Prohibition of arrest or detention of women and persons under disability

Notwithstanding anything in this Act, the Certificate Officer shall not order the arrest or detention in the civil prison of— (a) a woman, or (b) any person who in his opinion, is a minor or of unsound mind. Where the certificate holder is a co-sharer landlord and the certificate is for his share of the rent only, the provisions of rules 38, 39 and 40 shall not apply.
