The Bihar Specialized Universities Act, 2026
1. Short title, extent and commencement
Short Title, Extent and Commencement:
- (i) This Act may be called " Bihar Specialized Universities Act, 2026"
- (ii) It shall extend to the whole of the State of Bihar.
- (iii) It shall come into force on such date as the State Government may, by notification in the Official Gazette, specify.
2. Definitions
Definitions: – In this Act, unless there is anything repugnant to the subject or context-
- (a) ‘Academic Council’ means the Academic Council of the University;
- (b) 'Affiliated Institution' means an institution affiliated by the University.
- (c) 'Affiliation' means affiliation granted by the University in accordance with the Statutes, Rules and Regulations made for the purpose;
- (d) ‘Board of Studies’ means the Board of Studies of a Department of the University;
- (e) ‘Chancellor’ means the Chancellor of the University;
- (f) ‘Chief Minister’ means the Chief Minister of the State of Bihar;
- (g) ‘College’ means a college teaching courses leading to a Bachelor or Higher degree;
- (h) ‘Courses’ means courses as approved by the University to conduct and other concerned Apex Regulatory Body;
- (i) ‘Governing Council’ means the Governing Council of the University;
- (j) ‘Department’ means a Department of the University including a Centre of Studies;
- (k) ‘Employee’ means the employee of a University including teachers, librarians, officers and non-teaching staff.
- (l) ‘Executive Council’ means the Executive Council of the University.
- (m) ‘Faculty’ means a Faculty of Studies of the University.
- (n) ‘Finance Committee’ means the Finance Committee of the University;
- (o) ‘Government’ means the Government of Bihar;
- (p) ‘Head of the Department’ means the Head of any teaching Department of the University;
- (q) ‘Institution’ means an academic institution, not being a College, maintained by the University;
- (r) ‘Misconduct’ means an act of misconduct prescribed by the Statutes; ‘Notification’ means notification published in the Official Gazette;
- (t) ‘Ordinances’ means the Ordinances of the University for the time being in force;
- (u) ‘Principal’ means the Head of a College or Institution and includes, where there is no Principal, the person who is for the time being duly appointed to act as the Principal.
- (v) ‘Registrar’ means the Registrar of the University;
- (w) ‘Regulations’ means the Regulation made by any authority of the University under this Act for the time being in force;
- (x) ‘State’ means the State of Bihar;
- (y) ‘Statutes’ mean, respectively, the Statutes of the University for the time being in force;
- (z) ‘University’ means a University established and incorporated as a University under this Act.
- (aa) ‘University Fund’ means the fund of the University established under this Act.
- (bb) ‘University Grants Commission’ means the Commission established under Section-4 of the University Grants Commission Act, 1956 (Central Act 3 of 1956).
- (cc) 'University Review Commission' means the commission defined under this Act;
- (dd) ‘Vice-Chancellor’ means the Vice-Chancellor of the University.
3. The words and expressions used herein and not defined in the Act shall have the same meaning respectively assigned to them in the Act.
Establishment and incorporation of University Establishment and Incorporation of the University-
- (i) The State Government may, from time to time, by notification in the Official Gazette, establish one or more specialized and multidisciplinary universities under this Act by such name, with such thematic or disciplinary focus, or for such other special purposes as the State Government may deem fit for having such territorial jurisdiction, with such constituent, affiliated colleges or institutions, and with effect from such date as may be specified in the notification, as a body corporate, and upon publication of the notification in the Official Gazette, the University shall be deemed to be included in the Schedule of the Act. The State Government may also, by the same or any subsequent notification, amend the schedule (alter or increase or diminish or redefine the territorial jurisdiction), specialisation, special purpose, headquarters, constituent or affiliated colleges or any other particulars relating to such University.
- (ii) The Chancellor, the first Vice-Chancellor, and the first members of the Governing Council, of the Executive Council and of the Academic Council of each University established after the commencement of this Act, and specified in the Schedule to this Act and all persons who may hereafter become such officers or members thereof are, so long as they continue to hold such office or membership, shall be deemed to have constitute a body corporate by the name of the respective University specified in the Schedule to this Act.
- (iii) The University shall have perpetual succession and a common seal, and may sue and be sued by the said name.
4. Objects of the University
Objectives of the University—
- (a) The objectives of every University established under this Act shall be to advance, generate and disseminate knowledge, and to promote excellence in its areas of specialization and allied disciplines, and to create an enabling academic and research ecosystem for the generation, preservation, application and dissemination of knowledge for the advancement of society, sustainable development and the welfare of humanity.
- (b) to foster a multidisciplinary and interdisciplinary academic ecosystem in alignment with the National Education Policy, 2020;
- (c) to adopt and implement the Academic Bank of Credit, National Credit Framework, Multiple Entry and Multiple Exit, Credit Transfer, interdisciplinary and multidisciplinary programmes, and other academic reforms as may be prescribed from time to time.
