Reference to Advisory Board
The Bihar Control of Crimes Act, 2024In every case where a detention order has been made under this Act, the State Government shall, within three weeks from the date of detention of a person, place before the Advisory Board constituted by it under Section 9 the grounds on which the order has been made and the representation, if any, made by the person affected by the order. (1) The Commissioner of Police may, if he is satisfied that any person is acting in any manner prejudicial to the maintenance of public order, he may take action against him: (a) after giving notice to him, and (b) if such person is creating a situation in which the public is in danger. Order under Sections 3, 4, 5 and 6 may at any time be revoked or modified by the state Government provided that the revocation oi mooirication shall not be a Bar to the making of a fresh order under Section 3 against the same p"rron in *y case where fresh facts have arisen after an order of revocation or modification of the order by the State Government.
