The Andhra Pradesh Gram Panchayats, Panchayat Samitis and Zilla Parishads (Amendment) Amending Act, 1986

This Act may be called the Andhra Pradesh Gram Panchayats, Panchayat Samitis and Zilla Parishads (Amendment) Amending Act, 1986.

In the Andhra Pradesh Gram Panchayats Act, 1964, in section 21, for the words "for a period of two years", the words "for a period of three years" shall be substituted.

In the Andhra Pradesh Panchayat Samitis and Zilla Parishads Act, 1959, in section 16, in sub-section (1), for the words "for a period of two years", the words "for a period of three years" shall be substituted.

Amendment of section 18.—In section 18 of the principal Act, to sub-section (1), the following proviso shall be added, namely:— " Provided that the offices of Sarpanches of Gram Panchayats in each Panchayat Samiti shall be reserved for the members of the Scheduled Castes and Scheduled Tribes and for women in such number and in such manner as may be prescribed."

Amendment of section 20.- In section 20 of the principal Act, in sub-section (1), for the words "every Gram Panchayat", the words "every Gram Panchayat, except where the Gram Panchayat, for any reason, considers it unnecessary" shall be substituted.

Amendment of section 21.- In section 21 of the principal Act, in sub-section (1), for the words "every Gram Panchayat", the words "every Gram Panchayat, except where the Gram Panchayat, for any reason, considers it unnecessary" shall be substituted.

Amendment of section 22.—In section 22 of the principal Act, for the words “every year”, the words “every month” shall be substituted.

Amendment of section 23.—In section 23 of the principal Act, to sub-section (1), the following proviso shall be added, namely:—

Amendment of section 24 Amendment of section 24.—In section 24 of the principal Act, in sub-section (1), for the words "every year", the words "every five years" shall be substituted.

Amendment of section 25.—In section 25 of the principal Act, to sub-section (1), the following proviso shall be added, namely:— " Provided that the Government may, by notification, extend the period for a further period not exceeding six months."

Amendment of section 27.—In section 27 of the principal Act, in clause (a), for the words "every month", the words "every three months" shall be substituted.

Amendment of section 28.—In section 28 of the principal Act, in sub-section (1), for the words "every month", the words "every three months" shall be substituted.

Amendment of section 30.—In section 30 of the principal Act, in sub-section (1), for the words "every month", the words "every alternate month" shall be substituted.

Amendment of section 31.—In section 31 of the principal Act, in sub-section (1), for the words "every month", the words "every alternate month" shall be substituted.

Amendment of section 34.—In section 34 of the principal Act, for clause (a), the following clause shall be substituted, namely:—

1. (a) he has been convicted by a criminal court of any offence involving moral turpitude, unless a period of five years has elapsed since his conviction; or.

Amendment of section 36.—In section 36 of the principal Act, in sub-section (1), for the words "every month", the words "every three months" shall be substituted.

Amendment of section 37.—In section 37 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

1. (1) Every Gram Panchayat shall, within such time as may be prescribed, prepare and submit to the Panchayat Samithi a budget containing a detailed estimate of income and expenditure for the ensuing year: Provided that the Panchayat Samithi may, if it is satisfied that the budget prepared by the Gram Panchayat is not in accordance with the provisions of this Act or the rules made thereunder, return the same to the Gram Panchayat with such modifications as it deems necessary, and the Gram Panchayat shall, after Considering the modifications, finalise the budget.

Amendment of section 38.—In section 38 of the principal Act,—

1. (1) for the words "Panchayat Samithi" wherever they occur, the words "District Development Officer" shall be substituted;
2. (2) in the proviso to sub-section (2), for the words "local authorities", the words "local bodies" shall be substituted.

Amendment of section 39.- In section 39 of the principal Act, for clause (i), the following clause shall be substituted, namely:- "(i) the Sarpanch of every Gram Panchayat in the taluk;"

Amendment of section 40.- In section 40 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:- "(1) The Panchayat Samiti shall have the power-

1. (a) to examine and approve the annual budgets of the Gram Panchayats in its jurisdiction;
2. (b) to exercise general supervision over the activities of the Gram Panchayats;
3. (c) to perform such other functions as may be entrusted to it by the Government."

