Institution of Proceedings

(1) No prosecution shall be instituted under this Act except upon a complaint made by a District Magistrate. (2) On the application of a person accused of an offence under this Act, the District Magistrate may compound such offence by levying a composition fine not exceeding Rs. 2,000, at any stage before the judgment in the case has been announced. (3) No court inferior to that of a (Judicial Magistrate) of the first class shall try any offence under this Act.
