Chapter I PRELIMINARY
1. Short title and commencement
Short title and commencement
- (1) This Act may be called the Delhi Sports University Act, 2019.
- (2) It shall come into force on such date as the Government may, by notification in the Official Gazette, appoint.

2. Definitions
In this Act, unless the context otherwise requires,—
- (a) "Academic Staff" means such categories of staff as are designated as academic staff by the Ordinances;
- (b) "Centre for Community Outreach and Extension Services" means a centre established under section 28 of this Act;
- (c) "Centre for Professional Excellence in Sports" means a centre established under section 29 or section 30 of this Act;
- (d) "Controller of Examination" means the Controller of Examination of the University;
- (e) "Delhi Sports School" means the school established under section 5 of this Act;
- (f) "Finance Committee" means the Finance Committee of the University;
- (g) "Government" means the Government of the National Capital Territory of Delhi;
- (h) "Hall" means a unit of residence or of corporate life for the students of the University;
- (i) "Lieutenant Governor" means the Lieutenant Governor of the National Capital Territory of Delhi appointed by the President under article 239 of the Constitution of India;
- (j) "Prescribed" means prescribed by the Statutes or Ordinances or Regulations made under this Act;
- (k) "Statutes", "Ordinances" and "Regulations" mean, respectively, the Statutes, Ordinances and Regulations of the University for the time being in force;
- (l) "Students" means a person enrolled in the University for pursuing a course of study or for research work;
- (m) "Teacher" means Professors, Associate Professors, Assistant Professors and such other persons as may be appointed for imparting instruction or conducting research in the University or in the Delhi Sports School and are designated as teachers by the Ordinances;
- (n) "University" means the Delhi Sports University incorporated under this Act; and
- (o) "Vice-Chancellor" means the Vice-Chancellor of the University.
Chapter II THE UNIVERSITY
3. The University
The University
- (1) The Chancellor, the Vice-Chancellor, the members of the Board of Management, the Academic Council and the Finance Committee, and all other persons who may hereafter become such officers or members, so long as they continue to hold such office or membership, are hereby constituted a body corporate by the name of "The Delhi Sports University".
- (2) The University shall have perpetual succession and a common seal and shall sue and be sued by the said name.
- (3) The University shall be competent to acquire, hold and dispose of property, both movable and immovable, and to contract and to do all other things necessary for the purposes of this Act.
- (4) In all suits and other legal proceedings by or against the University, the pleading shall be signed and verified by the Registrar or any other person authorised by the Vice-Chancellor in this behalf and all processes in such suits and proceedings shall be issued to and served on the Registrar.
- (5) The headquarters of the University shall be at Delhi.
Chapter II THE UNIVERSITY
4. Objects of the University
Objects of the University The objects of the University shall be to —
- (a) establish and provide for instruction and training in such branches of sports and sports science as the University may deem fit;
- (b) make provision for research in sports, sports science, sports technology, sports management, sports psychology and such other fields as may be relevant to the development of sports in the country;
- (c) establish, maintain and manage the Delhi Sports School for the purpose of identifying and nurturing sporting talent at the school level;
- (d) facilitate and promote studies, training and research in emerging areas of sports and sports performance, with a focus on sports science, sports engineering, sports medicine, sports nutrition and sports management;
- (e) provide facilities and opportunities for graduate and post-graduate studies, post-doctoral research, consultancy, extension services and publication in the field of sports;
- (f) evolve and implement training programmes for coaches, trainers, sports scientists, support staff and other sports professionals;
- (g) foster national and international collaboration in the field of sports and sports science;
- (h) develop and implement sports related infrastructure and technology;
- (i) promote the spirit of sportsmanship, discipline and national integration;
- (j) act as a resource centre for excellence in sports;
- (k) provide a platform for athletes to balance their sports and academic careers;
- (l) undertake any other activities as may be necessary for the promotion and development of sports.
Chapter II THE UNIVERSITY
5. Powers of the University
Powers of the University.—The University shall have the following powers, namely:—
- (1) to provide for instructions in such branches of learning related to sports, sports education, sports sciences, sports technology, sports management, sports medicine and such other fields as the University may determine;
- (2) to make provisions for research and for the advancement and dissemination of knowledge;
- (3) to grant, subject to such conditions as the University may determine, diplomas or certificates to, and confer degrees or other academic distinctions on the basis of examinations, evaluation or any other method of testing on, persons and to withdraw any such diplomas, certificates, degrees or other academic distinctions for good and sufficient cause;
- (4) to confer honorary degrees or other distinctions in the manner prescribed by the Statutes;
- (5) to organize and to undertake extra-mural studies, training and extension services;
- (6) to institute Professorships, Associate Professorships, Assistant Professorships and other teaching or academic positions required by the University and to appoint persons to such positions;
- (7) to appoint persons working in any other University or academic institution, including those located outside the country, as teachers of the University for a specified period;
- (8) to create, subject to the approval of the Government, administrative, ministerial and other posts and to appoint persons to such posts;
- (9) to co-operate or collaborate or associate with any other University or authority or institution of higher learning within or outside India in such manner and for such purposes as the University may determine;
- (10) to establish, maintain and supervise the Delhi Sports School and other schools, centres, specialized laboratories or other units for research and instructions;
- (11) to establish and maintain halls and residences for students and hostels for other employees of the University;
- (12) to determine standards of admission to the University, which may include examination, evaluation or any other method of testing;
- (13) to demand and receive payment of fees and other charges as may be prescribed;
- (14) to supervise the residences of the students of the University and to make arrangements for promoting their health and general welfare;
- (15) to make such provisions as may enable its appointed Academy and staff to participate in sports and sports related activities;
- (16) to provide for the printing and publication of research and other works;
- (17) to make provisions for sports, games and physical training;
- (18) to accept grants, assignments, bequests, donations and transfers of any movable or immovable assets;
- (19) to deal with any property belonging to or vested in the University in any manner which is conducive to the objects of the University;
- (20) to receive funds from the Government, University Grants Commission, National Sports Federations, International Sports Bodies or any other national or international source;
- (21) to institute and award fellowships, scholarships, studentships, medals and prizes; and
- (22) to do all such other acts and things as may be necessary or incidental to the exercise of all the powers of the University or conducive to the attainment of all or any of the objects of the University.

