The Kerala State Commission for Economically Backward Classes Among Forward Communities Act, 2015
1. Short title and commencement
(1) This Act may be called the Kerala State Commission for Economically Backward Classes among Forward Communities Act, 2015. (2) It shall be deemed to have come into force on the 16th day of May, 2015.
2. Definitions
In this Act, unless the context otherwise requires,— (a) "Commission" means the Kerala State Commission for economically backward classes among Forward Communities constituted under section 3; (b) "Forward Community" means any community included in the list of forward communities identified by the Commission under clause (a) of section 9 which is published by the Government by notification in the Gazette; (c) "Government" means the Government of Kerala; (d) "Member" means a member of the Commission and includes the Chairperson; (e) "prescribed" means prescribed by rules made under this Act.
3. Constitution of the Commission
(1) The Government shall, by notification in the Gazette, constitute a body to be known as the Kerala State Commission for Economically Backward Classes among Forward Communities to exercise the powers conferred on, and to perform the functions assigned to, it under this Act. (2) The Commission shall consist of a Chairman and not more than two other members to be appointed by the Government: Provided that at least one of the members shall be a person who belongs to the economically backward classes among forward communities. (3) The Chairman and members shall be persons of ability, integrity and standing who have served in Government or in academic or social fields with distinction.
4. Term of office and conditions of service of Chairman and members
(1) The Chairman and every member shall hold office for a term of three years from the date he assumes office. (2) The Chairman or a member may, by writing under his hand addressed to the Government, resign from the office of Chairman or, as the case may be, of the member at any time. (3) The Government shall remove a person from the office of the Chairman or a member if he— (a) becomes an undischarged insolvent; (b) is convicted and sentenced to imprisonment for an offence which, in the opinion of the Government, involves moral turpitude; (c) becomes of unsound mind and stands so declared by a competent court; (d) refuses to act or becomes incapable of acting; (e) is, without obtaining leave of absence from the Commission, absent from three consecutive meetings of the Commission; or (f) has, in the opinion of the Government, so abused the position of Chairman or member as to render that person's continuance in office detrimental to the interests of the economically backward classes among forward communities or the public interest: Provided that no person shall be removed under this clause until that person has been given a reasonable opportunity of being heard in the matter. (4) A vacancy caused under sub-section (2) or otherwise shall be filled by fresh nomination or appointment and the person so nominated or appointed shall hold office for the remaining period of the term of the person in whose place he has been so nominated or appointed. (5) The salaries and allowances payable to, and the other terms and conditions of service of, the Chairman and members shall be such as may be prescribed.
5. Appointment of officers and employees of the Commission
(1) The Government may, appoint the following officers and employees necessary for the proper management of the Commission, namely:— (a) a Law Officer not below the rank of Joint Secretary to Government from the Law Department; (b) a Finance Officer from the Finance Department not below the rank of Joint Secretary to Government; and (c) such other officers and employees as may be prescribed and considered necessary for assisting the Commission to exercise the powers and perform the functions under this Act. (2) The salary and allowances payable to, and other terms and conditions of service of, the officers and employees of the Commission shall be such as may be prescribed. (3) Appointment of officers and employees may be made by the Government initially through deputation when the Commission is constituted and starts functioning. (4) The rules applicable to the Government employees in respect of the method of appointment, salary and allowances, discipline and other conditions of service shall be applicable to the officers and employees of the Commission.
6. കമ്മീഷന്റെ കാലയളവും സേവന വ്യവസ്ഥകളും
(1) കമ്മീഷൻ ചെയർപേഴ്സൺ അല്ലെങ്കിൽ അംഗമായി നിയമിക്കപ്പെടുന്ന വ്യക്തിയുടെ ഭരണകാലം, അദ്ദേഹം ചുമതലയേൽക്കുന്ന തീയതി മുതൽ 3 വർഷമായിരിക്കും. (2) കമ്മീഷന്റെ ചെയർപേഴ്സണും അംഗങ്ങൾക്കും നൽകേണ്ടതായ ശമ്പളവും ബത്തകളും സേവനത്തിനായുള്ള മറ്റ് നിബന്ധനകളും വ്യവസ്ഥകളും നിർണ്ണയിക്കപ്പെടാവുന്ന പ്രകാരമായിരിക്കും.