Amendment of section 41.—In section 41 of the principal Act,—

1. (1) in sub-section (1), for the word "Every" the words "Subject to the provisions of section 44, every" shall be substituted;
2. (2) in sub-section (2), for the word "A" the words "Subject to the provisions of section 44, a" shall be substituted.

Amendment of section 44.—In section 44 of the principal Act,—

1. (a) in sub-section (1), for the words "The Sarpanch and the Upa-Sarpanch of a Gram Panchayat", the words "The Sarpanch of a Gram Panchayat" shall be substituted;
2. (b) in sub-section (2), for the words "The Sarpanch and the Upa-Sarpanch", the word "The Sarpanch" shall be substituted;
3. (c) in sub-section (3),—
   • (i) for the words "The Sarpanch and the Upa-Sarpanch", the word "The Sarpanch" shall be substituted;
   • (ii) for the words "concerned authorities", the words "concerned authority" shall be substituted;
4. (d) in sub-section (4), for the words "The Sarpanch and the Upa-Sarpanch", the word "The Sarpanch" shall be substituted.

Amendment of section 45.—In section 45 of the principal Act, in sub-section (1),—

1. (a) in clause (a), for the words "one hundred", the words "five hundred" shall be substituted;
2. (b) in clause (b), for the words "five hundred", the words "one thousand" shall be substituted.

Amendment of section 47.—In section 47 of the principal Act, in sub-section (1), for the words "one thousand", the words "two thousand" shall be substituted.

Amendment of section 48.—In section 48 of the principal Act, in sub-section (1), for the words "every month", the words "every quarter" shall be substituted.

Amendment of section 50.—In section 50 of the principal Act, in sub-section (1), for the words "two hundred and fifty", the words "five hundred" shall be substituted.

Amendment of section 51.—In section 51 of the principal Act, in sub-section (1),—

1. (i) for the expression "not less than seven days' notice", the expression "not less than three days' notice" shall be substituted;
2. (ii) the proviso shall be omitted.

Amendment of section 52.—In section 52 of the principal Act, in sub-section (1), for the expression "not less than seven days' notice", the expression "not less than three days' notice" shall be substituted.

Amendment of section 53.—In section 53 of the principal Act,—

1. (i) for the words "every Panchayat Samiti shall have a President", the words "every Panchayat Samiti shall have a President and a Vice-President" shall be substituted;
2. (ii) for the words "The President shall", the words "The President and the Vice-President shall" shall be substituted.

Amendment of section 54.—In section 54 of the principal Act, for the words "The President of the Panchayat Samiti shall", the words "The President and in his absence the Vice-President of the Panchayat Samiti shall" shall be substituted.

Amendment of section 55.— In section 55 of the principal Act, in sub-section (1), for the words "every year", the words "every year and publish the same in the prescribed manner" shall be substituted.

Amendment of section 57.— In section 57 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

1. (1) Every Gram Panchayat shall levy in the village such cess, land cess or other taxes as may be prescribed.

Amendment of section 61.—In section 61 of the principal Act, for the words "one hundred rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 62.—In section 62 of the principal Act, for the words "fifty rupees", the words "two hundred and fifty rupees" shall be substituted.

Amendment of section 65.—In section 65 of the principal Act, in sub-section (2), for the words "one hundred rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 66.—In section 66 of the principal Act, in sub-section (2), for the words "five hundred rupees", the words "one thousand rupees" shall be substituted.

Amendment of section 67.—In section 67 of the principal Act, in section (1), for the words "every year", the words "every year within such time as may be prescribed" shall be substituted.

Amendment of section 69.—In section 69 of the principal Act, in sub-section (1), for the words "every year" the words "every year within such time as may be prescribed" shall be substituted.