6. University open to all castes, class, creed and gender
University open to all castes, class, creed and gender.—The University shall be open to persons of either gender and of whatever race, creed, caste or class, and it shall not be lawful for the University to adopt or impose on any person any test whatsoever of religious belief or profession in order to entitle him to be admitted therein as a teacher or student or to hold any office therein or to graduate thereat: Provided that nothing in this section shall be deemed to prevent the University from making special provisions for the employment or admission of women, persons with disabilities or of persons belonging to the weaker sections of the society and, in particular, of the Scheduled Castes, the Scheduled Tribes and the Other Backward Classes of citizens.

7. Teaching at the University
Teaching at the University
- (1) All recognised teaching in connection with the degree, diploma, certificate and other academic distinctions of the University shall be conducted, under the control of the Academic Council, by the teachers of the University in accordance with the syllabus prescribed by the Regulations.
- (2) The courses and curricula shall be such as may be prescribed by the Regulations.

8. Officers of the University
Officers of the University The following shall be the officers of the University:—
- (i) the Chancellor;
- (ii) the Vice-Chancellor;
- (iii) the Pro-Vice-Chancellor;
- (iv) the Registrar;
- (v) the Finance Officer;
- (vi) the Controller of Examination;
- (vii) the Dean of Academic Affairs;
- (viii) the Dean of Research and Development;
- (ix) the Dean of Students’ Welfare; and
- (x) such other officers as may be declared by the Statutes to be the officers of the University.

9. The Chancellor
The Chancellor
- (1) The Chancellor shall be appointed by the Visitor from a panel of not less than three persons of eminence in the field of sports or such other fields as may be decided by the Government, recommended by the Search Committee constituted by the Government.
- (2) The Chancellor shall hold office for a period of five years and shall not be eligible for re-appointment.
- (3) The Chancellor shall, by virtue of his office, be the Head of the University.
- (4) The Chancellor shall, if present, preside over the Convocation of the University held for conferring degrees, diplomas, certificates as may be prescribed by the Statutes.

10. The Vice-Chancellor
The Vice-Chancellor
- (1) The Vice-Chancellor shall be appointed by the Visitor from a panel of three persons of eminence in the field of sports or such other fields as may be decided by the Government, recommended by the Search Committee constituted by the Government.
- (2) The Vice-Chancellor shall be the principal academic and executive officer of the University and shall exercise general supervision and control over the affairs of the University and give effect to the decisions of all the authorities of the University.
- (3) The Vice-Chancellor shall hold office for a term of five years from the date on which he enters upon his office, or until he attains the age of seventy years, whichever is earlier, and shall be eligible for re-appointment for only one more term. (4) Provided that after the expiry of the term of five years, the Vice-Chancellor may continue to hold office for a period not exceeding one year until his successor is appointed and enters upon his office.
- (5) The Vice-Chancellor shall, if present, preside at any meeting of any authority of the University and in the absence of the Chancellor, preside over the Convocation of the University.
- (6) If the office of the Vice-Chancellor becomes vacant due to death, resignation or otherwise, the senior-most Professor of the University shall perform the duties of the Vice-Chancellor until a new Vice-Chancellor is appointed.