- (d) to promote high-quality research and scientific discovery in frontier and strategically significant areas of knowledge;
- (e) to develop human resources for the advancement of society, and sustainable development;
- (f) to promote innovation, entrepreneurship, and knowledge transfer through collaboration with academic, research, and industry partners;
- (g) to contribute to the intellectual, cultural, and economic development of the State of Bihar and to uphold its rich academic and civilizational legacy;
- (h) to fulfil such other special educational, research, developmental or strategic purposes as the State Government may, from time to time, specify.
- (i) to address societal and developmental challenges through research, policy engagement, and outreach activities;
- (j) to promote inclusivity, equity, and access to higher education, research and Innovation opportunities;
- (k) to uphold the values enshrined in the Constitution of India and ensure that the University functions consistently with the sovereignty, unity and integrity of the Nation.
5. Powers and functions of the University
Powers and functions of the University-
- (1) The powers and functions of the University shall be the following:—
- (i) To provide high-quality and advanced instruction in such branches of knowledge and other allied, interdisciplinary and emerging areas, and for such other special purposes as may be determined by the University or the State Government as the case may be, and to create and sustain a robust ecosystem for cutting-edge research, innovation, and the advancement, preservation, and dissemination of knowledge, with a view to addressing national and global challenges and advancing the intellectual and developmental aspirations of the State of Bihar and the Nation;
- (ii) to grant, subject to such conditions as the University may determine, diplomas or certificates to, and confer degrees or other academic distinctions on, persons, on the basis of examination, evaluation or any other method of testing, and to withdraw any such diplomas, certificates, degrees or other academic distinctions for good and sufficient cause;
- (iii) to organise and to undertake extramural studies, training and extension services;
- (iv) to confer honorary degrees or other distinctions in the manner prescribed by the Statutes;
- (v) to establish or constitute such committees, cells and procedures as direction issued by the University Grants Commission or any other statutory or regulatory authority;
- (vi) to provide facilities through the Online or distance education system to such persons as it may determine;
- (vii) to institute Professorships, Associate Professorships, Assistant Professorships and other teaching or academic positions, required by the University and to appoint persons to such Principalships, Professorships, Associate Professorships, Assistant Professorships or other teaching or academic positions;
- (viii) The University may, with the prior approval of the State Government, establish off-campuses, research parks, innovation hubs, incubation centres, advanced scientific laboratories or specialized research centres within the State of Bihar, in accordance with the provisions made thereunder and other applicable laws.
- (ix) to recognise an institution of higher learning for such purposes as the University may determine and to withdraw such recognition;
- (x) to co-operate or collaborate or associate with any other University or authority or institution of higher learning, including those located outside the country, in such manner and for such purposes as the University may determine;
- (xi) to establish such centers and specialised laboratories or other units for research and instruction as are, in the opinion of the University, necessary for the furtherance of its objects;
- (xii) to publish journals, books, monographs, research papers, technical reports, patents, scientific databases and such other publications as may be necessary for dissemination of knowledge.
- (xiii) to institute and award fellowships, scholarships, studentships, medals and prizes;
- (xiv) to establish and maintain Institutions, Halls and Hostels;
- (xv) to make provision for research and advisory services and for that purpose to enter into such arrangements with other institutions, industrial or other organisations, as the University may deem necessary;
- (xvi) to organise and conduct refresher courses, workshops, seminars and other programmes for teachers, evaluators and other academic staff;
- (xvii) to appoint on contract or otherwise visiting Professors, Emeritus Professors, Professor of Practice, Consultants and such other persons who may contribute to the advancement of the objects of the University as per provision of the Statutes; (xviii) to determine standards of admission to the University, which may include examination, evaluation or any other method of assessment;
- (xix) to introduce semester system, continuous evaluation and Choice-Based Credit System and the University shall enter into agreements with other Universities and academic institutions for credit transfer and joint degree programmes;
- (xx) to introduce innovative courses and programmes of studies with a provision for periodic review and restructuring;
- (xxi) to ensure active participation of students in all academic activities of the University, including evaluation of teachers;
- (xxii) to obtain accreditation from the National Assessment and Accreditation Council or any other accrediting agency at the national level; (xxiii) to receive grants, endowments, donations, gifts, benefactions, bequests, subscriptions, research funding and financial assistance from the Central Government, State Government, University Grants Commission, industries, philanthropic organizations, national and international funding agencies and other lawful sources;
- (xxiv) ensure efficient digital governance through paperless administration, digital evaluation, online academic services, e-office systems, learning management platforms, and the development of digital libraries and research data repositories; and
- (xxv) to introduce e-governance with an effective Management Information System.
- (2) Notwithstanding anything mentioned in the Act, the University shall require prior permission of the State Government before admitting any institution or before creation of any posts or establishment of any new Departments or Chair, before starting any new academic programmes requiring appointment of additional teachers, non-teachers and permanent infrastructure.
6. Admission not to be denied
University open to all irrespective of sex, race, creed, class, caste, place of birth, religion, or opinion-
- (1) No citizen of India shall be excluded from any office of the University or from membership of any of its authorities, bodies or committees, or from appointment to any post, or from admission to any degree, diploma, certificate or other academic distinctions or programmes or course of study on the grounds only of sex, race, creed, class, caste, place of birth, religious belief or profession or political or other opinion: Provided that, the University may maintain, accredit or recognize any college or institution exclusively for women, or reserved for women.
