Bare Act
The Suits Valuation and the Bombay Court-fees (Amendment) and the Bombay City Civil Court Decrees and Orders (Validation) Act, 1970
Civil19707 orders
This Act is a curative piece of legislation enacted to resolve jurisdictional uncertainties regarding the Bombay City Civil Court. Previously, disputes arose over whether the City Court could hear cases where the subject matter could not be valued in monetary terms. This Act settles the matter by assigning a notional value of three hundred rupees to such suits. Crucially, it validates past decrees and orders that might have been challenged on jurisdictional grounds, ensuring that legal proceedings are not dismissed due to technical valuation issues. It provides a mechanism for citizens to restore previously returned cases, protecting their right to justice.