Amendment of section 70.—In the Andhra Pradesh Gram Panchayats Act, 1964 (hereinafter referred to as the principal Act), in section 70, in sub-section (1), for the words "every Gram Panchayat", the words "every Gram Panchayat, the Sarpanch or Executive Officer concerned" shall be substituted.

Amendment of section 71.—In section 71 of the principal Act, in sub-section (1), the words "or the Sarpanch" shall be omitted.

Amendment of section 72.—In section 72 of the principal Act, for the words "one hundred rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 73.—In section 73 of the principal Act, for the words "five hundred rupees", the words "one thousand rupees" shall be substituted.

Amendment of section 74.—In section 74 of the principal Act, in sub-section (1), for the words "every month", the words "every quarter" shall be substituted.

Amendment of section 75.—In section 75 of the principal Act, in sub-section (1), for the words "every month", the words "every quarter" shall be substituted.

Amendment of section 76.—In section 76 of the principal Act,—

1. (a) in sub-section (1), for the words "every Gram Panchayat shall levy", the words "every Gram Panchayat shall, within such limits and subject to such rules as may be prescribed, levy" shall be substituted;
2. (b) in sub-section (2), for the words "Every Gram Panchayat may also levy", the words "Every Gram Panchayat may also, subject to such rules as may be prescribed, levy" shall be substituted.

Amendment of section 77.—In section 77 of the principal Act,—

1. (a) in sub-section (1), for the words "every Gram Panchayat shall levy", the words "every Gram Panchayat shall, subject to such rules as may be prescribed, levy" shall be substituted;
2. (b) in sub-section (2), for the words "The Gram Panchayat shall also levy", the words "The Gram Panchayat may also, subject to such rules as may be prescribed, levy" shall be substituted;
3. (c) in sub-section (3), for the words "Every Gram Panchayat shall levy", the words "Every Gram Panchayat shall, subject to such rules as may be prescribed, levy" shall be substituted.

Amendment of section 78.—In section 78 of the Andhra Pradesh Gram Panchayats Act, 1964 (hereinafter in this Chapter referred to as the principal Act),—

1. (a) in sub-section (1), for the words "The Sarpanch, Upa-Sarpanch or any other member", the words "The Sarpanch, Upa-Sarpanch, any other member or the Executive Officer" shall be substituted;
2. (b) in sub-section (2), for the words "the Sarpanch, Upa-Sarpanch or member", the words "the Sarpanch, Upa-Sarpanch, member or Executive Officer" shall be substituted;
3. (c) in sub-section (3), after the words "Upa-Sarpanch", the words "or the Executive Officer" shall be inserted.

Amendment of section 79.—In section 79 of the principal Act,—

1. (a) in sub-section (1), for the words "every Zilla Praja Parishad shall have a Chief Executive Officer", the words "every Zilla Praja Parishad shall have a Chief Executive Officer who shall be a person in the rank of a District Collector" shall be substituted;
2. (b) in sub-section (2), for the words "The Chief Executive Officer shall be appointed by the Government", the words "The Chief Executive Officer shall be appointed by the Government from among the officers of the Indian Administrative Service" shall be substituted.

Amendment of section 81.- In section 81 of the principal Act, in sub-section (1), for the words "every year", the words "every year and such tax shall be deemed to have been in force from the commencement of the financial year" shall be substituted.

Amendment of section 82.- In section 82 of the principal Act, in sub-section (1), for the words "every year", the words "every year and such tax shall be deemed to have been in force from the commencement of the financial year" shall be substituted.

Amendment of section 83.—In the Andhra Pradesh Gram Panchayats Act, 1964 (hereinafter referred to as the principal Act), in section 83, in sub-section (1), for the words "every Gram Panchayat", the words "every Gram Panchayat and every such authority as may be prescribed" shall be substituted.

Amendment of section 84.—In the principal Act, in section 84, in sub-section (1), for the words "every Gram Panchayat", the words "every Gram Panchayat and every such authority as may be prescribed" shall be substituted.

