Casual vacancies
The Madhya Pradesh charika, Prasavika, Up-Sahai Upcharika-Prasavika Swasthya Paridarshak Registration Tatha and commen- Adhiniyam, 1972(1) An elected or nominated member may at any time resign his membership by tendering his resignation in writing under his hand to the President, and his seat shall thereupon become vacant.
(2) An elected or nominated member shall be deemed to have vacated his seat if-
(i) he is absent without excuse sufficient in the opinion of the Council, from three consecutive ordinary meetings, of the Council; or (ii) he is absent out of India for a period exceeding six consecutive months; or
(iii) is name is removed from the State Register under section 17.
(3) If any question, dispute or doubt arises whether a vacancy has occurred under sub-section (2) it shall be decided by the State Government and its decision shall be final.
(4) A casual vacancy in the Council shall be filled by election or nomination, as the case may be, and the person elected or nominated to fill the vacancy shall hold office or the up-expired term of this predecessor.