11. The Registrar
The Registrar
- (1) The Registrar shall be appointed by the Vice-Chancellor with the approval of the Board of Management.
- (2) The Registrar shall have the power to enter into agreements, sign documents and authenticate records on behalf of the University and shall exercise such other powers and perform such other duties as may be prescribed by the Statutes.
- (3) The Registrar shall be the ex-officio Secretary of the Board of Management and the Academic Council, but shall not be deemed to be a member of any of these authorities.
- (4) The Registrar shall be responsible for the custody of the records and the common seal of the University.
- (5) The Registrar shall act as the Secretary of such other committees as may be prescribed by the Statutes.

12. The Controller of Examination
The Controller of Examination
- (1) The Controller of Examination shall be appointed by the Vice-Chancellor with the approval of the Board of Management in such manner and on such terms and conditions as may be prescribed by the Statutes.
- (2) The Controller of Examination shall be responsible for the conduct of examinations and for all matters allied thereto and shall perform such other duties as may be prescribed by the Statutes or required by the Vice-Chancellor.

13. The Finance Officer
The Finance Officer
- (1) The Finance Officer shall be appointed by the Vice-Chancellor in such manner and on such terms and conditions as may be prescribed by the Regulations.
- (2) The Finance Officer shall be the ex-officio Secretary of the Finance Committee and shall—
- (a) exercise general supervision over the funds of the University and shall advise it as regards its financial policy; and
- (b) perform such other financial functions, as may be assigned to him by the Vice-Chancellor or as may be prescribed by the Statutes or the Regulations.
- (3) Subject to the control of the Vice-Chancellor, the Finance Officer shall—
- (a) hold and manage the property and investments of the University including trust and endowed property;
- (b) ensure that the limits fixed by the Finance Committee for recurring and non-recurring expenditure for a year are not exceeded and that all moneys are expended on the purposes for which they are granted or allotted;
- (c) be responsible for the preparation of annual accounts and the budget of the University and for their presentation to the Finance Committee;
- (d) keep a constant watch on the state of the cash and bank balances and on the state of investments;
- (e) watch the progress of the collection of revenue and advise on the methods of collection employed;
- (f) ensure that the registers of buildings, land, furniture and equipment are maintained up-to-date and that the stock-checking of equipment and other consumable materials in all offices, colleges, workshops and stores of the University is conducted;
- (g) bring to the notice of the Vice-Chancellor any unauthorised expenditure and other financial irregularities and suggest appropriate action to be taken against persons at fault; and
- (h) call for from any office, department, college, centre or institution, under the University, any information or returns that he may consider necessary for the performance of his duties.
- (4) Any receipt given by the Finance Officer or the person or persons duly authorised in this behalf by the Finance Officer for any money payable to the University shall be sufficient discharge for payment of such money.

14. Other Officers
Other Officers
- (1) The following shall also be the officers of the University, namely:—
- (a) Controller of Examination;
- (b) Librarian;
- (c) Dean of Students' Welfare;
- (d) Proctor; and
- (e) such other persons in the service of the University as may be declared by the Statutes to be the officers of the University.
- (2) The manner of appointment, terms and conditions of service and powers and duties of the officers mentioned in sub-section
- (1) shall be such as may be prescribed by the Statutes.