Amendment of section 85.—In section 85 of the principal Act,—

1. (i) for the expression "the Panchayat Samiti", the expression "the Mandal Praja Parishad" shall be substituted;
2. (ii) for the expression "the Panchayat Samiti fund", the expression "the Mandal Praja Parishad fund" shall be substituted.

Amendment of section 86.—In section 86 of the principal Act,—

1. (i) in sub-section (1),—

1. (a) for the expression "the Panchayat Samiti", the expression "the Mandal Praja Parishad" shall be substituted;
2. (b) for the expression "the Panchayat Samiti fund", the expression "the Mandal Praja Parishad fund" shall be substituted;
   • (ii) for sub-section (2), the following shall be substituted, namely:— "(2) The Mandal Praja Parishad fund shall be vested in the Mandal Praja Parishad and the amount standing to the credit of the fund shall be kept in any Government treasury or in any bank approved by the Government."

Amendment of section 87.—In the Andhra Pradesh Gram Panchayants Act, 1964 (hereinafter referred to as the principal Act), in section 87,—

1. (1) in sub-section (1), for the words "every Gram Panchayat shall levy", the words "every Gram Panchayat may levy" shall be substituted;
2. (2) in sub-section (2), for the words "shall levy", the words "may levy" shall be substituted.

Amendment of section 88.—In section 88 of the principal Act, for the words "shall levy" wherever they occur, the words "may levy" shall be substituted.

Amendment of section 89.—In section 89 of the principal Act, for the words "one hundred rupees" occurring in two places, the words "five hundred rupees" shall be substituted.

Amendment of section 90.—In section 90 of the principal Act, for the words "one hundred rupees" occurring in two places, the words "five hundred rupees" shall be substituted.

Amendment of section 91.—In section 91 of the principal Act, in sub-section (1), for the words "every year", the words "every year or such other period as may be prescribed" shall be substituted.

Amendment of section 92.—In section 92 of the principal Act, in sub-section (1), for the words "every year", the words "every year or such other period as may be prescribed" shall be substituted.

Amendment of section 93.—In section 93 of the principal Act, for clause (i), the following clause shall be substituted, namely:—

1. (i) for the words "one hundred rupees", the words "five hundred rupees" shall be substituted;

Amendment of section 94.—In section 94 of the principal Act,—

1. (a) in sub-section (1), for the words "every Zilla Parishad shall have a Secretary", the words "every Zilla Parishad shall have a Chief Executive Officer" shall be substituted;
2. (b) for sub-section (2), the following sub-section shall be substituted, namely:— "(2) The Chief Executive Officer shall be a person belonging to the Indian Administrative Service or a person who has held the office of or is holding the office of a District Collector or an Additional District Collector or a Joint Collector or a Senior Scale Officer of the Andhra Pradesh State Higher Judicial Service or a Selection Grade or Senior Scale Officer of any State Service not lower in rank than that of a Deputy Development Commissioner or Chief Executive Officer of a Zilla Parishad.";
3. (c) in sub-section (3), for the words "Secretary" wherever they occur, the words "Chief Executive Officer" shall be substituted;
4. (d) in sub-section (4), for the words "Secretary" the words "Chief Executive Officer" shall be substituted.

Amendment of section 95.—In section 95 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

1. (1) Every Panchayat Samiti shall have power to levy a surcharge on such taxes as the Government may, by notification, specify, subject to such rules as may be prescribed.

Amendment of section 96.—In section 96 of the principal Act, in sub-section (1), in clause (a), the words "or at a meeting of the Zilla Parishad" shall be omitted.

Amendment of section 99 Amendment of section 99.—In Section 99 of the principal Act, for the words "one hundred rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 100.—In Section 100 of the principal Act, for the words "five hundred rupees", the words "two thousand rupees" shall be substituted.

