1. Interpretation-clause
In this Act, unless there shall be something repugnant in the subject or context,— "Book" includes every volume, part or division of a volume, and pamphlet, in any language, and every sheet of music, map, chart or plan separately printed: "Editor" means the person who controls the selection of the matter that is published in a newspaper: "Magistrate" means any person exercising the full powers of a Magistrate, and includes [a Presidency Magistrate] also: "Newspaper" means any printed periodical work containing public news or comments on public news: "Paper" means any document, and includes any newspaper as defined in this Act: "Prescribed" means prescribed by rules made by the Central Government under section 20A: "Press Registrar" means the Registrar of newspapers for India appointed by the Central Government under section 19A and includes any other person appointed by the Central Government to perform all or any of the functions of the Press Registrar: "Printing" includes cyclostyling and printing by lithography: "Register" means the Register of newspapers maintained under section 19B. (2) In this Act, any reference to any legislation which is not in force in the State of Jammu and Kashmir shall, in relation to that State, be construed as a reference to the corresponding legislation in force in that State.
2. Act not to extend to certain books [Repealed]

3. Particulars to be printed on books and papers
[Content as per original Act to be inserted] Every book or paper printed within [India] shall have printed legibly on it the name of the printer and the place of printing, and (if the book or paper be published) the [name] of the publisher and the place of publication.
4. Keeper of printing-press to make declaration
[Content as per original Act to be inserted] (1) Every person who shall keep in his possession any printing-press shall, year by year, make, and subscribe before the [District, Presidency or Sub-divisional Magistrate] within whose local jurisdiction such press may be, the following declaration:— "I, A.B., declare that I have a press which is situated at............". And the last mentioned place of holding shall be specified in the said declaration, and shall be filled up in the said place where such printing-press is stationed. (2) As often as the place where a printing-press is kept is changed, a new declaration shall be necessary: Provided that where the change is for a period not exceeding thirty days and the place where the printing-press is kept is in the same District, Presidency or Sub-divisional Magistrate's local jurisdiction as specified in sub-section (1), no new declaration shall be necessary if— (a) the change is notified to the concerned Magistrate within twenty-four hours of the change: and (b) the keeper of the printing-press continues to reside at the place.
5. Rules as to publication of newspapers
(1) Without prejudice to the provisions of section 3, every copy of every such newspaper shall contain the name of the owner and editor thereof and also the date of its publication. (2) Every such newspaper shall be printed or published under the declaration of the printer or publisher, or by the authorised agent of such person (in accordance with the rules made under section 20), before the District, Presidency or Sub-divisional Magistrate, within whose local jurisdiction such newspaper shall be printed or published, and shall make and sign the following declaration: “I, A.B., declare that I am the printer or publisher (or printer and publisher) of the newspaper entitled ........... and printed or published (or printed and published) at ........... (place).” And in the first line of the form of said declaration, all fields regarding where it is printed or published will be filled correctly and accurately. (2A) In every declaration under sub-section (2), the name of the newspaper, the language in which it is published and its periodicity shall be specified and it shall also include such other details as may be prescribed. (2B) Where the printer or publisher of a newspaper making a declaration under sub-section (2) is not the owner thereof, such declaration shall specify the name of the owner and shall also be accompanied by an authority in writing from the person so authorised to make and sign the declaration. (2C) It shall be necessary to make a declaration under sub-section (2) and to have it authenticated under section 6 regarding such newspaper before publishing such newspaper. (2D) Where there is a change in the name of the newspaper, its language or its periodicity, the declaration shall become void and a new declaration shall be required before continuing the publication of the newspaper. (2E) A new declaration shall be required as many times as there is a change in the ownership of the newspaper. (3) A new declaration shall be required as many times as there is a change in the place of printing or publication: Provided that where such change is for a period not exceeding thirty days and the place of printing or publication after the change is within the local jurisdiction of the Magistrate specified in sub-section (2), no new declaration shall be required if— (a) within twenty-four hours of the change, information about the change is given; and (b) the printer or publisher or printer and publisher of the newspaper remains the same person. (4) Every printer or publisher who has made the declaration shall, as many times as he goes out of India for a period exceeding thirty days or where such printer or publisher is unable to perform his duties due to illness or otherwise for a period exceeding thirty days in such circumstances in which he does not vacate his post, a new declaration shall be required. (5) Where the commencement of the publication of a newspaper— (a) in the case of a newspaper published once a week or more than once a week, within six weeks of the authentication of the declaration under section 6; and (b) in the case of any other newspaper, within three months of the authentication of the declaration under section 6, is not done, then every declaration made regarding the newspaper shall become void and a new declaration shall be required before publishing the newspaper in every such case. (6) Where in any period of three months, any daily, bi-weekly, tri-weekly, weekly or fortnightly newspaper, publishes its issues in such numbers which is less than the number to be published according to the declaration made at that time, then the declaration shall become void and a new declaration shall be required before continuing the publication of the newspaper. (7) Where the publication of any other newspaper has been stopped for a period exceeding twelve months then every declaration made regarding it shall become void, and a new declaration shall be required before the re-publication of the newspaper. (8) Every existing declaration regarding any newspaper shall be cancelled by the Magistrate before whom a new declaration regarding the same newspaper is made and signed: Provided that no person who does not ordinarily reside in India or who has not attained majority according to the Indian Majority Act, 1875 or according to the law to which he is subject in respect of the attainment of majority, shall be authorised to make a declaration under this section and no such person shall edit any newspaper.
