Chapter I PRELIMINARY
1. Short title, extent and commencement
- (1) This Act may be called the Indian Institute of Teacher Education Gujarat Act, 2010.
- (2) It extends to the whole of the State of Gujarat.
- (3) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
Chapter I PRELIMINARY
2. Definitions
- (1) In this Act, unless the context otherwise requires,—
- (a) "Academic Council" means the Academic Council of the University;
- (b) "authorities" means the authorities of the University as specified in section 17;
- (c) "Executive Council" means the Executive Council of the University;
- (d) "Finance Committee" means the Finance Committee of the University;
- (e) "General Council" means the General Council of the University;
- (f) "prescribed" means prescribed by statutes, ordinances or regulations;
- (g) "regulations" means the regulations made by the Academic Council under section 34;
- (h) "State Government" means the Government of Gujarat;
- (i) "statutes" and "ordinances" mean respectively the statutes and ordinances of the University made under this Act;
- (j) "University" means the Indian Institute of Teacher Education Gujarat established and incorporated under section 3;
- (k) "Vice-Chancellor" means the Vice-Chancellor of the University appointed under section 12.
Chapter II ESTABLISHMENT AND INCORPORATION OF UNIVERSITY
3. Establishment and incorporation of University
- (1) There shall be established a University by the name of "the Indian Institute of Teacher Education, Gujarat".
- (2) The Chancellor, the first Vice-Chancellor, the first Registrar and the members of the General Council, the Executive Council and the Academic Council and all persons who may hereafter become such officers or members so long as they continue to hold such office or membership are hereby constituted a body corporate by the name of "the Indian Institute of Teacher Education, Gujarat".
- (3) The University shall have perpetual succession and a common seal and shall sue and be sued by the said name.
- (4) The University shall be competent to acquire and hold property, both movable and immovable, to lease, sell or otherwise transfer any movable or immovable property which may have become vested in or have been acquired by it for the purposes of the University and to contract and do all other things necessary for the purposes of this Act.
- (5) In all suits and other legal proceedings by or against the University, the pleading shall be signed and verified by the Registrar or any other person authorised in this behalf by the Vice-Chancellor and all processes in such suits and proceedings shall be issued to and served on the Registrar.
Chapter II ESTABLISHMENT AND INCORPORATION OF UNIVERSITY
4. Headquarters of University
The headquarters of the University shall be at such place as the State Government may, by notification in the Official Gazette, specify.

5. Objects of University
Objects of University. - The objects of the University shall be to—
- (i) establish the University as an institution of excellence for the studies, research and extension of teacher education;
- (ii) provide for instructions in such branches of learning as the University may deem fit;
- (iii) provide for research and for the advancement of and dissemination of knowledge in the field of teacher education;
- (iv) undertake extra-mural studies, extension programmes and outreach activities to contribute to the societal development;
- (v) do all such acts and things as may be necessary or desirable to further the objects of the University.
Chapter II ESTABLISHMENT AND INCORPORATION OF UNIVERSITY
6. Powers and functions of University
Powers and functions of University. - The University shall have the following powers and functions, namely:—
- (i) to administer and manage the University and establish such centres for research, education and instruction as are in consonance with the objects of the University;
- (ii) to carry out teaching and research and offer continuing education programmes;
- (iii) to create such teaching, research, administrative and other posts as the University may deem necessary, and to make appointments thereto;
- (iv) to create courses of study and set up centres and specialised laboratories;
- (v) to institute and award degrees, diplomas, certificates and other academic distinctions;
- (vi) to lay down conditions of service of all categories of employees;
- (vii) to supervise and control the residence and regulate the discipline of students of the University and to make arrangements for promoting their health and general welfare;
- (viii) to make such provisions as it may deem necessary to enable students to undertake studies in courses of teaching and research in areas other than those offered by the University;
- (ix) to provide for the printing, publication and reproduction of research, educational material and other works and to organise exhibitions, conferences, symposia, workshops and seminars;
- (x) to collaborate with other academic and research institutions or organisations within or outside India;
- (xi) to construct, maintain and manage such buildings and other structures as are necessary for the functioning of the University;
- (xii) to receive funds, subscriptions, donations and gifts and to manage, invest and expend the funds and endowments of the University;
- (xiii) to undertake consultancy, research projects and other related activities;
- (xiv) to issue guidelines for the assessment, evaluation and continuous improvement of the standards of teacher education;
- (xv) to frame Statutes, Ordinances and Regulations for carrying out the objects of the University;
- (xvi) to do all such acts and things as may be necessary or incidental to the exercise of all or any of the powers of the University.
Chapter II ESTABLISHMENT AND INCORPORATION OF UNIVERSITY
7. Mode of research
Mode of research. - The research in the University shall be undertaken either through the faculty of the University or through the research centres or in collaboration with any other institution or organisation approved by the University.