7. Vacancies etc., not to invalidate proceedings of the Commission
No act or proceeding of the Commission shall be invalid on the ground of any defect in the constitution of the Commission or the existence of any vacancy in the Commission.
8. Procedure to be regulated by the Commission
(1) The Commission shall meet as and when necessary at such time and place as the Chairperson thinks fit: Provided that such meeting shall be held at least once in three months. (2) The Commission shall have the power to regulate its own procedure. (3) All orders and decisions of the Commission shall be authenticated by the Member-Secretary or any other officer of the Commission duly authorised in writing in this behalf by the Member-Secretary.
9. കമ്മീഷന്റെ ചുമതലകൾ
കമ്മീഷൻ താഴെപ്പറയുന്ന ചുമതലകൾ നിർവ്വഹിക്കേണ്ടതാണ്, അതായത്:— (എ) കേരള സംസ്ഥാനത്തിലെ മുന്നോക്ക വിഭാഗങ്ങളെ കണ്ടെത്തി ഒരു ലിസ്റ്റ് തയ്യാറാക്കി സർക്കാരിന് സമർപ്പിക്കുക; (ബി) മുന്നോക്ക വിഭാഗങ്ങളിലെ സാമ്പത്തികമായി പിന്നോക്കം നിൽക്കുന്നവരുടെ പ്രശ്നങ്ങൾ പഠിക്കുകയും അപഗ്രഥിക്കുകയും ക്ഷേമകാര്യങ്ങൾ ശിപാർശ ചെയ്യുകയും ചെയ്യുക; (സി) മുന്നോക്ക വിഭാഗമായി ഉൾപ്പെടുത്താനുള്ള ഏതെങ്കിലും വിഭാഗത്തിന്റെ അർത്ഥനകൾ പരിശോധിക്കുകയും അതു സംബന്ധിച്ച പരാതികൾ കേൾക്കുകയും ഉചിതമെന്നു തോന്നുന്ന ഉപദേശം സർക്കാരിന് നൽകുകയും ചെയ്യുക; (ഡി) മുന്നോക്ക വിഭാഗങ്ങളുടെ സാമൂഹിക സാമ്പത്തിക വികസനത്തിനുള്ള ആസൂത്രണ നടപടികളിൽ പങ്കെടുക്കുകയും ഉപദേശിക്കുകയും സംസ്ഥാനത്ത് അവരുടെ വികസനത്തിലുണ്ടായ പുരോഗതി വിലയിരുത്തുകയും ചെയ്യുക; (ഇ) മുന്നോക്ക വിഭാഗങ്ങളുടെ ക്ഷേമത്തിനും സാമൂഹിക സാമ്പത്തിക പുരോഗതിക്കും ആവശ്യമായ വ്യവസ്ഥകളും മറ്റ് നടപടികളും ഫലവത്തായി നടപ്പാക്കുന്നതിനുവേണ്ടി സർക്കാർ കൈക്കൊള്ളേണ്ട നടപടികളെ സംബന്ധിച്ച ശിപാർശകൾ നൽകുകയും വാർഷികമായോ കമ്മീഷൻ യുക്തമെന്നു കരുതുന്ന സമയത്തോ സർക്കാരിന് റിപ്പോർട്ട് നൽകുകയും ചെയ്യുക; (എഫ്) മുന്നോക്ക വിഭാഗങ്ങളുടെ സാമൂഹികവും സാമ്പത്തികവും വിദ്യാഭ്യാസപരവുമായ പുരോഗതിയുമായി ബന്ധപ്പെട്ട പ്രശ്നങ്ങളെ സംബന്ധിച്ച് പഠനം, ഗവേഷണം, വിശകലനം എന്നിവ നടത്തുക; (ജി) മുന്നോക്ക വിഭാഗങ്ങളെ സംബന്ധിച്ച് സർക്കാർ സ്വീകരിക്കേണ്ട യുക്തമായ നടപടികൾ നിർദ്ദേശിക്കുക; (എച്ച്) മുന്നോക്ക വിഭാഗങ്ങളെ സംബന്ധിക്കുന്ന ഏതെങ്കിലും കാര്യത്തെ സംബന്ധിച്ച്, പ്രത്യേകിച്ച് അവർ അഭിമുഖീകരിക്കുന്ന വൈഷമ്യങ്ങളെ സംബന്ധിച്ച്, സർക്കാരിന് കാലാകാലങ്ങളിലോ പ്രത്യേകം റിപ്പോർട്ട് സമർപ്പിക്കുക; (ഐ) മുന്നോക്ക വിഭാഗങ്ങളുടെ സംരക്ഷണവും ക്ഷേമവും വികസനവും ഉന്നമനവുമായി ബന്ധപ്പെട്ട് നിർണ്ണയിക്കപ്പെടാവുന്ന പ്രകാരമുള്ള അങ്ങനെയുള്ള മറ്റ് ചുമതലകൾ നിർവ്വഹിക്കുക; (ജെ) മുന്നോക്ക വിഭാഗങ്ങളുമായി ബന്ധപ്പെട്ട് സർക്കാർ ഏൽപിച്ചു കൊടുക്കുന്ന മറ്റേതെങ്കിലും കാര്യം ചെയ്യുക.