5A. Keepers of printing-presses and editors of newspapers in Jammu and Kashmir to make and subscribe declarations within specified period
[Content as per original Act to be inserted] (1) Any person who has made a declaration regarding any printing press under section 4 of the Jammu and Kashmir State Press and Publications Act, 1989 (Jammu and Kashmir Act No. 1 of 1989) and has signed it, shall not keep any printing press in his possession after the last day of December, 1968, for the printing of books or papers, unless before the expiry of such date, he makes a new declaration regarding such printing press under section 4 of this Act and signs it. (2) Every such person who has signed a declaration regarding any newspaper under section 5 of the Jammu and Kashmir State Press and Publications Act, 1989 (Jammu and Kashmir Act No. 1 of 1989), shall, after the last day of December, 1968, remain the editor, printer or publisher of the newspaper specified in such declaration only in such case when he makes a new declaration regarding that newspaper under sub-section (2) of the rules prescribed under section 5 of this Act before the expiry of such date, and signs it, otherwise not.
6. Authentication of declaration
इस प्रकार पूर्वोक्त रूप में की गई ता हस्ताक्षर की गई प्रत्येक घोषणा की दो मूल प्रतियों में से प्रत्येक प्रति उस मजिस्ट्रेट द्वारा जिसके समक्ष उक्त् घोषणा की गई है, हस्ताक्षररत ता प्राधिकारिक मुद्र से प्रमाणित की जाएगी; परंतु जहां किसी समाचार पत्र के बारे में धारा 5 के अधीन कोई घोषणा की गई है ता उस पर हस्ताक्षर किए गए हैं, वहां यह घोषणा, उसी व्यक्ति के साथ समाप्त समाचार पत्रों को छोड़कर, इस प्रकार अन्यथा प्रमाणित नहीं की जाएगी जब तक कि मजिस्ट्रेट का, प्रेस रजिस्ट्रार से पूछताछ करने पर, यह समाधान नहीं हो जाता है कि प्रकाशित किए जाने के लिए प्रस्तावित समाचार पत्र का वही नाम या उससे मिलता-जुलता नाम नहीं है जो या तो उसी भाषा में या उसी राज्य में किसी अन्य प्रकाशित समाचार पत्र का है। उक्त मूल प्रतियों में से एक मजिस्ट्रेट के कार्यालय के अभिलेखों में रखी जाएगी और दूसरी उच्च न्यायालय के या जहां उक्त घोषणा की गई थी, उस स्थान के लिए आरम्भिक अधिकारिता रखने वाले अन्य प्रधान सिविल न्यायालय के अभिलेखों में रखी जाएगी। प्रतियों का निरीक्षण तथा उनका दिया जाना- प्रत्येक मूल प्रति का भारतिक अधिकारी किसी भी व्यक्ति की, एक रुपया फीस संदाय करने पर, उस मूल प्रति का निरीक्षण करने देगा, और आवेदन करने वाले किसी भी व्यक्ति को, दो रुपया फीस संदाय करने पर, उक्त घोषणा की एक प्रति उस न्यायालय की मुद्र से, जिसकी अभिरक्षा में मूल प्रति है, अनुप्रमाणित करके देगा। मजिस्ट्रेट की प्राधिकारिक मुद्र से अनुप्रमाणित घोषणा की एक प्रति, या घोषणा अन्यथा प्रमाणित करने से इंकार करने वाले आदेश की एक प्रति, या प्रतिलिपि, उस व्यक्ति को, जो घोषणा करता है और उस पर हस्ताक्षर करता है, और प्रेस रजिस्ट्रार को भी, भेजी जाएगी।
7. Office copy of declaration to be prima facie evidence
In any legal proceeding whatever as well civil as criminal, the production of a copy of such declaration as is aforesaid, attested by the seal of some Court empowered by this Act to have the custody of such declarations, [or, in the case of the editor, a copy of the newspaper containing his name printed on it as editor,] shall be held (unless the contrary be proved) to be sufficient evidence, as against the person whose name [or place of residence] is subscribed to such declaration [or printed on such newspaper] as the case may be, that the said person was printer or publisher, or printer and publisher or (as the case may be) editor, [of every portion of every such newspaper, whereof the title is the same as the title of the newspaper mentioned in such declaration (according to the words of the declaration) or of such portion of such issue of the newspaper as is produced.].
