The Bihar Medical (Amendment) Act, 2026
1. Short title, extent and commencement
Short title, extent and commencement.—
- (1) This Act may be called Bihar Medical (Amendment) Act, 2026.
- (2) It shall extent to the whole of the State of Bihar.
- (3) It shall come into force from the date of publication in the official gazette.
2. Substitution of Section 2(c)
Substitution of Section 2(c).—In the Bihar and Orissa Medical Act, 1916 (hereafter in this Act referred to as the principal Act), in section 2, for sub-section (c), the following shall be substituted:-
- (c) the expression "registered practitioner" means any person registered under the provisions of this Act, and includes any medical practitioner whose name is validly entered in the National Medical Register or in the State Medical Register of any other State in India, and who has submitted a self-certification for practice in the State.
3. Insertion of section 2(d)
Insertion of section 2(d).—In section 2 of the principal Act, after sub-section (c), the following sub-section (d) shall be inserted, which is as follows:-
- (d) "Self-certification" means a certificate submitted by a medical practitioner registered with the National Medical Commission or any State Medical Council other than the State of Bihar, in the format as prescribed by the State Government.
4. Insertion of a new section 17A
Insertion of a new section 17A.—After section 17 of the principal Act, the following section shall be inserted: "17A. Practice on submission of self-certification.-
- (1) Notwithstanding anything contained in this Act, any medical practitioner whose name is validly entered in the National Medical Register or any other State Medical Register, shall be entitled to practice medicine in the State of Bihar without requiring fresh local registration or a No Objection Certificate
- (NOC) from their previous State Medical Council, Provided they submit a self-certification to the Council.
- (2) The Council shall maintain a register of medical practitioners practicing in the State on the basis of self-certification.
- (3) The Council shall have the power to suspend the right to practice within the State of Bihar for any practitioner operating under the self-certification model who is found guilty of professional misconduct. Such suspension shall be marked in the register maintained under sub-section (2) of this section and shall be immediately communicated to the concerned State Medical Council or National Medical Commission for appropriate action.
- (4) Any medical practitioner lawfully practicing in the State under the self-certification provisions of this section shall be treated as a registered practitioner for the purposes of Section 30 and Section 31 of this Act."
5. Amendment of section 33
Amendment of section 33.—In section 33 of the principal Act, in sub-section (2), after the existing clauses, the following clause shall be inserted:-
- (e) to determine the format, procedural guidelines, and the administrative mechanism for the submission of self-certification by medical practitioners registered in any other State Medical Council or National Medical Register, the power to prescribe which shall be vested exclusively in the State Government.
6. Repeal and Savings
Repeal and Savings.—
- (1) The Bihar Medical (Amendment) Ordinance, 2026 (Ordinance No. - 03, 2026) is hereby repealed.
- (2) Notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under the said ordinance shall be deemed to have been done or taken in exercise of the powers conferred by or under this Act as if this Act were in force on the day on which such thing was done or action taken.