- (2) The University shall adopt the Government policy and orders, issued from time to time by the State Government, in regard to the reservations, for various categories, with respect to appointment on different posts of teachers and non-teaching employees and for the purpose of admission of students in Colleges, University departments, University institutions or recognized institutions.
- (3) The University shall adopt and implement the policies and directives of the State Government relating to the welfare, inclusion, protection and advancement of weaker sections of society, minorities, women, persons with disabilities, senior citizens, transgender persons, and persons of diverse gender identities and sexual orientations, as may be issued from time to time.
7. Chancellor
The Chancellor
- (1) The Chief Minister of Bihar, by virtue of his office, shall be the Chancellor of every University specified in the Schedule.
- (2) The Chancellor, when present, shall preside over the Convocation of the University and may issue directions to the Vice-Chancellor to convene the meeting of any authority of the University for specific purposes, whenever necessary, and the Vice-Chancellor shall submit the minutes of such meeting to the Chancellor for his perusal.
- (3) The Chancellor,—
- (a) shall, on receiving a reference from the State Government under the proviso to Sub-Section (6) of section 29 in such matter; or
- (b) may, in any matter suo motu or otherwise, call for a report or an explanation or such information and record relating to such matter or any matter or affairs of the University, and shall, after considering such report or explanation, or information or record, issue such directions thereupon as may be deemed fit in the interest of the University or students or in the larger interest of the public, and his directions shall be final and shall be complied with by the University forthwith.
- (4) The Chancellor may, after taking report in writing from the Vice-Chancellor, cancel or suspend or modify any resolution, order or proceeding of any authority, body, committee or officer which, in his opinion, is not in conformity with this Act, Statutes, Ordinances or Regulations made thereunder, or is not in the interest of the University and the University, authority, body, committee and officer, shall comply with the same: Provided that, before making any such order, the Chancellor shall call upon the University, authority, body, committee or, as the case may be, officer to show cause why such an order should not be made, and if any cause is shown, within the time fixed by the Chancellor, the Chancellor shall consider the same and wherever the Chancellor deems it necessary, after consulting the State Government, decide the action to be taken in the matter, and his decision shall be final.
- (5) Where, in the opinion of the Chancellor, the conduct of any elected or nominated or appointed or co-opted member is detrimental to the smooth functioning of the University or any authority or body or committee, he may, after giving such member an opportunity to offer his explanation in writing and after considering such explanation, if any, and satisfying himself that it is necessary so to do, disqualify such member or suspend him for such period, as he may deem fit or to instruct to carry out disciplinary proceedings against the person as per the Statutes.
- (6) Where power is conferred upon him by this Act or the Statutes to nominate persons to authorities and bodies of the University, the Chancellor shall, to the extent necessary and without prejudice to such power, nominate persons to represent such interests not otherwise represented.
- (7) In case of differences amongst the authorities or officers of the University on any matter which cannot be otherwise resolved the decision of the Chancellor shall be final;
- (8) The Chancellor shall have the power to issue direction to the Universities and Colleges in the administrative or academic interest of the Universities and Colleges which he considers to be necessary. The direction issued by the Chancellor shall be implemented by the Vice-Chancellor, Principal Governing Council , Executive Council and other bodies of the Universities as the case may be.
- (9) The Chancellor shall exercise such other powers and perform such other duties as may be conferred upon or vested in him by or under this Act or as prescribed by the Statutes.
8. Officers of the University
Officers of the University – The following shall be the officers of the University, namely:-
- (1) the Vice-Chancellor,
- (2) the Deans, Faculty
- (3) the Registrar,
- (4) the Finance Officer,
- (5) the Dean, Student’s Welfare,
- (6) the Dean, Research and Development,
- (7) the Controller of Examination,
- (8) the Librarian
- (9) Such other officers as may be declared by the Statutes to be the officers of the University.
9. Vice-Chancellor
The Vice-Chancellor—
- (1) The Vice-Chancellor shall be an eminent academic, distinguished scientist, or educationist of national or international repute, possessing proven academic and administrative leadership, outstanding contributions to teaching, research, and innovation, and having significant experience in the relevant areas of specialization of the University or in allied and interdisciplinary fields.
- (2) The Vice-Chancellor shall be appointed by the Chancellor from out of a panel of not less than three persons recommended (the names being arranged in the alphabetical order) by a Screening Committee constituted under Sub-Section (3); Provided that if the Chancellor does not approve of any of the persons so recommended, he may call for the fresh recommendations;
- (3) The Screening Committee referred to in Sub-Section (2) shall consist of four members namely:—One Member nominated by the Chancellor, one member nominated by the State Government, One member nominated by the Chairman, University Grants Commission as per the regulation of UGC subject to the amendments applicable and one by Executive Council, and the member nominated by the Government shall be convener of the committee; Provided that the members nominated on the committee shall be persons who are not connected in any manner with the University concerned or any college or any recognized institution of that University;
- (4) The First Vice-Chancellor shall be appointed by the Government.