8. New declaration by persons who have signed declaration and subsequently ceased to be printers or publishers
[If any person who has made a declaration under section 5 with respect to any newspaper and been authenticated by a Magistrate under section 6 subsequently ceases to be the printer or publisher of the newspaper mentioned in such declaration he shall appear before any District, Presidency or Sub-divisional Magistrate and make and sign the following declaration in duplicate: 'I, A.B., declare that I have ceased to be the printer or publisher or printer and publisher of the newspaper titled ....................................'.] Authenticated and filing— Every original copy of the aforesaid declaration shall be authenticated by the signature and seal of that Magistrate before whom the aforesaid declaration is made and an original copy of the aforesaid declaration shall be filed along with each original copy of the previously made declaration. Inspection and copies of declaration— Any person applying shall be entitled to inspect each original copy of the aforesaid declaration on payment of a fee of one rupee and the applying person shall be provided a copy of the aforesaid original declaration certified by the seal of the Court in whose custody the original copy is, on payment of a fee of two rupees. Preservation of declaration as evidence— In all such cases where a copy of the previously authenticated declaration can be filed in court, it shall be sufficient that an authenticated copy of the aforesaid declaration be filed in court and this declaration shall not be taken in the form of evidence that the declarant was the printer or publisher of the newspaper mentioned therein, in any period after the date of the aforesaid declaration. [A copy of the aforesaid declaration authenticated by the seal of the Magistrate shall be sent to the Press Registrar.]
8A. Person whose name has been incorrectly published as editor may make a declaration before a Magistrate
[If any person, whose name has appeared as editor on a copy of any newspaper, shows that the issue on which his name has appeared in this manner was not edited by him, he may, within two weeks of his becoming aware that his name has been published in this manner, appear before any District, Presidency or Sub-divisional Magistrate and make a declaration that his name has been incorrectly published as its editor in that issue, and if the Magistrate is satisfied after conducting such inquiry as he deems necessary, that such declaration is true, he shall certify accordingly; and on being given such certificate, the provisions of section 7 shall not apply to that person in respect of that issue of the newspaper. In any case, the Magistrate can extend the period granted under this section if he is satisfied that such person was prevented from appearing and making the declaration within the aforesaid period for sufficient reason.]
8B. Cancellation of declaration
[Content as per original Act to be inserted] [If the Press Registrar or any other person makes an application or otherwise the Magistrate who authenticated the declaration under this Act is of the opinion that any declaration made with regard to any newspaper should be cancelled, he may, after giving the person concerned an opportunity to show cause against the proposed action, conduct an inquiry into the matter, and if after considering the cause given by such person, if any, and after giving him an opportunity of hearing, he becomes satisfied that: (i) the newspaper regarding which the declaration has been made is being published in violation of the provisions of this Act or the rules made thereunder; or (ii) the name of the newspaper mentioned in the declaration is not the same, or is similar to, the name of a newspaper published in the same language