8. Jurisdiction of University
Jurisdiction of University. -
- (1) The jurisdiction of the University shall extend to the whole of the State of Gujarat.
- (2) No college, institution or centre of teacher education shall, save with the consent of the University and the sanction of the State Government, be associated in any way with or seek admission to any privileges of any other University in India or abroad.

9. University open to all irrespective of religion, race, caste, sex or opinion
University open to all irrespective of religion, race, caste, sex or opinion.—
- (1) The University shall be open to all persons of whatever race, religion, belief, caste, class or sex and it shall not be lawful for the University to adopt or impose on any person any test whatsoever of religious belief or profession in order to entitle him to be appointed as a teacher of the University or to hold any other office therein or to be admitted as a student in the University or to graduate thereat or to enjoy or exercise any privilege thereof.
- (2) Nothing in this section shall be deemed to prevent the University from making special provisions for the admission of students of the weaker sections of the society and in particular of the Scheduled Castes, the Scheduled Tribes and the Other Backward Classes.
Chapter III OFFICERS OF UNIVERSITY
10. Officers of University
Officers of University.— The following shall be the officers of the University, namely:—
- (1) The Chancellor,
- (2) The Vice-Chancellor,
- (3) The Registrar,
- (4) The Finance and Accounts Officer, and
- (5) Such other officers in the service of the University as may be declared by the Statutes to be the officers of the University.

11. Chancellor
Chancellor.—
- (1) The Governor of Gujarat shall be the Chancellor of the University.
- (2) The Chancellor shall, by virtue of his office, be the Head of the University and the President of the General Council and shall, when present, preside over the meetings of the General Council and of any convocation of the University.
- (3) The Chancellor shall have the right to cause an inspection to be made by such person or persons as he may direct, of the University, its buildings, laboratories, libraries, museums, workshops and equipment and of any institution maintained by the University and also of the examinations, teaching and other work conducted or done by the University and to cause an inquiry to be made in the like manner in respect of any matter connected with the University.
- (4) The Chancellor shall, in every case, give notice to the University of his intention to cause an inspection or inquiry to be made and the University shall be entitled to appoint a representative who shall have the right to be present and be heard at such inspection or inquiry.
- (5) The Chancellor may address the Vice-Chancellor with reference to the result of such inspection or inquiry and the Vice-Chancellor shall communicate to the Executive Council the views of the Chancellor and shall, after ascertaining the opinion of the Executive Council, advise the Chancellor upon the action to be taken thereon.
- (6) The Chancellor shall have such other powers as may be conferred on him by or under this Act.

