Penalties.

(1) Any applicant who gives false information or fails to comply with the conditions or undertakings in the self-certification given on the web portal or to any Appropriate Authority, as the case may be, will face penalty which may extend to Rs. 15,000 for the first offence and upto Rs. 25,000 for the second or subsequent offences. (2) The Director, Industries Department will be the Competent Authority to pass an order to impose a penalty under sub-section (1) : Provided that no order of penalty will be passed without giving the concerned person an opportunity of being heard. (3) The Director, Industries Department will communicate order passed under sub-section (2) to the applicant concerned. The applicant will have to deposit the amount of such penalty with the State Investment Promotion and Facilitation Cell within thirty days from the date of communication of the order. (4) In case of undue delay in processing the case for clearances as per the time schedule prescribed, action shall be taken against the concerned officer by the concerned Disciplinary Authority under the applicable Service Conduct Rules.