or in the same state: or (iii) the printer or publisher has ceased to be the printer or publisher of the newspaper mentioned in such declaration; or (iV) the declaration was made on false representation or by concealing any material fact or was made regarding such printed work which is not a newspaper, then the Magistrate may by order cancel the declaration and shall send a copy of the order to the person who made or signed it and also to the Press Registrar.] यदि प्रेस रजिस्ट्रार या किसी अन्य व्यक्ति द्वारा किए गए आवेदन पर अथवा अन्यथा इस अधिनियम के अधीन घोषणा अनघ प्रमाणित करने के लिए विहित मजिस्ट्रेट की यह राय है कि किसी समाचारपत्र के बारे में की गई कोई घोषणा रद्द की जानी चाहिए तो वह संबंधित व्यक्ति को, प्रस्तावित कार्यवाही के विरुद्ध कारण दर्शित करने या अवसर देने के पश्चात उस मामले की जांच कर सकेगा और यदि ऐसे व्यक्ति द्वारा दिए गए कारण पर, यदि कोई हो, विचार करने के पश्चात तथा उसे सुनवाई का अवसर देने के पश्चात उसका यह समाधान हो जाता है कि - (i) वह समाचारपत्र जिसके बारे में घोषणा की गई है, इस अधिनियम या इनके अधीन बनाए गए नियमों के उपबंधों के उल्लंघन में प्रकाशित किया जा रहा है ; या (ii) घोषणा में उल्लेखित समाचारपत्र का नाम वही है, या उस नाम से मिलता जुलता है, जो या तो उसी भाषा में या उसी राज्य में प्रकाशित किसी समाचारपत्र का है: या (iii) मुद्रक या प्रकाशक, उस घोषणा में उल्लेखित समाचारपत्र का मुद्रक या प्रकाशक नहीं रह गया है ; या (iV) घोषणा, सामर्थ्य या व्यपदेशन पर या किसी असत्य तथ्य को छिपा कर की गई थी या ऐसी किसी कृति के बारे में की गई थी, जो समाचारपत्र नहीं है, तो वह मजिस्ट्रेट आदेश द्वारा घोषणा रद्द कर सकेगा और आदेश की एक प्रति घोषणा करने वाले या उस पर हस्ताक्षर करने वाले व्यक्ति को तथा प्रेस रजिस्ट्रार को भी यथास्थिति भेजेगा।
8C. Appeal
[Content as per original Act to be inserted] (1) Any person aggrieved by an order of the Magistrate under section 6 refusing to authenticate a declaration or under section 8B cancelling a declaration, within 60 days from the date on which such order was communicated to him, may appeal to the Appellate Board, which [shall consist of the Chairman and one other member nominated by the Press Council of India established under section 4 of the Press Council Act, 1978 (37 of 1978) from amongst its members,]: Provided that the Appellate Board may entertain an appeal after the expiry of the aforesaid period if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time. (2) On receipt of an appeal under this section, the Appellate Board, after calling for the records from the Magistrate and after conducting such further inquiry as it deems fit, may confirm, modify or set aside the order against which the appeal has been filed. (3) Subject to the provisions of sub-section (2), the Appellate Board may regulate its own method and procedure by order. (4) The decision of the Appellate Board shall be final.
9. Copies of books printed after commencement of Act to be delivered gratis to Government
[Content as per original Act to be inserted] प्रत्येक सम्पूर्ण पुस्तक की मुद्रित प्रतियां, जो इस अधिनियम के प्रवृत्त होने के पश्चात भारत में मुद्रित की जाती है, उनके सभी मानचित्रों, मुद्रणों या अन्य उत्कीर्णों सहित, जो उस पुस्तक की सर्वोत्तम कृतियों की भांति परिरक्षित और रंजित की गई हों, उनके मुद्रक या प्रकाशक के बीच (यदि पुस्तक प्रकाशित की जाए तो) किसी करार के होते हुए भी, मुद्रक द्वारा सरकार को मुफ्त ऐसे स्थान पर तथा ऐसे अधिकारी को, जिसके लिए राज्य सरकार, राजपत्र में अधिसूचना द्वारा समय-समय पर निर्देश दे, निम्नलिखित प्रकार से दी जाएंगी, अर्थात:- (क) किसी भी दशा में, उस तारीख के पश्चात एक कलैंडर माह के भीतर, जिसको ऐसी पुस्तक मुद्रणालय से पहली बार बाहर निकाली जाए, ऐसी एक प्रति, और (ण) यदि उस तारीख से एक कलैंडर वर्ष के भीतर राज्य सरकार मुद्रक से ऐसी दो से अधिक अन्य प्रतियां देने की अपेक्षा करती है तो, उस तारीख जिसको राज्य सरकार द्वारा मुद्रक से ऐसी अपेक्षा करने के दिन के पश्चात एक कलैंडर माह के भीतर, ऐसी अन्य एक या दो प्रतियां, जैसा भी राज्य सरकार