In this Act, unless the context otherwise requires,— (a) "Board" means the Kerala Bamboo, Kattuvally and Pandanus Leaf Workers Welfare Fund Board constituted under section 6; (b) "Chief Executive Officer" means the Chief Executive Officer appointed under section 9; (c) "contribution" means the contribution payable by the employee and the employer to the fund under the scheme; (d) "employee" means any person who is employed for wages in any work in connection with the bamboo, kattuvally and pandanus leaf industry; (e) "employer" means any person who employs either directly or through another person, or in any other manner whatsoever, one or more employees in any work in connection with the bamboo, kattuvally and pandanus leaf industry; (f) "Fund" means the Welfare Fund established under the scheme; (g) "Member" means a member of the Fund; (h) "Scheme" means the scheme framed under this Act; (i) "State" means the State of Kerala; (j) "wages" means all remuneration capable of being expressed in terms of money, which would, if the terms of contract of employment, express or implied, were fulfilled, be payable to an employee in respect of his employment or of work done in such employment, and includes notice pay and wages for leave period, but does not include the value of any house accommodation, or of supply of light, water, medical attendance or other amenity or of any service excluded by general or special order of the Government.

(1) The Government may, by notification in the Gazette, frame a scheme to be called the Bamboo, Kattuvally and Pandanus Leaf Workers Welfare Fund Scheme for the establishment of a fund under this Act for the welfare of the employees and there shall be established, as soon as may be after the framing of the scheme, a fund in accordance with the provisions of this Act and the scheme. (2) There shall be credited to the Fund: (a) contributions specified under section 4; (b) the amount borrowed by the Board; (c) damages realised under section 14; (d) grants or loans or advances made by the Government; (e) any fund of any welfare organisation which the Government may, by notification, direct to be credited to the Fund; (f) any other amount payable into the Fund under the scheme; (g) any voluntary donations. (3) The Fund shall vest in, and be administered by the Board. (4) The Fund may be utilised for all or any of the following purposes, namely:— (a) to provide for immediate relief to the employees in case of accident; (b) to provide for the welfare of the employees by way of medical aid, pension, family pension, education, marriage assistance and maternity benefit; (c) any other benefit which may be provided under the scheme. (5) The Scheme framed under sub-section (1) may provide for all or any of the matters specified in sub-section (5) of section 4. (6) The Government may, by notification in the Gazette, add to, amend or vary the scheme either prospectively or retrospectively. (7) Every scheme framed under this Act shall be laid, as soon as may be after it is framed, before the Legislative Assembly while it is in session for a total period of fourteen days which may be comprised in one session or in two successive sessions, and if, before the expiry of the session in which it is so laid or the session immediately following, the Legislative Assembly makes any modification in the scheme, the scheme shall thereafter have effect only in such modified form.

(1) If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Gazette, make such provisions, not inconsistent with the provisions of this Act, as appear to them to be necessary or expedient for removing the difficulty. (2) Every order issued under sub-section (1) shall, as soon as may be after it is issued, be laid before the Legislative Assembly.

(1) The Government may, by notification in the Gazette, constitute with effect from such date as may be specified therein, a Board to be called "The Kerala Bamboo, Kattuvally and Pandanus Leaf Welfare Fund Board" for the administration of the Fund and to supervise or carry out the activities financed from the Fund. (2) The Board shall be a body corporate by the name aforesaid, having perpetual succession and a common seal and shall by the said name sue and be sued.

(1) No suit, prosecution or other legal proceedings shall lie against any person for anything which is in good faith done or intended to be done in pursuance of this Act or any rule made thereunder. (2) No suit or other legal proceeding shall lie against the Government, the Board or any officer for any damage caused or likely to be caused by anything which is in good faith done or intended to be done in pursuance of this Act or any rule made thereunder.

(1) The Government may, by notification in the Gazette, make rules for the purpose of carrying into effect the provisions of this Act. (2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for (a) the constitution of the Board, the term of office of members, and the procedure to be followed in the meetings of the Board; (b) the mode of maintenance of the Fund; (c) the manner of registration of workers and employers. (3) Every rule made under this section shall be laid, as soon as may be after it is made, before the Legislative Assembly, while it is in session, for a total period of 14 days which may be comprised in one session or in two successive sessions.

(1) No person shall be disqualified for being chosen as, and for being, a member of the Legislative Assembly solely on the reason that he holds an office of profit under the Board. (2) The Board shall be deemed to be a local authority for the purposes of the Kerala State Legislature (Prevention of Disqualification) Act.

(1) The Board shall meet, at such places and times and shall observe such rules of procedure in regard to the transaction of business at its meetings as may be provided in the regulations made under this Act. (2) The Chairman of the Board shall preside over the meetings of the Board.
