Owners under disability or not in possession.—

1. (1) If any owner of a protected monument is unable, by reason of infancy or other disability, to act for himself, the person legally competent to act on his behalf shall, for the purposes of this Act, be deemed to be the owner.
2. (2) Nothing in this Act shall be deemed to prevent the owner of a protected monument, in possession thereof, from conveying or creating any rights in the monument in the same manner and to the same extent as he could have done if this Act had not been passed.