15. Authorities of the University
Authorities of the University. The following shall be the authorities of the University, namely:
- (1) The Chancellor;
- (2) The Vice-Chancellor;
- (3) The Board of Management;
- (4) The Academic Council;
- (5) The Finance Committee;
- (6) The Sports Council;
- (7) Such other authorities as may be declared by the Statutes to be the authorities of the University.
Chapter IV AUTHORITIES OF THE UNIVERSITY
16. The Board of Management
The Board of Management.
- (1) The Board of Management shall be the principal executive body of the University.
- (2) The administration, management and control of the University and the income thereof shall be vested in the Board of Management which shall control and administer the property and funds of the University.
- (3) The Board of Management shall consist of the following members, namely:
- (a) The Vice-Chancellor, who shall be the Chairperson;
- (b) The Principal Secretary or Secretary of the administrative department of the Government dealing with Sports, who shall be the Ex-officio member;
- (c) The Principal Secretary or Secretary of the Finance Department of the Government, who shall be the Ex-officio member;
- (d) The Principal Secretary or Secretary of the Education Department of the Government, who shall be the Ex-officio member;
- (e) Two eminent sports persons, to be nominated by the Chancellor;
- (f) Two eminent sports academicians or experts, to be nominated by the Chancellor;
- (g) One distinguished person from the industry or sports management field, to be nominated by the Chancellor;
- (h) Two Deans of the University, to be nominated by the Vice-Chancellor by rotation;
- (i) The Registrar, who shall be the Secretary of the Board of Management.
- (4) The term of office of the nominated members shall be three years.
Chapter IV AUTHORITIES OF THE UNIVERSITY
17. The Academic Council
The Academic Council
- (1) The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act, the Statutes, Ordinances and Regulations, coordinate and exercise general supervision over the academic policies of the University.
- (2) The Academic Council shall consist of such members as may be prescribed by the Statutes.
- (3) The term of office of the members of the Academic Council shall be such as may be prescribed by the Statutes.
Chapter IV AUTHORITIES OF THE UNIVERSITY
18. Academic Staff
Academic Staff
- (1) The following shall be the Academic Staff of the University, namely:—
- (a) Dean of Faculties;
- (b) Professors;
- (c) Associate Professors;
- (d) Assistant Professors;
- (e) Teachers;
- (f) Librarians;
- (g) Directors of Physical Education; and
- (h) such other persons as may be declared by the Statutes to be the Academic Staff of the University.
- (2) The method of appointment and the terms and conditions of service of the Academic Staff shall be such as may be prescribed by the Statutes.

19. Finance Committee
Finance Committee
- (1) The Finance Committee shall be the main financial advisory body of the University.
- (2) The constitution, powers and functions of the Finance Committee shall be such as may be prescribed by the Statutes.

20. Other Authorities
Other Authorities The constitution, powers and functions of such other authorities as may be declared by the Statutes to be the authorities of the University shall be such as may be prescribed by the Statutes.

21. University Funds
University Funds
- (1) The University shall have a General Fund to which shall be credited—
- (a) all its income including fees and endowments;
- (b) contributions or grants made by the Government;
- (c) contributions or grants made by other sources; and
- (d) amounts received from any other source.
- (2) The General Fund shall be utilised for such purposes of the University as may be prescribed by the Statutes.
- (3) The University shall have such other funds as may be prescribed by the Statutes.
- (4) All funds of the University shall be deposited in such banks or invested in such manner as the Board of Management may decide on the recommendations of the Finance Committee: Provided that the funds of the University shall be utilised for the objects of the University only and not for any other purpose.
Chapter V STATUTES, ORDINANCES AND REGULATIONS
22. Annual Report
Annual Report
- (1) The Annual Report of the University shall be prepared under the direction of the Board of Management which shall include, among other matters, the steps taken by the University towards the fulfilment of its objects and shall be submitted to the Board of Management on or before such date as may be prescribed by the Statutes and shall be considered by the Board of Management in its annual meeting.
- (2) The Board of Management shall submit the Annual Report along with the audited accounts of the University to the Chancellor and the Government.
- (3) The Government shall cause the Annual Report and the Annual Accounts to be laid before the Legislative Assembly of the National Capital Territory of Delhi.
Chapter V STATUTES, ORDINANCES AND REGULATIONS
23. Annual Accounts
Annual Accounts
- (1) The annual accounts and balance sheet of the University shall be prepared under the direction of the Board of Management and shall, at least once in every year and at intervals of not more than fifteen months, be audited by the auditors appointed by the University.
- (2) The annual accounts, when audited, shall be published in such manner as may be prescribed and a copy thereof shall be submitted to the Government along with the report of the Board of Management.
- (3) The University shall submit the annual accounts and balance sheet referred to in sub-section
- (1) to the Government through the Academic and Audit Committee for their comments and the University shall comply with the observations of the Government, if any.
Chapter V STATUTES, ORDINANCES AND REGULATIONS
24. Power to make Statutes
Power to make Statutes
- (1) Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:
- (a) the constitution, powers and duties of the authorities and other bodies of the University, as may be constituted from time to time;
- (b) the election and continuance in office of the members of the authorities and bodies, the filling up of vacancies of members, and all other matters relating to those authorities and bodies for which it may be necessary to provide;
- (c) the appointment, powers and duties of the officers of the University and their emoluments;
- (d) the appointment of teachers, academic staff and other employees of the University and their emoluments;
- (e) the conditions of service of employees including the provision for pension, insurance and provident fund, the manner of termination of service and disciplinary action;
- (f) the principles governing the seniority of service of employees of the University;
- (g) the procedure for arbitration in case of dispute between employees or students and the University;
- (h) the procedure for appeal to the Board of Management by any employee or student against the action of any officer or other authority of the University;
- (i) the institution of fellowships, scholarships, studentships, medals and prizes;
- (j) the procedure for the award of degrees, diplomas and other academic distinctions;
- (k) the conferment of honorary degrees;
- (l) the intake capacity for admission in various courses of study in the University;
- (m) the regulation and conduct of the institutions, centres, etc. related to the University;
- (n) the maintenance of discipline among the students;
- (o) all other matters which by this Act are to be or may be provided for by the Statutes.