- (5) The Vice-Chancellor shall hold office for a term of three years from the date on which he enters upon his office; Provided that the Chancellor may, on being satisfied with the performance of the Vice-Chancellor during the first term, require the Vice-Chancellor to continue in office for a further period, as may be specified by the Chancellor, so, however, that such further period shall not exceed three years. Provided that the maximum age limit for continuance upon the office of the Vice-Chancellor will be seventy-five years;
- (6) The emoluments and other conditions of service of the Vice-Chancellor shall be as prescribed by Statutes;
- (7) If the office of the Vice-Chancellor becomes vacant due to death, resignation or otherwise or if he is unable to perform his duties due to ill health or any other cause, the Chancellor shall have the authority to designate any eminent person to perform the functions of the Vice-Chancellor until the new Vice-Chancellor assumes his office or until the existing Vice-Chancellor attends to the duties of his office, as the case may be.
10. Powers and duties of Vice-Chancellor
Powers, duties and functions of the Vice-Chancellor—
- (1) The Vice-Chancellor shall be the principal executive and academic officer of the University and shall exercise general supervision and control over the affairs of the University and give effect to the decisions of the authorities of the University.
- (2) The Vice-Chancellor may, if he/she is of the opinion that urgent or important action is necessary on any matter, exercise any power conferred on any authority of the University by or under this Act and shall report the action to the authority concerned at its next meeting the action taken by him on such matter; Provided that such exercise of power shall be made only in emergent situations and in no case in respect of creation, and upgradation of posts and appointments thereto; Provided further that if the Governing Council is of the opinion that such action ought not to have been taken, it may refer the matter to the Chancellor whose decision thereon shall be final; Provided also that if any person in the service of the University who is aggrieved by the actions taken by the Vice- Chancellor under this Sub-Section shall have the right to appeal against such action to the Governing Council within three months from the date on which decision on such action is communicated to him and thereupon the Governing Council may confirm, modify or reverse the action taken by the Vice-Chancellor.
- (3) The Vice-Chancellor, if he is of the opinion that any decision of any authority of the University is beyond the powers of the authority conferred by the provisions of this Act, the statutes, the Regulations or that, any decision taken is not in the interest of the University, may ask the authority concerned to review its decision within thirty days of such decision and if the authority refuses to review the decision either in whole or in part or no decision is taken by it within the said period of thirty days, the matter shall be referred to the Chancellor whose decision on the matter shall be final.
- (4) The Vice-Chancellor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes or the Regulations.
- (5) The Vice-Chancellor shall be the Chairperson of the Executive Council, Finance Committee, and the Academic Council of the University.
- (6) The Vice-Chancellor shall, in the absence of the Chancellor, preside at any convocation of the University and shall preside at the meeting of the Governing Council.
11. Removal of Vice-Chancellor
Removal of the Vice-Chancellor—
- (1) If at any time and after such enquiry as may be considered necessary, it appears to the Chancellor that the Vice-Chancellor: -
- (i) has failed to discharge any duty imposed upon him, by or under this Act, the Rules; and Statutes, or
- (ii) has acted in a manner prejudicial to the interests of the University, or
- (iii) has been incapable of managing the affairs of the University. The Chancellor may, notwithstanding the fact that the term of office of the Vice-Chancellor has not expired, require the Vice-Chancellor, by an order in writing stating the reasons thereof to resign his post from the date as may be specified in the order.
- (2) No order under Sub-Section-1 shall be passed unless a notice stating the specific grounds on which such action is proposed has been served and a reasonable opportunity to show cause against the proposed order has been given to the Vice-Chancellor.
- (3) On and from the date specified in Sub-Section-1, it shall be deemed that Vice-Chancellor has resigned his post and office of the Vice-Chancellor shall be deemed vacant.
12. Dean of Faculties
The Dean of Faculty—Every Dean shall be appointed in such manner, and shall exercise such powers and perform such duties as may be prescribed by the Statutes.
13. Registrar
The Registrar—
- (1) The Registrar shall be appointed in such manner, on such terms and other conditions of service as may be prescribed by the Statutes. However, the first Registrar of the University shall be appointed by the State Government and shall hold office for a term of three years or till the appointment of the Registrar as prescribed by the Statutes or the Rules, whichever is earlier;
- (2) The Registrar shall have the power to enter into agreements, sign documents and authenticate records on behalf of the University and shall exercise such powers and perform such duties as may be prescribed by the Statutes.
14. Finance Officer
The Finance Officer—The Finance Officer shall be appointed in such manner and on such terms and conditions of service, and shall exercise such powers and perform such duties, as may be prescribed by the Statutes. However, the first Finance Officer of the University shall be appointed by the Government and shall hold office for a term of three years or till the appointment of the Finance Officer as prescribed by the Statutes or Rules, whichever is earlier;
15. Dean of Student Welfare
The Dean Student Welfare— The Dean student welfare shall be appointed in such manner, and shall exercise such powers and perform such duties as may be prescribed by the regulation or rules.
