The Madhya Pradesh Aviation (Non-Gazetted) Service Recruitment Rules, 1990
1. Short title
Short title —These rules may be called the Madhya Pradesh Aviation (Non-Gazetted) Service Recruitment Rules, 1990
2. Definitions
Definitions —In these rules, unless the context otherwise, requires; —
- (a) "Appointing Authority" in respect of the service means the Director of Aviation;
- (b) "Board" means the Madhya Pradesh Junior Service Selection Board;
- (c) "Examination" means competitive Examination for recruitment to the Service to be held under Rule 11 of these rules;
- (d) "Schedule" means a schedule appended to these rules;
- (e) "Schedule Caste" means any caste race or tribe or part of or group within a caste race or tribe specified as Scheduled Castes with respect to the State of Madhya Pradesh under Article 341 of the Constitution of India;
- (f) "Schedule Tribes" means any tribe or part of group within a caste or tribe specified as Scheduled Tribes with respect to the State of Madhya Pradesh under Article 342 of the constitution of India.
- (g) "Service" means the Madhya Pradesh Aviation (Non-Gazetted Service).
3. Provided that the Government may, from time to time, add to or reduce the number of posts included in the service, either on a permanent or temporary basis.
Scope and Application Scope and Application.—Without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Service (General Conditions of Service) Rules, 1961, these rules shall apply to every member of the Service.
4. Constitution of the Service
Constitution of the Service. —The service shall consist of the following persons namely; —
- (1) persons, who at the time of Commencement of these rules, are holding substantively or in officiating capacity the posts specified in Schedule-I;
- (2) Persons recruited to the service before the commencement of these rules; and
- (3) Persons recruited to the service in accordance with the provision of these rules.
5. Classification, Scale of Pay etc
Classification, Scale of Pay etc.—The classification and the number of posts included in the service and the scale of pay attached thereto, shall be in accordance with the provisions contained in the Schedule-I;
6. Method of recruitment
Method of recruitment —(1) Recruitment to the service after the commencement of these rules, shall be made by the following Methods, namely:
- (a) by direct recruitment by selection by competitive examination or interviews;
- (b) by promotion of the members of the service as specified in column
- (2) of Schedule-IV;
- (c) by transfer of person who hold in a substantive capacity such posts in such service as may be specified in this behalf.
- (2) The number of persons recruited under clause (b) or clause (c) of sub-rule (1) shall not at any time, exceed the percentage shown in schedule II of the number of duty posts as specified in schedule-I.
- (3) Subject to the provisions of these rules, the method or methods of recruitment to be adopted for the purpose of filling any particular vacancy or vacancies in the Service as may be required to be filled during any particular period of recruitment and the number of person to be recruited by each method shall be determined on each occasion by the Appointing Authority in consultation with the Government.
- (4) Notwithstanding anything contained in sub-rule (1) if in the opinion of the Appointing Authority, the exigencies of the Service so requires, it may (through the Administrative Department) after approval of the Government and with prior concurrence of the General Administration Department adopt such methods of recruitment to the service other than those specified in said sub-rule as it may, by order issued in this behalf, prescribe.
7. Appointment to the Service
Appointment to the Service:—All appointments to the service after the commencement of these rules, shall be made by the Appointing Authority and no such appointment shall be made except after selection by one of the methods of recruitment specified in rule 6.
8. Conditions of eligibility for direct recruitment
Conditions of eligibility for direct recruitment:—(1) In order to be eligible a candidate must satisfy the following conditions, namely:—
- (a) have attained the age as specified in column
- (3) of Schedule-III and not obtained the age specified in column
- (4) of the said schedule on the 1st day of January next following the date of commencement of the examination/selection.
