Preliminary

1. (1) This Act may be called the Arunachal Pradesh Water Resources Regulatory Authority Act, 2006.
2. (2) It extends to the whore of the State of Arunachal Pradesh.
3. (3) Itshall come into force on such date as the State Governmentmay, bynotificationinOfficial Gazette,appointanddifferenldates may beappointed fordifferentareasand fordifferentsections of this Act.

1. (1) InthisAct,unlessthe contextotherwise requires-
   • (a) "Aggregate Bulk WaterEntitlement"means an aggregateofEntitlementsissued 10a group orassociationofWaterUserEntities lor the purpose of joint management of the Bulk water Entitlements;
   • (b) "Allocation"meanstheportionorpercentageof anEnt[tlementdeclaredannuallyor seasonally bythePrescribedAuthorityto bemade availabletotheholderof anErititlementbased upon theavailabilityofwaterfortheperiod withintilesub-basin, riverbasin,projector storage facility forIhatseasonoryear;and duringwatercrisisorscarcityon theprinciple of proportionate entitlement.
   • (c) "Authority"meansthe'Arunachal PradeshWater ResourcesRegulatoryAuthorityestablished undersection3 ;. -
   • (d) "Board"meanstheStateWaterBoard constitutedundersection15;
   • (e) "BulkWaterEnlitlemenl"shallmean the volumetricentitrement(0ashareofthe surface waterresourcesproducedby aproject,river system orstoragefacility,for a specific category orCategoriesot Use, anddeliverable withina specificperiodof timeasspecificallyprovided in theordergrantingtheEnlillement;
   • (f) "CategoryofUse"shallmean use otwaterfor differentpurposes,suchasfordomestic, agriculturalirrigation,'.agro-basedindustries, industrialorcommercial, environmental,etc., andincludessuchouterpurposesasmaybe prescribed;
   • (g) "Chairperson" meanstheChairpersonof the Authority;
   • (h) "Council"meanstheStateWaterCouncil constitutedundersection16 ;
     • (i) "Entitlement"meansanyauthorisationbyany riverbasinagencyto use thewaterfor the purposes ofthisAct;
   • (j) "Government"or''BtateGovernment"meansIhe Governmentof ArunachalPradesh.
   • (k) "Governor"meansttieGovernorofArunachal Pradesh.
   • (l) "IndividualWater Entitlement" means any authorizationbythe Authoritytouse the water otherthan BulkWaterEntitlementor an AggregateBulkWalerEntitlement;
   • (m) "Integrated State WaterPlan"means a water plan approved bythe State WaterCouncil;
   • (n) "Irrigation Project" meansa project constructed to provideirrigation faciJiliesto the land situated in thecommandarea inaccordancewith the projectreports andordersin this regard. as revised from time totime;
   • (o) "Member"meansaMemberof theAuthorityand- includes the Chairperson;
   • (p) "Prescribed"meansprescribedbythe rules made under this Act;
   • (q) "Prescribedauthcrity" meansanyauthorityet variouslevelswithin thewaterresource managementsystemthathas been duly authorised by Ihe Authority to determine and declare, on an annual or seasonal basis, the quota or amount of water available within a system for use as an allocated percentage of the entitlements duly issued by the Authority;
   • (r) 'Project Level Entity"means a group01all Water User Entities. from a common supply source withina water resources project; "Quota" means a VOlumetricquantity of water made availableto an Entitlement holder,which is derived by multiplying an Entillement by the annual or seasonal allocation percentage;
   • (t) "Regulations" means regulations made by Ihe Authority under this Act
   • (u) "River basin Agency" means any River basin Development Corporationsoperatingin the River basin or otherwise includes the Government Authorilies as specified by the Government. from limetotlme..
     • (v) "SelectionCommittee"means aSelection Committee constituted under section 5;
   • (w) "Slate" means theStat!'!of Arunachal Pradesh;
     • (x) "StateWaterPolicy"means theWaterPolicy of the State;
   • (y) "Sub-Basin"means ahydrologicunitor hydrologicsub-unitof ariverbasin withinthe State;
   • (z) "Sub-surfaceentitlement"meansanindividual or Bulk WaterEntitlementto a volumetric quantityof water to be extractedin the command area of the irrigationprojectfrom a tube well, bore well or otherwellorbyany other means of extractionofsub-surfacewater, or agroupor fieldorwellsdulyandlegallypermitted, registeredandconstructedin accordancewith standardsprscribedbytheAuthority;
   • (za) "Utility"meansanyWaterUserEntity responsiblefor the management, treatmentand distributionofdomesticormunicipalwater supplies(includingwateruse forIndustries);
   • (zb) "Volumetric"means ameasurementof water on the basis ofvolumeasperthenormsof the Bureau of IndianStandard; (2C) "WaterUserEntity"meansanyWaterUser's Association,Utility,IndustrialUser's Association,otherUser'sAssociation,or any othergroup (orindividual)whichis authorised by theAuthoritytoreceiveandutilizea water Entitlement;
   • (zd) 'WaterUser'sAssociation"meansa Water User'sAssociationformed at theminorlevel or above,whichrepresentsthe users ofirrigation waterfrom thatsegmentof anyproject,canal ornaturalflowstoragesystem;
2. (2) Wordsandexpressionsusedand notdefined in this Act butdefinedinvariousirrigationor waterresourcesrelatedActs in the State shall havethemeaningsrespectivelyassignedto them in those Acts.