16. Controller of Examinations
The Controller of Examination (CoE)—The Controller of Examination shall be appointed in such manner and on such terms and conditions of service, and shall exercise such powers and perform such duties, as may be prescribed by the Statutes. However, the first Controller of Examination shall be appointed by the Government and shall hold office for a term of three years or till the appointment of the Controller of Examination, as prescribed by the Statutes, whichever is earlier.
17. Dean of Research and Development
Dean, Research and Development -
- (i) The Dean of Research and Development (R&D) shall be appointed by the Vice- Chancellor for a period of three years from amongst the University Professors or Associate Professor in such manner as prescribed in the Statutes.
- (ii) The Dean of R&D shall create awareness about research, innovation, incubation, startups and development among faculty and students. The Dean of Research and Development shall coordinate with other faculties to ensure high standards in Ph.D programmes and research publications. This involves organizing workshops and seminars on research methodologies, facilitating interdisciplinary collaboration, promoting research activities, and maintaining quality assurance for academic excellence.
- (iii) The Dean of R&D shall act as a liaison between researchers and relevant funding agencies.
- (iv) The Dean of R&D shall establish, maintain and strengthen links of the University with premier national and international universities and institutions.
- (v) The duties, powers and functions of the Dean of Research and Development shall be prescribed by the Statutes.
18. Other Officers
Other Officers—The manner of appointment and powers and duties of other officers of the University shall be prescribed by the Statutes.
19. Authorities of the University
Authorities of the University—The following shall be the authorities of the University:-
- (1) The Governing Council;
- (2) The Executive Council;
- (3) The Academic Council;
- (4) The Research Council;
- (5) The Board of Studies;
- (6) The Board of Affiliation
- (7) The Board of Planning;
- (8) The Finance Committee; and
- (9) such other authorities as may be declared by the Statutes to be the Authority of the University.
20. Governing Council
Governing Council—
- (1) The Governing Council shall be the apex Body of the University.
- (2) There shall be a Governing Council of the University consisting of the following members, namely:
- (a) Chancellor of the University – Chairperson
- (b) Minister, Higher Education Department;
- (c) Vice-Chancellor of the University;
- (d) Chief Secretary, Government of Bihar;
- (e) One Vice-Chancellor from among the State Universities to be nominated by the State Government;
- (f) Additional Chief Secretary/Principal Secretary/Secretary of Higher Education Department;
- (g) Additional chief Secretary/ Principal Secretary/ Secretary Department of Finance;
- (h) Additional chief Secretary/ Principal Secretary/ Secretary Dept. of Science, Technology and Technical Education, Bihar ;
- (i) Director, Higher Education Department
- (j) Two Directors from leading national institutions of higher learning, research or management, such as Institutions of National Importance or such other reputed institutions of Bihar relevant to the area of specialization of the University, nominated by the Chancellor;
- (k) One representatives of the University Grants Commission to be nominated by the Chairman of the Commission;
- (l) Three eminent academicians, scientists, or domain experts of national or international repute, having distinguished contributions in the relevant areas of specialization of the University or in allied and interdisciplinary fields, nominated by the Chancellor, of whom at least one shall be from outside the State of Bihar;
- (m) One eminent industrialist, technologist, or domain expert from industry, innovation, public policy, or professional sectors relevant to the specialization of the University, nominated by the Chancellor;
- (n) Dean of Research and Development (R&D)
- (o) Two Deans of the University, to be nominated by the Vice-Chancellor on rotation for three years from the date of nomination.
- (p) One faculty representative not below the rank of Professor to be nominated by the Vice-Chancellor by rotation and seniority from amongst the Professors
- (q) One Principal of Affiliated college of the University (in case affiliated to the University)
- (r) Dean of the Student’s Welfare; Finance officer of the University
- (t) Registrar of the University
- (3) The Registrar shall be the ex-officio Member-Secretary to the Governing Council.
- (4) Where a person has become a member of the Governing Council by reason of the office or appointment he holds, his membership shall terminate when he ceases to hold that office or appointment;
- (5) The term of office of the nominated members of the Governing Council other than the ex officio members shall be three years;
- (6) A member of the Governing Council shall cease to be a member if he resigns or becomes of unsound mind, or becomes insolvent or is convicted of a criminal offence involving moral turpitude. A member, other than the Vice-Chancellor, Registrar shall also cease to be a member if he accepts a full-time appointment in the University; or if he not being an Ex-Officio member fails to attend three consecutive meetings of the Governing Council without the leave of the Chancellor;
- (7) A member of the Governing Council other than an ex-officio member may resign his office by a letter addressed to the Chancellor and such resignation shall take effect as soon as it has been accepted; and
- (8) Any vacancy in the Governing Council shall be filled by nomination by the respective nominating authority for the remaining period of the term and on expiry of the period of the vacancy; such nomination shall cease to be effective.