- (b) The upper age limit shall be relaxed upto a maximum of 5 years if a candidate belongs to Scheduled Caste or a Scheduled Tribe;
- (c) The upper age limit shall also be relaxed in respect of candidates who are or have been employees in the Madhya Pradesh Government to the extent and subject to the condition specified below :—
- (i) A candidate who is a permanent Government Servant should not be more than 38 years of age:
- (ii) A candidate who is temporary Government Servant and applying for another post should not be more than 38 years of age: (This concession shall also be admissible to the contingency paid employees, work charged employees and employees working in project implementing Committees);
- (iii) A candidate who is a retrenched Government servant shall be allowed to deduct from his age, the period of all temporary service previously rendered by him upto a maximum limit of 3 years even if it represents more than one spell, provided that the resultant age does not exceed the upper age limit by more than three years. Explanation.—The term 'retrenched Government servants' denotes a person who was in temporary Government service of the State or of any of the constituent units, for a continuous period of not less than six months and who was discharged because of reduction in establishment not more than three years prior to the date of his registration at the Employment Exchange or of application made otherwise for employment in Government service:
- (iv) A candidate who is an Ex-servicemen shall be allowed to deduct from his age the period of all defence service previously rendered by him, provided that the resultant age does not exceed the upper age limit by more than three years. Explanation.—The term "Ex-servicemen" denotes a person who belonged to any of the following categories and who was employed under the Government of India for a continuous period of not less than six months and who retrenched surplus as a result of the recommendation of the economic unit or due to normal reduction in the Establishment, not more than three years before the date of his registration at any employment exchange or application made otherwise for employment in Government services:—
- (i) Ex-servicemen enrolled for the second time and discharged on released under mustering and concessions ;
- (ii) Ex-servicemen enrolled for the second time and discharged on :—
- (a) Completion of short term engagement;
- (b) fulfilling the conditions of enrolment;
- (iii) Ex-personnel of Madras Civil Unit;
- (iv) Officers (Military and Civil) discharged on completion of their contract (including short service regular commissioned officers);
- (v) Officers discharged after working for more than six months continuously against leave vacancies;
- (vi) Ex-servicemen invalided out of service;
- (vii) Ex-servicemen discharged on the ground that they are unlikely to become efficient soldiers;
- (viii) Ex-servicemen who are medically boarded out on account of gunshot wounds etc:
- (d) The upper age limit for widow candidates shall be 35 years:
- (e) The upper age limit shall be relaxed upto a maximum of 2 years for those candidates who are holding green cards under the Family planning welfare Programme:
- (f) The upper age limit shall be relaxed upto five years in respect of awarded superior caste partner of a couple under the Inter-Caste Marriage incentive programme of the Tribal, Harijan and Backward classes Welfare Department ;
- (g) The upper age limit shall also be relaxed upto five years in respect of the "Vikram Award" holders candidate; Note.—Candidates who are admitted to the examination selection under the age concessions mentioned in sub-clause (c)
- (i) and (ii) above shall not be eligible for appointment if after submitting the application, they resign from service either before or after examination/selection. They shall however, continue to be eligible if they are retrenched from the service or post after submitting the application. Departmental candidates must obtain previous permission of the Appointing Authority to appear for the selection.
- (II) Educational qualifications.—The candidates must possess the educational qualifications prescribed for the service as shown in column
- (5) of Schedule III. Provided that;— In exceptional cases, the Board may, on the recommendation of the Director, treat as qualified a candidate, who, though not possessing any of the qualifications prescribed in this clause, has passed the examinations conducted by other Universities/Institutions by a standard, which, in the opinion of the Board justifies the consideration of the candidate for appearing in the examination/selection; and Candidates who are otherwise qualified but have taken degree from foreign universities being universities not specifically recognised by the Government may also be considered for appearing in the examination at the discretion of the Board.
- (III) Fees.—The candidates must pay the fees prescribed by the Appointing Authority/Board.
9. Disqualifications
Disqualifications.—Any attempt on the part of a candidate to obtain support for his candidature by any means, may be held by the Board to be disqualification for selection.
10. Boards decision as to eligibility of candidate shall be final
Boards decision as to eligibility of candidate shall be final.—The decision of the Board as to the eligibility or otherwise of the candidate for admission to examination/selection shall be final and no candidate to whom a certificate of admission has not been issued shall be allowed to appear in examination/interview.
11. Direct Recruitment by Competitive examination
Direct Recruitment by Competitive examination.—(1) A competitive examination for direct recruitment to the service shall be held at such intervals as, the Appointing Authority may, in consultation with the Board, from time to time, determine.
- (2) The examination shall be conducted by the Board in accordance with such orders, as the Appointing Authority may, from time to time issue in consultation with the Board.
- (3) 16 percent and 20 percent of the available vacancies for direct recruitment shall be reserved for candidates who are members of the Scheduled Castes and Scheduled Tribes respectively. In filling the vacancies so reserved, Candidates, who are members of the Scheduled Castes and the Scheduled Tribes, shall be considered for appointment in order in which the names appear in the list referred to in rule 12 irrespective of their relative rank as compared with other candidates.
- (4) Candidates belonging to the Scheduled Castes or Scheduled Tribes recommended by the Board for appointment to the service, with due regard to maintenance of the efficiency of Administration may appointed to the vacancies reserved for the candidates of the Scheduled Castes or the Schedule Tribes, as the case may be, under sub-rule (3).
- (5) If sufficient number of candidates belonging to the Scheduled Castes and Scheduled Tribes are not available for filling all the vacancies reserved for them, the remaining vacancies shall be re-advertised twice exclusively for these candidates, if even after re-advertisement any vacancies remain unfilled they shall be filled from among the general candidates and an equivalent number of additional vacancies shall be reserved for candidates belonging to the Scheduled Castes and Scheduled Tribes as the case may be, during the subsequent examination/selection: Provided that the total number of vacancies reserved for the candidates belonging to the Scheduled Castes and Scheduled Tribes (including the vacancies carried forward), shall not at any time exceed 45 percent of the total vacancies advertised.
12. Direct recruitment by selection
Direct recruitment by selection.--(1) Selection for recruitment to the service shall be held at such intervals as the Appointing Authority may, in consultation with the Board, from time to time determine.
