Highway deemed to be Government property

Notwithstanding anything contained in any other law for the time being in force all lands forming part of a highway which has not already been vested in the Government shall, for the purpose of this chapter, be deemed to be Government property. Where, in contravention of sub-section (1), any damage has been caused to any highway, the highway authority shall have the damage repaired and the expenses involved, together with fifteen per cent overhead charges, shall, without prejudice to any other action that may be taken against the person responsible for the contravention, be recovered from him in such manner as may be prescribed.
