Dissolution of the Council

Dissolution of the Council.—(1) If, in the opinion of the Governor, the Council,—

1. (i) has shown incompetence to perform, or has made default in the performance of the duties imposed on it by or under this Act or any other law for the time being in force, or
2. (ii) has exceeded or abused its powers, the Governor may by order to be published in the Government Gazette, stating the reasons therefor, dissolve the Council and direct that it be reconstituted within such period not exceeding six months as may be specified in the order.

1. (2) The Governor shall, before making any order under sub-section (1), give to the Council a notice, containing the charges and opportunity of making representation within the period prescribed in the notice to the Governor in respect of the same.
