(1) No. 22 of 1947: The Central Provinces and Berar Shops and Establishments Act, 1947. (2) No. 7 of 1952: The Madhya Bharat Shops and Establishments Act, Samvat 2009. Amendment 21 of 2014. The Madhya Pradesh Shops and Establishments (Amendment) Act, 2014 An Act further to amend the Madhya Pradesh Shops and Establishment, Act, 1958. Be it enacted by the Madhya Pradesh Legislature in the sixty-fifth year of the Republic of India as follows:— 1. (1) This Act May be called the Madhya Pradesh Shops and Establishments (Amendment) Bill, 2014. (2) It shall come into force on the date of its publication in the Madhya Pradesh Gazette. 2. In section 6 of the Madhya Pradesh Shops and Establishments Act, 1958... in sub-section (3)... Provided that if no adverse order is passed by the Inspector within the prescribed period from the date of submission of application under sub-section (2), then the registration shall be deemed to be duly granted. (3) Notwithstanding anything contained in sub-section (1), no Inspector shall exercise his powers, in an establishment where less than ten employees are employed, except with the permission of the Labour Commissioner or an officer so authorised by him. Provided that the Government, by order may devise or notify consolidated forms for maintaining registers and records in lieu of the forms prescribed above: Provided further that the Government may allow the registers and records to be maintained in computerised or digital formats. 7. In Section 59 of the principal Act, in sub-section (2), in clause (e), for the words “precautions against fire”, the words “precautions against fire and hazards” shall be substituted. 8. (1) The Madhya Pradesh Shops and Establishments (Amendment) Ordinance, 2014 (No. 7 of 2014) is hereby repealed. (2) Notwithstanding the repeal of the said Ordinance, anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under the corresponding provision of this Act. Amendment 20 of 2025. The Madhya Pradesh Shops and Establishments (Amendment) Act, 2025 An Act further to amend the Madhya Pradesh Shops and Establishments Act, 1958. Be it enacted by the Madhya Pradesh Legislature in the Seventy-Sixth year of the Republic of India as follows :- 1. (1) This Act may be called the Madhya Pradesh Shops and Establishments (Amendment) Act, 2025. (2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette. 2. In Section 11 of the Madhya Pradesh Shops and Establishments Act, 1958 (No. 25 of 1958), in sub-section (2), for the words "six hours in any week" the words "one hundred forty four hours in any quarter" shall be substituted. 3. In Section 16 of the principal Act, in sub-section (2), for the words "six hours in any week" the words "one hundred forty four hours in any quarter" shall be substituted. 4. In Section 21 of the principal Act, in sub-section (2), for the words "six hours in any week" the words "one hundred forty four hours in any quarter" shall be substituted. Amendment 25 of 2025. The Madhya Pradesh Shops and Establishments (Second Amendment) Act, 2025 An Act further to amend the Madhya Pradesh Shops and Establishments Act, 1958. Be it enacted by the Madhya Pradesh Legislature in the seventy-sixth year of the Republic of India as follows:— 1. (1) This Act may be called the Madhya Pradesh Shops and Establishments (Second Amendment) Act, 2025. (2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette. 2. In Section 2 of the Madhya Pradesh Shops and Establishments Act, 1958 (No. 25 of 1958),- (i) after clause (1), the following clause shall be inserted, namely:- "(1A) "central inspection system" means the online, computerized platform notified by the state Government for scheduling, allocating, conducting and monitoring inspections under this Act;". (ii) after clause (19), the following clause shall be inserted, namely:- "(19A) "portal" means the online website notified by the Department of Labour of the Government of Madhya Pradesh;". (iii) for clause (20), the following clause shall be substituted, namely:- "(20) "register of establishments" means "collation of the portal generated registration certificates issued under this Act". (iv) for clause (21), the following clause shall be substituted, namely:- "(21) "registration certificate" means a digital certificate generated by the portal;". (i) for clause (a) of sub-section (1), the following clause shall be substituted, namely:- "(a) enter, at all reasonable times and with such assistants, if any, being person in the service of the Government or of any local authority, as he thinks fit, any place which is or which he has reasons to believe is an establishment allotted by central inspection system;". (ii) For sub-section (3), the following sub-section shall be substituted, namely:- "(3) Notwithstanding anything contained in sub-section (1), no inspector shall exercise his powers, in an establishment where not more than twenty employees are employed, except with the permission of the Labour Commissioner or an officer so authorised by him.". 3. For Section 33 of the principal Act, the following section shall be substituted: [See Section 33 in Principal Act] 4. In Section 41 of the principal Act, after sub-section (2), the following new sub-section shall be added: 5.
