Establishment, constitution and incorporation of Council

Statutory text
- (1) The Government may, as soon as may be, by notification establish a Council to be called, 'the Council of Homoeopathic System of Medicines, Himachal Pradesh' for the purpose of carrying out the provisions of this Act.
- (2) The Council shall be a body corporate with name aforesaid, having perpetual succession and a common seal with power to acquire, hold and dispose of property, and to contract, and may by that name sue and be sued.
- (3) The Council shall consist of eight members residing in Himachal Pradesh of whom-
- (a) three members shall be nominated by the Government one of them, if possible, being a person connected with such institutions as are referred to in Schedule-I; and
- (b) five members, of whom not less than three shall be persons holding a degree, diploma or certificate in the Homoeopathic system from such institutions as are referred to in Schedule-I, shall be elected by the registered practitioners from amongst themselves.
- (4) The Chairman of the Council shall be nominated by the Government from amongst the members and shall hold office during the pleasure of the Governor.
- (5) The Chairman of the Council and five members mentioned in clause
- (b) of sub-section
- (3) shall in the case of first Council to be constituted, be nominated by the Government from amongst practitioners, and such members shall be deemed to have been duly elected under clause
- (b) of sub-section (3):
