Powers and functions of the Council
The Chhattisgarh Council for Physiotherapy and Occupational Therapy Act, 2015(1) The Council shall take such measures for the development of Physiotherapy and Occupational Therapy education as it may think fit. (2) The Council shall exercise such powers and perform such functions assigned to it under this Act as may be prescribed. (3) Without prejudice to the generality of the power mentioned in sub-section (2), the Council shall perform the following functions, namely:— (a) to maintain the register of Physiotherapists and Occupational Therapists; (b) to prescribe standard of education and training; (c) to grant recognition to the institution; (d) to conduct the examinations; (e) to determine the subjects and syllabi; (f) to grant registration or renewal of registration to the professionals; (g) to advice the State Government on the matters relating to the profession; (h) to lay down code of ethics for the professionals; (i) to inspect colleges and institutions. (4) If at any time, the Council is of the opinion that the courses of study or the examinations of any institution are not such as to secure to persons undertaking the courses of study and examinations, the requisite knowledge and skill for the efficient practice of Physiotherapy and Occupational Therapy, the Council shall report the fact to the State Government. (5) On receipt of the report under sub-section (4), the State Government may after consultation with the Council, direct the institution to make such improvement within such period as may be specified and if the institution fails to comply with the direction, the Council may withdraw the recognition granted to it, in the manner as may be prescribed. (6) The inquiry into the affairs of an institution, the manner of such inquiry, the nature of report and the further action to be taken shall be such as may be prescribed. (7) The Council may, on the basis of the report submitted under sub-section (3) of section 17, and after giving such institution an opportunity of being heard, in the manner as may be prescribed, by order, withdraw the recognition of any college or institution, if it fails to comply with the norms or standards of education/courses, in the manner as may be prescribed by the Council: Provided that no such order shall be passed without giving an opportunity of being heard to the institution: Provided further that if the institution fails to achieve the norms, the Council may recommend to the State Government to withdraw the affiliation of such institution: Provided also that the institution shall be bound to follow the rules and regulations fixed by the University or the examining body. The Council shall have the right to inspect the institution or college at any time, in the manner as may be prescribed. If before the commencement of this Act, any person has established an institution or any institution has opened a new or higher course of study or training or increased its admission capacity, such person or institution, as the case may be, shall seek, within a period of one year from the commencement of this Act, the permission of the Govemment.
