Power of State Government to make rules
The Uttarakhand Co-operative Societies Act, 2003(1) The State Government may, after publication in Gazette, make rules generally for carrying out the purposes of this Chapter, including any rules prescribing fees in respect of any proceedings under this Chapter. (2) In particular and without prejudice to the generality of the power under sub-section (1) the State Government may make rules providing for all or any of the following matters- (a) the procedure for the distraint and sale of produce of land mortgaged to Uttarakhand State co-operative Bank; (b) the procedure for sale of property mortgaged to Uttarakhand State co-operative Bank; (c) fixing the percentage under clause (c) of sub-section 3 of section 136 for determining the limit of the debentures issued by the Bank; (d) laying conditions under which the maximum amount of guarantee given by the State Government may be increased, withdrawn restricted or modified; (e) any other matter which has to be, or may be prescribed. (3) All rules made under this section shall as soon as may be, after they are made, be laid before the State Legislature while it is in session, for a total period of not less than 14 days and shall take effect from the date of their publication in the Gazette.