- (2) The selection of candidates for the service shall be made by the Board after interviewing them.
- (3) 16 percent and 20 percent of the available vacancies for direct recruitment shall be reserved for candidates who are members of Scheduled Castes and Scheduled Tribes respectively.
- (4) In filling the vacancies so reserved candidates who are members of the Scheduled Castes and the Scheduled Tribes shall be considered for appointment in the order, in which their names appear in the list referred to in rule 13 irrespective of their relative rank as compared with other candidates.
- (5) Candidates belonging to the Scheduled Castes and Scheduled Tribes, selected by the Board to be suitable for appointment to the service with due regard to the maintenance of efficiency in administration, may be appointed to the vacancies reserved for the candidates of the Scheduled Castes and the Scheduled Tribes, as the case may be under sub-rule (3).
13. List of candidates recommended by the Board
List of candidates recommended by the Board.--(1) The Board shall forward to the Appointing Authority a list arranged in order of merit of the candidates who have qualified by such standard as determined by the Board and of candidates belonging to the Scheduled Castes and Scheduled Tribes who though not qualified by that standard are declared by the Board to be suitable for appointment to the service with due regard to the maintenance of efficiency in administration. The list shall also be published for general information.
- (2) Subject to the provisions of these rules and of the Madhya Pradesh Civil Services (General Conditions of Service) Rules 1961, candidates shall be considered for appointment to the available vacancies from the list in the order in which their names appear in the list.
- (3) The inclusion of a candidate's name in the list confers no right to appointment unless the Appointing Authority is satisfied after such enquiry as may be considered necessary, that the candidate is suitable in all respects for appointment to the service.
14. Appointment by Promotion
Appointment by Promotion.--(1) There shall be constituted a Departmental Promotion Committee consisting of the members mentioned in Schedule IV for making preliminary selection for promotion of eligible candidates.
- (2) The committee shall meet at intervals ordinarily not exceeding one year.
- (3) 16 percent and 20 percent of the vacancies available for promotion in which the percentage of promotion is 33 or more as specified in Schedule II, shall be reserved for the employees belonging to Scheduled Castes and Scheduled Tribes respectively who are eligible for promotion in accordance with the provisions of rule 15. Provided that the appointment to the vacancies reserved shall be in accordance with the instructions issued by the Government in the General Administration Department from time to time. Provided further that any junior person shall not be considered for selection-grade/promotion in preference to the person senior to him only on the basis of his completing the prescribed qualifying service.
15. Condition for eligibility for promotion/transfer
Condition for eligibility for promotion/transfer.--(1) Subject to the provision of sub-rule (2), the committee shall consider the cases of all persons, who on the first day of January of that year had completed not less than such number of year of service (whether officiating or substantive) in the posts from which promotion is to be made as specified in column
- (4) of Schedule IV and are within the zone of consideration in accordance with the provisions of sub-rule (2). Provided that the services of the released officers of the Emergency Commission and Short Service Commission, after their appointment in the service, shall be counted from the date from which they have been appointed in the service in accordance with the General Administration Department Memo No. 2260/987/10/67, dated the 21st October, 1967.
- (2) The field of selection, shall ordinarily be limited to 5 times the number of officers to be included in the select list, in respect of posts filled on the basis of merit-cum-suitability and 3 times the number of officers to be included in the select list in respect of posts filled on the basis of seniority-cum-merit: Provided that if the required number of suitable employees are not available in the field, so determined, the field may be enlarged to the extent considered necessary by the committee by specific record of reasons for such enlargement in the records of all persons included in the committee proceedings.
16. List of suitable persons
List of suitable persons.--(1) The committee shall prepare a separate list for persons belonging to Scheduled Caste and Scheduled Tribes and other persons who satisfy the condition prescribed in rule 15 above and as are held by the committee to be suitable for promotion/transfer to the service. The list shall be sufficient to cover the anticipated vacancies on account of retirement promotion etc.
- (2) The selection for inclusion in such list shall be based on merit and suitability in all cases except for promotion by seniority-cum-merit.
- (3) The names of the officers included in the list shall be arranged in order to seniority in the service or posts, as specified in column
- (2) of Schedule IV.
- (4) The select list shall ordinarily be in force until it is reviewed or revised in accordance with rule (4) of 11 but its validity shall not be extended beyond a total period of 18 months from the date of its preparation: Provided that in the event of any grave lapse in the conduct or performance of duties on the part of any person included in the select list a special review of the select list may be made at any time by the Appointing Authority in consultation with the Departmental Promotion Committee to review and remove the name of such person from the select list.
17. Appointment from the select list
Appointment from the select list.--(1) Appointment to the service from the select list on the posts in the service shall follow the order in which the names of such employees appear in the select list.
Provided that where administrative exigencies so require, a member of the service not included in the select list or who is junior to other persons included in the select list, may be appointed to the service if the Appointing Authority is satisfied as to the vacancies are likely to last for a period not more than three months.
