The Punjab State Legislature (Vacation of Seats) Act, 1957
This Act regulates the membership of the Punjab State Legislature, specifically addressing situations where an individual is elected to both the Legislative Assembly and the Legislative Council. It establishes a clear procedure to prevent dual membership, ensuring that a representative serves in only one house. If a person is elected to both houses but has not yet taken a seat, they must notify the Chief Electoral Officer within ten days of the election declaration to choose their preferred house; otherwise, the Council seat is automatically vacated. Furthermore, the Act mandates that if a sitting member of one house is elected to the other, their original seat is automatically vacated upon the publication of the new election results.