12. Vice-Chancellor
Vice-Chancellor.—
- (1) The Vice-Chancellor shall be appointed by the State Government from amongst such persons as may be recommended by the Search Committee constituted by the State Government for this purpose.
- (2) The Vice-Chancellor shall hold office for a term of five years and shall be eligible for re-appointment for a further term of five years.
- (3) The Vice-Chancellor shall be the principal executive and academic officer of the University and shall exercise general control over the affairs of the University and shall be responsible for the due maintenance of discipline in the University.
- (4) The Vice-Chancellor shall preside over the meetings of the Executive Council and Academic Council of the University.
- (5) The Vice-Chancellor shall ensure that the provisions of this Act, the Statutes, the Ordinances and the Regulations are faithfully observed.
- (6) The Vice-Chancellor shall have the power to take such action as he may deem necessary and shall, at the earliest opportunity thereafter, report the action taken by him to such authority or body as would have, in the ordinary course, dealt with the matter.
- (7) If in the opinion of the Vice-Chancellor, any emergency has arisen which requires immediate action to be taken, he shall take such action as he deems necessary and shall report the same for confirmation to the next meeting of the authority, which, in the ordinary course, would have dealt with the matter.
Chapter III OFFICERS OF UNIVERSITY
13. Terms and conditions of appointment of Vice-Chancellor
Terms and conditions of appointment of Vice-Chancellor.—
- (1) The Vice-Chancellor shall be a whole-time salaried officer of the University.
- (2) The salary and allowances payable to, and the other conditions of service of, the Vice-Chancellor shall be such as may be determined by the State Government.
- (3) The Vice-Chancellor shall not be a member of any political party.
- (4) The Vice-Chancellor may, by writing under his hand addressed to the Chancellor, resign his office.

14. Powers and functions of Vice Chancellor
- (1) The Vice-Chancellor shall be the principal academic and executive officer of the University and shall exercise general superintendence and control over the affairs of the University and shall execute the decisions of the authorities of the University.
- (2) The Vice-Chancellor may, if he is of the opinion that immediate action is necessary on any matter, exercise any power conferred on any authority of the University by or under this Act and shall report to such authority the action taken by him on such matters: Provided that if the authority concerned is of the opinion that such action ought not to have been taken, it may refer the matter to the State Government whose decision thereon shall be final: Provided further that any person in the service of the University who is aggrieved by the action taken by the Vice-Chancellor under this sub-section shall have the right to appeal against such action to the Executive Council within three months from the date on which the decision on such action is communicated to him and thereupon the Executive Council may confirm, modify or reverse the action taken by the Vice-Chancellor.
- (3) The Vice-Chancellor, if he is of the opinion that any decision of any authority of the University is beyond the powers of the authority conferred by the provisions of this Act, or is likely to be prejudicial to the interests of the University, may request the concerned authority to review its decision within such period as he may specify and if the authority refuses to review the decision either in whole or in part or no decision is taken by it within the said period, he shall refer the matter to the State Government whose decision thereon shall be final.
- (4) The Vice-Chancellor shall exercise such other powers and perform such other functions as may be prescribed by the Statutes, Ordinances and Regulations.
Chapter III OFFICERS OF UNIVERSITY
15. Registrar
- (1) The Registrar shall be appointed by the State Government on such terms and conditions as may be prescribed by the Statutes.
- (2) The Registrar shall be the ex-officio Secretary of the General Council, the Executive Council, the Academic Council and of every other authority, committee or body of the University.
- (3) The Registrar shall exercise such powers and perform such duties as may be prescribed by the Statutes, Ordinances and Regulations.

16. Finance and Accounts Officer
- (1) The Finance and Accounts Officer shall be appointed by the State Government on such terms and conditions as may be prescribed by the Statutes.
- (2) The Finance and Accounts Officer shall manage the funds and investments of the University and shall advise the University with regard to its financial policy and perform such other financial functions as may be prescribed by the Statutes, Ordinances and Regulations.
Chapter IV AUTHORITIES OF UNIVERSITY
17. Authorities of University
The following shall be the authorities of the University, namely:—
- (i) The General Council;
- (ii) The Executive Council;
- (iii) The Academic Council;
- (iv) The Finance Committee;
- (v) Such other bodies as may be declared by the Statutes to be the authorities of the University.