21. Powers and functions of Governing Council
Powers, functions and meetings of the Governing Council—
- (1) The Governing Council shall be the apex Body of the University and shall formulate and review from time to time the broad policies, and programmes of the University and devise measures for the improvement and development of the University and shall also have the following powers and functions namely: -
- (i) To consider and pass the annual report, financial statement and the annual budget estimates prepared by the Executive Council and to adopt them with or without modification:
- (ii) To make Statutes concerning the administration of the affairs of the University including prescribing the procedures to be followed by the authorities and the officers of the University in the discharge of their functions. (2)
- (i) The Governing Council shall meet at least once in a year and annual meeting of the Governing Council shall be held on a date to be fixed by the Chancellor;
- (ii) A report of the working of the University during the previous year, together with a statement of receipts and expenditure, the balance sheet as audited, and the financial estimates shall be presented by the Vice-Chancellor to the Governing Council at its annual meetings;
- (iii) Meetings of the Governing Council shall be called by the Chancellor either on his own motion or at the requisition of not less than 50% members of the Governing Council;
- (iv) For every meeting of the Governing Council, fourteen days’ notice shall be given. However, in emergent situation the meeting of the Governing Council may be called by the Chancellor at short notice.
- (v) One-third of the members existing on the rolls of the Governing Council shall form the quorum;
- (vi) Each member shall have one vote and if there be equality of votes on any question to be determined by the Governing Council, the Chancellor presiding over the meeting shall, in addition, have a casting vote;
- (vii) To exercise such other powers and perform other duties as may be conferred or assigned by this Act or the Statutes.
22. Executive Council
Executive Council—
- (1) The Executive Council shall be the principal executive body of the University.
- (2) The Executive Council shall consist of the following persons namely: - a. Vice-Chancellor of the University – Chairperson b. Additional Chief Secretary/Principal Secretary/Secretary of Higher Education Department or his/her representative not below the rank of joint secretary; c. Additional chief Secretary/ Principal Secretary/ Secretary Department of Finance or his/her representative not below the rank of Joint Secretary; d. Additional chief Secretary/ Principal Secretary/ Secretary Dept. of Science, Technology and Technical Education, Bihar or his/her representative not below the rank of Joint Secretary; e. Director, Higher Education Department f. Two Directors from leading national institutions of higher learning, research or management, such as Institutions of National Importance or such other reputed institutions of Bihar relevant to the area of specialization of the University, nominated by the Chancellor; g. Two eminent academicians, scientists, or domain experts of national or international repute, having distinguished contributions in the relevant areas of specialization of the University or in allied and interdisciplinary fields, nominated by the Chancellor, of whom at least one shall be from outside the State of Bihar; h. One eminent industrialist, technologist, or domain expert from industry, innovation, public policy, or professional sectors relevant to the specialization of the University, nominated by the Chancellor; i. Dean of Research and Development (R&D) j. One Principal of Affiliated college of the University (in case affiliated to the University) k. Two Deans of the University, to be nominated by the Vice-Chancellor on rotation for three years from the date of nomination. l. Three faculty representative not below the rank of Professor to be nominated by the Vice-Chancellor by rotation and seniority from amongst the Professors m. Dean of the Student’s Welfare; n. Finance officer of the University o. Controller of Examination of the University p. Registrar of the University- member secretary (3)
- (i) Where a person has become a member of the Executive Council by reason of the office or appointment he holds, his membership shall terminate when he ceases to hold that office or appointment;
- (ii) The term of office of the nominated members of the Executive Council other than ex officio members shall be three years;
- (iii) A member of the Executive Council shall cease to be a member, if he resigns or becomes unsound mind or becomes insolvent or is convicted of a criminal offence involving moral turpitude. A member other than the Vice-Chancellor and the Registrar shall also cease to be a member if he accepts a full time appointment in the University;
- (iv) A member of the Executive Council other than an ex-officio member may resign his office by a letter addressed to the Vice-Chancellor and such resignation shall take effect as soon as it has been accepted by him;
- (v) Any vacancy in the Executive Council shall be filled by nomination by the respective nominating authority for the remaining period of the term and on expiry of the period of the vacancy, such nomination shall cease to be effective.
- (4) Powers, Functions and Meetings of the Executive Council I. The Executive Council shall be the Chief Executive Authority of the University and as such shall have all powers necessary to administer the University subject to the provisions of this Act and the Statutes; made there under, and may make Regulations with approval of Governing Council for that purpose and also with respect to matters provided hereunder. II. The Executive Council shall have the following powers and functions:
- (i) To prepare and present the following to the Governing Council at its annual meetings:
- (a) A report on the working of the University;
- (b) A statement of accounts;
- (c) Budget proposals for the ensuing academic year; and
- (d) Any other matter of importance that for to be presented;
- (ii) To manage and regulate the finances, accounts, investments, properties, business and all other administrative affairs of the University and for that purpose, constitute committees and delegate the powers to such committees or such officers of the University as it may deem fit;
- (iii) To provide buildings, premises, furniture and apparatus and other means needed for carrying on the work of the University;
- (iv) To present important notification, reports and Policy matters before Governing Council.
- (v) To entertain, adjudicate upon, and if it thinks fit, to redress any grievances of the students and the employees of the University;
- (vi) To create administrative, ministerial and other necessary posts, to determine the number and emoluments of such posts, to specify the minimum qualifications for appointment to such posts on such terms and conditions of service as may be prescribed by the Statutes and Regulations made in this behalf with concurrence of the state govt.