10. സർട്ടിഫിക്കറ്റ്
സംസ്ഥാന മുന്നോക്ക വിഭാഗങ്ങളിലെ സാമ്പത്തികമായി പിന്നോക്കം നിൽക്കുന്ന വിഭാഗങ്ങൾക്ക് വേണ്ടിയുള്ള കമ്മീഷന്റെ ശിപാർശ പ്രകാരം, സംസ്ഥാനത്ത് താമസിക്കുന്ന മുന്നോക്ക വിഭാഗത്തിൽ പെടുന്നവർക്ക് സർക്കാർ നിർണ്ണയിക്കപ്പെടാവുന്ന രീതിയിലും ഫോറത്തിലും മുന്നോക്ക സമുദായ സർട്ടിഫിക്കറ്റ് നൽകേണ്ടതാണ്.
11. റിപ്പോർട്ട് വയ്ക്കൽ
സർക്കാർ, 9-ാം വകുപ്പ് (ഇ) ഖണ്ഡത്തിൽ പരാമർശിക്കുന്ന പ്രകാരമുള്ള റിപ്പോർട്ടുകൾ, അതിന്മേലെടുത്തതോ എടുക്കുവാൻ ഉദ്ദേശിക്കുന്നതോ ആയ നടപടിയും ശിപാർശകൾ സ്വീകരിക്കാതിരിക്കാനുള്ള കാരണങ്ങൾ, എന്തെങ്കിലുമുണ്ടെങ്കിൽ, അതും വിശദമാക്കി കൊണ്ട്, നിയമസഭ മുമ്പാകെ വയ്പ്പിക്കേണ്ടതാണ്.
12. Powers of the Commission
(2) The Commission may, for the purpose of taking evidence in connection with enquiries, utilise the services of any officer of the Government or investigation agency.
(3) The officer or investigation agency, whose services have been utilised under sub-section (2), shall take evidence after making enquiry regarding it and the report thereon shall be submitted to the Commission within the period fixed by the Commission in this behalf.
(4) The Commission shall satisfy itself regarding the correctness of any inferences arrived at in the report or facts in the report submitted under sub-section (3) and for this purpose it may conduct enquiry as it deems fit, including the examination of the person who had taken the evidence or assisted for the same.
13. Statements given by persons to the Commission
The statement given by a person about himself at the time of giving evidence before the Commission, shall not be used against the said person in the proceedings before any civil court or criminal court, except in prosecution proceedings for giving false evidence by such statement:
Provided that such statement shall be,—
(a) given as a reply to a question which is required by the Commission to be answered by that person;
(b) relevant to the subject matter in which the evidence is taken by the Commission.
14. Persons likely to be prejudicially affected to be heard
If, at any stage of the inquiry the Commission— (a) considers it necessary to inquire into the conduct of any person; or (b) is of the opinion that the reputation of any person is likely to be prejudicially affected by the inquiry, the Commission shall give to that person a reasonable opportunity of being heard in the inquiry and to produce evidence in his defence.
15. Grants by the Government
(1) The Government shall, after due appropriation made by the State Legislature by law in this behalf, pay to the Commission, by way of grants, such sums of money, which is considered to be necessary for being utilised for the purposes of this Act.