18. General Council
- (1) The General Council shall consist of the following members, namely:—
- (i) The Chancellor, who shall be the Chairman;
- (ii) The Vice-Chancellor;
- (iii) The Secretary to the Government, Education Department or his nominee not below the rank of Deputy Secretary;
- (iv) The Secretary to the Government, Finance Department or his nominee not below the rank of Deputy Secretary;
- (v) The Director of Higher Education, Gujarat State;
- (vi) The Director of Elementary Education, Gujarat State;
- (vii) Five eminent educationists to be nominated by the Chancellor;
- (viii) One person to be nominated by the State Government from amongst the representative of the industry;
- (ix) Two teachers to be nominated by the Vice-Chancellor on the basis of seniority and rotation;
- (x) Six representatives from the organizations engaged in Teacher Education, to be nominated by the State Government.
- (2) The Registrar shall be the ex-officio Secretary of the General Council.
- (3) The term of office of the nominated members shall be three years.
- (4) The General Council shall be the supreme authority of the University and shall have the power to review the acts of the Executive Council and the Academic Council.
- (5) The powers and functions of the General Council shall be such as may be prescribed by the Statutes.
Chapter IV AUTHORITIES OF UNIVERSITY
19. Powers and functions of General Council
Powers and functions of General Council.—The General Council shall have the following powers and functions, namely:—
- (a) to review from time to time the broad policies and programmes of the University and to suggest measures for the improvement and development of the University;
- (b) to consider and pass resolutions on the annual report and the annual accounts and the audit report of the University;
- (c) to advise the Chancellor in respect of any matter which may be referred to it for advice; and
- (d) to exercise such other powers and perform such other functions as may be prescribed by the Statutes.

20. Executive Council
Executive Council. -
- (1) The Executive Council shall consist of the following members, namely:-
- (a) the Vice-Chancellor, who shall be the Chairperson;
- (b) the Secretary to Government, Education Department or his representative not below the rank of Deputy Secretary;
- (c) the Secretary to Government, Finance Department or his representative not below the rank of Deputy Secretary;
- (d) three persons to be nominated by the General Council, not being employees of the University;
- (e) two Deans of the University, to be nominated by the Vice-Chancellor;
- (f) two Professors of the University, to be nominated by the Vice-Chancellor;
- (g) one teacher of the University to be nominated by the Vice-Chancellor;
- (h) the Registrar, who shall be the Secretary of the Executive Council.
- (2) The term of office of the nominated members shall be three years.
Chapter IV AUTHORITIES OF UNIVERSITY
21. Powers and functions of Executive Council
Powers and functions of Executive Council.—(1) The Executive Council shall be the principal executive body of the University.
- (2) Subject to the provisions of this Act, the Executive Council shall have the following powers and functions, namely:—
- (a) to hold, control and administer the properties and funds of the University;
- (b) to direct the form, custody and use of common seal of the University;
- (c) to administer the funds placed at the disposal of the University for specific purposes;
- (d) to accept, on behalf of the University, trusts, bequests, donations and transfers of any movable or immovable property to the University;
- (e) to provide for the research, consultancy and training activities by the University;
- (f) to arrange for and direct the inspection of colleges and schools;
- (g) to institute fellowships, scholarships, studentships, medals and prizes;
- (h) to confer honorary degrees and other academic distinctions in the manner prescribed by the Statutes;
- (i) to manage and regulate the finances, accounts, investments, property, business and all other administrative affairs of the University and for that purpose, appoint such agents as it may think fit;
- (j) to invest any money belonging to the University, including any unapplied income, in such stocks, funds, shares or securities as it may from time to time think fit in the manner prescribed by the Statutes;
- (k) to enter into, vary, carry out and cancel contracts on behalf of the University;
- (l) to regulate and determine all other matters concerning the University in accordance with the provisions of this Act and the Statutes;
- (m) to delegate any of its powers to the Vice-Chancellor, the Registrar or any other officer or authority of the University or to a committee appointed by it, as it may deem fit.