- (vii) To appoint examiners and moderators, and if necessary to remove them and to fix their fees, emoluments and travelling and other allowances, after consulting the Academic Council;
- (viii) To select a common seal for the University; and
- (ix) To exercise such other powers and to perform such other duties as may be considered necessary; or imposed on it by or under this Act, or Statutes. III.
- (i) The Executive Council shall meet at least once in four months and not less than fourteen days’ notice shall be given of such meetings;
- (ii) The meeting of the Executive Council shall be called by the Registrar under instructions of the Vice-Chancellor or at the request of not less than three members of the Executive Council;
- (iii) Registrar of the University shall act as ex-officio Member-Secretary to the Executive Council
- (iv) One half of members of the Executive Council shall form the quorum at any meeting;
- (v) In case of difference of opinion among the members, the opinion of the majority shall prevail;
- (vi) Each member of the Executive Council shall have one vote and if there be equality of votes on any question to be determined by the Executive Council, the Chairperson of the Executive Council or as the case may be, the member presiding over that meeting shall, in addition, have a casting vote;
- (vii) Every meeting of the Executive Council shall be presided over by the Vice-Chancellor and in his absence by a member authorized by the Vice-Chancellor.
- (viii) If urgent action by the Executive Council becomes necessary, the Vice-Chancellor may permit the business to be transacted by circulation of papers to the members of the Executive Council. The decisions so taken shall not be valid unless agreed to by a majority of members of the Executive Council. Such decisions shall be forthwith intimated to all the members of the Executive Council.
23. In case the Executive Council fails to take decision, the matter shall be referred to the Chancellor whose decision shall be final.
Academic Council Academic Council.—
- (1) The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act, the Statutes, Regulation and the Ordinances, co-ordinate and exercise general supervision over the academic policies of the University.
- (2) The Academic Council shall consist of the following persons, namely: a. Vice-Chancellor of the University – Chairperson b. Two Directors or his/her representative not below the rank of professor from leading national institutions of higher learning, research or management, such as Institutions of National Importance or such other reputed institutions of Bihar relevant to the area of specialization of the University, nominated by the Chancellor; c. One eminent academicians, scientists, or domain experts of national or international repute, having distinguished contributions in the relevant areas of specialization of the University or in allied and interdisciplinary fields, nominated by the Chancellor; d. Dean of Research and Development (R&D) e. Two Principal of Affiliated college of the University (in case affiliated to the University) f. All Deans of the University g. all Heads of University Departments h. Four faculty representative not below the rank of Professor to be nominated by the Vice-Chancellor by rotation and seniority from amongst the Professors i. Finance officer of the University j. Controller of Examination of the University k. Registrar of the University- member secretary
- (3) Powers, Functions and Meeting of the Academic Council.—Subject to the provisions of the Act, Statutes and Regulations and overall supervision of the Executive Council, the Academic Council shall manage the academic affairs and matters in the University and in particular shall exercise and perform the following powers and functions namely:
- (i) to report on any matter referred or delegated to it by the Governing Council or the Executive Council;
- (ii) to make recommendations to the Executive Council with regard to the creation, abolition or classification of posts in the University and the emoluments payable and the duties attached thereto;
- (iii) exercise supervision and control over the conduct of teaching in the colleges in such manner as may be prescribed by the Statutes;
- (iv) to advise the Executive Council on academic policies and recommend measures for the implementation of the Academic Bank of Credits (ABC), National Credit Framework (NCrF), Multiple Entry and Multiple Exit, Credit Transfer, interdisciplinary and multidisciplinary programmes, and other academic reforms in accordance with the Regulations, Guidelines and Standards issued from time to time by the University Grants Commission or any other statutory or regulatory authority.
- (v) to formulate and modify or revise schemes for the organization of the faculties, and to assign to such faculties their respective subjects and also to report to the Executive Council as to the expediency of the abolition or sub-division of any faculty or the combination of one faculty with another;
- (vi) to promote research under the University and to require from time to time, reports on such research;
- (vii) to propose draft of Ordinances relating to the academic matter to the Executive Council
- (viii) to consider proposals submitted by the faculties;
- (ix) to recommend recognition of degrees of other Universities and institutions and to determine their equivalence in relation to the certificates, diplomas and degrees of the University;
- (x) to fix subject to any conditions accepted by the Governing Council, the time, mode and conditions of competition for Fellowships, Scholarships and other prizes and to recommend for the award of the same;
- (xi) to make recommendations to the Executive Council in regard to the appointment of examiners and if necessary, their removal and fixation of their fees, emoluments and travelling and other expenses;
- (xii) to recommend arrangements for the conduct of examinations and the date for holding them;
- (xiii) to declare or review the result of the various examinations or to appoint committees or officers to do so, and to make recommendations regarding the conferment or grant of degrees, honors, licenses, titles and marks of honors;
- (xiv) to recommend stipends, scholarships, medals and prizes and to make other awards in accordance with the regulations and such other conditions as may be attached to the awards;
- (xv) to approve or revise lists of prescribed or recommended text books and to publish the same and to approve syllabus and courses of study;
- (xvi) to approve such forms and registers as are from time to time, required by the Regulations; and
- (xvii) to perform, in relation to academic matters, all such duties and to do all such acts as may be necessary for the proper carrying out of the provisions of this Act, the Statutes and the Regulations made there under. (4)
- (i) The Academic Council shall meet as often as may be necessary, but not less than two times during an academic year;
- (a) One half of the existing members of the Academic Council shall form the quorum for a meeting of the Academic Council;
- (b) In case of difference of opinion among the members, the opinion of the majority shall prevail;
- (c) Each member of the Academic Council, including the Chairperson of the Academic Council, shall have one vote and if there be an equality of votes on any question to be determined by the Academic Council, the Chairperson of the Academic Council, or as the case may be, the member presiding over the meetings, shall in addition, have a casting vote;
- (d) Every meeting of the Academic Council shall be presided over by the Vice-Chancellor and in his absence by a member chosen in the meeting to preside on the occasion;
- (e) If urgent action by the Academic Council becomes necessary, the Chairperson of the Academic Council may permit the business to be transacted by the circulation of papers to the members of the Academic Council. The decision taken shall not be valid unless agreed to, by a majority of the members of the Academic Council. The decision so taken shall forthwith be intimated to all the members of the Academic Council.