(2) The Commission may spend such sums, out of grants, as it thinks fit, for performing the functions under this Act and such sums shall be treated as expenditure payable out of the grants referred to in sub-section (1).
16. Accounts and Audit
(1) The Commission shall maintain proper accounts and other relevant records and prepare an annual statement of accounts in such form as may be prescribed.
(2) The accounts of the Commission shall be audited annually by the auditor entrusted by the Comptroller and Auditor General in this behalf.
(3) All the accounts and other records of the Commission shall be made available to the auditor for the purpose of the audit.
17. Annual report
The Commission shall prepare, in such form and at such time for each financial year as may be prescribed, its annual report, giving a full account of its activities during the previous financial year and forward a copy thereof to the Government.
18. Audit report to be laid before the Legislature
The Government shall cause the audit reports to be laid, as soon as may be, after they are received, before the Legislative Assembly.
19. Chairperson, Members and staff of the Commission to be public servants
The Chairperson, Members, officers and other employees of the Commission shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code, 1860 (Central Act 45 of 1860).
20. Power to make rules
(1) The Government may, by notification in the Gazette, make rules for carrying out the purposes of this Act, either prospectively or retrospectively.
(2) In particular, and without prejudice to the generality of the foregoing powers, such rules may provide for all or any of the following matters, namely:—
(a) salaries and allowances payable to, and the other terms and conditions of service of, the Chairperson and Members under sub-section (5) of section 4 and of officers and other employees under sub-section (2) of section 5;
(b) the manner and form of issuing forward community certificate by the Government under section 10;
(c) any other matter under clause (f) of section 12;
(d) the form of annual statement of accounts to be prepared under sub-section (1) of section 16;
(e) the form in, and time at which the annual report shall be prepared under section 17;
(f) any other matter which is to be, or may be, prescribed.
(3) Every rule made under this Act shall be laid, as soon as may be after it is made, before the Legislative Assembly while it is in session for a total period of fourteen days which may be comprised in one session or in two successive sessions, and if, before the expiry of the session in which it is so laid or the session immediately following, the Legislative Assembly makes any modification in the rule or decides that the rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule.
21. Power to remove difficulties
If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Gazette, make such provisions, not inconsistent with the provisions of this Act, as appear to them to be necessary or expedient for removing the difficulty. No suit, prosecution or legal proceeding shall lie against the Chairperson or any member of the Commission or any officer or any employee acting under the instructions of the Commission for anything which is done or intended to be done in good faith under this Act.
22. Repeal and saving
(1) The Kerala Reservation in Admission to Private Self-Financing Medical and Dental Colleges Ordinance, 2016 (2 of 2016) is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under this Act. (1) If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Gazette, make provisions not inconsistent with the provisions of this Act which appear to it to be necessary or expedient, for removing the difficulty:
Provided that no such order shall be made after the expiry of a period of two years from the date of commencement of this Act.
(2) Every order made under this section shall, as soon as may be after it is made, be laid before the Legislative Assembly.
23. Repeal and saving
(1) 2015-ലെ മുന്നോക്ക വിഭാഗങ്ങൾക്കു വേണ്ടിയുള്ള കേരള സംസ്ഥാന കമ്മീഷൻ ഓർഡിനൻസ് (2015-ലെ 9) ഇതനാൽ റദ്ദാക്കിയിരിക്കുന്നു. (2) അങ്ങിനെ റദ്ദാക്കിയിരുന്നാൽത്തന്നെയും, പ്രസ്തുത ഓർഡിനൻസ് പ്രകാരം ചെയ്തതോ ചെയ്തതായി കരുതപ്പെടുന്നതോ ആയ ഏതെങ്കിലും കാര്യമോ എടുത്തതോ എടുത്തതായി കരുതപ്പെടുന്നതോ ആയ ഏതെങ്കിലും നടപടിയോ ഈ ആക്റ്റ് പ്രകാരം ചെയ്തതായോ എടുത്തതായോ കരുതപ്പെടേണ്ടതാണ്. 2015 ഡിസംബർ മാസം 16-ാം തീയതി കേരള സംസ്ഥാന നിയമസഭ ഈ ബിൽ പാസ്സാക്കി.
