1. Short title and commencement

Short title and commencement.—(1) This Act may be called the Gujarat Legislative Assembly Members' Pension Act, 1984.
- (2) It shall be deemed to have come into force on the 1st day of April, 1984.
2. Definitions

Definitions.—In this Act, unless the context otherwise requires,—
- (a) "Assembly" means the Gujarat Legislative Assembly;
- (b) "Member" means a member of the Assembly;
- (c) "Term of office" means the period beginning with the date of publication of the notification in the Official Gazette constituting the Assembly or, as the case may be, the date of the notification of the election of the member, whichever is later, and ending with the date on which his seat becomes vacant.
3. Pension to members

Pension to members.—
- (1) With effect from the date of commencement of this Act, there shall be paid a pension of two thousand rupees per mensem to every person who has served as a member of the Gujarat Legislative Assembly: Provided that where any such person is entitled to any pension under any other law for the time being in force, then such person shall be entitled to receive the pension under this Act only if the amount of pension under such other law is less than the pension payable under this Act and shall be entitled to receive only such difference.
- (2) The pension payable under sub-section
- (1) shall be paid to such person for his life.
4. Power to make rules

Power to make rules.—
- (1) The State Government may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act.
- (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:—
- (a) the form and manner in which and the authority to whom an application for pension shall be made;
- (b) any other matter which is to be, or may be, prescribed.
- (3) All rules made under this section shall be laid for not less than thirty days before the State Legislature as soon as possible after they are made and shall be subject to such modifications as the State Legislature may make during the session in which they are so laid or the session immediately following.