22. Academic Council
Academic Council.—
- (1) The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act, the Statutes and the Ordinances, coordinate and exercise general supervision over the academic policies of the University.
- (2) The Academic Council shall consist of the following members, namely:—
- (a) the Vice-Chancellor, who shall be the Chairman;
- (b) the Dean (Academic);
- (c) the Dean of all faculties;
- (d) such other members as may be prescribed by the Statutes.

23. Powers and functions of Academic Council
Powers and functions of Academic Council.—
- (1) Subject to the provisions of this Act, the Statutes and the Ordinances, the Academic Council shall have the following powers and functions, namely:—
- (a) to advise the Executive Council on all academic matters;
- (b) to design, develop and oversee the academic courses curricula;
- (c) to approve the recommendations of the Boards of Studies;
- (d) to monitor the academic development of the University;
- (e) to recommend to the Executive Council the establishment of Departments, Schools or Sections of the University and the abolition or sub-division of any of them;
- (f) to recommend to the Executive Council the institution of fellowships, travelling fellowships, scholarships, studentships, medals and prizes and to make regulations for their awards;
- (g) to review and update the curricula from time to time;
- (h) to make regulations for sports, extra-curricular activities, and proper maintenance and well-being of students;
- (i) to organize and conduct examinations and to set up selection committees for academic staff;
- (j) to exercise such other powers and perform such other functions as may be conferred or imposed upon it by the Statutes or Ordinances.
Chapter IV AUTHORITIES OF UNIVERSITY
24. Meetings of Academic Council
Meetings of Academic Council.—
- (1) The Academic Council shall meet as often as may be necessary but shall meet at least twice a year.
- (2) The Academic Council shall meet on such date and at such time and place as the Chairman may think fit.
- (3) One-third of the total number of members of the Academic Council shall form the quorum for a meeting of the Academic Council.