25. Statutes how to be made
Statutes how to be made
- (1) The first Statutes in respect of matters set out in section 24 shall be made by the Government.
- (2) The Board may, from time to time, make new or additional Statutes or may amend or repeal the Statutes referred to in sub-section (1): Provided that the Board shall not make, amend or repeal any Statute affecting the status, powers or constitution of any authority of the University until such authority has been given a reasonable opportunity to express its opinion in writing on the proposed changes, and any opinion so expressed shall be considered by the Board.
- (3) Every new Statute or addition to the Statutes or any amendment or repeal of a Statute shall require the assent of the Chancellor, who may assent thereto or remit it to the Board for reconsideration.
- (4) A new Statute or a change to the Statutes shall have no validity unless it has been assented to by the Chancellor.

- (1) Subject to the provisions of this Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely:
- (a) the admission of students to the University and their enrolment as such;
- (b) the courses of study to be laid down for all degrees, diplomas and certificates of the University;
- (c) the medium of instruction and examination;
- (d) the award of degrees, diplomas, certificates and other academic distinctions, the qualifications for the same and the means to be taken relating to the granting and obtaining of the same;
- (e) the fees to be charged for courses of study in the University and for admission to the examinations, degrees and diplomas of the University;
- (f) the conditions of the award of fellowships, scholarships, studentships, medals and prizes;
- (g) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (h) the maintenance of discipline among the students of the University;
- (i) the conditions of residence of students at the University;
- (j) the special arrangements, if any, which may be made for the residence, discipline and teaching of women students and prescribing of special courses of studies for them;
- (k) the creation, composition and functions of any other body which is considered necessary for improving the academic life of the University;
- (l) the organization of those co-curricular activities and sports, which are part of the University system; and
- (m) all other matters which by this Act or the Statutes are to be or may be provided for by the Ordinances.
- (2) The first Ordinances shall be made by the Vice-Chancellor with the previous approval of the Government.
- (3) The Board may, from time to time, make new or additional Ordinances or may amend or repeal the Ordinances referred to in sub-section (2).
- (4) Every Ordinance made by the Board shall be reported to the Chancellor, and the Chancellor may, within three weeks of the receipt of the Ordinance, annul or remit it to the Board for reconsideration.

- (1) The University shall make Ordinances to provide for all or any of the following matters, namely:—
- (a) the admission of students to the University and their enrolment as such;
- (b) the courses of study to be laid down for all degrees, diplomas and certificates of the University;
- (c) the award of degrees, diplomas, certificates and other academic distinctions, the qualifications for the same and the means to be taken relating to the granting and obtaining of the same;
- (d) the fees to be charged for courses of study in the University and for admission to the examinations, degrees and diplomas of the University;
- (e) the conditions of the award of fellowships, scholarships, studentships, medals and prizes;
- (f) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators;
- (g) the maintenance of discipline among the students of the University;
- (h) the conditions of residence of students at the University;
- (i) the special arrangements, if any, which may be made for the residence, discipline and teaching of women students and prescribing of special courses of studies for them;
- (j) the creation and abolition of posts of teachers of the University;
- (k) the regulation of the conduct and duties of the teachers and other employees of the University;
- (l) the manner of enforcement of discipline among the teachers and other employees of the University;
- (m) the code of conduct for persons working in the University;
- (n) the categories of persons to be considered as teachers;
- (o) all other matters which by this Act or the Statutes are to be or may be provided for by the Ordinances.
- (2) The first Ordinances shall be made by the Vice-Chancellor with the previous approval of the Government and the Ordinances so made may be amended, repealed or added to at any time by the Board of Management in the manner prescribed by the Statutes: Provided that until the first Ordinances are made, the Ordinances existing immediately before the commencement of this Act shall, as far as they are consistent with the provisions of this Act, continue to be in force and be deemed to be the Ordinances made under this Act.
Chapter VI ACCOUNTS AND FINANCE
28. Power to make Regulations
Power to make Regulations The authorities of the University may make Regulations consistent with this Act, the Statutes and the Ordinances for the conduct of their own business and that of the Committees appointed by them and not provided for by this Act, the Statutes or the Ordinances, in the manner prescribed by the Statutes.
Chapter VII ADMISSION AND EXAMINATIONS
29. Appointments teaching and non-teaching
Appointments teaching and non-teaching.—
- (1) All appointments of teaching and non-teaching staff of the University shall be made in accordance with the provisions of this Act, the Statutes and the Ordinances.
- (2) Every appointment of a teacher or any other member of the staff shall be made on the basis of merit by a selection committee constituted in accordance with the Statutes.
- (3) The University shall strictly comply with the reservation policy as may be prescribed by the Government of National Capital Territory of Delhi, as applicable from time to time.
Chapter VII ADMISSION AND EXAMINATIONS
30. Arbitration of disputes
Arbitration of disputes.—
- (1) Any dispute arising out of any contract between the University and any employee of the University shall, at the request of the employee concerned or at the instance of the University, be referred to a Tribunal of Arbitration consisting of one member nominated by the Board of Management, one member nominated by the employee concerned, and an umpire to be appointed by the Chancellor.
- (2) The decision of the Tribunal of Arbitration shall be final and shall not be questioned in any court.
- (3) No suit or proceeding shall lie in any civil court in respect of any matter which is required by this section to be referred to the Tribunal of Arbitration.