Amendment of section 101.—In section 101 of the principal Act,—

1. (a) for the marginal heading, the following shall be substituted, namely:— "Constitution of Zilla Praja Parishad";
2. (b) in sub-section (1), for the words "Zilla Parishad" wherever they occur, the words "Zilla Praja Parishad" shall be substituted;
3. (c) in clause (i), for the words "Panchayat Samitis", the words "Mandal Praja Parishads" shall be substituted;
4. (d) in clause (iii), for the words "District Collector", the words "District Collector" shall be omitted;
5. (e) in clause (iv), for the words "Panchayat Samitis", the words "Mandal Praja Parishads" shall be substituted;
6. (f) in sub-section (2), for the words "Zilla Parishad" wherever they occur, the words "Zilla Praja Parishad" shall be substituted.

Amendment of section 102.—In the Andhra Pradesh Gram Panchayats Act, 1964 (Act 2 of 1964) (hereinafter in this Chapter referred to as the principal Act), in section 102,—

1. (a) in sub-section (1), for the words "District Collector" wherever they occur, the words "District Development Officer" shall be substituted;
2. (b) in sub-section (2), for the words "District Collector", the words "District Development Officer" shall be substituted.

Amendment of section 103.—In section 103 of the principal Act, for clause

1. (a) of sub-section (1), the following clause shall be substituted, namely:—
2. (a) every transfer of land, whether by sale, gift, exchange, mortgage with possession, lease in perpetuity or otherwise, and whether such transfer is inter vivos or by a decree or order of a Court or any other authority; and

Amendment of section 104.—In section 104 of the principal Act, in sub-section (1), for the words "every transfer of land" the words "every transfer of land, whether by sale, gift, exchange, mortgage with possession, lease in perpetuity or otherwise, and whether such transfer is inter vivos or by a decree or order of a Court or any other authority" shall be substituted.

Amendment of section 105.—In section 105 of the principal Act, for clause

1. (ii) of sub-section (1), the following clause shall be substituted, namely:—
2. (ii) such share of the land cess and such share of the education cess not exceeding fifteen per cent. of the land cess and education cess as the Government may, by notification, direct, levied under the Andhra Pradesh Gram Panchayats Act, 1964.

Amendment of section 106.—In section 106 of the principal Act, in sub-section (1), for the words "every Zilla Parishad shall have a fund to be called the Zilla Parishad Fund", the following shall be substituted, namely:— "every Zilla Parishad shall have a fund to be called the Zilla Parishad General Fund".

Amendment of section 107.—In the Andhra Pradesh Gram Panchayats Act, 1964 (hereinafter referred to as the principal Act), in section 107, for the words "every Gram Panchayat", the words "every Gram Panchayat or Panchayat Samiti or Zilla Parishad" shall be substituted.

Amendment of section 108.—In section 108 of the principal Act, for the words "every Gram Panchayat", the words "every Gram Panchayat or Panchayat Samiti or Zilla Parishad" shall be substituted.

Amendment of section 109.—In section 109 of the principal Act,—

1. (a) in sub-section (1), for the words “every Panchayat Samiti shall have a President”, the words “every Panchayat Samiti shall have a President and a Vice-President” shall be substituted;
2. (b) in sub-section (2), for the words “The President”, the words “The President and the Vice-President” shall be substituted.

Amendment of section 110.—In section 110 of the principal Act,—

1. (a) in sub-section (1), for the words "by the Gram Panchayat", the words "to the Gram Panchayat" shall be substituted;
2. (b) in sub-section (2), for the words "taxes or fees levied by the Gram Panchayat", the words "taxes or fees due to the Gram Panchayat" shall be substituted;
3. (c) in sub-section (3), for the words "collect the taxes and fees", the words "collect the taxes and fees due" shall be substituted.