24. In case the Academic Council fails to take decision, the matter shall be referred to the Chancellor whose decision shall be final.
Board of Studies The Board of Studies.— The constitutions, power and functions of the Board of Studies shall be prescribed by the Statutes.
25. Affiliation Board
The Board of Affiliation.— The Board of Affiliation shall be responsible for affiliating colleges and institutions to the University.
26. The constitution of the Board of Affiliation, the term of office of its members and its functions shall be prescribed by the Statutes.
Planning Board Board of Planning.— The Board of planning shall be responsible for preparing plans of growth and development, long term and short terms perspective plan of the University to achieve its objective.
27. The constitutions, power, term of office of its members and functions of the Board of Planning shall be prescribed by the Statutes.
Research Council Research Council.—The constitution, powers, the term of its members and functions of the Research Council shall be prescribed by the Statutes.
28. Finance Committee
The Finance Committee.— The constitution, powers and functions of the Finance Committee shall be prescribed by the Statutes.
29. Prerequisites for certain actions
Jurisdiction of the State Government.—
- (1) Without prior approval of the State Government, the University shall not,—
- (a) create new posts of teachers, officers or any other kind of employees;
- (b) revise the pay, allowances, post-retirement benefits and other benefits of its teachers, officers and other employees;
- (c) grant any special pay, allowance or other extra remuneration of any description whatsoever, including ex-gratia payment or other benefits having financial implications, to any of its teachers, officers or other employees;
- (d) divert any earmarked funds received for any purpose other than that for which it was received;
- (e) transfer by sale or lease of immovable property;
- (f) incur expenditure on any development work from the funds received from the State Government or University Grants Commission or any person or body for the purposes other than the purposes for which the funds are received;
- (2) The University shall be competent to incur expenditure, in consonance with the policies and directives of the State Government issued from time to time, from the funds received from,—
- • various funding agencies without any share or contribution from the State Government;
- • contributions received from individuals, industries, institutions, organizations or any person whosoever, to further the objectives of the University;
- • contributions or fees for academic or other services offered by the University for aided and self-supporting academic programmes;
- • development fund, or any other fund established by the University; for the purposes of,—
- (i) starting any academic programmes on self-supporting basis;
- (ii) granting remunerations or incentives to its employees for performing any task assigned to them other than their regular duties and responsibilities;
- (iii) incurring expenditure on any development work and on welfare activities of its students and employees: Provided that, there is no financial liability, direct or indirect, immediate or in future, on the State Government.
- (iv) Notwithstanding anything contained in this Act, all matters relating to financial expenditure, drawal and disbursement of State Government funds, treasury operations, accounts and audit of the University shall be governed by the Bihar Financial Rules, the Bihar Treasury Code and the instructions, circulars, guidelines and directions issued by the Finance Department, Government of Bihar, from time to time
- (3) The State Government may, in accordance with the provisions contained in this Act, for the purpose of securing and maintaining uniform standards in all universities in the State, by notification in the Official Gazette, prescribe a Standard Code providing for the classification, manner and mode of selection, appointment, induction and advance training, field exposure, deputation and reservation of posts as per State Government norms.
- (4) Qualifications and other purpose of appointment of teaching and non-teaching employees in the universities shall be as may be specified by the Government, by an order published in the Official Gazette.
- (5) The State Government through any officer not below the rank of Deputy Secretary or equivalent shall have the right to cause inspection of the University or its institution or University department.
- (6) In case of failure of the University to exercise powers or perform duties specified in section 5, or where the University has not exercised such powers or performed such duties adequately, or where there has been a failure to comply with any order issued by the State Government, or under any other circumstances as the State Government may deem fit, the State Government may issue a directive to the University for proper exercise of such powers or performance of such duties or compliance with the order; and it shall be the duty of the University to comply with such direction. In case the University fails to comply with the directives, the State Government may refer the matter to the Chancellor for taking necessary action under Sub-Section (3) of section 7.
