2. Definitions
In this Act, unless the context otherwise requires,— (a) "Commission" means the Bihar State Minorities Commission constituted under section 4 of the Act; (b) "Government" means the Government of Bihar; (c) "Minorities" means persons belonging to religious and linguistic minority communities living in the State of Bihar, who have been recognized as such minorities by the Government; (d) "Prescribed" means prescribed by this Act or by rules made thereunder; (e) "Public Servant" means a person as defined under the following clauses, namely—
3. आयोग का मुख्यालय
(1) आयोग का मुख्यालय पटना में अवस्थित होगा। (2) सरकार राज्य में आयोग का एक या इससे अधिक कार्यालय राज्य के किसी स्थान पर स्थापित कर सकेगी।
4. आयोग का गठन
(1) इस अधिनियम के उद्देश्यों को कार्य-रूप देने के लिये सरकार एक आयोग का गठन करेगी जो बिहार राज्य अल्प-संख्यक आयोग कहलायेगा। (2) आयोग में एक अध्यक्ष, दो उपाध्यक्ष और अधिकतम आठ सदस्य होंगे जो राज्य सरकार द्वारा मनोनीत किये जायेंगे।
5. आयोग की पदावधि
आयोग के अध्यक्ष, उपाध्यक्ष या सदस्य के रूप में मनोनीत किसी व्यक्ति की पदावधि उसके पद भार ग्रहण करने की तिथि से तीन वर्षों की होगी : परन्तु यह कि (क) आयोग का अध्यक्ष, उपाध्यक्ष या कोई सदस्य स्वहस्ताक्षरित लिखित रूप में सरकार को संबोधित कर अपना पदत्याग कर सकेगा। (ख) यदि किसी समय राज्य सरकार को यह प्रतीत हो कि आयोग का अध्यक्ष, उपाध्यक्ष या कोई सदस्य अयोग्य हो गया है या कदाचार अथवा कर्तव्यहीनता या अपनी शक्ति का दुरुपयोग करने का दोषी पाया गया है, जिसके कारण जनहित में आयोग से उसे हटाना आवश्यक हो गया है, तो राज्य सरकार राजकीय गजट में अधिसूचना द्वारा उसे उस पद से हटा सकेगी।
6. Functions of Commission
(1) The functions of the Commission shall be as follows :— (a) to examine the working of various safeguards provided in the Constitution of India, and the law passed by the State Legislature for protection of minorities of the State; (b) to make recommendations with a view to ensuring effective implementation and enforcement of such safeguards and laws, as mentioned in sub-clause (a); (c) to undertake review of the implementation of policies and schemes of the State Government for the welfare of minorities of the State; (d) to conduct studies, researches and analysis and make recommendations for the socio-economic uplift of the minorities of the State; (e) to make such recommendations as may be deemed necessary and proper for ensuring protection of rights and interests of the minorities of the State; (f) to make recommendations for ensuring, maintaining and promoting communal harmony in the State; (g) to make periodical reports at prescribed intervals to the government. (2) The Government may by notification in the official gazette, confer upon the Commission such additional functions in relation to the welfare and redress of grievances of the minorities of the State, as may be specified in the notification.
7. Status and emoluments
(1) The Government may from time to time, provide such status to the Chairman, Vice-Chairman or Members of the Commission and pay such salary, allowances and grant other facilities as may be prescribed.
8. Power to investigate
(1) The Commission shall have power to examine the following matters, brought before it either by a complaint by the aggrieved person or by any institution or brought to the notice of the Commission from any other reliable source— (a) violation of any right, safeguard provided to the minorities by the Constitution of India or by any law passed by the State Legislature; (b) encroachment upon any place of worship and graveyard belonging to the minority community; (c) such circumstances and causes which may create an atmosphere of hatred or conflict or tend to create such atmosphere appearing to create hatred or conflict between different communities; and (d) any other matter connected with the welfare, protection and safety of minorities of the State : Provided that the Commission shall not investigate into any such matter which is pending before any court or Tribunal or Quasi judicial body.
9. अन्वेषण की प्रक्रिया
(1) यदि आयोग इस अधिनियम के अधीन जांच करने का प्रस्ताव करे तो वह— (क) परिवाद की एक प्रतिलिपि या उसका सारांश संबद्ध प्राधिकारी, विभाग या लोक सेवक को भेजेगा और परिवाद में दिये गये विवरणों के संबंध में उसकी रिपोर्ट या मन्तव्य विनिर्दिष्ट समय के भीतर मांगेगा; (ख) संबंधित स्थान पर व्यथित व्यक्ति या संस्था एवं संबंधित व्यक्तियों के साथ परिवादित मसले पर विचार-विमर्श हेतु आयोग या इसके किसी सदस्य के साथ बैठक नियत एवं आयोजित करेगा। (2) यथा पूर्वोक्त के सिवाय किसी निश्चित मामले की जांच करने की प्रक्रिया वही रहेगी जैसा कि इस अधिनियम के अंतर्गत नियम में विहित है। (3) इस अधिनियम के अधीन अन्वेषण प्रारम्भ हो जाने से उस कार्रवाई पर या अन्वेषाधीन मामले के संबंध में आगे कार्रवाई करने में लोक सेवक बाधित नहीं होगा। (4) इस अधिनियम के अधीन किसी अन्वेषण के प्रयोजनार्थ आयोग किसी लोक सेवक या किसी अन्य व्यक्ति से, जो उसकी राय में अन्वेषण से सुसंगत जानकारी प्रस्तुत करने या दस्तावेज पेश करने के योग्य हो, यह अपेक्षा कर सकेगा कि वह ऐसी जानकारी प्रस्तुत करे या ऐसे दस्तावेज की प्रति पेश करे; परन्तु वैसे दस्तावेज की प्रति की आपूर्ति नहीं की जायेगी जो राज्य हित या जनहित के विरुद्ध हो। (5) आयोग को निम्नलिखित विषयों के बारे में शक्तियां होंगी :— (क) किसी भी व्यक्ति को आह्वान करे एवं उसे शपथ पर परीक्षा करे, वैसे व्यक्ति द्वारा दस्तावेज प्रस्तुत करने या संदेह उपस्थित होने के मामले में आयोग के निर्देश की अवज्ञा करने पर, वह व्यक्ति आयोग की अनुशंसा पर सरकार द्वारा अनुशासनिक कार्रवाई का उत्तरदायी होगा; (ख) किसी कार्यालय से किसी सरकारी अभिलेख या उसकी प्रतिलिपि की अध्यपेक्षा करना; (ग) साक्षियों या दस्तावेजों की परीक्षा के लिये कमीशन बहाल करना; (घ) अन्य ऐसे विषय, जो विहित किये जायें। (6) किये जाने वाले अन्वेषण के स्वरूप और विशेष परिस्थितियों को ध्यान में रखते हुए यदि सरकार की यह राय हो कि जांच कमीशन अधिनियम, 1952 की धारा 5 की उप-धारा 2 या 3 या 4 अथवा 5 के सभी या कोई भी उपबंध आयोग पर लागू किया जाय तो सरकार, राजकीय गजट में अधिसूचना द्वारा, निदेश दे सकेगी कि सभी या उक्त उपबंध, जैसा कि अधिसूचना में विनिर्दिष्ट किया जाय, आयोग पर लागू होगा और ऐसी अधिसूचना के निर्गत होने पर, उपबंध तदनुसार लागू होंगे।
10. एजेंसियों की सेवाओं के उपयोग करने की शक्ति
आयोग, इस अधिनियम के अधीन, अन्वेषण संचालित करने के प्रयोजनार्थ राज्य सरकार की पूर्व सहमति से राज्य सरकार के किसी पदाधिकारी या राज्य सरकार के अन्वेषी एजेंसी की सेवा का उपयोग कर सकेगा।
11. आयोग को दिया गया बयान
आयोग, धारा 10 में यथाउपबंधित पदाधिकारी या एजेंसी के समक्ष साक्ष्य देने के क्रम में आयोग को किसी व्यक्ति द्वारा दिये गये बयान का उपयोग उसके विरुद्ध किसी दीवानी या फौजदारी कार्यवाही में नहीं किया जा सकेगा और न ही इस बयान के आधार पर उसके विरुद्ध किसी प्रकार की दीवानी या फौजदारी कार्यवाही की जा सकेगी, किन्तु ऐसे बयान द्वारा मिथ्या साक्ष्य देने के लिये अभियोजन चलाया जा सकेगा।
12. परित्राण
इस अधिनियम के अधीन सद्भावनापूर्वक किये गये या किये जाने के लिये तात्पर्यित किसी कार्य या आयोग के अधिकार के अधीन दी गयी किसी रिपोर्ट या कार्यवाही के लिये आयोग या इसके अध्यक्ष या उपाध्यक्ष या कोई सदस्य या कोई अन्य व्यक्ति, जो

