Power to make rules.

  1. (1) The State Government may make rules to carry out all or any of the purposes of this Act.
  2. (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:—
    • (a) the terms and conditions for constitution of guarantee fund under Section 9 (1);
    • (b) the rate at which the contribution shall be made under Section 9 (2);
    • (c) the manner in which the fund shall be maintained and utilised under Section 9 (3);
    • (d) the manner in which inquiry shall be made under Section 16;
    • (e) the manner in which, the authority by which and the time within which the application shall be disposed of under Section 16;
    • (f) the form of declaration in which affidavit shall be given under Section 18;
    • (g) the terms upto which, the loan shall be given under Section 18 (4);
    • (h) the form of notice which shall be published under Section 19 (2);
      • (i) the manner in which the property shall be sold under Section 27 (1);
    • (j) the form of certificate which shall be granted under Section 29 (1);
    • (k) the period within which the amount shall be paid under Section 39 (1);
    • (l) the restrictions, limitations and conditions subject to which the Registrar shall have powers under Section 42 (1);
    • (m) the manner in which the copies shall be certified under Section 42 (3);
    • (n) the time within which and, the manner in which the copies of the parchment shall be filed under Section 43;
    • (o) the manner in which the copies shall be certified under Section 45;
    • (p) the manner in which previous sanction shall be obtained under Section 52;
    • (q) any other matter which is required to be or may be prescribed or in respect of which rules may be made under this Act.
  3. (3) All rules made under this Act shall be published in official Gazette and laid on the table of the Legislative Assembly.
