposit which shall accompany such application;
- (b) Conditions under sub section
- (5) of section 10 subject to which license may be granted;
- (c) the period for which, the fee on the payment of which and the condition subject to which the license may be renewed under sub-section
- (6) of Section 10;
- (d) the form in which, the officer to whom and the period in which returns shall be submitted under Section 14;
- (e) provisions for installation of electric connection, etc. under sub-section
- (2) of Section 16;
- (f) provisions for utilization of amount realised from the Wood Based Industries, by way of fees/ penalties etc., on execution of schemes for increasing forest/ tree cover in the State.
- (g) any other matter which is required to be or may be regulated.
- (3) Every Rule made under this Act shall be laid, as soon as may be after it is made, before each house of the State Legislature while it is in session for a total period of fourteen days which may be comprised in one session or in more than one successive sessions, and if, before expiry of the session in which it is so laid or the session immediately following, both the Houses agree in making any modification in the Rule or both the Houses agree that the Rule should not be made, the Rule shall thereafter have effect only in such modified form or be of no effect as the case may be.
33. However, any such modification or annulment shall be without prejudice to the validity of anything previously done under that Rule.
Other Acts and laws not to apply to Wood Based Industry Other Acts and laws not to apply to Wood Based Industry. - Nothing contained in any other Act, or Law, Rule, Order or any other thing having a force of law in any area of the State shall apply to the matter relating to Wood Based Industries and processings in respect of which provisions are contained in this Act. Moreover, all the Wood Based Industries will follow all environmental and other regulations prescribed by the State Pollution Control Board, the Central Pollution Control Board and the Ministry of Environment, Forest and Climate Change as applicable to these industries under the Environment (Protection) Act, 1986 and other Central and State Acts and guidelines.
34. Provisions of the Act not applicable on certain activities
Provisions of the Act not applicable on certain activities.- The provisions of this Act or the Rules made thereunder shall not apply to-
- (a) the ordinary operations of carpentry not involved in sawing operations;
- (b) the Wood Based Industry owned by the State Government.
35. Power to make amendments
Power to make amendments. - If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by order, do anything not inconsistent with the provisions of this Act which appear to it to be necessary or expedient for the purpose of removing the difficulty.
36. Provided that no such order shall be made after the expiry of a period of two years from the date of commencement of this Act.
Repeal and Saving Repeal and Saving. –
- (1) The Bihar Saw mills (Regulation) Act, 1990, (as amended from time to time) and the rules made and orders issued thereunder which are contrary to the provisions made in this Act are hereby repealed.
- (2) Notwithstanding such repeal, anything done or any action taken under the said Acts or rules shall be deemed to have been done or taken under this Act, as if this Act, was in force on the date on which such thing or action was done or taken.
37. English version of the Act to prevail in case of any difference between English and Hindi versions
English version of the Act to prevail in case of any difference between English and Hindi versions.- In case of any difference between the English and the Hindi versions of any of the provisions under this Act, the English version will prevail.
