The Gujarat Statutory Bodies Laws (Amendment and Validation) Act, 1999
1. Short title and commencement
Short title and commencement.—
- (1) This Act may be called the Gujarat Statutory Bodies Laws (Amendment and Validation) Act, 1999.
- (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
2. Validation of certain acts and proceedings of statutory bodies
Validation of certain acts and proceedings of statutory bodies.— Notwithstanding any judgment, decree or order of any court, any act or proceeding of any statutory body specified in the Schedule, done or taken during the period commencing on the date of the expiry of the term of the members of such body and ending on the date of the commencement of this Act, shall not be deemed to be invalid or ever to have been invalid merely by reason of the fact that at the time when such act or proceeding was done or taken, the term of the members of such body had expired: Provided that nothing in this section shall render any person liable to any conviction or penalty in respect of any act or omission done or omitted to be done by him if such act or omission would not have been an offence or, as the case may be, would not have been liable to penalty, had this Act not been passed.
3. Amendment of certain Acts
Amendment of certain Acts.
- (1) The enactments specified in the Schedule shall be amended in the manner and to the extent specified in the fourth column thereof.
- (2) Anything done or any action taken (including any appointment made, notification, order or direction issued or rule made) before the commencement of this Act, by any of the statutory bodies specified in the Schedule, in the exercise of any powers conferred by or under the enactments specified in the said Schedule, shall be deemed to have been validly done or taken as if the said enactments had been in force at all material times with the amendments made therein by this Act; and accordingly, no suit or other legal proceeding shall be maintained or continued in any court or before any authority against the State Government or any statutory body or any officer or person for any action taken or omission made on the ground that the action taken or the omission made was not in accordance with law; and no court or authority shall enforce any decree or order directing the refund of any tax, fee or other dues collected under any of the enactments so amended.

(List of Acts) (See section 3) Year No. Short title Amendment 1961 Guj. 42 The Gujarat State Tax on Professions, Trades, Callings and Employments Act, 1976. In the said Act, in the Schedule, for serial No. 1 and the entries relating thereto, the following shall be substituted, namely:— "1. Gujarat Electricity Board constituted under the Electricity (Supply) Act, 1948 (54 of 1948). Rs. 2500 per annum."