निर्देश दे, और इस प्रकार दी गई प्रतियां जिल्दबंदी, सिली हुई या पंक्कों से सिली हुई और ऐसे सर्वोत्तम कागज पर होंगी जिस पर उस पुस्तक की प्रतियां मुद्रित की गई हों। प्रकाशक या कोई अन्य व्यक्ति जो मुद्रक को नियोजित करे पूर्वोक्त परिरक्षित तथा रंजित सभी मानचित्रों, मुद्रणों और उत्कीर्णों को जो मुद्रक को पूर्वोक्त अपेक्षाओं को अनुपालन करने के समर्थ बनाने के लिए आवश्यक हों, उक्त माह की समाप्ति के पूर्व उचित समय पर देगा। इस धारा के पूर्वोक्त भाग की कोई भी बात निम्नलिखित को लागू नहीं होगी- (i) किसी पुस्तक का द्वितीय या पश्चातवर्ती संस्करण, जिस संस्करण में पुस्तक के लेयर प्रेस में या मानचित्रों, मुद्रणों या अन्य उत्कीर्णों में कोई परिवर्तन या परिवर्तनों नहीं किए गए हैं, और जिस पुस्तक के प्राय: किसी पूर्ववर्ती संस्करण की प्रति इस अधिनियम के अधीन दी जा चुकी है, या (ii) इस अधिनियम की धारा 5 में अधिकथित नियमों के अनुरूप प्रकाशित कोई समाचारपत्र।
10. Receipt for copies delivered under section 9
वह अधिकारी, जिसे किसी पुस्तक की प्रति अंतिम पूर्वगामी धारा के अधीन दी गई है, मुद्रक को उनके लिए लिखित रसीद देगा।
11. Disposal of copies delivered under section 9
इस अधिनियम की धारा 9 के प्रथम पैरे के ण (क) के अनुसरण में दी गई प्रति का वैसे ही निपटारा किया जाएगा जैसे राज्य सरकार, समय-समय पर अवधारित करे। उक्त पैरे के ण (ण) के अनुसरण में दी गई कोई प्रति या प्रतियां केंद्रीय सरकार को भेजी जाएंगी।
11A. Copies of newspapers printed in India to be delivered gratis to Government
भारत में प्रत्येक समाचारपत्र का मुद्रक ऐसे समाचारपत्र के प्रत्येक अंक की दो प्रतियां सरकार को ऐसे स्थान पर तथा ऐसे अधिकारी को जिसके लिए राज्य सरकार राजपत्र में अधिसूचना द्वारा निर्देश दे, उनके प्रकाशन के बाद यथाशीघ्र मुफ्त देगा।
11B. Copies of newspapers to be delivered to Press Registrar
ऐसे किन्हीं नियमों के अधीन रहते हुए, जो इस अधिनियम के अंतर्गत बनाए जाएं, भारत में प्रत्येक समाचारपत्र का प्रकाशक, प्रेस रजिस्ट्रार को ऐसे समाचारपत्र के प्रत्येक अंक की एक प्रति, उनके प्रकाशन के पश्चात यथाशीघ्र, मुफ्त देगा।
12. Penalty for printing contrary to rule in section 3
जो कोई इस अधिनियम की धारा 3 में दिए गए नियम के अनुरूप कोई पुस्तक या पत्र मुद्रित या प्रकाशित न करके अन्यथा प्रकाशित करेगा, वह मजिस्ट्रेट के समक्ष दोषसिद्धि पर जुर्माने से, जो दो हजार रूपए से अधिक का नहीं होगा या दे कारावास से, जिसकी अवधि छह मास से अधिक की नहीं होगी, या दोनों से, दंडित किया जाएगा।
13. Penalty for keeping printing presses without making declaration required by section 4
जो कोई, पूर्वोक्त कोई मुद्रणालय इस अधिनियम की धारा 4 में अंतर्विष्ट उपबंधों में से किसी के उल्लंघन में, अपने कब्जे में रखेगा, वह मजिस्ट्रेट के समक्ष दोषसिद्धि पर जुर्माने से, जो दो हजार रूपए से अधिक का नहीं होगा या दे कारावास से, जिसकी अवधि छह मास से अधिक की नहीं होगी, या दोनों से, दंडित किया जाएगा।
14. Penalty for making false statement
कोई ऐसा व्यक्ति, जो इस अधिनियम के प्राधिकार के अधीन कोई घोषणा या अन्य कार्य करते हुए ऐसा कार्य करेगा जो असत्य है और जिसके बारे में वह या तो यह जानता है या विश्वास करता है कि वह असत्य है या उसके सही होने के बारे में वह विश्वास नहीं करता है, मजिस्ट्रेट के समक्ष दोषसिद्धि पर जुर्माने से, जो दो हजार रूपए से अधिक का नहीं होगा और कारावास से, जिसकी अवधि छह मास से अधिक की नहीं होगी, दंडित किया जाएगा।
15. Penalty for non-compliance with rules for printing or publishing newspaper
(1) Whoever shall edit, print or publish any newspaper without conforming to the rules hereinbefore provided, or whoever shall edit, print or publish, or shall cause to be edited, printed or published, any newspaper, knowing that the said rules have not been complied with in respect of such newspaper, shall, on conviction before a Magistrate, be punished with fine not exceeding Rs. 2,000 or simple imprisonment for a term not exceeding six months, or both. (2) Where an offence is committed in relation to a newspaper under sub-section (1), the Magistrate may, in addition to the punishment imposed under the said sub-section, also cancel the declaration made in respect of the newspaper.