Amendment of section 111.- In section 111 of the principal Act,—

1. (a) in sub-section (1), for the words "tax on professions, trades, callings and employments", the words "tax on professions, trades, callings and employments shall subject to such rules as may be prescribed" shall be substituted;
2. (b) in sub-section (2), for the words "every company which transacts business", the words "every company which after the commencement of the Andhra Pradesh Gram Panchayats, Panchayat Samitis and Zilla Parishads (Amendment) Act, 1986 transacts business" shall be substituted;
3. (c) in sub-section (3), for the words "the Gram Panchayat", the words "the Gram Panchayat shall, subject to such rules as may be prescribed," shall be substituted;
4. (d) in sub-section (4), for the words "The tax leviable", the words "The tax leviable shall subject to such rules as may be prescribed" shall be substituted.

Amendment of section 112.—In section 112 of the principal Act,—

1. (a) in sub-section (1), for the words "every Zilla Parishad shall have a Chief Executive Officer", the words "every Zilla Parishad shall have a Chief Executive Officer who shall be a District Collector or an officer of the rank of a District Collector" shall be substituted;
2. (b) for sub-section (2), the following sub-section shall be substituted, namely:— "(2) The Chief Executive Officer shall have the right to attend the meetings of the Zilla Parishad and of any committee thereof and to take part in the proceedings but shall not have the right to vote.";
3. (c) in sub-section (3), for the words "The Chief Executive Officer", the words "Subject to the control of the Zilla Parishad, the Chief Executive Officer" shall be substituted.

Amendment of section 113. — In section 113 of the principal Act, in sub-section (1), for the words "local cess", the words "local cess or land cess" shall be substituted.

Amendment of section 114. — In section 114 of the principal Act, in sub-section (1), for the words "local cess", the words "local cess or land cess" shall be substituted.

Amendment of section 115.—In section 115 of the Principal Act,—

1. (a) in sub-section (1), for the words "every Gram Panchayat shall incur", the words "every Gram Panchayat may incur" shall be substituted;
2. (b) in sub-section (2),—
   • (i) for the words "shall, with the previous sanction", the words "may, with the previous sanction" shall be substituted;
   • (ii) for the words " provided that the Gram Panchayat shall not", the words " provided that the Gram Panchayat may not" shall be substituted.

Amendment of section 116.—In section 116 of the principal Act,—

1. (a) in sub-section (1), for the words "every Gram Panchayat shall", the words "every Gram Panchayat may, and if so required by the Government shall" shall be substituted;
2. (b) in sub-section (2), for the words "every Panchayat Samiti shall", the words "every Panchayat Samiti may, and if so required by the Government shall" shall be substituted;
3. (c) in sub-section (3), for the words "every Zilla Parishad shall", the words "every Zilla Parishad may, and if so required by the Government shall" shall be substituted.

Amendment of section 117.—In section 117 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

1. (1) Every Gram Panchayat shall have a Gram Panchayat Fund to which shall be credited all the moneys received by the Gram Panchayat.

Amendment of section 118.—In section 118 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

1. (1) All moneys received by the Gram Panchayat shall be lodged in the nearest Government Treasury or in such other bank as may be approved by the Government.

Amendment of section 119.—In section 119 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

1. (1) Every person who is in default in the payment of any tax or other amount due to a Gram Panchayat or a Mandal Praja Parishad or a Zilla Praja Parishad shall be liable to pay such penalty, as may be prescribed, in addition to the amount due.

Amendment of section 120.—In section 120 of the principal Act,—

1. (1) in sub-section (1), for the words "Panchayat Samiti or Zilla Parishad", the words "Mandal Praja Parishad or a Zilla Praja Parishad" shall be substituted;
2. (2) in sub-section (2), for the words "the Panchayat Samiti or Zilla Parishad" wherever they occur, the words "the Mandal Praja Parishad or the Zilla Praja Parishad" shall be substituted.

Amendment of section 121.—In section 121 of the principal Act,—

1. (a) in sub-section (1), for the words "every Gram Panchayat", the words "every Gram Panchayat or Mandal Praja Parishad" shall be substituted;
2. (b) in sub-section (2),—
   • (i) for the words "executive authority of the Gram Panchayat", the words "executive authority of the Gram Panchayat or the Mandal Development Officer of the Mandal Praja Parishad" shall be substituted;
   • (ii) for the words "that Gram Panchayat", the words "that Gram Panchayat or Mandal Praja Parishad" shall be substituted;
3. (c) in sub-section (3), for the words "Gram Panchayat" wherever they occur, the words "Gram Panchayat or Mandal Praja Parishad" shall be substituted.

