- (1) Any person who establishes or maintains a clinical establishment in contravention of the provision of section 3 or who, being a certificate holder, fails, without reasonable excuse, to keep or affix the certificate of registration in the clinical establishment in contravention of sub-section
- (2) of section 5, shall, on conviction, be punishable with fine which may extend to ten thousand rupees; and where any such person after being convicted under this section for any offence continues to commit the offence or commits it for the second or any subsequent time, he shall be punishable with imprisonment for a term which may extend to three years, or with fine which may extend to twenty thousand rupees, or with both.
- (2) Any person who contravenes any of the provision of this Act other than those mentioned in sub-section (1), shall, on conviction, be punishable with fine which may extend to one thousand rupees and in the case where any such person, after conviction under this sub-section for any offence continues to commit the offence, he shall, on conviction, be punishable with further fine which may extend to one hundred rupees for every day after the first day during which the said contravention is continued.
