Grounds of order of detention to be disclosed to person
The Bihar Control of Crimes Act, 2024(1) When a person is detained in pursuance of a detention order, the authority making the order shall, as soon as may be, communicate to him the grounds on which the order has been made and shall afford him the earliest opportunity of making a representation against the order to the State Government. (2) Nothing in section (1) shall require the authority to disclose facts which it considers to be against the public interest to disclose. (1) No detention order shall be deemed to be invalid or inoperative by reason that the person to be detained is outside the limits of the territorial jurisdiction of the officer making the order. (2) Detention order shall not be invalid or inoperative on the ground that the person is outside the limits of the territorial jurisdiction of the officer, if the person is within the territory of India. 1. 4n, person aggrieved by an order made under section 3 or section 4 or section 5 may appear to the commissioner within rineen oays rrom in-e date of such order. 2. The Commissioner may either confirm the order with or without modification or set it aside and may, pending disposaf of tn" uppuJ, stay the operation of the order subject to such terms, if ant;;:-;; thinks fit.
