Act to provide for the establishment and maintenance of the
Constituency Fund of the State of Madhya Pradesh.
Be it enacted by the Madhya Pradesh Legislature in Seventh Year of the Republic of India as follows:-
1. Short title and commencement
(1) This Act may be cited as the Madhya Pradesh Contingency Fund Act, 1957. (2) It shall come into force immediately on its publication in the Official Gazette of the State.
2. Definitions
In this Act unless there is anything repugnant in the subject or context, "the Fund" means the Contingency Fund of the State of Madhya Pradesh established under section 3.
3. Establishment of the Contingency Fund of the State of Madhya Pradesh
There shall be established a Fund in the nature of an imprest entitled "The Contingency Fund of the State of Madhya Pradesh" into which shall be paid from and out of the Consolidated Fund of the State of Madhya Pradesh a sum of Rs. 100.00 crore.
4. Custody of Fund and withdrawals therefrom
The fund shall be held by the Governor and shall be administered by the Secretary to the Government of Madhya Pradesh in the Finance Department, and no advances shall be made out of the Fund, except for the purposes of meeting unforeseen expenditure pending authorisation of such expenditure by the Legislature of the State under appropriation made by Law.
5. Power to make rules
For the purpose of carrying out the objects of this Act, the State Government may make rules regulating all matters connected with or ancillary to the custody of, payment of moneys into, and the withdrawal of moneys from the Fund.
6. Repeal and Savings
(1) The Madhya Pradesh Contingency Fund Ordinance, 1956 (No. V of 1956), is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under this Act as if this Act were in force on the date on which such thing was done or action was taken.

(1)Supplementary estimatesor Voteon Account. as the case maybe, for all expenditureso finenced, "shall be presented to the Legislative&Assembly, atthe frst session meeting immediately after the advance is sanctioned unless such advance has been resumed to the Contingency Fund in accordance with the provision of sub-rule (2). Where, however, an advance from the Contingency Fund is sanctioned after the finalisation of the. Supple-
nentary Estimates/Vote on Account in the Finance Department, the estimate in respect of the expenditure so financed. may be presented to the Legislative Assembly at the
session next after.
- (2) As soon as the Legislative Assembly.has authorised additional expenditure by means of an Act, the advance or advances made from the Contingency Fund whether for meeting the expenditure incurred before the estimates were presented to the Legislative Assembly or after they were so presented shall be resumed to the Fund to the 'iull extent of the Appropriation made in the Act. All advances sanctioned from the Contingency Fund to meet expenditure in excess.of the provision for the. sérvice included in an Appropriation (Vote on Account) Act shall be resumed to the Contingency Fund as soon as the Appropriation Act in respect of the expenditure on the service for thewholeyear including the excess metfrom theadvancesfromtheContingencyFund,ha been passed. 10. (1)TheAdministrativeDepartmentshallbe responsibleforsendingtoFinanceDepartmenttheproposalsforestimatesinrecqupementofadvancesfrom the ContingencyFundand,inthe preciesexplainingthe estimates,anotetothefollowingeffectshallbe appended:- "A sum ofRs. hasbeen advancedfrom the Contingency Fund in. andan equivalent amountis requiredto enable repaymentto be madetothat Fund". advances

the Contingency
Fund

the

explaining
the estimates,
a
note
to
the
following
effect
shall
be appended
:- "A
sum
of
Rs. has

advanced
from the
Contingency
Fund

equivalent amount
is
required
to
enable
repayment
to
be
made
to
that Fund". (2)
In
case
of
expenditure
on
a
'new
service'
not
con- templated
in
the.
Annual
Financial,
Statement,
advanceн from
the
Contingency
Fund,
despite
savings
fo
the
extent being
avallable
within
the
sapctioned
grant,,
shoilld
be
to the
full
extent
of
the,
expenditure
to
be
incurred
up
to
the date
of
obtaining
the
Supplementary
Grant,
which
should be

13. The accountingprocedureforexpendituremet
outof advancefromthe ContingencyFundshallbe as follows:-
(i):Alldrawingofficersshall prepareseparate bills
inrespectof expendituretobemetoutofthe
advance from the Contingency Fund and all such bills shallbe labeiled conspicuouslyon top"ContingencyFund" by using a rubber stampor by writingin red ink. Detail d classificationof the expenditure in the bill

(ii)Accountof the expenditure shall be maintained separately and reportedtothe Chief Controlling Officers monthlyfor contrel.of expenditurein a statement, headed "Expenditure met from the Contingeney Fund". The account shall be maintainedin 'the samedetails as for