15A. Penalty for failure to make declaration under section 8
यदि कोई व्यक्ति, जो किसी समाचारपत्र का मुद्रक या प्रकाशक नहीं रह गया है, धारा 8 के अनुपालन में घोषणा करने में असफल रहेगा या घोषणा करने में उपेक्षा करेगा तो वह मजिस्ट्रेट के समक्ष दोषसिद्धि पर, जुर्माने से जो, दो सौ रूपए से अधिक का नहीं होगा, दंडनीय होगा।
16. Penalty for not delivering books or not supplying printer with maps
[Content as per original Act to be inserted] If any printer of any such book as is referred to in section 9 of this Act, shall neglect to deliver copies of the same in pursuance of that section, he shall for every such default forfeit to the Government such sum not exceeding Rs. 50 as a Magistrate having jurisdiction in the place where the book was printed may, on the application of the officer to whom the copies should have been delivered or of any person authorised by that officer in this behalf, determine to be in the circumstances a reasonable penalty for the default, and, in addition to such sum, such further sum as the Magistrate may determine to be the value of the copies which the printer ought to have delivered. If any publisher or other person employing any printer shall neglect to supply him, in the manner required in the second paragraph of section 9 of this Act, with the maps, prints or engravings which may be necessary to enable the printer to comply with the provisions of that section, such publisher or other person shall for every such default forfeit to the Government such sum not exceeding Rs. 50 as the aforesaid Magistrate may, on such application as aforesaid, determine to be in the circumstances a reasonable penalty for the default, and, in addition to such sum, such further sum as the Magistrate may determine to be the value of the maps, prints or engravings which such publisher or other person ought to have supplied.
16A. Penalty for failure to supply copies of newspapers gratis to Government
[Content as per original Act to be inserted] If any printer of any newspaper published in India neglects to deliver copies of the same in compliance with section 11A, he shall, on the complaint of the officer to whom the copies should have been delivered or of any person authorised by that officer in this behalf, be punishable, on conviction before a Magistrate having jurisdiction in the place where the newspaper was printed, by fine which may extend to Rs. 50 for every such default.
16B. Penalty for failure to supply copies of newspapers to Press Registrar
[Content as per original Act to be inserted] If any publisher of any newspaper published in India neglects to deliver copies of the same in compliance with section 11B, he shall, on the complaint of the Press Registrar, be punishable, on conviction before a Magistrate having jurisdiction in the place where the newspaper was printed, by fine which may extend to Rs. 50 for every such default.
