Power of State Government to take possession of works and cancel powers of Board
The Tuticorin Port Trust Act, 1924If, at any time, it appears to the State Government that the works intended to be executed by the Board under this Act have not been and are not likely to be properly carried out or maintained by the Board, the State Government may give six months' notice, by order published in the Official Gazette, that unless, within that period, the Board take measures to the satisfaction of the State Government for the carrying out or maintenance of the said works the powers by this Act conferred on the Board shall, at the end of such period, be withdrawn or revoked. If, at the end of such period, the Board has not taken such measures, the State Government may assume possession and management of the works already constructed, and may, by a like notification, declare the powers of the Board to be withdrawn or revoked and upon publication of such notification, all immovable and movable property, all debts and liabilities, and all moneys and securities, and all rights of suit, which at the time are vested in the Board shall be transferred to, and vested in the State Government ; and the rights of all creditors of the Board under this Act shall continue as against the State Government to the extent of the property so transferred to and vested in them.