Amendment of section 122.—In section 122 of the principal Act,—

1. (a) for the marginal heading, the following shall be substituted, namely:— "Power to remove difficulties.";
2. (b) for sub-section (1), the following sub-section shall be substituted, namely:— "(1) If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Andhra Pradesh Gazette, make such provisions, not inconsistent with the provisions of this Act, as appear to them to be necessary or expedient for removing the difficulty.";
3. (c) in sub-section (2), for the words "one year", the words "two years" shall be substituted.

Amendment of section 123.- In section 123 of the principal Act, in sub-section (1), for the words "one hundred rupees", the words "five hundred rupees" shall be substituted.

Amendment of section 124.- In section 124 of the principal Act, in sub-section (1), for the words "ten rupees", the words "fifty rupees" shall be substituted.

Amendment of section 125.—In section 125 of the principal Act,—

1. (a) in sub-section (1), for the words "every Gram Panchayat shall", the words "every Gram Panchayat shall, subject to the control of the Government," shall be substituted;
2. (b) in sub-section (2), for the words "The Gram Panchayat may", the words "The Gram Panchayat may, subject to the control of the Government," shall be substituted;
3. (c) in sub-section (3), for the words "The Gram Panchayat may", the words "The Gram Panchayat may, subject to the control of the Government," shall be substituted.

Amendment of section 126.—In section 126 of the principal Act,—

1. (a) in sub-section (1), for the words "every Gram Panchayat", the words "every Gram Panchayat or as the case may be, the Mandal Praja Parishad" shall be substituted;
2. (b) in sub-section (2), for the words "the Gram Panchayat", the words "the Gram Panchayat or the Mandal Praja Parishad" shall be substituted;
3. (c) in sub-section (3), for the words "Gram Panchayat", the words "Gram Panchayat or the Mandal Praja Parishad" shall be substituted.

Amendment of section 127.—In section 127 of the principal Act, in sub-section (1), for the word "Every", the words "Subject to such rules as may be prescribed, every" shall be substituted.

Amendment of section 128.—In section 128 of the principal Act, in sub-section (1), for the words "The Executive Officer", the words "Subject to such rules as may be prescribed, the Executive Officer" shall be substituted.

Amendment of section 129.—In section 129 of the principal Act,—

1. (a) in sub-section (1), for the words "every Gram Panchayat", the words "every Gram Panchayat or any other person authorised by the Gram Panchayat" shall be substituted;
2. (b) in sub-section (2), for the words "every Panchayat Samiti", the words "every Panchayat Samiti or any other person authorised by the Panchayat Samiti" shall be substituted;
3. (c) in sub-section (3), for the words "every Zilla Parishad", the words "every Zilla Parishad or any other person authorised by the Zilla Parishad" shall be substituted.

Amendment of section 130.— In section 130 of the principal Act,—

1. (a) in sub-section (1), for the words "every Zilla Parishad", the words "every Zilla Praja Parishad" shall be substituted;
2. (b) in sub-section (2), for the words "Zilla Parishad" wherever they occur, the words "Zilla Praja Parishad" shall be substituted;
3. (c) in sub-section (3), for the words "Zilla Parishad", the words "Zilla Praja Parishad" shall be substituted.

Amendment of section 131.—In section 131 of the principal Act, for clause (ii), the following clause shall be substituted, namely:—

1. (ii) such share of the land cess and education cess levied under the Andhra Pradesh Gram Panchayats Act, 1964 as may be prescribed for each of the institutions;

Amendment of section 132.—In section 132 of the principal Act, in sub-section (1), for the words "every Zilla Parishad shall constitute a District Development Board", the words "every Zilla Parishad may constitute a District Development Board" shall be substituted.