17. Recovery of forfeitures and disposal thereof and of fines
[Content as per original Act to be inserted] Any sum forfeited to the Government under section 16 shall be recovered, under the warrant of the Magistrate determining the sum, or his successor in office, in the manner authorised by the Code of Criminal Procedure for the time being in force, and within the period prescribed by the Indian Penal Code, for the levy of a fine. * * * * *
18. Registration of memoranda of books
[Content as per original Act to be inserted] There shall be kept at such office, and by such officer as the State Government shall appoint in this behalf, a book to be called a catalogue of books printed in India, wherein shall be registered a memorandum of every book which shall have been delivered in pursuance of clause (a) of the first paragraph of section 9 of this Act. Such memorandum shall (so far as may be practicable) contain the following particulars (that is to say):- (1) The title of the book and the contents of the title page, with a translation into English of such title and contents, if the same are not in the English language; (2) The language in which the book is written; (3) The name of the author, translator, or editor of the book or any part thereof; (4) The subject; (5) The place of printing and the place of publication; (6) The name of the firm of the printer and the name of the firm of the publisher; (7) The date of issue from the press or the date of publication; (8) The number of sheets, leaves or pages; (9) The size; (10) The number of the edition, whether first, second or other; (11) The number of copies of the edition; (12) Whether the book is printed, cyclostyled or lithographed; (13) The price at which the book is sold to the public; and (14) The name and residence of the proprietor of the copyright or of any portion of such copyright. Such memorandum shall be registered after the delivery of the 2 copies of every book in pursuance of clause (a) of the first paragraph of section 9, and shall be registered as soon as may be. * * *
19. Publication of memoranda registered
[Content as per original Act to be inserted] The memoranda registered during each quarter in the said catalogue shall be published in the Official Gazette, as soon as may be after the end of such quarter, and a copy of the memoranda so published shall be sent to the Central Government. There shall be kept at such office, and by such officer as the State Government shall appoint in this behalf, a book to be called a Catalogue of Books printed in British India, wherein shall be registered a memorandum of every book which shall have been delivered pursuant to clause (a) of the first paragraph of section 9 of this Act. Such memorandum shall (so far as may be practicable) contain the following particulars (that is to say): (1) the title of the book and the contents of the title-page, with a translation into English of such title and contents, when the same are not in the English language: (2) the language in which the book is written: (3) the name of the author, translator, or editor of the book or any part thereof: (4) the subject: (5) the place of printing and the place of publication: (6) the name of the printer and the name of the publisher: (7) the date of issue from the press or the date of publication: (8) the number of sheets, leaves or pages: (9) the size: (10) the first, second or other edition: (11) the number of copies of which the edition consists: (12) whether the book is printed, cyclostyled or lithographed: (13) the price at which the book is sold to the public: and (14) the name and residence of the proprietor of the copyright or of any portion of such copyright. Such memorandum shall be registered after the delivery of the copies of the book in the manner provided in the first paragraph of section 9, and the copies so delivered shall be registered. [Omitted]
19A. Appointment of Press Registrar and other officers
[Content as per original Act to be inserted] The Central Government may appoint a Registrar of Newspapers for India and such other officers under the general superintendence and control of the Press Registrar as may be necessary for the purpose of performing the functions assigned to them by or under this Act, and may, by general or special order, provide for the distribution or allocation of functions to be performed by them under this Act.
19B. Register of newspapers
(1) The Press Registrar shall maintain in the prescribed manner a Register of Newspapers. (2) The Register shall, as far as may be practicable, contain the following particulars about every newspaper published in India, namely: (a) the name of the newspaper: (b) the language in which the newspaper is published: (c) the periodicity of the publication of the newspaper: (d) the name of the editor, printer and publisher of the newspaper: (e) the place of printing and publication: (f) the average number of pages per week: (g) the number of days of publication in a year: (h) the average number of copies printed, the average number of copies sold to the public and the average number of copies distributed free to the public, the average being calculated on the basis of the number of copies in respect of which circulation is certified: (i) the retail selling price of each copy: (j) the names and addresses of the owners of the newspaper and such other related particulars as may be prescribed: (k) such other particulars as may be prescribed. (3) On receiving information from time to time about the aforesaid particulars, the Press Registrar shall cause the relevant particulars in the Register to be updated and may make such necessary corrections as may be required to keep the Register up to date.
19C. Certificate of registration
[Content as per original Act to be inserted] On receiving the copy of the declaration under section 6, and on the publication of such newspaper, the Press Registrar shall, after the same is registered, issue a certificate of registration in respect of such newspaper to its publisher.
19D. Annual statement, etc., to be furnished by newspapers
[Content as per original Act to be inserted] It shall be the duty of the publisher of every newspaper: (a) to furnish to the Press Registrar an annual statement in respect of the newspaper at such time and containing such particulars as may be prescribed under sub-section (2) of section 19B: (b) to publish in the newspaper at such time and in relation to the newspaper such particulars as may be specified in this behalf by the Press Registrar under sub-section (2) of section 19B.
19E. Returns and reports to be furnished by newspapers
[Content as per original Act to be inserted] The publisher of every newspaper shall furnish to the Press Registrar such returns, statistics and other information concerning any of the particulars prescribed under sub-section (2) of section 19B as the Press Registrar may from time to time require.
19F. Right of access to records and documents
[Content as per original Act to be inserted] The Press Registrar or any other officer authorised by him in this behalf in writing may, for the purpose of the collection of any information relating to any newspaper under this Act, have access to any relevant record or document relating to the newspaper in the possession of the publisher thereof, and may enter at any reasonable time any premises where he believes such records or documents to be and may inspect or take copies of the relevant records or documents or may ask any question necessary for obtaining any information required to be furnished under this Act.