15. Procedure of Commission
The Commission shall, subject to any procedure made in this behalf, have powers to regulate its own procedure, including the fixing of places and time of its meetings.
16. Staff of the Commission
(1) The secretary of the administrative department of the Government or any officer not below the rank of Deputy Secretary nominated by the Government shall be the ex-officio Member-Secretary of the Commission. (2) The Government shall provide such other staff to the Commission, as may be required for the proper functioning of the Commission.

17. Submission of Reports
(1) The Commission shall present annually a consolidated report on the performance of its functions under this Act to the Government. (2) The Commission may, at its discretion, submit from time to time special reports on any matter of public importance to the Government. (3) On receipt of the annual report under sub-section (1) or a special report under sub-section (2), the Government shall lay a copy thereof, with an explanatory memorandum before each House of the State Legislature.

18. Power to make rules
(1) The Government may, by notification, in the official gazette, make rules for the purposes of carrying out the provisions, of this Act. (2) In particular and without prejudice to the generality of the foregoing provisions, such rules may provide for— (a) to determine the status of Chairman and Vice-Chairman of Commission; (b) the salary, allowance and other emoluments payable to the Chairman, Vice-Chairman and Members of the Commission and other conditions of their service; (c) any other matter, which is to be or may be prescribed in pursuance of the provisions of the Act and that provision is in the opinion of Government necessary for the proper implementation of this Act. (3) Every rule made under this Act shall be laid as soon as may be after it is made, before each House of State Legislature while it is in session for a total period of fourteen days, which may be comprised in one session or in two successive sessions and, if, before the expiry of the session in which it is so laid or the sessions immediately following, both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, the rule shall hereafter have effect only in such modified form, or be of no effect, as the case may be, without prejudice to the validity of anything previously done under that rule.