25. Finance Committee
Finance Committee.—
- (1) The Finance Committee shall consist of the following members, namely:—
- (a) the Vice-Chancellor, who shall be the Chairman;
- (b) the Registrar;
- (c) the Finance and Accounts Officer, who shall be the Secretary;
- (d) three persons to be nominated by the Executive Council from amongst its members.
- (2) The Finance Committee shall perform the following functions and exercise the following powers, namely:—
- (a) to review the financial position of the University;
- (b) to make recommendations to the Executive Council on all proposals involving expenditure for which no provision has been made in the budget or for which sufficient provision has been made;
- (c) to examine the annual budget estimates and to make recommendations thereon to the Executive Council;
- (d) to examine the annual accounts and the annual financial estimates of the University and to submit them to the Executive Council for approval.
Chapter IV AUTHORITIES OF UNIVERSITY
26. Powers and functions of Finance Committee
- (1) The Finance Committee shall be the principal financial body of the University and shall be responsible for the management of the finances, accounts and investments of the University.
- (2) The Finance Committee shall have the following powers and functions, namely :—
- (a) to examine the annual accounts and the financial estimates of the University and to submit them to the Executive Council for approval;
- (b) to scrutinize the financial proposals of the University;
- (c) to review the financial position of the University from time to time;
- (d) to make recommendations to the Executive Council on all matters relating to the finances of the University;
- (e) to perform such other functions as may be prescribed by the Statutes or Ordinances.
Chapter IV AUTHORITIES OF UNIVERSITY
27. Disqualifications for membership of authorities of University
- (1) A person shall be disqualified for being chosen as, and for being, a member of any of the authorities of the University—
- (a) if he is of unsound mind and stands so declared by a competent court;
- (b) if he is an undischarged insolvent;
- (c) if he has been convicted by a court of law of any offence involving moral turpitude.
- (2) If any question arises as to whether a person has been disqualified under sub-section (1), the question shall be referred to the Vice-Chancellor whose decision thereon shall be final.
Chapter V RESEARCH COUNCILS
28. Constitution and functions of Research Council
- (1) There shall be a Research Council of the University.
- (2) The constitution of the Research Council, the term of office of its members and the powers and functions of the Research Council shall be such as may be prescribed by the Statutes.
Chapter VI FINANCE
29. University Fund
- (1) The University shall establish a fund to be known as the "University Fund" to which shall be credited—
- (a) all moneys provided by the State Government;
- (b) all fees and other charges received by the University;
- (c) all moneys received by the University by way of grants, gifts, donations, benefactions, bequests or transfers;
- (d) all moneys received by the University from any other source.
- (2) The funds of the University shall be kept in such scheduled bank or invested in such manner as the Executive Council may think fit.
- (3) The fund shall be applied for the purposes of the University in such manner as may be prescribed.
Chapter VI FINANCE
30. Fund of sponsored scheme
- (1) The University shall establish a separate fund to be known as the "Fund of sponsored scheme".
- (2) The money received from agencies for any sponsored scheme shall be kept in the Fund of sponsored scheme and shall be utilized for the purpose of the scheme in accordance with the terms and conditions of grant of such scheme.
Chapter VI FINANCE
31. Accounts, Audit and Annual Report
- (1) The annual accounts and financial statements of the University shall be prepared under the direction of the Executive Council and shall be audited at least once in a year by the auditors appointed by the University with the approval of the State Government.
- (2) The annual report of the University shall be prepared under the direction of the Executive Council and shall be submitted to the State Government on or before such date as may be specified by the State Government.
Chapter VII STATUTES, ORDINANCES AND REGULATIONS
32. Statutes
- (1) Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:—
- (a) the constitution, powers and duties of the authorities and other bodies of the University;
- (b) the election, appointment and continuance in office of the members of the authorities and bodies of the University;
- (c) all other matters which by this Act are to be, or may be, provided for by the Statutes.
- (2) The first Statutes shall be made by the State Government and a copy thereof shall be laid before the State Legislature.
- (3) The Executive Council may, from time to time, make new or additional Statutes or may amend or repeal the Statutes: Provided that the Executive Council shall not make, amend or repeal any Statute affecting the status, powers or constitution of any authority of the University until such authority has been given an opportunity of expressing an opinion in writing on the proposed changes.
- (4) Every Statute or any amendment to, or repeal of, a Statute shall require the assent of the Chancellor.
Chapter VII STATUTES, ORDINANCES AND REGULATIONS
33. Ordinances
Ordinances.
- (1) Subject to the provisions of this Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely:—
- (a) the admission of students to the University and their enrolment as such;
- (b) the courses of study to be laid down for all degrees, diplomas, certificates and other academic distinctions of the University;
- (c) the conditions under which students shall be admitted to the courses of study leading to degrees, diplomas, certificates and other academic distinctions of the University;
- (d) the fees to be charged for courses of study in the University and for admission to the examinations, degrees, diplomas and certificates of the University;
- (e) the conditions of the award of fellowships, scholarships, studentships, medals and prizes;
- (f) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (g) the conditions of residence of the students of the University;
- (h) the maintenance of discipline among the students of the University;
- (i) the maintenance of discipline among the employees of the University;
- (j) the procedure for the discipline and appeal;
- (k) any other matter which by this Act or the Statutes are to be or may be provided for by the Ordinances.
- (2) The first Ordinances shall be made by the Vice-Chancellor with the previous approval of the State Government.
- (3) The Executive Council may, from time to time, make new or additional Ordinances or may amend or repeal the Ordinances in the manner hereinafter provided:

34. Provided that no Ordinance shall be made by the Executive Council unless a draft of such Ordinance has been proposed by the Academic Council.
Power to make regulations Power to make regulations. —
- (1) The authorities of the University may make regulations consistent with this Act and the Statutes and the Ordinances for the conduct of their own business and that of the committees appointed by them and not provided for by this Act, the Statutes or the Ordinances, in the same manner as the Statutes and Ordinances are made.
- (2) The Academic Council may, subject to the approval of the Executive Council, make regulations providing for all or any of the matters which by or under this Act are to be or may be provided for by regulations.
Chapter VIII SUPPLEMENTARY PROVISIONS
35. Prior approval of State Government
Prior approval of State Government.—No statute, Ordinance or Regulation shall be made by the University under this Act affecting the powers of the State Government, without the prior approval of the State Government.