19G. Annual Report
[Content as per original Act to be inserted] The Press Registrar shall prepare once every year, in such time and in such form as may be prescribed, an annual report containing a summary of the information obtained by him during the previous year in respect of the newspapers in India and giving an account of the working of such newspapers, and copies thereof shall be sent to the Central Government.
19H. Furnishing of copies of extracts from Register
[Content as per original Act to be inserted] On the application of any person for the supply of the copy of any extract from the Register, and on payment of such fee as may be prescribed, the Press Registrar shall furnish such copy to the applicant in such form and in such manner as may be prescribed.
19I. Delegation of powers
[Content as per original Act to be inserted] Subject to the provisions of this Act and rules made thereunder, the Press Registrar may delegate all or any of his powers under this Act to any officer subordinate to him.
19J. Press Registrar and other officers to be public servants
[Content as per original Act to be inserted] The Press Registrar and all officers appointed under this Act shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code (45 of 1860).
19K. Penalty for contravention of section 19D or section 19E, etc.
[Content as per original Act to be inserted] If the publisher of any newspaper: (a) refuses or neglects to comply with the provisions of section 19D or section 19E; or (c) publishes in the newspaper any particulars in contravention of clause (b) of section 19D, which he has reason to believe to be false, then he shall be punishable with fine, which may extend to five hundred rupees.
19L. Penalty for improper disclosure of information
[Content as per original Act to be inserted] If any person engaged in connection with the collection of information under this Act wilfully discloses any information or the contents of any return furnished under this Act otherwise than in the execution of his duties under this Act or for the purposes of the prosecution of an offence under this Act or under the Indian Penal Code (45 of 1860), he shall be punishable with imprisonment for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.
19T. Penalty for contravention of section 19D or section 19E, etc.
If any publisher of any newspaper— (a) refuses or neglects to comply with the provisions of section 19D or section 19E, or (c) publishes in the newspaper, any such particulars relating to the newspaper as are not in accordance with the requirement of clause (c) of section 19D, having reason to believe that they are false, shall be punishable with fine which may extend to five hundred rupees.
19U. Penalty for improper disclosure of information

20. Power of State Government to make rules
[Content as per original Act to be inserted] (1) The State Government may, by notification in the Official Gazette, make such rules (not inconsistent with the rules made by the Central Government under section 20A) as may be necessary or desirable for carrying out the objects of this Act. (2) Every rule made by the State Government under this section shall be laid, as soon as may be after it is made, before the State Legislature.
20A. Power of Central Government to make rules
(1) The Central Government may, by notification in the Official Gazette, make rules for the following purposes: (a) such particulars as are to be registered as may be given in the declaration made under section 5 and the form in which, and the manner in which, the names of the printer, publisher, owner, and editor of the newspapers and the place of their printing and publication shall be printed on each copy of such newspapers; (b) [Omitted]; (c) such manner as copies of any newspaper are to be sent to the Press Registrar under section 11B; (d) such manner as registration is to be made under section 19D and what such particulars shall be; (e) such particulars as are to be registered, which are to be given in the annual return sent by the publisher of any newspaper to the Press Registrar; (f) such form and manner as the annual return under clause (a) of section 19D or the return under section 19E, statistics, or other information are to be sent to the Press Registrar; (g) such fees for giving copies of extracts from the register and such manner as such copies are given; (h) such manner as the certificate of registration in respect of any newspaper is to be issued; (i) such form is to be registered and such time is to be registered, within which the annual report is to be prepared and sent to the Central Government by the Press Registrar. (2) Every rule made under this section shall be laid, as soon as may be after it is made, before each House of Parliament, while it is in session, for a total period of thirty days which may be comprised in one session or in two or more successive sessions, and if, before the expiry of the session immediately following the session or the successive sessions aforesaid, both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule.
20B. Rules made under this Act may provide for punishment
[Content as per original Act to be inserted] Any rule made under any of the provisions of this Act may provide that any contravention thereof shall be punishable with fine which may extend to one hundred rupees.
21. Power to exclude any class of books from operation of Act
[Content as per original Act to be inserted] The State Government may, by notification in the Official Gazette, exclude any class of books or papers from the operation of the whole or any part or parts of this Act: Provided that no such notification in respect of any class of newspapers shall be issued without consulting the Central Government.
22. Extent