31. Pension and Provident Fund
Pension and Provident Fund
- (1) The University shall constitute for the benefit of its officers, teachers, and other employees such pension, provident fund, and insurance schemes as it may deem fit in such manner and subject to such conditions as may be prescribed.
- (2) Where such provident fund and insurance schemes have been so constituted, the Government may declare that the provisions of the Provident Funds Act, 1925 (19 of 1925) shall apply to the University as if it were a local authority.

32. Disputes as to constitution of University authorities and bodies
Disputes as to constitution of University authorities and bodies If any question arises as to whether any person has been duly elected or appointed as, or is entitled to be, a member of any authority or other body of the University, the matter shall be referred to the Chancellor whose decision thereon shall be final:

- (1) All casual vacancies among the members (other than ex-officio members) of any authority or other body of the University shall be filled as soon as may be convenient, by the person or body who appointed, elected or co-opted the member whose place has become vacant and the person appointed, elected or co-opted to a casual vacancy shall be a member of such authority or body for the residue of the term for which the person whose place he fills would have been a member.

35. Protection of action taken in good faith
- (1) No suit, prosecution or other legal proceeding shall lie against any officer, employee or authority of the University for anything which is in good faith done or intended to be done in pursuance of any of the provisions of this Act or any Statutes or Ordinances made thereunder.
- (2) No suit or other legal proceeding shall lie against the University for any damage caused or likely to be caused by anything which is in good faith done or intended to be done in pursuance of any of the provisions of this Act or any Statutes or Ordinances made thereunder.

36. Mode of proof of University record
A copy of any receipt, application, notice, order, proceeding or resolution of any authority or a committee of the University or other documents in possession of the University or any entry in any register duly maintained by the University, if certified by the Registrar or any other person authorised in this behalf, shall be received as prima facie evidence of such receipt, application, notice, order, proceeding, resolution or document or the existence of entry in the register and shall be admitted as evidence of the matters and transactions therein recorded in any case where the original thereof would, if produced, have been admissible in evidence.

37. Power to remove difficulties
Power to remove difficulties.
- (1) If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the official Gazette, make such provisions, not inconsistent with the provisions of this Act, as may appear to it to be necessary or expedient for removing the difficulty: Provided that no such order shall be made under this section after the expiry of three years from the date of commencement of this Act.
- (2) Every order made under this section shall be laid, as soon as may be after it is made, before the Legislative Assembly of the National Capital Territory of Delhi.

