Power to require trees, hedges, etc., to be trimmed

(1) Whoever, without the permission of Municipal Commissioner or the Executive Officer lops or cuts the branches or twigs of any tree or plant standing on a public place, or plucks the fruits, flowers or leaves of such tree or plant, or causes any damages thereto, shall be punishable with fine which may extend to Rs. 5,000, and in the case of a second or subsequent breach, to Rs. 2,000. (2) The Municipal Commissioner or the Executive Officer may, if he thinks fit, by notice, in writing, require the owner or the occupier any land in the municipal area on which trees, shrubs or hedges are growing to keep such trees, shrubs or hedges in a trim condition, and remove any such tree, shrub or hedge, if it obstructs traffic on any street or poses a danger to public safety or overhangs any street causing inconvenience or danger to the passers-by. (3) If it appears to the Municipal Commissioner or the Executive Officer that immediate action is necessary for public safety, he may, without notice, cause such tree, shrub or hedge to be removed from the land as aforesaid and the expenses thereof shall be paid by the owner or the occupier of such land.
