The Bihar State Child Labour Commission (Amendment) Act, 2024
1. Short title, extent and commencement
Short title, extent and commencement:-
- (1) This Act may be called the Bihar State Child Labour Commission (Amendment) Act, 2024.
- (2) It shall extend to the whole state of Bihar.
- (3) It shall come into force immediately after its publication in the Official Gazette.
2. Amendment in section 5 of Bihar State Child Labour Commission Act, 1996
Amendment in section 5 of Bihar State Child Labour Commission Act, 1996 (Bihar Act 1, 1997).- The following proviso will be added after Section 5 of the Bihar State Child Labour Commission Act, 1996 (Bihar Act 1, 1997): - Notwithstanding tenure prescribed in above section, the State Government shall have the power to dissolve the Commission any time if it is satisfied that dissolution is in larger public interest to make the functioning of the commission consistent with its aim and objects.
3. Addition of new sections after section 7 of Bihar State Child Labour Commission Act, 1996
Addition of new sections after section 7 of Bihar State Child Labour Commission Act, 1996 (Bihar Act 1, 1997).- After Section 7 of the Bihar State Child Labour Commission Act, 1996, the following sections 7A, 7B, 7C and 7D will be added: -
7A. Dissolution of existing Commission
- (1) With effect from the date the Act comes into force, the existing Bihar State Child Labour Commission shall stand dissolved.
- (2) On dissolution of existing Bihar State Child Labour Commission under above subsection the Government of Bihar shall appoint an Administrator to manage the affairs of the Commission.
7B. Constitution of a committee of experts
- (1) Upon dissolution of the Bihar State Child Labour Commission the State Government shall constitute a committee of experts to study and make
recommendations for reorganization and restructuring of the Commission with a
view to make it consistent with the provisions of the Commission.
- (2) The committee of experts shall be constituted by the State Government comprising of not more than 05 members of whom at least one member shall be a person possessing adequate knowledge of the subject related to child labour and different affairs of child labour.
- (3) The committee shall submit its recommendations to the State Government within a period of one month from the date of constitution. All logistic support to the committee shall be provided by the Labour Resources Department, Government of Bihar.
- (4) On recommendation submitted by the committee, it shall be examined by the
7C. State Government and shall be accepted with such modification as deemed necessary in the interest of child labour and other affairs related to child labour.
Constitution of a new Commission
- (1) The State Government shall constitute a new Bihar State Child Labour
7D. Commission within a period of 02 months from the date of its dissolution.
Power to remove difficulties -1 7D
- (1) If any difficulty arises in giving effect to the provisions of existing Act or the amending Act, the State Government may make such order or do such things not consistent with the provision of existing Act or amending Act as it appears to be necessary or expedient for removing the difficulty.
- (2) The State Government may issue appropriate directions for accomplishing the task entrusted to the committee. The State Government may also issue such direction as deemed necessary for carrying out objects of the existing or amending Act to the administrator and administrator shall be bound by such direction of State Government.