38. Act to override other enactments
Act to override other enactments. The provisions of this Act, and any rules and statutes made thereunder shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force or any instrument having effect by virtue of any law other than this Act.
I. The First Schedule
THE FIRST SCHEDULE (See section 39) 1. The Delhi Sports University shall be a body corporate by the name of “Delhi Sports University” and shall have perpetual succession and a common seal with power, subject to the provisions of this Act, to acquire, hold and dispose of property, both movable and immovable, and to contract and shall by the said name sue and be sued. 2. The University shall be residential and shall, subject to the provisions of this Act, be open to persons of either sex and of whatever race, creed, caste or class and it shall not be lawful for the Government to adopt on grounds of religion, race, creed, caste, sex or place of birth or any of them, any test for religious belief, profession or institution in order to entitle him to be appointed as a teacher of the University or to hold any other office therein or to be admitted as a student in the University or to graduate thereat or to enjoy or exercise any privilege thereof: Provided that nothing in this paragraph shall be deemed to prevent the University from making any special provision for the admission or appointment of students or teachers or other persons belonging to the Scheduled Castes, the Scheduled Tribes or other socially and educationally backward classes of citizens or for women or for persons with disability in such manner and to such extent as may be prescribed. 3. The University shall have the following objects, namely:— (a) to provide for studies, teaching, research, consultancy and extension work in the field of physical education and sports sciences and in such other branches of knowledge as the University may deem fit; (b) to enhance the quality of sports education and training by fostering, facilitating and improving the professional capacity, competence and excellence of students and learners; (c) to foster, facilitate and promote the development of sports excellence, inclusive of high performance, grassroot development, sports infrastructure, pedagogy, administration and management; (d) to conduct high-level research in sports sciences, sports performance, training methods, talent identification and related fields; (e) to build capacity for a sports ecosystem including coaches, support staff, analytics, sports medicine, physiotherapy, nutrition, psychology, data science, journalism, management and governance; (f) to establish international partnerships for promoting sports education and research; (g) to promote gender equality and inclusivity in sports through education; (h) to take appropriate measures for promoting innovations in teaching-learning process and inter-disciplinary studies and research; (i) to establish campuses, centres, schools and other institutions of learning as may be necessary for the furtherance of the objects of the University; (j) to institutionalize sports as an academic discipline of equal status as other streams of higher education; (k) to act as a think-tank for the Government for formulation of sports policies and strategies; (l) to organise, conduct and facilitate sports competitions at local, regional, national and international levels; and (m) to perform such other functions as may be necessary or considered necessary by the University to achieve its objects. 4. The University shall have the following powers, namely:— (a) to provide for instruction in such branches of learning as the University may, from time to time, determine and to make provision for research and for the advancement and dissemination of knowledge; (b) to grant, subject to such conditions as the University may determine, diplomas or certificates to, and confer degrees or other academic distinctions on, the basis of examinations, evaluation or any other method of testing on persons, and to withdraw any such diplomas, certificates, degrees or other academic distinctions for good and sufficient cause; (c) to organise and to undertake extra-mural studies and extension services; (d) to confer honorary degrees or other distinctions in the manner prescribed; (e) to provide for the autonomy of its departments and centres; (f) to institute and award fellowships, scholarships, studentships, medals and prizes; (g) to cooperate, collaborate or associate with any other University or authority or institution of higher learning in such manner and for such purposes as the University may determine; (h) to establish, maintain and supervise residences, hostels and halls of residence and managed related amenities; (i) to declare a centre, an institution, a department, a school or a college, as the case may be, in accordance with the regulation, as a constituent unit of the University; (j) to determine standards of admission to the University, which may include examination, evaluation or any other method of testing; (k) to demand and receive payment of fees and other charges as may be prescribed; (l) to supervise the residences of the students of the University and to make arrangements for promoting their health and general welfare; (m) to make provision for research and advisory services and for that purpose to enter into such arrangements with other institutions or bodies as the University may deem necessary; (n) to appoint, including on contract, such persons as may be necessary for the performance of the duties of the University; (o) to create academic, administrative, ministerial and other posts and to make appointments thereto; (p) to regulate and enforce discipline among the employees and students of the University and take such disciplinary measures in this regard as may be deemed by the University to be necessary; (q) to make arrangements for promoting the health and general welfare of the employees of the University; (r) to receive benefactions, donations and gifts and to acquire, hold, manage and dispose of any property, movable or immovable, including trust and endowment properties for the purposes of the University; to borrow, with the approval of the Government, on the security of the property of the University, money for the purposes of the University; (t) to do all such other acts and things as may be necessary, incidental or conducive to the attainment of all or any of the objects of the University. 