Manner of executing order for giving possession of immovable property
The Chhattisgarh Co-operative Societies Act, 1960When an order for giving possession of immovable property has been passed against any person under this Act, such order shall be executed in the following manner, namely: (a) by serving a notice upon the person or persons in possession, requiring them to vacate the same within such time as may appear reasonable after the receipt of the said notice; and (b) if such notice is not complied with, by removing or deputing a subordinate to remove any such person who refuses to vacate the same; and (c) if any person resists or obstructs the officer removing such person, by appointing any of the officers specified in section 3 who shall conduct a summary inquiry into the facts of the case and if he is satisfied that there was no just cause for the resistance or obstruction and that such resistance or obstruction is still continuing, he may, without prejudice to any proceedings to which such person is liable under any law for the time being in force relating to the punishment for such resistance or obstruction, act or cause to be acted, and may use or cause to be used such force as, in the opinion of such officer, is reasonably necessary to ensure compliance with such order.