37. The State Government may, from time to time, issue such directions to the University as it deems fit, for the effective administration of this Act and the University shall comply with such directions.

38. The Executive Council may constitute a Standing Committee of the University which shall consist of such members and exercise such powers and perform such functions as may be prescribed by the Statutes.
Resignation from membership and filling up casual vacancy
- (1) Any member, other than an ex-officio member, may resign by a letter addressed to the Vice-Chancellor and the resignation shall take effect as soon as it is accepted by the Vice-Chancellor or the appointing authority, as the case may be.
- (2) Any vacancy occurring in any of the authorities of the University due to death, resignation or otherwise shall be filled as soon as possible by the authority or the person who had appointed or nominated the member whose place has become vacant or by the person in whose place the vacancy has occurred: Provided that the person appointed or nominated to a casual vacancy shall be a member of such authority for the residue of the term for which the person in whose place he is appointed or nominated would have been a member.

39. Indemnity
No suit, prosecution or other legal proceeding shall lie against any officer or employee of the University for anything which is in good faith done or intended to be done in pursuance of any of the provisions of this Act or the Statutes, Ordinances or Regulations made thereunder.

40. Officers, members of authorities, bodies and employees of University to be public servant
Every officer, member of an authority, body and employee of the University shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code.

41. Power of State Government to make rules
- (1) The State Government may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act.
- (2) All rules made under this section shall be laid for not less than thirty days before the State Legislature as soon as possible after they are made and shall be subject to such modifications as the State Legislature may make during the session in which they are so laid or the session immediately following.
- (3) Any rescission or modification so made by the State Legislature shall be published in the Official Gazette and shall thereupon take effect.

42. Power to remove difficulties
- (1) If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by notification in the Official Gazette, make such order, not inconsistent with the provisions of this Act, as may appear to it to be necessary or expedient for the purpose of removing the difficulty: Provided that no such order shall be made after the expiry of two years from the commencement of this Act.
- (2) Every order made under sub-section (1) shall be laid, as soon as may be after it is made, before the State Legislature.

- (1) Notwithstanding anything contained in section 12, the first Vice-Chancellor shall be appointed by the State Government as soon as practicable after the passing of this Act for a period not exceeding three years on such terms and conditions as the State Government thinks fit.

- (1) Notwithstanding anything contained in section 15, the first Registrar shall be appointed by the State Government as soon as practicable after the passing of this Act for a period not exceeding three years on such terms and conditions as the State Government thinks fit.

45. Transitory powers of first Vice-Chancellor
"Transitory powers of first Vice-Chancellor."
- (1) The first Vice-Chancellor shall, in addition to the powers and duties conferred upon him by this Act, exercise such powers and perform such duties as may be necessary in order to give effect to the provisions of this Act and to establish the University in such time as he may deem necessary.
- (2) The first Vice-Chancellor shall, with the approval of the State Government, make the first Statutes, the first Ordinances and the first Regulations and shall for that purpose act as a member of the General Council, the Executive Council and the Academic Council, till such time as the first authorities are constituted under this Act.

46. Extra ordinary powers of first Vice-Chancellor
"Extra ordinary powers of first Vice-Chancellor."
- (1) The first Vice-Chancellor appointed under section 43 shall have powers to constitute such committees and to involve such experts as he may deem necessary, to ensure the establishment of the University and discharge the functions of the University.
- (2) The first Vice-Chancellor shall act as the Registrar till the first Registrar is appointed under section 44.

- (1) Notwithstanding anything contained in this Act, the first appointment of the officers other than the Vice-Chancellor and the Registrar shall be made by the State Government or by the first Vice-Chancellor with the prior approval of the State Government.