5. The following shall be the officers of the University:— (a) the Chancellor; (b) the Vice-Chancellor; (c) the Pro-Vice-Chancellors; (d) the Deans of Schools/Faculties; (e) the Registrar; (f) the Finance Officer; (g) the Controller of Examination; (h) the Librarian; and (i) such other officers as may be declared by the Statutes to be officers of the University. 6. The Chancellor shall be appointed by the Government: Provided that if the Chancellor is not the Lieutenant Governor of Delhi, the Chancellor shall be an eminent person with significant contribution in the field of sports or relevant field. 7. The Vice-Chancellor shall be the principal executive and academic officer of the University and shall exercise general supervision and control over the affairs of the University and give effect to the decisions of all the authorities of the University. 8. The following shall be the authorities of the University:— (a) the Court; (b) the Executive Council; (c) the Academic Council; (d) the Board of Studies; (e) the Finance Committee; and (f) such other authorities as may be declared by the Statutes to be the authorities of the University. 9. The Executive Council shall be the principal executive body of the University. 10. The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act, the Statutes and the Ordinances, coordinate and exercise general supervision over the academic policies of the University. 11. Subject to the provisions of this Act, the Statutes may provide for any matter which is necessary for the administration of the University and may, in particular, provide for— (a) the constitution, powers and functions of the authorities and other bodies of the University; (b) the election and continuance in office of the members of the authorities and bodies; (c) the appointment, powers and duties of the officers of the University; (d) the conferment of honorary degrees; (e) the withdrawal of degrees, diplomas, certificates and other academic distinctions; (f) the establishment of departments of studies and schools; (g) the maintenance of discipline among the students. 12. Subject to the provisions of this Act and the Statutes, the Ordinances may provide for all or any of the following matters, namely:— (a) the admission of students to the University and their enrolment as such; (b) the courses of study to be laid down for all degrees, diplomas and certificates of the University; (c) the medium of instruction and examination; (d) the award of degrees, diplomas, certificates and other academic distinctions, the qualifications for the same and the means to be taken relating to the granting and obtaining of the same; (e) the fees to be charged for courses of study in the University and for admission to the examinations, degrees and diplomas of the University; (f) the conditions of the award of fellowships, scholarships, studentships, medals and prizes; (g) the conduct of examinations, including the terms of office and manner of appointment and the duties of examining bodies, examiners and moderators; (h) the conditions of residence of the students of the University; (i) the special arrangements, if any, which may be made for the residence, discipline and teaching of women students and prescribing of special courses of studies for them; (j) the appointments and the emoluments of employees other than those for whom provision has been made in the Statutes; (k) the establishment of centres of studies, boards of studies, inter-disciplinary centres, special centres, specialised laboratories and other committees; (l) the manner of cooperation and collaboration with other Universities and authorities; (m) any other matter which by this Act or the Statutes is to be, or may be, provided for by the Ordinances. 13. The authorities of the University may make Regulations consistent with this Act, the Statutes and the Ordinances for the conduct of their own business and that of the committees appointed by them. 14. The University shall institute, for the benefit of its officers, teachers and other employees, such pension, insurance and provident fund as it may deem necessary in such manner and subject to such conditions as may be prescribed by the Statutes. 15. Annual Report – (1) The annual report of the University shall be prepared under the direction of the Executive Council, which shall include, among other matters, the steps taken by the University towards the fulfilment of its objects and shall be submitted to the Court on or before such date as may be prescribed by the Statutes and shall be considered by the Court in its annual meeting. (2) The Court may submit the annual report to the Government with such comments as it may think fit. 16. Annual Audit – (1) The annual accounts and balance sheet of the University shall be prepared under the direction of the Executive Council and shall once at least every year and at intervals of not more than fifteen months be audited by the auditors appointed by the Government. (2) The accounts, when audited, shall be published in the Gazette of the Government and a copy of the accounts together with the auditor’s report shall be submitted to the Government. 17. Any dispute arising out of any contract between the University and any officer or teacher of the University shall, at the request of the officer or teacher concerned or at the instance of the University, be referred to a Tribunal of Arbitration consisting of one member appointed by the Executive Council, one member nominated by the officer or teacher concerned and an umpire appointed by the Chancellor. 18. Every employee of the University shall be appointed under a written contract, which shall be lodged with the University and a copy of which shall be furnished to the employee concerned. 19. Notwithstanding anything contained in this Act, the University shall be competent to establish or maintain any centre for research, specialised studies and training in any place in India or abroad and to grant recognition to such centre as a constituent unit of the University. 20. If any question arises as to whether any person has been duly appointed as, or is entitled to be, a member of any authority or other body of the University, the matter shall be referred to the Chancellor whose decision thereon shall be final. 21. All casual vacancies among the members (other than ex-officio) of any authority or other body of the University shall be filled, as soon as may be, by the person or body who appoints, elects or co-opts the member whose place has become vacant and the person appointed, elected or co-opted to a casual vacancy shall be a member of such authority or body for the residue of the term for which the person whose place he fills would have been a member. 22.
